As a result of these economic challenges, many European Union member states have issued calls for the European Unions budget to be cut. Individual member states have argued that, by reducing the amount they pay into the EUs budget, they will be able to beter focus on spending priorites on a domestc level. The EU budget is dierent from natonal budgets. The EU budget is an investment tool to support long-term development and strategic European co-operaton. In fact 94% of the EU budget is invested in the member states to create a European added value or in making sure the EU speaks with one voice on the world stage. The budget cannot run a decit and cannot produce debt. It gives additonal instruments to the member states and the regions that are crucial in tmes of austerity. As such, in my 2012 report presented to the European Parliament's Commitee on Regional Development, I argued it is necessary to ensure an ecient and extensive infrastructure network that improves access to drinking water and drainage and waste management systems. More specically, I concluded that the terms of the Cohesion Fund budgetng round from 2014 to 2020 should contain measures designed to "address the signicant needs for investment in the water sector to meet the requirements of the Union's environmental acquis" as well as promotng energy eciency, job creaton and economic growth. This report demonstrates the scale of the problem that exists across the 27 EU member states. The quality of water in many countries has to improve and the money needs to be found to make it happen startng with the city of Brussels, in which the European Unions insttutons are based. As we prepare to commit billions of Euros of investment to infrastructure projects, through the EU Cohesion Fund, we must demand improvements from these failing cites, regions and countries. Every country needs to apporton funds to meet minimum standards of water quality that we should all expect across Europe. Investment in the water sector and Cohesion Fund projects more generally is not simply an investment in infrastructure. It is an investment in more growth and more jobs for all parts of the European Union; from building and maintaining infrastructure on the ground to the research, development and innovaton centres that devise solutons to challenges facing the sector. The challenge to the European Union is clear. At a tme when Europe is facing economic challenges on an unprecedented sale, it would be foolhardy to cut the very funding that provides the economic motor that can return Europe to a positon of economic growth while at the same tme bringing about demonstrable benets to the quality of life of millions of European citzens. Victor Bostnaru MEP INTRODUCTION FROMVICTOR BOSTINARU MEP PAGE5 EXECUTIVE SUMMARY The European Union is currently concluding its arrangements for the 2014 to 2020 Cohesion Fund. The Cohesion Fund provides funding support for infrastructure-related project to regions across Europe whose economic development lags behind EU average standards. Since the launch of the Cohesion Fund in 1994, it has brought untold benets in terms of upgraded infrastructure in many countries across the European Union. This has resulted in economic growth and improved living standards for millions of people. For the 2007 to 2013 funding period, nancial support totalled 347 billion - equivalent to approximately one third of the European Union's total budget. The European Union is responsible for formulatng legislaton in respect of the water sector; including regulatons governing water monitoring requirements, cleanliness and chemical treatment. A total of 6,311 areas across Europe are stll not in compliance with European Union laws governing the water sector. Romania is the country with least compliance with EU water legislaton with a total of 2,476 instances of non-compliance followed by Spain (1148), Bulgaria (901), Hungary (631) and Slovakia (356). Brussels, the capital of the European Union, is also featured in the report. Instances of non-compliance with EU water legislaton span both north and south Europe and occur in both old and new EU member states. Non-compliance with EU water legislaton leaves taxpayers across the European Union area vulnerable to nes of up to 3,026,124 a day or 1,104,535,260 a year. The Cohesion Fund can be used as a means by which to assist EU countries (partcularly those from the 2004 and 2007 accession waves) in bringing their domestc water standards into compliance with the law. Ongoing EU investment in the water sector is crucial for improving the quality of life of EU citzens, providing employment opportunites and encouraging ongoing research and innovaton in Europe. The budget of the European Union and individual EU member states is under pressure from the drive for austerity. Such cuts should not be insttuted while infrastructure and legal compliance challenges remain in so many EU member states. The Fund has proved partcularly crucial in respect of assistng member states in remedying problems with their natonal water infrastructure; improving public health and increasing the degree to which EU member states adhere to legislaton mandatng the scrupulous testng and cleanliness of water. The support from the Cohesion Fund is based on the principle of co- nancing. The maximum rate of support for any specic investment projects brought about by the Cohesion Fund can only amount to 85% with individual natonal governments or member states also having to make up the remaining 15% from their own natonal budgets. Writng in 2006, the then European Commissioner for Environmental Policy Stavros Dimas outlined details of the three Cohesion Fund support streams available for water-related projects (these funding mechanisms are discussed in more detail later in this report): Convergence funding: Support to stmulate growth potental by focussed investment in collectve services needed to ensure long-term compettveness. Dimas argued that massive investment in water infrastructure was required to upgrade and extend water and sanitaton systems to new member states whose laws were not in line with EU law. Regional compettveness and employment: To antcipate and promote economic change and development by improving compettveness and atractveness through investments in the knowledge- based economy and innovaton. Dimas argued that the investment in the water sector was necessary to ensure a business environment that was conducive to economic development as well as being sensitve to environment and human concerns. Therefore, this funding stream had clear relevance to the need for member states to adhere to stringent environmental standards. Cooperaton: To promote the balanced and sustainable development of all regions of the European Union so as to ensure that one region, country or sub- region (such as a county or state) lagged considerably behind the rest of the European Union in terms of its environmental and social standards. Lower costs and improved compettveness for economic enttes whose primary business operatons are focussed on the water sector (i.e. private or state water suppliers); Increased availability of water supplies for consumers and businesses where they otherwise may have been sporadic and unreliable; Development of new and innovatve environmental, water treatment and waste treatment technologies which in turn can bring about increased investment in the EU economy and create high-quality jobs; The building of modern and long-lastng infrastructure can lead to reduced maintenance charges and processing costs; saving both private businesses and taxpayers money; Lastng improvements in pipes, treatment plants and other ancillary water infrastructure reduce the need for further investment in the short to medium term; Planning security for economic actvity and development; Increased opportunites for development of the tourism sector based on greater condence in the safety of drinking water supplies or recreatonal waters (i.e. seaside areas or inland lakes). Economic Increasing the quality of water brings clear benets to public health in terms of reduced illnesses brought about by water contaminaton by both chemical compounds and natural propertes (i.e. E Coli and cryptosporidium); Expanded water quality projects and infrastructure can benet the wider environment, including the quality and diversity of all water sources; More ecient water infrastructure can cut down the need for excessive use of chemicals in the treatment process and the amount of energy used, therefore decreasing carbon dioxide emissions; Reduced need for more water than is otherwise necessary to be extracted from the natural environment in order to serve domestc and industrial demands. Environmental PAGE10 Legal basis The Cohesion Funds operatons are enshrined in Artcle 161 of the Treaty establishing the European Community (scope of assistance) which states that: Assistance from the Fund shall be given to actons in the following areas, ensuring an appropriate balance, and according to the investment and infrastructure needs specic to each Member State receiving assistance: a. trans-European transport networks, in partcular priority projects of common interest as idented by Decision No 1692/96/EC; b. the environment within