A ceremony honoring Daryl and recognizing other nominees was held on March 27th in the Atrium of City Hall Commons. It is always a great honor to give recogniton to one of the many unsung heroines who serves our neighborhoods, said Syracuse Mayor Stephanie A. Miner. A long-tme North Side resident, Daryl Files is a retred small business owner. She is a community organizer who has been focused on neighborhood preservaton, womens empowerment and working with the new American community. She has been actve in several organizatons and initatves including the Interfaith Works Center for New Americans and Women Transcending Boundaries. Daryl Files is a champion of many causes and the North Side is a beter place because of her, Miner said. She works to revitalize the Buternut Street Corridor through her Buternut Style Initatve and the worked to establish the Tapestry Garden. She was also an organizer of the A-OK! weekend of service. The Syracuse Commission for Women, which made the call for nominees in February and selected Files in March, was established in the 1980s to advise the Mayor on womens issues in the community. Today, the Commission consists of ten members and focuses on organizing and empowering women and girls throughout the community and empowering volunteerism across the city. Other nominees for the 2013 Woman of the Year award were: Willie Mary Andrews, Marilyn Higgins, Dorothy Mathews, Agnes McCray, Laura Serway, Cindy Seymour, Diane Turner, and Rose Viviano. They will also be recognized for their ongoing community actvism at the 2013 Woman of the Year award ceremony. Daryl Files Syracuse 2013-2014 Budget Submitted The Syracuse budget for the 2013- 2014 fscal year has was submited to the Common Council Monday morning by Mayor Stephanie A. Miner. The school budget is 2.2 percent larger than last year. The city will contnue to invest $1 million in support of the Say Yes to Educaton program, which is a program that provides internships, mentoring, and networking opportunites for Syracuse City School District graduates and also promises free tuiton for SCSD graduates who meet certain requirements. There will be an increase of less than a quarter of a percent for the rest of the budget. There are no increases in property taxes, water or sewer rates. There was a $4 million raise in pension and healthcare costs. The city will not partcipate in a state authorized borrowing program to cover those costs, however, there will be cuts to operatng budgets to supplement these costs by a decrease in funding of approximately $4 million. Most of the savings are coming from the police and fre departments. Miners budget contains the closure of fre staton seven. Rather than pay more than $1 million to keep it open, the city wants to close the staton on East Fayete Street. The fre house responded to six thousand emergency calls last year on the citys east side. The statons frefghters would be relocated to other statons, but some fre ofcials are worried about response tmes due to the amount of emergency calls received from the east side of the city. According to the budget, residents of Syracuse will not have their taxes increased. By Associated Press SYRACUSE, N.Y. Four days afer Syracuse lost in the natonal semifnals of the NCAA tournament, star point guard Michael Carter-Williams has decided to enter the NBA draf. I want to thank coach (Jim) Boeheim and all the coaches for the amazing experience Ive had playing basketball at Syracuse, Carter-Williams said in a statement Wednesday. I also want to thank my current and past teammates because if it wasnt for them I wouldnt be able to chase my lifelong dreams. In additon, the fans, who have been unbelievable from the moment I got here, Ill always be a proud member of the Syracuse program. The 6-foot-6 Carter-Williams started all 40 games for the Orange this season. He fnished ffh natonally in assist average (7.3) and fourth in steals (2.78) among Division I players, and also averaged 11.9 points and a team- best 35.2 minutes. His star rose greatly in the postseason as he led Syracuse on a scintllatng run afer an end-of-year skid. In free fall with four losses in fve games to close the regular season, the Orange beat Seton Hall, Pitsburgh and Georgetown in the Big East tournament before falling to eventual natonal champion Louisville in the ttle game at Madison Square Garden. In the NCAA tournament, Carter- Williams scored a career-high 24 in an upset of top-seeded Indiana in the semifnals of the East Regional, just days afer his family home had been ravaged by a fre. Two days later, in the regional fnal, he had 12 points, eight rebounds, six assists and fve steals with just one turnover in a victory over Marquete and was named the most outstanding player of the regional. Hes coming of a tremendous season and we appreciate all hes done for Syracuse basketball, Boeheim said. We wish Michael the best of luck as he pursues a pro