PARTY
The organizers of the 12th Annual Cavalier King Charles Spaniel Beach Party, scheduled this
year for April 20, 2013, have requested that the City waive fees associated with this annual
event. This is the first waiver request from this group.
The waiver request was denied administratively on January 23, 2013 per the policy adopted by
the City Council by Resolution 2012-22. Staff denied the request for the following reasons:
1) The event is a one day event and Council has never waived fees for a one day event.
2) It is well-established and is in its 12th year.
3) The event fees have been paid by the organization since the fee schedule was adopted.
4) The event generates approximately $4,000 in revenue from ticket sales, which is then
donated to a non-profit organization in Pacific Grove.
FISCAL IMPACT
The impact to the City would be $400 for the fees associated with the use ofthe beach. The
$200 cleaning deposit for the beach is refundable and is not included in the waiver request.

WHEREAS, on July 12, 2011, the City Council adopted Resolution 2011-38,
adopting Community Services fees associated with special events in the City; and
WHEREAS, these fees, which include the use of Devendorf Park and beach, the
closure of streets, and other miscellaneous event-related fees were meant to more accurately
cover the expenses ofhaving special events in the City; and
WHEREAS, the organizers of the 12th Annual King Charles Spaniel Beach Party
have requested that the City waive the $400 in fees associated with its event.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF CARMEL-BY-THE-SEA DOES:
1. Approve a waiver of fees for the 12th Annual Cavalier King Charles Spaniel
Beach Party in the amount of $400.

I . Purpose.
The City supports community events and encourages events that have a significant economic,
charitable, or community benefit. The City will consider waiving certain fees in order to
promote the City and special events. The City is regularly being approached to waive fees for
Community Events. This policy is designed to outline criteria for the submittal and review by
Council of fee waiver requests.

Clerk.
Staff shall be given authority to apply this policy for waivers up to $5,000. Staff or the
applicant can appeal a waiver request to the City Council.
Events proposed for co-sponsorship must be placed on a City Council agenda

Annual beach party for the dog breed Cavalier King Charles Spaniel. Proceeds to benefit
Animal Friends Rescue Project (AFRP). Every party has a theme. This year it is "A
Cavalier Circus". Events include food & beverages, raffles, Cavalier fashion parade with
ribbons awarded, group photo.
Rented tables to be set up on the beach for food/beverages, raffle items, AFRP sign-
in/admissions. Small barbeques (gas) for grilling hot dogs. 8 collapsible leaf containers
which hold plastic bags for garbage and recycling. One banner (which is strung using
string on the stair rail going down to the beach at 9th. One battery operated portable CD
player for music.

Request for Waiver of Special Event Permit Fee for Annual Cavalier King Charles Spaniel Beach Party
Prepared for Carmel-by-the-Sea City Council- March 5, 2013
Background:
I began the process to request waiver of the $400. Special Event permit fee on January 2, 2013 well in advance of our
April 20th event. We have held this party on Carmel Beach for many years. Our proceeds go to Animal Friends Rescue
Project (AFRP) a local non-profit. Attendance has grown exponentially. Last year we had an estimated 300 people
participate and we recognize the need to adhere to City policies regarding Special Event Permits and Liability Insurance.
City staff provided me a copy of the City Council Policy on Event Fee Waivers on January 23, 2013. I followed this policy
to the Jetter and submitted packages to the City Administrator with a copy to the Mayor on January 28, 2013. My
request was that I be placed on the March 5th Agenda so that I could address the Council.
I was advised by City staff on Thursday, February 28, that I had been given the wrong Fee Waiver Policy and that staff
have the authority to approve fee waivers up to $5,000. My request was denied. Further, I was not on the March
Agenda, but could appeal to Council during Public Appearances.
I strongly believe we meet all of the Council' s criteria for fee waiver and have followed the guidelines provided. To
summarize:
City Council Policy- Criteria for Fee Waiver;
Economic Impact to Community - 85% of our attendees come from out of town. We estimate that half of them
make Carmel-by-the-Sea a weekend destination and believe that our party cont ributes 100 nights'
accommodation during an off season, non-event weekend. These people also eat in our restaurants and shop in
our local stores. As of Friday, March 1