the priorites assigned to the Community environmental protecton policy under the policy and acton programme on the environment .In this context, the Fund may also intervene in areas related to sustainable development which clearly present environmental benets, namely energy eciency and renewable energy and, in the transport sector outside the trans-European networks, rail, river and sea transport, intermodal transport systems and their interoperability, management of road, sea and air trac, clean urban transport and public transport The administraton of how money related to the Cohesion Fund is spent is a fairly unique case in terms of the general operaton of the EU budget. While the majority of programmes the European Union funds are administered directly by the European Commission, the system for cohesion funding works as follows: 1. The Commission negotates and approves the programmes proposed by individual countries and allocates resources; 2. The individual EU countries and their regions manage the programmes, implement them by selectng which projects they wish to carry out and then monitor their implementaton; 3. The Commission is involved in programme monitoring, commits and pays out approved expenditure and veries the control systems. When a decision is taken to spend money (an operatonal programme) the individual government of the European Union member state in queston appoints: a) a managing authority (a natonal, regional or local public authority or public/private body to manage the operatonal programme); b) a certcaton body (a natonal, regional or local public authority or body to certfy the statement of expenditure and the payment applicatons before their transmission to the Commission); c) an auditng body (a natonal, regional or local public authority or body for each operatonal programme to oversee the ecient running of the management and monitoring system). European Regional Development Fund The purpose of the European Regional Development Fund is to strengthen, on a pan-European basis, the economic and social fabric of the European Union in order to reduce inequalites between wealth levels in individual regions. As an example, the wealthiest area of the EU (Inner London) has a GDP per capita of roughly 60,000 Euros per year while the average is only 2,500 Euros in the EUs poorest area, North East Romania. The priorites for this fund are Improved human health and the eliminaton of social and geographic barriers which prevent certain groups from accessing clean water; Material improvements in the quality of life for residents in areas with decaying urban infrastructure or underdeveloped rural infrastructure; Increased employment opportunites in relaton to research and development into, constructon of and maintenance/operaton of technologies; High public awareness of the need to invest in robust water infrastructure can engender lastng debates in communites about water security, quantty and quality; Increased tourism and investment as a result of improvements in the atractveness of the area in which infrastructure developments are upgraded. Social Funding streams explained PAGE11 mandated as follows: Research, development and innovaton; Improving access to and quality of informaton and communicaton technologies; Climate change and moves towards a low-carbon economy; Business support for small and medium-sized enterprises; Telecommunicatons, energy and transport infrastructure; Enhancing insttutonal capacity i.e. civil service reform; Health, educaton and social infrastructure; and Sustainable urban development projects. In order to ensure that funding is focussed on these individual priority areas, the 2014 to 2020 funding round mandates that 80% of ERDF resources allocated to transiton or more- developed regions must be spent on energy eciency and renewable energy projects. Countries considered to be less-developed will have more lattude as to how ERDF funding is spent, although 50% of their budgets will have to be spent on energy eciency, renewables, innovaton and support for small and medium-sized enterprises. European Social Fund While the European Regional Development Fund is very much focussed upon business an d infrastructure, the Social Fund is targeted at investments in employment and educatonal opportunites. The fund has four main policy priorites: Promotng increased employment across the EU, including supportng labour mobility; Promotng social inclusion and reducing poverty and inequalites; Providing assistance for increased investments in educaton, skills and life-long learning; Enhancing state capabilites i.e. improving public administraton processes. The European Social Fund is also designed to encourage a sustainable economic framework created to provide the jobs of the future. As such, money can be provided from its budget for projects intended to promote a low-carbon economy, promote resource eciency, develop climate resilient solutons, enhance the use of informaton technology, strengthen research and development capabilites and boost SME compettveness. In order to bring an element of stability and predictability to the European Unions budgetary processes, the framework in which the Cohesion Fund operates is xed for a six year period. Prior to the 2014 to 2020 budget round, the funds budget was xed for the period from 2007 to 2013. During this period, the general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund mandated that EU funding be provided to support the convergence objectve of improving the infrastructure and development of poorer regions of Europe whose economies lagged behind the EU average in terms of average earnings and job creaton. Under the terms of the Fund, the EU was able to provide funding for up to 85% of the cost of individual projects. For the period from 2007 to 2013, the allocatons made available to each European Union member state were as per the table on the following page. To date, the Cohesion Fund has made a signicant impact on improving infrastructure in many areas across Europe. Successes include widening public access to drinking water, upgrading the capacity of waste-water and improving piping infrastructure. Despite the successes of the fund, considerable challenges remain for member states. Many are stll not compliant with EU water laws and require substantal contnued EU support in order to be able to do so. Country-by-country analysis The funding made available to Bulgaria for Cohesion Fund-related project was approved on 7th November 2007 by the European Commission. While some countries were only granted Cohesion Fund monies for partcular regions, the relatvely low GDP per capita in Bulgaria meant that the whole country was judged to be in need of funding under the terms of the convergence objectve. Bulgaria was allocated a total budget of 6 billion in Cohesion Fund monies for the period 2007-2013. At the tme the money was allocated to the country the Bulgarian government declared that their number one priority would be the preservaton and improvement of the environmental conditons of the water in the country by improving water supply and wastewater infrastructure to the standards required by EU law. In partcular, the country outlined its wish to bring about the constructon and modernisaton of sewage treatment networks and waste water treatment plants. By 2013, EU funding had delivered 65 new or rehabilitated waste water treatment plants serving an additonal 1,845,000 people, and 22 integrated waste management systems serving an additonal 3.5 million people. 2 Bulgaria Case study: Ruse is a city of 160,000 inhabitants with a harbour on the Danube. The European Union funded the rehabilitaton and extension of the water supply and sewerage network, along with the constructon of an urgently needed waste water treatment plant. The main objectve of this project was to protect the environment by reducing polluton in the Danube, and to increase the reliability of the water supply and the ecient use of water resources. The total estmated cost of the project was 46.8 million, with an EU contributon of 35 million. 3 For the period from 2007 to 2013, the Czech Republic was allocated a total of 23.6 billion for cohesion- related projects. Nearly 40% of the total allocaton was spent on environment-related projects such as waste water treatment and measures to reduce air polluton. Prior to the commencement of the 2007 to 2013 budget round, a report by the European Commission concluded that part of the [countrys] sewerage system has not been connected to wastewater treatment plants and 11% of water was not clean with highly polluted waters evident in large parts of the country, largely as a result of former mining and industrial processes. 4 Czech Republic Case study: The objectve was to reduce surface and wastewater polluton in the South-East region of Jihovchod in the Czech Republic. The implementaton of the project enabled an additonal 4,198 inhabitants to be connected to the new wastewater infrastructure, while the overall rehabilitaton of existng sewerage systems beneted up to 15 469 inhabitants, 115 of whom were connected to the wastewater infrastructure for the rst tme. The project included 53.1 km of new sewers, 20.6 km of reconstructed sewers and 3 km of reconstructed water pipes. Total investment was 54.1 million of which the EU provided 39.3. 