career. Carter-Williams, of Hamilton, Mass., is being projected as a lotery pick. The deadline for underclassmen to declare is April 28. In his lone year as a starter, Carter- Williams broke the school record for steals in a season with 111 and fnished with 292 assists, the second- highest total in Syracuse history behind only Sherman Douglass record of 326 in 1988-89. Carter-Williams also recorded nine double-doubles. Syracuse, which fnished 30-10, ended the season with a 61-56 loss to Michigan Saturday. Carter-Williams fouled out with 1:14 lef, giving a big tug on his jersey while walking to the bench afer a 1-for-6 shootng night that included just two assists with fve turnovers. Andrew Cuomo, New York district attorneys plan corruption reforms By MICHAEL GORMLEY ALBANY, N.Y. (AP) A person familiar with the proposal says Gov. Andrew Cuomo and New York City prosecutors are set to announce a package of reforms aimed at rootng out government corrupton. Cuomo plans a Tuesday afernoon announcement in New York City. The person familiar with the proposal tells The Associated Press the reforms will help district atorneys pursue the kinds of government and politcal corrupton cases brought by the U.S. Atorneys Ofce in Manhatan last week. The person spoke on conditon of anonymity because the informaton was scheduled for release only by Cuomo. U.S. Atorney Preet Bharara said last week that public corrupton is rampant in Albany. State politcians were arrested last week in two bribery cases brought by Bharara. ALBANY, N.Y. (AP) New York correctons ofcials have proposed letng local jails across the state close their law libraries used by inmates. The state Commission of Correcton estmated that could save each jail about $5,000 a year, though the 63 jails would stll have to preserve prisoner access rights to legal materials. That could be done through computer terminals with online access, similar to the approach in the state prison system. Another alternatve is submitng writen inmate requests to nearby court libraries. Thats current practce of six small jails that have waivers from the library requirement in Hamilton, Otsego, Delaware, Cortland, Orleans and Oswego countes. Under the new regulaton, each jail must stll provide access to legal materials to all inmates, commission spokeswoman Janine Kava said. The signifcant change is that they are not required to maintain the library inside the facility, and the new regulaton specifcally allows for electronic access. According to inmate advocates, the change will make it harder for inexperienced individuals to do research without being able to browse law books, especially where they have to wait three days to see if specifc requests to court libraries produce the documents they need. Its not comparable access to a law library in our opinion, said Jack Beck, director of the prison visitng project at the Correctonal Associaton of New York. These are not lawyers. Its going to make it nearly impossible for individuals who are not very sophistcated to do their research. The commission proposal would let jails that choose to maintain a law library to pay the costs with profts from the commissary where inmates buy extra food, toiletries and some other goods. The fnal rule, if adopted, would take efect May 18. NY may let county jails close law libraries, provide inmates online legal resources WASHINGTON (AP) Vice President Joe Biden says he refuses to believe a small group of senators will block a vote on gun legislaton. The vice president says it would be embarrassing if a flibuster would be the climax of a natonal tragedy like the shootng at Connectcuts Sandy Hook Elementary School. Biden spoke to law enforcement ofcers at the White House just before Senate Majority Leader Harry Reid announced he would push for a vote Thursday. He encouraged the police and sherifs deputes to go talk to their lawmakers in uniform to encourage passage of the bill. Biden vowed to win the fght on guns, even if this vote is blocked. However, new informaton has recently come to light regarding the district atorneys long-standing, working relatonship with Syracuse University that may shed some light on the tumultuous relatonship. An ofcial report obtained by CNY Vision (the sister publicaton to Minority Reporter)in the wake of the Syracuse basketball teams loss in the NCAA fnal fourchronologically lays out several instances where SU athletes and coaches have received special treatment by Fitzpatrick and his ofce datng as far back as 2001.