t, the Cypress Inn reported that they have booked 39 of 44 rooms for the
April 20th weekend.
Charitable Contributions to the Community- Proceeds from the event go to Animal Friends Rescue Project of
Pacific Grove. This 501(c}3 nonprofit directly benefits the citizens of Carmel by placing animals in new adoptive
homes (312 in Carmel since 2010}. They provide Carmel residents with any re-homing needs. They do talks in
our schools on everything from animal care to career information. They run a community spay/neuter voucher
program for residents who cannot afford to have their animals altered and they also provide opportunities for
Carmel youth and adults to volunteer with animals. Last year's party generated almost $5700. most of it from
out of the area, for this worthwhile local organization.
Pet Friendly Carmel-by-the-Sea- the Carmel Chamber website proudly proclaims Carmel-by-the-
Sea is definitely a dog-town destination". Our Annual Cavalier King Charles Spaniel Beach Party directly
contributes to this designation. Last year, author, artist and Cavalier owners Emily Randolph and Dan Merchant
from Scottsdale, AZ came to our event and subsequently published a charming children's book titled lilt' s a
King's Life in Carmel-by-the-Sea". Local hotels, restaurants, and of course the Cavalier Beach Party figure
prominently. They are returning for this year's party and will be holding a book signing at a private site and
donating a portion of book sales proceeds to AFRP.

Economic impact on the community
The Cavalier KCS Beach Party has grown exponentially over the past decade. 85% of the attendees are from out of
town. We now attract 300 guests, many from Sacramento, the Bay areas and LA but also as far away as FL, AZ,
WA, NY and NJ. About half of them make Carmelby.the-Sea a destination weekend. We conservatively estimate
that 100 rooms are booked for the event weekend. As of Friday, March 1st 29 of the 34 rooms at the Cypress Inn
were booked, a direct result of our Beach Party (two night minimum on Saturdays). Both day and weekend visitors
shop and eat in our many pet friendly stores and restaurants.
We intentionally hold the event on the weekend before the Big Sur Marathon so as not to compete for restaurants
and lodging. See emails from Cypress Inn and Visitors Center of the Carmel Chamber included with this
submission.
Last year husband and wife team Dan Merchant and Emily Randolph travelled to Carmel from Arizona with their
two Cavaliers in tow to attend the 11th CKCS Beach Party. They subsequently published a children's book titled
"It's a King's Life in Carmel-by-the Sea". It's a delight and the Cavalier KCS Beach Party features prominently,
along with glowing descriptions of dog friendly Carmel, its hotels and restaurants. The book is selling well on
Amazon, as well as other sites and the authors will be returning in 2013. Attendees will have an opportunity to
purchase the book before the party and have their copies signed at the Beach Party. A portion of each book sold will
be donated to Animal Friends Rescue Project (AFRP).
Charitable Contributions to the community
We have historically donated ALL money raised to Animal Friends Rescue Project (AFRP) a 50l(c)(3) nonprofit
organization based in Pacific Grove. AFRP is dedicated to fmding good permanent homes for abandoned, stray and
abused companion animals and ending the pet overpopulation crisis through focused spay/neuter programs. AFRP
rescues animals out of the County shelter, which is where Carmel sends their strays. They help Carmel residents by
placing new animals in adoptive homes (312 in Carmel since 2010). They provide Carmel residents with any
rehoming needs. They do talks at the high school, junior high and grade schools on everything from animal care to
career information. They provide a Prevent-A-Litter Program (P.A.L.), a community spay/neuter voucher program