5 2 Atanas Kostadinov, Former Deputy Minister of Environment and Water, Bulgaria 3 Bulgarian Ministry of Regional Development and Public Works, European Infrastructure Projects Directorate 4 Strategic Evaluaton of Environmental and Risk Preventon Under Structural and Cohesion Funds for the Period 2007-2013 , Natonal Evaluaton Report for Czech Republic 5 INFOREGIO PAGE15 For the period from 2007 to 2013, Estonia was allocated a total of 3 billion for cohesion-related projects. At the tme the money was allocated the Estonian Government declared that water and waste management infrastructure would be their top priority for the 2007 to 2013 funding round. The programmes implemented to improve such infrastructure were designed to ensure that a total of 55,000 individuals were provided with new drinking water and sewage systems. 6 In 2010, however, the Estonian Natonal Audit Oce published a report statng that the country would be "unable to guarantee sucient waste water treatment in all built-up areas in the country" in a tmely enough manner to bring the country into full compliance with EU water law. The report concluded that "too litle funding is planned for the improvement of water management systems" with "several local governments unable to take part in projects as their ability to co-nance them is restricted." 7 Estonia Case study: It was necessary to launch a programme reconstructve of water and wastewater networks in Narva city. The project consisted of the replacement of some 26 km water distributon pipelines, the reconstructon of drinking water treatment plant and water reservoirs. Some 65,000 inhabitants living in the project area directly beneted from the improved water services by receiving drinking water of higher quality. Safe drinking water contributed to the reducton of health risks for the populaton. Leakages reduced to 20%. Wastewater disposal improved the hygienic conditons and the quality of the environment. For the period from 2007 to 2013, Cyprus was allocated a total of 580 million for cohesion-related projects. At the tme, the Cypriot Government described investments in "basic infrastructure in the environment and energy sectors" as their top "priority axis," including the "constructon of pipes for the collecton and transfer of waste, constructon of pumping statons and waste treatment statons, tanks for storing processed water and central water distributon pipes." 8 Cyprus Case study: "EU funds will help to bring state of the art sewage facilites to a region of Europe that currently has no modern sewage system. Untl completon of the Sewerage System of Kokkinochoria Complex project, every householder in the Kokkinochoria area is responsible for the building, maintenance and operaton of his or her own septc tank and absorpton pit. The project involves constructng a new system for the collecton, conveyance and centralised treatment of urban sewage from the Kokkinochoria Complex. Eleven new wastewater pumping statons will be installed, along with new transfer and mains systems to link the local communites. 432 jobs will be created during the projects implementaton, with a further 13 long- term jobs in place when constructon is over. The total project cost 95 million of which the EU provided 64.6 million." 9 6 Managing Authority for Operatonal Programme Development of the Economic Environment, Estonia 7 Toomas Matson, Communicaton Manager of Natonal Audit Oce of Estonia 8 Overview of the mechanisms of Structural and Cohesion Funds, Cyprus Insttute of Energy 9 Instrument for Structural Policies for Pre-Accession Monitoring Department, European Commission For the 2007 to 2013 period, Latvia was allocated a total of 4.09 billion Euros for cohesion-related projects. Upon conrmaton of this gure, the Latvian Government announced that "water management infrastructure and services" would be amongst their top priorites in the eld of environmental policy. Latvia PAGE16 For the 2007 to 2013 period, Latvia was allocated a total of 761 million Euros for cohesion-related projects. When seeking to dene their objectves for the spending of Cohesion Fund monies, the Maltese government declared that improving water supply and water and waste management 13 would be amongst their priorites for the period up to the end of 2013. Malta For the 2007 to 2013 period, Latvia was allocated a total of 6.09 billion for cohesion-related projects. Amongst the chief goals of the Cohesion Fund in Lithuania were eorts to upgrade water supply and water treatment plants for a total of 220 communites. 10 The results of this investment were quickly felt in Lithuania with the countrys Minister for the Environment Valentnas Mazuronis declaring that over 900 km of new wastewater and water supply networks were built and more than 200 km were reconstructed and 25 wastewater treatment plants were built or modernised in Lithuanian cites and towns 11 by October 2009. The countrys Ministry of Finance conrmed in February 2010 that the following projects had either been implemented or were at a shovel ready 12 stage: New and renovated wastewater network lines 728 km. New and renovated water supply network lines 865 km. I n s t a l l e d / r e c o n s t r u c t e d wastewater pump statons 380 Additonal citzens connected to centralised wastewater network lines 36,794 Additonal citzens connected to centralised water supply network lines 35,993 New wastewater treatment plants 35 Reconstructed wastewater treatment plants 15 Lithuania 10 Rolandas Kriinas, Ministry of Finance Director Financial Assistance Department, Governor of Lithuania 11 Ministry of Environment of the Republic of Lithuania 12 Ministry of Finance of the Republic of Lithuania 13 Country Report on Achievements of Cohesion Policy, European Commission Directorate-General for Regional Policy 16 Instrument for Structural Policies for Pre-Accession Monitoring Department, European Commission For the period from 2007 to 2013, Poland was allocated a total of 59.69 billion for cohesion-related projects. Poland's share of Cohesion Fund monies was by far the largest allocated to any European Union member states and reected both the country's relatvely large populaton size as well as the scale of the challenges it faced in respect of bringing its infrastructure and living standards in line with European Union averages. 14 The country's Operatonal Programme Infrastructure and Environment - the document outlining how EU cohesion-related monies would be spent during the 2007 to 2013 period - mandated that "water and sewage management" and "waste management and the protecton of earth" would be amongst its feen "priority axes" for implementaton. 15 Poland Case study: A project was undertaken to upgrade the water and sewage management in the city of Nowy Scz, the city and the municipality of Stary Scz and two municipalites of Nawojowa and Kamionka Wielka. As a result of the implementaton of the project the water supply system will be connected to around 8,000 inhabitants of the cites of Nowy and Stary Scz and municipality Nawojowa. The modernizaton of the water puricaton staton ensures reliability of supply of the drinking water of appropriate quality, which will contribute to fullment of basic health and economic needs of the local community. The total project cost 64.1 million of which the EU provided 43.9 million. 16 PAGE17 For the 2007 to 2013 period, Romania was allocated a total of 17.3 billion Euros for cohesion-related projects. In order to access European funding for infrastructure related projects, it is necessary for individual EU member states to outline a strategy indicatng their priorites. In Romanias case, several of the priorites for the 2007-2013 funding round had clear relevance to the water sector: Priority axis 1: Extension and modernizaton of water and wastewater systems. This priority sought to address one of the main weaknesses of the water and wastewater systems reectng poor rate of connecton of the communites to basic water and wastewater infrastructure (52%), poor quality of drinking water and lack of sewerage collecton and treatment facilites in some areas. As well, it addresses the issue of limited eciency of public water services mainly due to a large number of small operators, many of them dealing with dierent other actvites (public transport, urban heatng, local electricity, etc.) and due to long term under-investments, poor management, lack of long term development strategies and business plans. Priority axis 5: Implementaton of adequate infrastructure of natural risk preventon in vulnerable areas. Support under this priority axis was intended to focus on investments providing for adequate level of protecton against oods by improvements of the economic, environmental, ecological and conservaton status in the most vulnerable ood areas. Priority axis 6 (technical assistance): The aim of this priority was to ensure the ecient implementaton of EU law in respect of environmental standards, as well as encouraging the use of innovatve technologies. 