Although the statute of limitatons has run out on most of the cases, the reportgiven on terms of anonymityincludes cases where charges were suspected to be either mishandled by the district atorney, or surrepttously dismissed altogether. The reason for Fitzpatricks alleged bias, according to the report, is based on the fact that the university is his alma mater. The report also labels him as being a ferce basketball fan. Case in point: the frst case detailed in the report regards former SU basketball player William Edelin. Edelin was suspended by the university in 2001 based on allegatons from two female students of unwanted sexual conduct, including one accusaton of rape. However, the district atorneys ofce decided not to fle criminal charges. At the tme, even though the schools judicial review board found merit with the victms testmony, Fitzpatrick publicly stated: We took the girls story and didnt fnd the conduct of Mr. Edelin reached criminal conduct.
As a result, Edelin received minor disciplinary acton from the school in the form of a suspension from the university for one year, according to the report. However, with no criminal charges lodged against him, he was able to return to the university in 2002, and ultmately helped lead the school to an NCAA championship in 2003. Fitzpatrick also questoned whether Syracuse University ofcials and members of its judicial boards have the ability to assess the issues of credibility, the report states. The public had no reason to believe that the ofce may be ethically compromised, and gave full weight to the statements made by DA William Fitzpatrick, who led them to believe that Edelin commited no crime. All informaton found was to the contrary. In 2004, another case took place where an SU athlete faced substantated criminal charges that were subsequently dropped by Fitzgeralds ofce; again, for no apparent reason, according to the report. Diamond Ferri, a former startng strong safety for the Syracuse football team, was arrested afer an altercaton at a local bar and charged with third- degree assault and resistng arrest on May 22, 2004. The report stated: Syracuse University announced that disciplinary procedures would be postponed pending the outcome of criminal charges. Ferris court dates were adjourned numerous tmes through the football season untl April 20, 2005, when he received a six-month ACD (adjournment in contemplaton of dismissal). If a six-month ACD was an acceptable conclusion, the case appears to have been delayed for almost a year without legitmate purpose. According to the report, Suspiciously, the long delayed conclusion to the case was reached within a day or two of Ferri traveling to New York City and signing as a free agent with the New York Giants. The events in this case are another example of what appears to be unethical communicaton and possibly even collusion between the district atorneys ofce and SU athletc departments, their coaches and/or their atorneys, the report said. Eugene Brown, a former junior defensive tackle for the SU football team, was charged with second- degree felony assault, afer resistng arrest and injuring a police ofcer when ofcers were called to break up a fght at a local bar in March 2005. Syracuse University announced Brown was suspended, pending a decision within the criminal justce system, the report states. Fitzgerald never prosecuted. Instead, the case was adjourned for six months, then completely dismissed and sealed, according to the report. Two weeks afer the incident, it was reported that Brown had been reinstated to the University and was back on the football team without further explanaton. All charges were dismissed (six-month ACD). The case was dismissed quietly and without the injured ofcers notfcaton, the report stated. On top of this, another unusual incident occurred a couple of years later when, in October 2007, three SU basketball players, Antonio Scoop Jardine, Johnny Flynn and Ricky Jackson, were alleged to have sexually abused another student, the report states. The victms only desire was to be heard in front of a judicial afairs board, the report said. As a result, The victm did not supply the Syracuse police with enough details for them to take further acton other than to complete a basic incident report. The Syracuse police were neither involved in any investgaton nor were they provided informaton from the district atorneys ofce or Syracuse University to commence an investgaton. The next tme the victms name appeared at the Syracuse Police Department was the following: On Dec. 20, 2007, an e-mail was sent out by Syracuse University outlining the details of an informal agreement between the players/their atorneys as well as the university and the victm/ atorney. By LisA DumAs 8 www.cnyvision.com | april 11 -17 | 2013 According to the report, some of the terms of the agreement included the fact that the young men would be placed on probaton, required to live in housing away from the victm, and their parents would be notfed. In additon, there would be an agreement on confdentality. However, the victm was not satsfed and never signed the agreement, the report said. Yet, for an unknown reason, she was stll not allowed to testfy at a judicial afairs board. Then the university, believing the victm was leaving the school, closed the case without her approval. Several months later, the victm told