Area Office (Davao City) 4th Level Herrera Building, Alvarez Street Davao City 8000 SUBJECT:Request for immediate resolution for the Administrative Aspect of the Criminal Case No. 6169-09 entitled BULINGAN SAMPORNA HADJI SIRAD, et. Al., versus ARMINA GUILING DIDA-AGUN: For MALVERSATION OF PUBLIC FUNDS (Annex A) Dear Sir, This pertains to my Administrative Complaint against BULINGAN SAMPORNA HADJI SIRAD et. al, OIC of MSU-LNCAT, Marawi City before the Office of the Ombudsman through the Post Office of Iligan City dated January 16, 2012. (See Annex A). On December 7, 2011, the Criminal Case No. 6169-09 was arraigned before the 12 th Regional Judicial Court of Lanao del Sur, Branch 8 and subsequently the Pre-Trial was scheduled on January 23, 2012. Unfortunately it was postponed for the reason that January 23 is a National Holiday and was moved on February 8, 2012. Similarly, on February 8, 2012, Prosecutor Flerida Aisa Boloto-Macaraya had not appeared in Court because according to her proxy Prosecutor Saipal Alawi, she was confined in hospital for medical treatment. Furthermore Prosecutor Saipal Alawi moved on motion to postpone the Pre Trial Conference for reason the he is not ready and have no copy on the file of the criminal case No. 616909 and was therefore scheduled on March 5, 2012. Frankly speaking, I already suffered very much for my withheld salary for almost 3years without just cause and the long process of Prosecution. In view of the above, I am politely requesting the Honorable Office of the Ombudsman to direct the Commission on Audit to verify if my salary starting from July 2009 up to the present is still intact in the LNCAT Account at the Land Bank of the Philippines considering that they alleged in their Counter Affidavit on Criminal Case with NPS Docket No. XIV-06-INV-09H-00075 (See Annex B) and that respondents be ordered to pay for my salary which they withheld unjustly starting July 2009 to the present. Furthermore, I am praying before this Honorable Office of the Ombudsman for the favourable and immediate resolution of this Administrative case and the suspension of the respondents Public Officers before the Pre Trial of the Criminal Case No. 6169-09 before the RTC 12 th of Lanao del Sur on March 5, 2012, pursuant to Section 15 and 24 of Republic Act No. 6770 and Section 13 under Article 212, Title VII, Book II of the Revised Penal Code. Again, I would be very happy if you can afford me a reply on the status of this Administrative Aspect of the Criminal Case No. 6169-09 through my Email address, agdidaagun@yahoo.com.,, because this time I doubt the services of our Post Office employees of Marawi City.