17 Romania Case study: Piatra Neamt is a medium-sized town with a populaton of about 125,000, situated in the north-east part of Romania. Our project involved the eliminaton of waste previously unsafely deposited in the streets by means of the introducton of safe and sound collecton methods contributes to the reducton of health risks. A substantal increase in waste recycling, a reducton in waste disposed in landll, and reduced soil and water polluton levels were achieved. The EU contributon to this project was 10.4 million. 18 Case study: Water services are being vastly improved in eight towns and communes across a large county in south-eastern Romania. This work will deliver EU-standard drinking water and wastewater to almost their entre populaton. The four-year project targets some 59,700 people and will include the constructon of three wastewater treatment plants. It will be implemented over four years. New wastewater treatment plants are to be built in Bragadiru-Cornetu, Domnest-Ciorogarla, and Branest capable respectvely of handling sewage for populatons equivalent to 16,200, 13,000 and 11,330. The local economy will benet from the creaton of 170 jobs during the project implementaton and almost 50 jobs during the operatng stage. The EU contributon to this project is 55.6 million. Case study: The development and upgrading of the water and wastewater systems in Dmbovita County represents the rst step in a long term investment plan for the region. The project consists of infrastructure investments to upgrade drinking water treatment and distributon, and wastewater collecton and treatment; it will include six treatment plants. Over 170,000 residents in Dmbovita, Romanias most densely populated county, will gain access to clean water and an upgraded and rehabilitated modern water supply and wastewater service. It is estmated that 95% of the inhabitants will be connected to the drinking water network and safe water resources, representng an additonal 25,800 inhabitants connectng to the safe drinking water supply system. The connecton rate to the sewer collecton system will reach 94%, bringing in an additonal 59,391 inhabitants to the wastewater system. The project is also expected to directly mobilise 310 jobs during the implementaton phase and 10 jobs during the operatng stage. The EU contributon to this project is 107.7 million of the total 138.8 million cost. 17 Silviu Stoica, Director General, Ministry of Environment and Sustainable Development, Government of Romania 18 Instrument for Structural Policies for Pre- Accession Monitoring Department, European Commission PAGE18 Case study: A project is currently underway to bring about the extension and rehabilitaton of water and wastewater systems in Medias, Agnita and Dumbraveni regions in Sibiu County. The project consists of the replacement and constructon of 45 km distributon pipelines, the rehabilitaton of three drinking water treatment plants and ve water reservoirs. Some 68,000 inhabitants living in the project area will directly benet from improved water services. Partcularly, the investment will improve the quality of life of the citzens living in the service area by ensuring beter access to drinking water and wastewater services: 100 % of the populaton living in the municipalites of Medias, Agnita and Dumbraveni will have access to compliant drinking water supply afer project implementaton and 100% of the populaton of the concerned wastewater agglomeratons will be connected to the sewerage system. Case study: A project is underway to bring about the extension and the rehabilitaton of water and wastewater systems in Calarasi County. It will be implemented for the agglomeratons of Calarasi, Urziceni, Oltenita, Lehliu, Fundulea and Budest. The ultmate purpose is to promote the compliance with the relevant EU environmental legislaton and in turn improve the quality of the water services. The project involves the rehabilitaton and extension of 81 km of sewers, the constructon of 13 pumping statons, the extension and rehabilitaton of ve wastewater treatment plants. The target populaton served will be of 117,000 people. The EU is funding roughly 80% of the 99 million project. For the 2007 to 2013 period, Slovenia was allocated a total of 3.7 billion for cohesion-related projects. Following the grantng of these monies, the Slovene Government conrmed that issues relatng to the environmental and water quality sector would form party of the priority axes for part Cohesion Fund spending in the period from 2007 to 2013. More specically, the Governments plan stated that the programme would facilitate the constructon of waste water treatment plants, the installaton of main water supply systems and long- term protecton of existng and potental potable water sources the EU and the Natonal Government will provide respectvely 325,483,339 and 57,438,237 respectvely, for this program, for a total investment of 382.921.576. 19 Slovenia Case study: Slovenia introduced a wastewater management programme to improve the quality of the water in the rivers around Celje. Celje is located along the banks of two rivers, just where the Voglajna meets the Savinja and then the later river turns abruptly south to join the Sava. Celje is the third largest city in Slovenia and also an important regional centre for business and commerce, educaton and tourism. It covers an area of 24 square kilometres and has over 50,000 inhabitants. Formerly, all the wastewater that was produced in Celje owed into the regional sewage system that discharged more than 4,500 cubic metres of untreated water directly into the Savina River. The quality of the water in this river was rated as 3rd to 4th class, in accordance with the EU fresh water classicaton scale, and naturally, the euent from Celje owed on to contaminate the purity of water in the Sava. The Municipality paid for the upgrading of the primary collector of wastewater and then the treatment plant was built, which had the capacity to handle output from the equivalent of 85,000 inhabitants. Additonal collectors of a total length of 7.7 kilometres were installed and six pumping statons and ve retenton tanks were constructed along the Savinja River. In the new plant, the wastewater is mechanically and biologically puried and it renes household and pre-treated industrial and hospital euents. The nal products are cleansed water, which ows into the Savinja, and sludge that has been dehydrated and can then be used as manure on farmland. The project is one step towards ensuring that Slovenia meets the requirements of the EU Urban Wastewater Directve and the Natonal Environmental Acton Programme. The total cost of the project was 15.1 million, of which the EU provided 8.4 million. 19 Peter Wostner, Oce for Local Self-Government and Regional Policy, Government of Slovenia PAGE19 For the 2007 to 2013 period, Slovakia was allocated a total of 10.2 billion for cohesion-related projects. Given the challenges facing the country in respect of bringing its domestc water quality standards in line with European Union requirements the Slovak Government described the water sector as being in need of the heaviest investment given the need to comply with the EUs environmental acquis. Throughout the period from 2007 to 2013, it was envisaged that there would be an increase in the number of people connected to public sewers to 4.4 million, the percentage of populaton connected to waste water treatment plants to 81% and the proporton of the populaton supplied with drinking water from public water supply networks to 91%. 20 Slovakia Case study: The Myjava waste water treatment plant is located in the Trenin region close to the Myjava river. The main objectve of the project was to reconstruct and intensify the works of the existng Myjava WWTP in order to achieve compliance with European environmental law. The projects secondary objectve was to protect water quality: the Myjava river, which is a natural monument, together with its riverside vegetaton, represents a signicant landscape and eco-stabilising factor. The vegetaton also protects the river body from polluton by absorbing part of the fertlizers washed down from the surrounding elds. In the longer term, the reconstructed WWTP should create favourable conditons for the preservaton of several species of sh and invertebrates in that protected area. Before the works began in 2005, the treatment eciency of the Myjava WWTP was approximately 76%. Afer the project was nished in 2007, measurements proved 95% eciency of waste water treatment. The total cost of the project was 1.7 million of which the EU contributed 1.3 million. 21 20 Results of the Negotatons of Cohesion Policy Strategies and Programmes 200713, European Commission 21 Instrument for Structural Policies for Pre-Accession Monitoring Department, European Commission 22 Country Report on Achievements of Cohesion Policy, European Commission Directorate- General for Regional Policy 23 Dr Pusks Tivadar, Mayor of Szombathely According to gures published by the European Commission in 2003, at that stage only 16% of water courses in Hungary were of a good or excellent quality, 37% had a tolerable quality and around 47% of the countrys waters were contaminated or extremely contaminated. The number of homes connected to the sewerage system was only 59%. The European Commission Directorate-General for Regional Policy Country Report on Achievements of Cohesion Policy stated that, in 2003, many public utlity network and wastewater treatment facilites were obsolete or worn out. Consequently, the capacity of wastewater treatment plants and the eciency of treatment technologies did not comply with basic criteria at many locatons in Hungary most facilites need refurbishment, and many need complete replacement of infrastructure. 