her story to David Poter, dean of student afairs for Syracuse Universitys College of Arts and Sciences. In March 2008, Poter, as well as several other employees, began pettoning judicial afairs and the university to re-open the incident on the victms behalf. Afer that, according to the report, Fitzpatrick stepped in. District Atorney William Fitzpatrick suddenly involved himself in this incident, the report stated. There was no informaton found that would explain why the DA was involved legally. She did not want to pursue criminal charges. Judicial afairs at SU is not a public courtroom and their proceedings do not require a district atorney. No informaton was found as to who notfed Fitzpatrick. There wasnt even a criminal investgaton going on. If the victm and the police did not call the DA, then who? Of all the partes involved in this case, only Syracuse University was lef. Potentally, the university would not want to lose their players nor have their players arrested, so why would they want to notfy him? In apparent answer to the queston, the district atorney opened a subsequent grand jury investgaton into the mater, the report stated. This move allowed SU to delay the judicial afairs hearing again pending the outcome. Eventually, the victm was found not credible enough by the grand jury to warrant criminal charges. However, no request was made to obtain grand jury testmony due to the sensitve nature of this report, the report said. Following the decision, the victm was fnally allowed to testfy in front of a judicial afairs board, where the athletes were found to be in violaton of student code and placed on probaton for one year, while stll allowed to play basketball. In the afermath, Poter and several other employees involved in re- opening the case were consequently fred, the report said. But, of all the employees who were let go, Poter was the only one who declined to sign a confdentality agreement. In an Oct. 2008 artcle published by Inside Higher Ed, Poter said of his advocacy for the female student, From my perspectve, its a straightorward mater of principle. I wanted to resolve it. Im not angry at anyone. I dont want to take anyone out. I believe in daylight and conversaton and not shadow and covers. Next, in yet another strange case concerning the district atorney, and an SU basketball player, Eric Devendorf was involved in two incidents that resulted in investgaton afer the 2007-2008 season. According to the report, the frst case was deemed an assault; however the police, unable to acquire a statement from the victm, were incapable of making an arrest. In the second case, though, of harassment, the victm desired prosecuton, the report said. Nonetheless, William Fitzpatrick refused to prosecute Devendorf for harassment in the second-degree. At the tme, Fitzpatrick interviewed alleged witnesses, several of which were basketball players, according to the report, and said he found diferences between those and the victms accounts. But, in the subsequent judicial afairs decision, the testmony obtained by Fitzpatrick was called scripted and biased and disregarded as evidence. Therefore, Devendorf was suspended for one academic term. However, upon winning an appeal, the sentence was reduced to 40 hours of community service, afer which he could be reinstated to the school. While reducing his sentence is not inherently illegal for the private insttuton, it bears witness to the overwhelming pressure asserted to keep Devendorf on the basketball court, the report states. William Fitzpatricks actons, or lack thereof, appear to be part of this pressure. In 2010, the report said an incident involving star tailback for the SU football team Delone Carter ofered more interference from Fitzpatrick. According to the report, Carter was accused of striking SU student William Hotaling in his face, rendering Hotaling unconscious while on his feet and unable to break his fall to the ground. And, even though Hotaling faced severe and substantal head injuries, including fractured bones and a permanently dislocated jaw, the charge was eventually plea bargained down to a charge of second-degree harassment by the district atorney, with a one-year conditonal discharge, the report states. Carter was immediately suspended from the football team and the university for two semesters, those being the remainder of the spring semester and the summer semester, the report said. He was reinstated in tme to make the frst fall practce on Aug. 9, 2010. According to the report, the conditonal discharge meant that the case would remain open for 12 months, and then be closed as long as Carter stayed out of additonal trouble. In the end, the report found that the Syracuse Police Department, took the investgatons as far as possible without visible support of the district atorneys ofce. All of this led up to the more recent fallout between Fitzpatrick and the Syracuse Police Department, during an investgaton