COMELEC Facts Bagong Bayani and Akbayan filed a petition for Certiorari against Resolution 3785, which Resolution accredited 154 parties and organizations for the 2001 elections; Petitioners seek to disqualify mainstream political parties as the party-list system is for the benefit of the marginalized and underrepresented. The mere fact of being a political party is not sufficient for disqualification. Article IX(C) of the Constitution allows for registered national, regional, and sectoral parties. Article VI similarly refers to such parties. 2. Not all political parties may participate, since they must be consistent with the party-lists purpose, which is to enable the marginalized and underrepresented to be members of Congress. 3. RA 7941 implementing the system states that they must represent labor, peasant, fisherfolk, urban poor, and other similar groups. They are those with no welldefined constituents and could contribute to legislation that would benefit the nation as a whole.