22 As such, the country faced signicant challenges in bringing its domestc water quality standards into line with minimum European Union requirements. Mindful of this, Hungary was allocated a total of 22.4 billion for cohesion-related projects for the period from 2007 to 2013 amongst the largest aid recipients in Europe. Hungary Case study: The Municipality of Szombathely is in the centre of Vas county next to the Hungarian- Austrian border. Its waste water, together with that from Kszeg and 24 communites, is treated by an existng waste water treatment plant which was upgraded in 2008. Four thousand people were connected to the waste water collecton system in the City of Szombathely, an increase from 92.4% to 96.7% of the populaton. The project also contributed to mitgatng negatve environmental impacts including odour nuisance, contaminaton of groundwater and surface water from storm-water overows and sewage ooding. It also provided a sustainable sludge disposal soluton that complies with EU environmental legislaton. The European Union made a nancial contributon of 11.9 million to this project, out of a total budget of 19.8 million. 23 PAGE20 On 6th October 2011, the European Commission announced its draf legislatve package to underpin the operaton of the Cohesion Fund for the period from 2014 to 2020. The proposal focussed on a number of distnct areas, including: Concentratng on boostng measures for economic growth in line with the Europe 2020 strategy which encourages sustainable development in order to foster economic growth; Reinforcing the territorial cohesion objectve of ensuring countries with weaker or less developed infrastructure were brought up to EU standards; Simplifying the means by which countries and regions are allowed to apply for funding for cohesion-related projects. The total budget made available for cohesion funding for the 2014 to 2020 period was 376 billion. The proposal mandated that every region across the European Union would have a right to benet from cohesion funding whether it be from the European Regional Development Fund (ERDF) or the European Social Fund (ESF). A distncton, however, was drawn between regions considered to be less developed (i.e. North East Romania), in transiton from being a low income to medium income area (the majority of Polish regions) or more developed (i.e. the South East of England). Less developed regions are dened as being those with an average GDP per capita of less than 75% of the European Union average while a transiton region is one where the average GDP lies between 75% and 90% of the average. While funding was not explicitly banned from being passed to more developed regions for projects ensuring compettveness in the eld of the digital economy or shifing towards low carbon technologies, the clear focus remained in respect of lower income regions. In respect of European Social Fund monies, a minimum share mechanism was established for each category of region of 25% for less developed regions, 40% for transiton regions and 52% for more developed regions. This calculaton resulted in a minimum overall share of the overall EU cohesion fund budget of 25%, equatng to 84 billion. The Cohesion Fund, it was decided, would contnue to support EU member states with a Gross Natonal Income (GNI) per capita of less than 90% with their eorts to invest in trans-European transportaton projects such as motorways or railway systems and environment-related projects such as water infrastructure. One of the key critcisms of the 2007- 2013 budget round was that individual EU member states in receipt of cohesion fund monies had had signicant problems in absorbing and spending European funding. In some cases, money was misdirected or signicant under-spends occurred. In order to remedy these problems, the 2014 to 2020 funding round introduced several new principles that must be followed when allocatng funding: Cohesion funding made available to each country must not exceed 2.5% of the countrys total GDP; Cohesion funding will only be made available to pay for up to 85% of any individual project in less developed regions, 60% in transiton regions and 50% in more developed regions; Partnership Contracts will be introduced between the EU and enttes receiving funding in order to improve transparency and accountability in the funding process. The 2014-2020 Budget Round PAGE21 European Union regulaton of European water began in 1975 with standards for those of our rivers and lakes used to provide drinking water, and resulted in setng binding quality targets for drinking water in 1980 with the Ground Water Directve on dangerous substances. This directve aimed to improve the quality of sh waters, shellsh waters, bathing waters and groundwater. Afer a period of review the EU launched a second phase of water legislaton which, in the early 1990s, resulted in the: Urban Waste Water Treatment Directve, providing for secondary (biological) waste water treatment, and even more stringent treatment where necessary; Nitrates Directve, addressing water polluton by nitrates from agriculture; Later in the decade the EU adopted the Drinking Water Directve, which tghtened water quality standards, and the Directve for Integrated Polluton and Preventon Control (IPPC) which aimed to reduce polluton from large industrial installatons. Throughout this process there were growing calls for a more comprehensive approach to water regulaton and legislaton. The European Parliament and European Council requested that the Commission bring forward a single piece of legislaton to combine all of the disparate and fragmented pieces of water legislaton. Afer widely consultng NGOs, the academic community and industry the Commission published its proposal for the Water Framework Directve which was duly adopted. European acton on water has since focussed on the proper implementaton of existng legislaton and the Blueprint to Safeguard Europe's Waters which includes a signicant review on the progress made towards achieving the goals laid out in the Water Framework Directve. Water Framework Directve In 2000 the EU agreed the terms of the Water Framework Directve (WFD). All Member States had been required to produce River Basin Management Plans (RBMPs) by 2009, and these provide the basis for protectng, improving and maintaining the environmental conditon of surface and ground waters by certain milestone dates: 2015, 2021 and 2027. Member States should aim to ensure that, by the nal date of 2027, all rivers and water bodies have reached, or have maintained, good or high status, and their progress towards that objectve is to be reported at the earlier milestone dates. There are a number of objectves in respect of which the quality of water is protected. The key aims of this at European level are general protecton of the aquatc ecology, specic protecton of unique and valuable habitats, protecton of drinking water resources, and protecton of bathing water. In practce, good status means a general requirement for ecological protecton, and a general minimum chemical standard. Under the Water Framework Directve, the basic management units for river basin management planning are the River Basin Districts (RBDs) that may comprise one or more river basins (and include as appropriate lakes, streams, rivers, groundwater and estuaries, together with the coastal waters into which they ow). The WFD requires that river basin management plans (RBMPs) must be developed and reviewed on a six- yearly basis, specifying the actons required within each period to achieve set environmental quality objectves. The planning process should include an economic analysis of all water uses in each RBD, as well as determining the pressures and impacts on the water environment. A key element of this process is public informaton and consultaton. The WFD requires that all inland, estuarial and coastal waters within RBDs must reach at least good status by 2015. This is based on EUROPEAN UNION WATER LAW PAGE22 an assessment of ecological, chemical and quanttatve criteria. There are more limited criteria for assessing the status of heavily modied and artcial water bodies; groundwater status is assessed on quanttatve and chemical criteria (the amount of water and the levels of priority substances in that water) alone. Direct discharges into groundwater are prohibited and governments are required to monitor groundwater bodies so as to detect changes in chemical compositon, and to reverse any human induced upward polluton trend. There are over 30 diering criteria for assessing the status of rivers, lakes, transitonal waters and coastal waters, but they all include consideraton of: biological quality, including presence or absence of various algae, plants, sh and invertebrates; physical and chemical quality, including oxygenaton and nutrient conditons; environmental quality standards for levels of specic pollutants, such as pestcides; and physical aspects that support the biological