into the largely- publicized case of SU assistant basketball coach Bernie Fine, who, in Nov. 2011, was accused of sexually abusing two former ball boys. The report alleges blatant misconduct by the district atorneys ofce during that tme, including one documented telephone conversaton between Fines atorney, Donald Martn, and an unknown person. In the conversaton Fitzpatrick was mentoned specifcally: No, I havent heard anything from Fitz, Martn allegedly stated. None of his people are here. The last I talked with him, he said that as*hole deputy chief called the feds. The call ended shortly aferwards, the report said. Detectve Joseph DeCaro allegedly overheard the exchange and included the dialogue in his report afer a search of Fines home on Nov. 25, 2011. According to a 2011 artcle published in Syracuses The Post-Standard, in a rare move, police ultmately turned the case over to federal prosecutors. It appeared to police that the DAs ofce, in those early days of the investgaton, was out to discredit the victms, Deputy Chief of Police Shawn Broton said. And, although Fitzpatrick denied the allegatons, Brotons report said theres a history of SU athletes getng preferental treatment from the DAs ofce, the artcle stated. Recently, Fine, afer having been fred over the mater, has fled a defamaton lawsuit against ESPN, according to a March 28 artcle in USA Today. In additon, questons regarding favoritsm for SU athletes by the school have also resurfaced, according to a March 20 artcle in The Post-Standard ttled, Sources: Syracuse basketball program under wide-ranging NCAA investgaton. NCAA investgators have conducted face-to-face interviews of SU employees or former employees for at least the past school year in a wide- ranging investgaton that includes the handling of Fab Melos academic eligibility and a 2007 alleged sexual assault case involving three players, two named and two unnamed sources told The Post-Standard, the artcle states. The transgressions were described as both major and wide- ranging in nature, CBS reported. The investgaton also encompasses football but is believed to primarily involve basketball, according to the report. The artcle stated one NCAA investgator, Meg Babcock Locker, spent two hours interviewing former associate dean David Poter, who also recommended Locker interview Cathryn Newton an SU professor and former dean. According to The Post, Newton said of the alleged 2007 sexual assault case: An arts and sciences student fled a complaint that was specifc and credible, and that complaint did not progress in the usual way. Fitzpatrick began his tenure in the district atorneys ofce as a law clerk in 1975, and has been district atorney since Jan. 1992. The hearings have very high stakes, with billions of dollars on the line, depending on how they turn out. As it stands, a total of 4,200 players have sued the NFL for various brain injuries. Some have sufered from dementa, depression, Alzheimers disease and other neurological problems. Some players have even killed themselves afer being unable to endure the sufering they experienced when their playing days were over. The players atorneys say that the NFL promotes the violence of the game and isnt forthcoming about the long- term health efects that occur from play on the feld. Their goal now is to determine what the NFL knew about concussions, and when in fact they knew it. The NFL failed to live up to its responsibility: it negligently heightened players exposure to repeated head trauma and fraudulently concealed the chronic brain injuries that resulted, the players lawyers wrote in a legal fling. The NFL is an economic behemoth, with $9.2 billion in annual revenue. Big money buys you big excuses, since its difcult to shut down an economic engine this massive. Players may get what they want, but its going to be a long and ugly fght. The rule in our league is simple: Medical decisions override everything else, NFL Commissioner Roger Goodell said in a speech. At this point, the key decision being made by Senior U.S. District Judge Anita B. Brody of Philadelphia is whether or not the lawsuits should remain in federal court. The NFL says that the collectve bargaining agreement should undercut the lawsuits. But the plaintfs atorneys want the case in court to ensure a stronger and more robust discovery process. If Brody rules in favor of players, then their individual cases would be referred back to their home states, where damages would be awarded based on the seriousness of their injuries. If she sides with the NFL, then players will be subject to arbitraton. When it comes to the NFL and brain damage, I am reminded of the song, Mama, dont let your babies grow up to be Cowboys. I think that the song should refer to Dallas Cowboys, or any kind of man who has to put on a football helmet in order to feed his family. The physical breakdowns that occur afer even two or three years on the feld can lead to a lifetme