for residents who cannot otherwise afford to have their animal altered. AFRP also provides opportunities for Carmel
youth and adults to volunteer with animals. The 11th Cavalier KCS Beach Party in 2012 generated over $5600.for
this very worthwhile organization.
Documentation Required with Waiver Request:
Detailed Scope
The Cavalier KCS Beach Party is normally held on the beach between 9th and 1Oth. The event runs from 1 to 4 PM.
This year it will be held on Saturday, April20. Set up begins around 6:30AM. We have a hired crew who for the
past 6 years have delivered tables, food, all party items and clean and rake the beach prior to set up. They also
breakdown and clean at 4PM. Two volunteers return to the site the next day and inspect to ensure all garbage from
the party has been removed and that the garbage/recycling bags left behind in the pickup area on Scenic are still in
good order.
Volunteers from AFRP set up a table to sell raffle tickets and admission to those who did not sign up and pay online
in advance.
Food and beverages are provided as part of the admission. A themed fashion parade is held with winners receiving
ribbons. The raffle tables generate a lot of interest. Last year we had 22 prizes (ranging from hotel room stays, to
Gift baskets and Gift Certificates).
We try and take a group photo at around 3:30, but with the vast number Cavaliers and owners this is always a
challenge and we seem to end up with as many people taking pictures as those having their pictures taken.
We select a theme for every party. Over the years these have included: Hawaiian Luau, Cinco de Mayo, Cowboy,
Rock & Roll, Pirates, Scottish and April in Paris. Some of the outfits on both two and four-legged attendees are very
creative. Our theme for 2013 is "A Cavalier Circus".
Cavalier King Charles Spaniels are very sweet and loving dogs and not aggressive in the least. Jt is truly a
remarkable (and very Carmel-like) experience to see 200+ of these creatures cavorting on our beautiful sand Beach,
tails waving high.

Party volunteers has historically paid for all food/beverage/labor/etc. costs and we have donated 100% of the money
collected to AFRP. Over the past 10 years this has amounted to close to $30K.

Center) as well as some photos from prior events.

I just got an email from Denise Hamma saying the Carmel Cavalier Beach Party might NOT be
happening this year as it's so much work !
First of all...
1.) Sophie and Abby ( my 2 Cavalier Babies) and I LIVE for this event EVERY year. It's virtually the
ONLY 3 day/2 night vacation I've taken 1 x/year for the past 5 years ! ! !
2.) I've met sooo many awesome people and their doggies at this event. .. Tim and Kyle Hall (their dog
Rizzo), Denise Hamma, YOU (Janet), Judy Gelderrnan etc. etc. ! !

Beach Party Here are the details from the organizer: Dear Cavalier
KCS friends and families, The long awaited nth Annual Cavalier
KCS Carmel, CA Beach Party will be held on Saturday, April 21st
(from 1-4 PM). This year's theme is "April in Paris". I have
attended this event twice and it's really fun. There were
approximately 200 Cavaliers in attendance. Some people dress
their dogs in theme-appropriate costumes. There is a raffle and
prizes for costumes. The event benefit some worthy cause -but I'm
not yet sure what the cause will be this year. My 2 Cavaliers and I
will be in Carmel that weekend - specifically because this event is
so much fun.

The event was great! We were in doggy heaven. It was organized, fun
and couldn't ask for better weather!!!!! Sophie had a great time running
around and meeting new friends.
Definitely will go again next year!