quality of the water body, such as the quantty and dynamics of water ow (hydromorphological quality) There are a number of exemptons to the general objectves, including disproportonate cost, which allow for less stringent objectves, extension of the deadline beyond 2015 or the implementaton of new projects. For all these exemptons, strict conditons must be met and a justcaton must be included in the river basin management plan. The WFD also acts to coordinate the measures outlined in previous directves aimed at specic polluton problems such as the Urban Waste Water Treatment Directve and the Nitrates Directve, which together tackle the problem of eutrophicaton (as well as health eects such as microbial polluton in bathing water areas and nitrates in drinking water); and the Integrated Polluton Preventon and Control Directve, which deals with chemical polluton. In practce coordinaton means that where implementaton of these directves does not result in the river basin achieving the status required by the WFD, the Member State must identfy exactly why, and design whatever additonal measures are needed to satsfy all the objectves established. These might include stricter controls on pollutng emissions from industry and agriculture, or urban waste water sources. The WFD both assimilates and replaces previous water legislaton. It replaces the inital water legislaton such as the directves on surface water, measurement methods and sampling frequencies and exchanges of informaton on fresh water quality, sh water, shellsh water, and groundwater and the directve on dangerous substances discharges. The Surface Water Abstracton Directve was repealed in December 2007 and replaced by amended Water Supply Regulatons and elements of the Water Framework Directve. The Blueprint to Safeguard Europes Water Resources Since 2010, the European Commission has reviewed EU freshwater policy, with a partcular focus on the WFD. This has included a preliminary study, or tness check, of the relevance, coherence, eectveness and eciency of EU freshwater policy. This tness check in turn underpins the Commissions Blueprint to Safeguard Europes Water Resources which was published at the end of 2012, with the aim of ensuring good quality water in sucient quanttes for all. The Commission has stated that the Blueprint is the policy response to rstly the challenges to water resource management posed by implementaton issues arising out of the current EU policy framework, and secondly the need to develop measures to tackle water availability and water quantty problems. While PAGE23 the tme horizon of the Blueprint will be 2020, the underpinning analysis will cover a tmespan up to 2050. The need to consider water protecton issues extends to other EU policies. Two of these areas are: the adaptaton of EU agriculture and forestry to climate change; and innovaton in EU agriculture. In both of these water resource management is a key policy consideraton: expanding the scope of water protecton to all waters, surface waters and groundwater; achieving good status for all waters by a set deadline; water management based on river basins; combined approach of emission limit values and quality standards; ensuring equitable pricing of water supply and related services; getng the citzen involved more closely; streamlining legislaton. Groundwater Directve Artcle 17 of the Water Framework Directve required the Commission to propose specic measures to prevent and control groundwater polluton and achieve good quanttatve and chemical status by 2015. To this end the Commission produced the Groundwater Directve in 2006. The Directve requires Member States to carry out polluton trend studies, the reversal of these trends by 2015 and the introducton of measures to prevent or limit inputs of pollutants into groundwater so that WFD environmental objectves can be achieved by 2015. Drinking Water Directve The Drinking Water Directve sets microbiological, chemical and organoleptc quality standards for drinking water quality at the tap and the general obligaton that drinking water must be wholesome and clean. It obliges Member States to regular monitoring of drinking water quality and to provide to consumers adequate and up-to-date informaton on their drinking water quality. The Directve sets a total of 48 microbiological and chemical parameters that must be monitored and tested regularly. These are based on World Health Organisaton (WHO) guidelines. Member States are allowed to gold plate this legislaton when introducing natonal legislaton, but also may derogate from the chemical quality standards as long as there is not a potental danger to human health and provided that the supply of water intended for human consumpton in the area concerned cannot be maintained by any other reasonable means. Nitrates Directve The Nitrates Directve aims to reduce water polluton by nitrate from agricultural sources and to prevent such polluton occurring in the future; it forms an integral part of the Water Framework Directve and is one of the key instruments in the protecton of waters against agricultural pressures. It requires Member States to identfy polluted or threatened waters (those with high levels of nitrates), to designate vulnerable zones that contribute to nitrate polluton which are to be subject to Acton Programmes to reduce polluton, and to establish a voluntary code of good agricultural practce to be adopted by farmers. Most importantly, the Directve requires natonal monitoring and reportng every four years on nitrates concentratons and eutrophicaton. Urban Waste Water Directve The Urban Waste Water Directve is designed to reduce the polluton of freshwater, estuarine and coastal waters by domestc sewage and industrial waste water. The Directve concerns the collecton, treatment and discharge of urban waste water and the treatment and discharge of waste water from certain industrial sectors. The Directve regulates industrial waste water entering collectng systems and the disposal of waste water and sludge from urban waste water treatment plants. By 2006 all agglomeratons of between 2,000 and 10,000 p.e. which discharge their euent into sensitve areas, and all agglomeratons of between 2,000 and 15,000 p.e. which do not discharge into such areas, must have had a collecton and treatment system installed. The Directve also requires Member States to draw up lists of sensitve and less sensitve areas which receive the treated waters. The treatment of urban water is to be varied according to the sensitvity of the receiving waters. The Directve also sets out requirements for discharges from specic industrial sectors of biodegradable industrial waste water not entering urban waste water treatment plants before discharge to receiving waters. Importantly, Member States are responsible for monitoring both discharges from treatment plants and the receiving waters. Integrated Polluton Preventon and Control Directve The Integrated Polluton Preventon and Control Directve requires certain industrial and agricultural installatons with a high polluton potental to have a permit. For a permit to be issued by a Member State the installaton must: use the best available polluton- preventon techniques (which produce the least waste or use less hazardous substances); prevent all large-scale polluton; prevent, recycle or dispose of waste in the least pollutng way possible; PAGE24 use energy eciently; ensure accident preventon and damage limitaton; return sites to their original state when the actvity is over. Member States are obliged to monitor these installatons to ensure compliance and there is a regular exchange of informaton on best available monitoring techniques between the Commission, the Member States and the industries concerned. Bathing Water Directve The 2006 Bathing Water Directve replaces the former 1976 Bathing Water Directve. It applies to surface waters that can be used for bathing except for swimming pools and spa pools, conned waters subject to treatment or used for therapeutc purposes and conned waters artcially separated from surface water and groundwater. The Directve aims to provide up to date informaton to citzens about the quality of bathing water, as well as ensuring this quality. As such it requires regular (at least four tmes a season) monitoring of the levels of intestnal enterococci and escherichia coli in bathing waters. The Directve requires that by the 2015 season all bathing water should be of a sucient standard. PAGE25 SUMMARYLIST OF NON-COMPLIANCE It is the responsibility of the government of each European Union member state to conduct ongoing tests to ascertain water quality. Such tests allow member states to demonstrate their compliance with EU law and apply to water released from factories during industrial processes, waste treatment processes or found in standing waters such as lakes. Despite the numerous advances that have been made in recent years in relaton to the quality of Europes water infrastructure, there are many areas of Europe which stll lag behind in terms of adhering to acceptable standards. While many might expect the most signicant problems in respect of water infrastructure to exist in newly-admited European Union member states in Eastern Europe, signicant problems also exist in