of medicaton, pain, and even drug addicton. This doesnt even consider the possibility that the player has signifcant brain damage. All of these outcomes are afected by the decision made by the boys parents when that litle league coach walks up and says, You wanna sign your son up to play footbal this year? Im not one to tell parents whether they should or shouldnt let their boys get on the feld. But I can say that a) I personally would not, and b) you should be fully aware of the short and long-term risks before choosing to do so. Finally, I say that its high tme that we start to realize that there are other ways for a black man to get rich besides hoping that a white guy will pay him to carry a ball. There are communites across America that allow our boys to over-invest in professional football careers, most of which never come to fruiton. Too many of our kids, when asked what they want to do for a living, simply say, I wanna play football. This makes me sad, because the so-called dream of professional sports ofen turns into a nightmare, especially when we let our boys neglect their educatonal opportunites in favor of the chance to play a sport. This is not to disrespect those who love sports, for I am a sports fan myself. But these lawsuits, if they tell us anything, should make us fully aware that professional football might not be the most productve way to make a living. It would be easier just to get a good educaton and start your own business. In fact, most my wealthy friends involved in sports are the ones who work behind the scenes, not the ones who actually play on the feld. Unlike many of my friends who think America is going to hell in a hand basket, and have given up thinking things will get beter for those whove been marginalized for so long, I stll have hope for a beter day. When Barack Obama was running for President of the United States, a close friend told me, Mark my word. When Senator Obama is elected, some people will go absolutely crazy, and afer hes re-elected, they will go mad! His ratonale was that the average White person had never had the opportunity to wake up every morning and see a brilliant Black man on television who was the most powerful man in the world! Unless they were wed to FOX News and the OReilly, Hannity, Beck,Von Sustern programs, they would learn so much about us- so many good things they had refused to acknowledge before. So many of our people are brilliant in what they do, but never had a fair chance to be seen in a positve light in their daily newspapers or on mainstream television or heard on major radio statons. Now, here we are afer the Obama victories. Hes there every single day! The madness really swung into high gear with the Tea Party, Michelle Bachman, Sarah Palin, Senator Ted Cruz and a whole lot of others. Some I didnt menton because they were already on the list of what most of us have come to know as the crazies, such as Rush Limbaugh and his horrible ilk. Black women like our First Lady, Michelle Obama, had not ofen been seen on the evening news, except when they were there crying over a son or daughter whod been shot or accused of being involved in some kind of wrongdoing. Now, here she was-beautful, smart, Mom in Chief, presiding over social events for world leaders and their frst ladies. She was dealing with real American challenges-such as military families and childhood obesity. She was out making speeches and inspiring women of all backgrounds. With people who could not stand all these positve scenes and unbelievable accomplishments, insanity set in, and instead of grinning and bearing the strides America was making, they began trying to set us back to what they called the good ole days. Some make every efort to send Black people to the back of the bus, send immigrants of color back to from wherever they had come, send gay people back into the closet, and force women to go back to the kitchen! They began talking about taking back their country as though they didnt take it from the Natve Americans and as though immigrants and enslaved people had done nothing to build this country. Many in the U.S. House of Representatves and the U.S. Senate tried to block every thing President Obama supported-even if they had supported the same things in the past. They were tone deaf to the phrase Where there is no justce, there will be no peace! With a President who truly tried to make all levels of government look like America by appointng women, Hispanics, Asians, gays and lesbians, Democrats and Republicans and being totally inclusive of all of us, those whod gone mad did not understand that you cannot put a genie back in the box. We may be going through a rough period as far as progress on equality and justce, but I stll believe there are enough good people who will work through their prejudices and biases with which they were reared as they understand that those of us whove previously been lef out, wont turn back.
