MINUTES OF A WORKSHOP/SPECIALMEETING OF THE
GOVERNING BODY OF PELICAN BAY

On this the 17th day ofAugust, 2004,the Council ofthe City ofPelican Bay convened in a workshop/special meeting, the same being
open to the public at the regular meeting place thereof, in the City Hall, and notice ofsaid meeting having time, place and subject
thereof, having been posted as prescribed in Article 6261-17 V.S.C.S.

CALL TO ORDER. Mayor Hawkins calledthe meetingto order at7:02p.m.

2. ROLL CALL. Alderman Keller, Alderman Hunter, Alderman Davis, Alderman Sparks and Alderman
McElyea were present.

J. EMPLOYMENT WORKSHOP. Rose Thomason,Human ResourcesConsultant, conducted a questions


and answersemployrnent workshop to understandthe presentpolicies and to determine future policies.

4. BUDGET WORKSHOP. Gary Williams reviewedthe proposedbudget and financial concerns.

5. ADJOURN TO SPECIAL MEETING. The workshopendedat9:32p.m.

CALL TO ORDER. Mayor Hawkins called the specialmeetingto order at 9:38 p.m. Alderman Hunter
made a motion to move the ExecutiveSessionto TuesdayAugust 24,2004 at 7:00 p.m. The motion was
secondedby Alderman Davis and did not passby a vote of 2/FOR and 3/OPPOSED.

APPROVE THE DISPOSITION OF THE POLICE VEHICLES. Alderman Davis moved to not
approvethe dispositionof the Police Vehiclesat this time. AlderrnanKeller secondedthe motion that
passedby a vote of 5/FOR and 0/OPPOSED.

8. DISCUSS RESERVE POLICE OFFICERS. Council discussedreservepolice officers. Chief Clark


requestedthe Council to reconsider and hire Officer Jarvis as a ReserveOfficer. No action was taken and
this requestwill be on the September2004 Council Agenda.

9. REVIEW AND APPROVE TERMINATION OF A FIREFIGHTER. A motion was madeby


Alderman Davis and secondedby Alderman McElyea to terninate Randall Meredith as a PelicanBay
Volunteer Firefighter. The motion passedby a vote of 4/FOR 0/OPPOSEDand l/ABSTAINED.
Alderman Hunter left the meeting prior to the vote.

10. REVIEW AND DISCUSS FIRE DEPARTMENT RADIOS. Council discussedmoving the Fire
Department radios to a high band frequency. Michael Mitchell was instructed to researchthe changeof
radio frequencyto high band.

l1 REVIEW AND APPROVE PURCHASE OF TIRES FOR BRUSH TRUCK. A motion was madeby
Alderman Keller and secondedby Alderman Sparksto approvethe $384.24purchaseof tires for the Brush
Truck. The motion passedby a vote of 4/FOR, 0/OPPOSEDand I/ABSTAINED.

12. CONSIDER AND .APPROVE FIRE DEPARTMENT FUND RAISING PROGRAMS. Alderman
Sparks moved to approve the Fire Department Fund Raising Programs. After some discussion,Alderman
Sparks withdrew his motion. A motion was then made by Alderman Sparks to approve Fire Department
Fund Raising and the purchaseof $65.00 worth of candyfor fund raising purposes. The motion was
secondedby Alderman Keller and passedby a vote of 4/FOR and 0/OPPOSED.

13. CONSIDER APPROVAL OF A CONTROLLED BURN. A motion was made by Alderman Sparksto
table approval of a Controlled Burn of a frame house at Partridge Court. The motion to table was seconded
by Alderman Davis and passedby a vote of 4/FOR and 0/OPPOSED.
14. EXECUTIVE SESSION PURSUANT TO THE PROVISIONS OF SEC.551.074.TEXAS
GOVERNMENT CODE TO HEAR COMPLAINTS AGAINST AND TO DELIBERATE THE
APPOINTMENT, EMPLOYMENT, EVALUATION, REASSIGNMENT, DUTIES, DISCIPLINE,