longer-established member states. Using data made publicly available by the European Commission, it is possible to see which areas of Europe including individual villages, towns, cites and agglomeratons (individual water treatment systems) are not compliant with European Union legislaton in respect of water standards. This document does not claim to provide an exhaustve and denitve list of all areas of the European Union that are not currently in compliance with water treatment standards. The status of individual agglomeratons can change at any tme depending on work completed by the local, regional and natonal governments of individual areas to bring their water systems into compliance with the law. When countries repeatedly prove themselves to not be in compliance with European Union legislaton, they leave themselves open to the threat of legal acton by the European Commission. If the European Commission is successful in challenging the countrys non- compliance in the European Court of Justce, the court then has the power to impose signicant nes upon the country in queston for its breach of the law. On 27th October 2011 a daily ne of 1,248 was imposed on Luxembourg for its failure to comply with water legislaton in respect of four areas that were not compliant with EU water law. The decision to ne Luxembourg at this rate follows a previous European Court of Justce ruling imposing a daily penalty of 62,000 on Belgium for the failure of 114 areas to comply with the Urban Waste Water Treatment Directve. If such a ne was applied to each EU area, this would total 3,026,124 or 1,104,535,260 per year. 24 Non- compliance with environmental laws in respect of the water sector not only poses a signicant risk in relaton to public health, it also faces placing a signicant nancial burden upon EU member states. PAGE26 Country-by-country list of non-compliance Romania By far the most cases of non- compliance with European Union water legislaton were found in Romania. Romanias failings in this respect are rooted in infrastructure weaknesses. Industrial polluton is also a consequence of outdated infrastructure, weak enforcement of regulatons and the absence of economic incentves to promote cleaner producton. In turn, infrastructure weaknesses are rooted in the limited availability of nances for upgrading and modernisaton. Given that Romania joined the European Union in 2007, the country has untl the end of 2018 to bring their water infrastructure, treatment and testng systems up to acceptable standards or face sanctons. Areas that are at present judged to not have infrastructure that complies with European Union laws in respect of the water sector include the capital city Bucharest (1,931,000 populaton) and the second and third cites Cluj- Napoca (309,136) and Timioara (303,708). Bulgaria Given that Bulgaria joined the European Union in 2007, the country has untl the end of 2018 to bring their water infrastructure, treatment and testng systems up to acceptable standards or face sanctons. The many areas in Bulgaria that do not conform to European Union environmental standards in respect of water treatment include the parts of the capital city Soa (1,300,000 residents) as well as the countrys second city Plovdiv (338,153). Bulgaria has made signicant eorts in recent years to increase the number of tourists who visit the country partcularly in coastal areas. It will be of partcular concern to the country, therefore, that coastal areas such as the region in close proximity to the city of Varna on the Black Coast also feature amongst those areas whose infrastructure does not meet acceptable European Union standards. Spain Spain has been a member of the European Union since 1986 and, during this tme, has been amongst the largest recipients of EU funding for infrastructure projects. Despite the long-term investments that have been made in the countrys water infrastructure, a number of cases contnue to exist of areas that are not compliant with EU legislaton in respect of water treatment. This problem is partcularly acute in the Andalucia, Galicia, Extremadura and Castlla La Mancha regions. On 16th June 2011, the European Commission referred Spain to the European Court of Justce for breaching the Urban Wastewater Treatment Directve. Although Spain has made progress since the original 1998 deadline, the Commissions view is that overall compliance remains poor. At least 39 towns (with more than 10,000 residents) contnue to discharge urban waste water into environmentally sensitve or potentally sensitve areas without appropriate treatment. Spain had already been referred to the Court of Justce on 5th May 2010 for failing to introduce sucient urban waste water measures in 38 other towns (with more than 15,000 residents). It also received a nal writen warning for failing to implement adequate measures in the Valencia region. The European Commission rst indicated that it planned to pursue legal acton against Spain over the Urban Wastewater Directve in November 2008. On 16th June 2011, the European Commission urged Spain to comply with the Drinking Water Directve, partcularly with a view to improving the quality of drinking water in Alicante. The Commission was concerned that local residents suered from water not considered to be t for human consumpton. Despite acknowledgement by the Spanish government of the poor quality of the drinking water, the Commission expressed its concern that no tangible acton had been taken to address the problem. Hungary Hungary joined the European Union in 2004 and, to date, a total of 631 areas of the country are stll not compliant with water-related legislaton. In March 2012, the European Council voted to suspend 495.2 million in scheduled funding for Hungary under the Cohesion Fund due to the country running an excessive decit that was beyond that permited by European Union rules. This was the rst tme that the clause enabling the suspension of funding had been invoked since the Cohesion Fund was established in 1994. Funding was reinstated later that year following the Hungarian Governments decision to adopt measures designed to bring the countrys decit back in line with EU standards. During this period, however, funding for cohesion-related projects was stalled. Of 876 natural and 150 artcial water bodies idented in Hungary, 579 freshwater surface bodies have been classied as being at risk from 24 Calculaton: (1,248 / 4 = 416) + (62,000 / 114 = 543) / 2 = 479.5 x 6,311 = 3,026,124.5 per day PAGE27 organic, nutrient or priority hazardous substances according to EU Water Framework Directve denitons. Slovakia A European Union member since 2004, there are a total of 356 areas in Slovakia that are currently not compliant with EU water legislaton. Included in this number are the capital city region of Bratslava (populaton of 450,000) and fh largest city Nitra (84,800). Specically, in June 2010, the European Commission issued a formal notce to Slovakia for its failure to fully and correctly transpose the Drinking Water Directve into natonal law. Italy Italy is a founder member of the European Union and, as such, one might have expected its domestc infrastructure and processes to be suciently robust to be in accordance with EU regulatons governing water standards. Regretably, however, there are 443 cases of non-compliance with water-related legislaton that contnue to persist. On 22nd March 2012, the European Commission warned Italy that it would be referred to the European Court of Justce for failure to comply with the Water Framework Directve. Italy has failed to implement a number of provisions correctly, including the need to put in place a number of measures to achieve the good status objectves set for river basins before the agreed deadline and the requirement to keep an updated register of protected areas. The Commission was also concerned about the transpositon of Annex II of the Directve, which covers the characterisaton of surface and ground waters. It also pointed out that Annex V, concerning monitoring of the status of surface and ground waters, also lacked certain aspects, including the requirements to monitor the discharge of extra water into groundwater bodies and to provide maps with the characteristcs specied in the Directve to describe the chemical levels and amounts of water per groundwater body. On 19th May 2011, Italy was warned that it would be taken to the European Court of Justce if it did not comply with the requirements of the Urban Waste Water Directve. The Commission was concerned that 143 Italian towns (with more than 10,000 residents) were not connected to a suitable sewage system. In a separate, earlier case concerning the Urban Waste Water Directve, Italy received a second and nal writen warning on 19th February 2009 from the European Commission for not complying with the Urban Waste Water Directve. The Commission had found that 229 towns and cites (with more than 15,000 residents) which were not treatng waste water to EU standards. The rst warning leter had been sent in July 2004. In May 2010, the Commission announced that, as 178 Italian towns stll did not meet the required standards, the case was being referred to the European Court of Justce. Portugal Portugal has been a member of the European Union since 1986 and, during