(R.GANESH) Sr. Personnel Officer (RR) For Chief Personnel Officer Sub:- Imposing penalty of removal from service or compulsory retirement for ESMs/ASMs. Ref: - GM/Southern Railways D.O. letter No. T.5/A/DAR/P dated 27.10.2009 addressed to Member Traffic. Vide above mentioned reference, Southern Railway had proposed inclusion of a specified punishment (removal or compulsory retirement from service) to the ESM, and/or the ASM, for attending to Signal Gears (leading to an accident) without a Disconnection Memo. On a similar reference received from another Railway, instructions had already been issued to Zonal Railway vide Boards letter of even No. dated 6.10.2009 (copy enclosed), which are relevant in this matter. The Zonal Railway may take action accordingly. Ref: i) Northern Railways letter No. 1-T/O/Pt. XXIV/Policy/Accident/07 dated 25.8.2009. ii) South Western Railways letter No. T.5/DAR/Policy dated 28.3.2007 In the context of clarifications sought vide referred letters in regard to above subject, it is stated that Board have already issued norms of punishments in different types of accidents due to common causes arising out of failure of staff. It is not possible to legislate punishment norms for all possible scenarios. The extent of the failure and responsibility of staff and of the Sr. Subordinates and even of the Management cannot be clearly distinctly identified applicable for all possible scenarios. Our Policy leaves some room for discretion to the General Managers of the Zonal Railways on items not covered in the Boards guidelines. It would be advisable that for some specific items the minimum penalty may be got specified with the approval of the GM; where required post facto confirmation of Railway Board may be obtained if considered essential by the Railway.