need better police units,whetherthey be refurbishedor used units,or new ones.l\fter speakingwith the
TexasDepartmentof PublicSafetyFleetsales,I havebeenquotedthe priceof $8,050.00dollarsfor a
2OO2FordCrownVictoriaPoliceInterceptor.MayorHawkinsadvisedme he contactedthe bank and they
advised that the appraisedvalue of a 2OO2Crown Victoria is between $9,OO0rdollars and $12,OOO
dollars,so if we got a bank notefor $8.O5Ofor one unit,and rolledthe note into orurexistingnote on the
{.999 CrownVictoria,the paymentwould not be much higher,if evenhigherat all. I feel this is a crucial
,reedto providea betterserviceto the community,w@havealreadybeen left oncewith only one police
vehicleand I am afraid we will get to the point when all the vehiclesgo down,and we are unableto
respondto calls. The Tarrant CountySheriffs Office has been wonderfulto us and helped us in many
ways,but SheriffDee Andersondid make it clearto me that they would no longerrbe able to take calls
for our Citywith out charginga fee.So I seethis as a necessity, and a matterthat needsto be addressed
immediately. Since October of 2003 we have spent a total of $10,410.218on vehicle repairs,
unfortunatelythis has only been delayingthe inevitable,causing us to wastertaxpayersdollars on
vehiclesthat will continueto cost the Cityin the future.I ask for your helpwith this situation.The money
we are spendingor havespentcouldbe goingon paymentson two usedvehiclesfrom D.P.S.I wouldlike
the CityCouncilapprovalto get a bank loanfor $17,OOO and roll it into our existingnote,so that we may
get 2 used dependablevehiclesfrom DPS.I would then seek authorizationto sale the GhevroletCaprice,
and the White Unit#2, to help make up a little of the difference.We couldthen take the slick top unit
and give it to the Animal ControlDepartmentfor their use.I havealsoattachedquotesfrom FordMotor
Credit, where they have offered their assistanceafter seeing the recent article in the Fort Worth Star
Telegram.Philpott Fordwill get us into two 2OO4CrownVictoriaPoliceInterceptorc,with 3 year thirty Six
Thousandmile bumperto bumperwarranties,on a MunicipalLeaseplan,for 36 nnonths, with the option
to purchase the vehiclefot 1 dollarat the end of the lease,or turn them in for anotherlease.The total
purchaseprice on the Leasewould be $40,294.OO. For36 months,we havespentover$1O,OOO in the
Last 12 months repairing2 vehicles,a 3 year investmentat $4O,O0Ofor two new cars,could save us a
lot of in the longrun,becausethesecarsare goingto continueto breakdovvn.

NOTICE OF A MEETING
OF THE
GOVERNING BODY
OF
PELICAN BAY

On this the 1Othday of August, 2004, the Council of the City of Pelican Bay convened in a meeting, the same being open
to the public at the regular meeting place thereof, in the City Hall, and notice of said meeting having time, place and
subject thereof, having been posted as prescribed in Article 6261-17V.S.C.S.

l. CALL TO ORDER. Mayor Hawkins called the meetingto order at7:02p.m.

2, ROLL CALL. Alderman Keller, Alderman Hunter, Alderman Davis, Alderman Sparks and Alderman McElyea were
present.

3. OPENING PRAYER. Aldennan Davis openedthe meetingwith prayer.

4. REVIEW AND CONSIDER APPROVAL OF THE CITY COUNCIL MINUTES FOR THE PREVIOUS
MEETING. Alderman Sparks moved to approve the minutes of the previous meeting. The motion was secondedby
Alderman Hunter and passedby a vote of 5/FOR and 0/OPPPOSED.

5. CONSIDER REQUEST FROM CHURCH TO USE CITY PARK. Alderman Sparksmoved to approvethe First
Baptist Church's requestto use city property for a children'sevent. Alderman Davis secondedthe motion that passed
by a vote of 4/FOR,0/OPPOSEDand 1/ABSTAINED.

6. REVIEW AND APPROVE THE STATE REQUIRED SHELTER ADVISORY BOARD. Alderman Sparks
made a motion to table the approval of the Shelter Advisory Board until more information is received. The motion
was secondedby Alderman McElyea and passedby a vote of 4/FOR and 1/OPPOSED.

7. REVIEW AND APPROVE ANIMAL CONTROL/CODE ENF'ORCEMENT ORDINANCE SITUATION.


Alderman Keller moved to table the review and approvalof the animal control/codeenforcementsituationuntil after
the code report and then if there is any discussionto go into an executivesession.Alderman Hunter secondedthe
motion that passedby a vote of 5/FOR and 0/OPPOSED.

8. DISCUSS SOUTHTEL COMMUNICATIONS CABLE COMPANY. Citizenswere told about the bankruotcvand
given information regardingalternativecompanies.

9. DISCUSS DISPOSITION OF POLICE VEHICLES. Chief Clark presentedinformation regardingthe statusof the
police vehiclesand severalalternativesfor the purchaseof newervehicles. After a period of discussion,he was asked
to continuehis researchand bring further informationand severalproposalsto the next meeting.

10. REVIEW APPLICATIONS AND CONSIDER APPROVAL OF RESERVE POLICE OFFICERS. Alderman
Sparksmoved to approvethe applicationof Officer Leavell as a ReserveOfficer. The motion was secondedby
Aldern-ranKeller and passedby a vote of 5/FOR and 0/OPPOSED. A motion was made by Alderman Keller to not
approvethe applicationof Officer Jarvisas a ReserveOfficer. The motion was secondedby Alderman McElyea and
passedby a vote of 4/FOR and 1/ABSTAINED.

11. REVIEW SUSPENSION OF A FIREFIGHTER. FirefighterCindy Mitchell presentedinformationregardingthe


performanceof Firefighter Randall Mitchell and requestedterminationratherthan suspension.The action item will be
broughtbefore the Council at the next Council Meeting.