It was a perfect day. Hundreds of beautiful Cavalier's, just like my Lacey,
on the beautiful white sandy beach in Carmel. We had warm, sunny day
too. Good doggies, good people, good food and some nice raffle prizes,
even if we didn't win one, Iol. And the$ went for a good cause, to help
rescue animals. We will definitely plan on going again next year.

fall. In order to put on the musical, which has dozens of
young kids and teens in its cast, the nonprofit needs to raise

the Forest Theater Guild's season," explained board vice
president Safwot Malek.

year, memberships and donations declined, and foundation

many will bear an uncanny resemblance
to The King. Benefiting the Animal
Friends Rescue Project, the party- this
year bearing the theme, "Cavaliers Rock
'n' Roll" - will feature a costume con-
test wilh prizes, food and libation, and
other fun.
Cavalier owner Janet McTurk is orga-
nizing the gathering, which will run
from I to 4 p.m. Sarurday, April 18, in
the cove at 13th Avenue.
"Rumor has it that there may be mul-
tiple Cavalier Elvis sightings, so you
will not want to miss this one!" she said
There's no charge to >ttcnd, but
McTurk suggested donation amounts of
S 15 per adult, $5 per child or $40 per
fami ly. All donors will receive raflle
tickets, with additional tickets avai lable
for purchase.
The money will go to the AFRP,
which offers the last hope for dogs, cats,
rbbits and other stray, abused and aban-
doned pets in need of safe and healthy
homes. In many cases. the animals the
AFRP helps might otherwise be cutha-
nized.

California counties for a string of holdups
that began in Carmel Valley last November,
54-year-old Michael Koselka of Aptos was
arrested April 3 in Marysville, and Monterey
County Sheriff's investigator Mark Stevens
believes he's guilty of multiple local bank
robberies.
Marysville police jailed Koselka- nick
named the Slee\ "s Bandit because his dis-
guises included long-sleeved shirts designed
to make the wearer appear tattooed - after
interrupting a bank robbery, according to
Stevens. Confronted as he fled, the suspect
led authorities on a high-speed chase, in
which he reportedly crashed into squad cars.
In custody, he admitted to 16 bank rol>-
beries in the Los Angeles, Santa Barbara,
San Luis Obispo, Madera. Monterey, Santa
Cruz and Yuba County areas, according to
Stevens.
"Mid-valley was the first one," he said
this week, referring to the Nov. 26, 2008,
robbery of Washington Mutual Bank on

ears - at Carmel Beach fete

A CONTINGENT of costumed Cavalier
King Charles spaniels and their equally fes-
tive owners will converge on Cannel Beach
Saturday, April 19, for the 7th Annual CKCS
Beach Party. Set for 1 to 4 p.m. on the sand
at Scenic and 13th, the gathering will present
an unusual sight for passersby.
"We have a pirate theme this year, so we
hope to see lots of Cavaliers and their friends
and families decked out in appropriate
attire," wrote organizer Janet McTurk.
Attached was an invitation featuring her
dog, Lilly, and another pup, Lexie
Harrington, in full pirate regal ia and flanking
a treasure chest. (The amiable Lilly appar-
ently exhibited the same spirit as she has
when festively costumed to help McTurk
ring the Salvation Army bell outside the post
office each December, when she was always
joined by fellow Cavalier Harry Dodds.)
"T remember the year he wore the tuxedo
and top hat at the beach party," McTurk said
of Harry, who died recently. "He really did
walk around with a mayoral attitude."
Though it is free to attend, organizers rec-
ommcnd donations of $15 per adult, $5 per
child or $40 per family to benefit the Animal
Friends Rescue Project based in Pacific
Grove. Everyone who donates will receive
one raffle ticket, with more available for pur-
chase, and those funds will also go to the
AFRP. "These hardworking people, mostly
volunteers, do a great job of helping our
four-legged friends, both dogs and cats, who
have not led li ves as fortunate as our
Cavaliers," Me Turk said.
Regardless of whether people donate, she
continued, "We are happy to have you enjoy
an all.ernoon at the beach with a great gang
oft.vo- and four-legged attendees."
Event organizers could usc some help
with setup that morning, as well as during
the party, when volunteers greet guests, hand
out name tags, sell raffle tickets, set out food,
man the pirate tattoo booth and preside over
the pinata - "nothing too onerous, but
activities which will ensure everyone has a
great time," McTurk said.