this tme, has beneted tremendously from nancial assistance provided to it for the upgrading and improvement of its infrastructure. Signicant challenges remain, however. At present there are a total of 201 areas of the country that do not comply with EU water legislaton. In May 2009 the Commission decided to refer Portugal to the Court of Justce for its failure to ensure compliance with its more stringent treatment obligatons for sensitve areas, under the Urban Waste Water Directve. The Court of Justce gave its judgment against Portugal on 7th May 2009 in case C-530/07 for its failure to ensure compliance with these requirements for a number of agglomeratons. Belgium Despite being a founder member of the European Union and the home of the organisatons insttutons, Belgium stll lags behind many other parts of Europe in correctly implementng European Union legislaton. Indeed, the city of Brussels itself is judged not to be in compliance with EU water legislaton. On 26th January 2012, the European Commission issued Belgium with a warning about its failure to transpose EU water legislaton into natonal law. The Commission highlighted that Directve 2009/90/EC on technical specicatons for chemical analysis and monitoring of water status should have been in place by 1st August 2011. PAGE28 On 6th April 2011, the European Commissioned warned the government of Belgium that the country was not compliant with EU laws relatng to the treatment of waste water. The Commission concluded that "the lack of sucient collecton and treatment systems that should have been in place since 2005 poses risks to human health and to the marine environment". According to the EU's Urban Wastewater Treatment Directve, all towns with a populaton of 2,000 to 10,000 residents were mandated to have adequate sewage treatment processes in place by 2005. 67 towns in the regions of Flanders and Waloonia did not have such processes in place. On 27th January 2011, the European Commission requested that the government of Belgium comply with the terms of the Priority Substances Directve in respect of environmental quality standards for surface water. EU governments had a deadline of July 2010 to bring their natonal legislaton in line with legislaton to limit water emissions containing "certain substances and groups of substances that are known to pose a substantal risk to the aquatc environment." Cyprus One of the more recent additons to the European Union, Cyprus joined the European Union in 2004. On the 3rd May 2012, it was reported that the head of the European Parliaments Commitee on the Environment, Cristna Guterrez- Cortnes, expressed satsfacton over Cyprus response to a series of issues concerning the implementaton of EU law, including on water. Guterrez- Cortnes noted that the Cypriot Government is making an enormous eort to implement EU directves on water, waste and climate change. Given the concerned agged by Guterrez-Cortnes, it is unsurprising to note that the country has a total of 57 locatons that are considered to not be in compliance with European Union environmental legislaton in respect of the water sector. In the European Environment Country Prole 2010, the environmental infrastructure in Cyprus was classed as underdeveloped, especially in relaton to urban waste water treatment. On the 28th October 2010, the European Commission urged seven Member States to comply with EU water legislaton and submit their plans for managing Europe's river basins; one of these Member States was Cyprus. The river basin management plans should have been adopted by 22nd December 2009. As a result, the Commission is now sending the seven States, including Cyprus, a leter urging them to comply. Greece While media coverage of the challenges facing Greece has in recent tmes tended to focus upon economic challenges, the country also faces partcular problems in relaton to its compliance with water-related legislaton. A total of 22 areas are failing in this respect. On 31st May 2012, the European Commission formally asked Greece to improve its treatment of waste water, alleging that twelve areas in Greece fail to treat their urban waste water to sucient standards as mandated in the Urban Waste Water Directve. According to the Commission, a 2009 report submited by the Greek authorites showed that urban waste water in Prosotsani, Doxato, Elefheroupoli and Vagia was not subject to the secondary treatment required by the Directve, and that in eight other agglomeratons the discharges from the respectve waste water facilites did not satsfy requirements. While the Commission acknowledged that the Greek authorites recognise the existence of a problem in both cases and are trying to address it, they noted that the necessary measures had stll not been taken. On 27th October 2011, the European Commission sent a communicaton to Greece requestng that the country fully implement the Nitrates Directve, which has been in force since 1991. According to the Commission, both countries have yet to designate all the zones which are vulnerable to nitrates polluton and adopt measures to eectvely combat nitrates polluton in these zones. The Commission said: An examinaton of Greek law revealed that seven of the Acton Plans, adopted in Greece in 2001 and 2006, have shortcomings and are not being correctly implemented on the ground. Legal proceedings began last year, and while some progress has been made, the Commission is not satsed with the pace of change, and a reasoned opinion is therefore being sent. This acton followed a leter of formal notce in March 2010. On 6th April 2011, the European Commission announced that it was taking Greece, along with three other Member States, to the EU Court of Justce over its failure to comply with the EU Water Directve and submit plans for managing its river basins plans that should have been adopted by 22nd December 2009. The Commission noted that Greece had not yet started public consultatons and that it would only publish its plans by March 2012. This followed a reasoned opinion from the Commission on the mater in October 2010. On 16th February 2011, the European Commission urged Greece to take acton to comply with a European Court of Justce ruling to ensure proper urban waste water treatment in nine towns and cites. In a case brought by the Commission, Case C- 440/06 Commission v Greece, the European Court of Justce ruled in October 2007 that Greece was in breach of the Urban Wastewater Treatment Directve as 23 agglomeratons (towns and cites) across the country did not have the necessary collecton and treatment systems. The Commission said that since the judgment and a subsequent PAGE29 Leter of Formal Notce sent on 1 December 2008, 14 of these areas had conformed to the legislaton, but the other nine were stll in breach of the rules. The Commission added that the lack of treatment poses a risk for the health of residents and marine environment. Proper waste water treatment is recognised as an important factor in ensuring a thriving tourist industry, a key sector for the Greek economy. On 27th January 2011, the European Commission announced that is was referring Greece to the European Court of Justce for its failure to protect Lake Koroneia, an internatonally important wetland in the region of Thessaloniki. The Commission said that Greece was failing to meet its obligatons regarding the lake under several key directves the Habitats and Birds Directves, the Urban Waste Water Treatment directve, and discharges into water of dangerous substances. The Commission explained that the lake has been seriously aected by polluton and illegal water extracton, with serious consequences for local fauna and ora. Although a comprehensive plan is in place to rehabilitate the lake, with many actons partly nanced by EU funds, progress has been slow. Luxembourg On 26th January 2012, the European Commissioned called on Luxembourg to comply with the Water Framework Directve. The complaint was that Luxembourg had not informed the Commission on technical specicatons for chemical analysis and monitoring of water status, which should have been in place by August 2011. Four individual areas of Luxembourg have been found to not be compliant with EU legislaton with regards to water. On 27th October 2011, Luxembourg was referred back to the European Court of Justce for failing to comply with the Urban Wastewater Treatment Directve. The Court had previously ruled in November 2006 that Luxembourg had not met its obligaton to treat and dispose urban waste water adequately. Five years on, the Commission found that four towns stll do not comply and, at the request of Environment Commissioner, Janez Potonik, the Commission requested that the Court of Justce impose nes and suggested a lump sum of 11,340 and a daily penalty payment of 1,248 untl Luxembourg fully meets its obligatons. On 24th November 2010, Luxembourg was implement a ruling by the European Court of Justce and comply with measures contained in the Nitrates Directve. The Court had ruled in June 2010 that Luxembourg had failed to adopt acton plans for zones vulnerable to nitrate polluton. On 24th June 2010, Luxembourg was referred by the European Commission to the European Court of Justce for failing to comply with the Groundwater and Drinking Water Directves.
