dear scribd readers,staff,etc..., my name is abraham gladney jr.,and this letter

is in request of your voice/help to bring to light in the public arena,the gross
and malignant actions of prison staff of the state of indiana dept. of
correction.I dont know how this work,how to get a ground swell of voices/support
to assist me in the legal recourse I seek against the state of indiana dept.of
correction,for the abuse above and beyond the definition of torture,in which I
suffered at and by the hands of prison staff through out my incarseration.you dont
know me,but from the outside looking in it could appear that I'm a pathetical 49-
year old,unmarried with no kids,ex-convict loser.however,to and for those who can
and are willing to see and not turn blind eyes toward,looking out of the two
windows of reality from which I see,I'm not so much that pathetic
loser.people,please allow me to explain and make clear the situation in which I
find myself,so that you your self can decide whether or not anyone(not just
myself),who's life circumstances and situation is in,and of the following content
for which you are about to read,deserves your vocal support and understanding
consideration. my complaint and plea for the publics voice/vocal support,has
nothing to do with my life in general(who I am,how I was raised,my
ethnicity,etc...,BooHoo BooHoo.please,cry me a fucking river will you).I have no
problems with the philosophy and practice of,and infact I'm a firm believer in the
philosophy of "ablled" adults being responsible for themselves and their
actions.people,my plea for your vocal support are for reasons above and beyond the
natural/ordinary mental and physical bumps and bruises,that this thing we call
LIFE! contributes to each and every one of our lives,in our journeys to adulthood.
I suffer from a sleep disorder(which I dont know the correct/medical term
for),that allows me to be assaulted both sexually and physically when
asleep,without awakening during these assaults. a sleep disorder that I was
unaware that I had or suffered from until march,april and may of 1997,where the
night of march30th,1997,I was drugged and raped as I slept in my southbend indiana
apartment. which unfortunately and regretably led to the april4th,1997
confrontation with a disabled co-worker,as to his knowledge of that march30th
assault upon me,a confrontation that resulted in my fatally shooting this disabled
co-worker(not the intended result I was looking for).my intent was to scare him
with the gun I produced while confronting him,into telling me what he knew about
this assault,but his response was not what I expected taking me totaly by
surprise,and when I came to myself/senses,I was in (broad daylight),standing over
him as he lay shot on the ground,trying to pull the trigger again but the gun had
jammed.an unfortunate and regretable"adult" action on my part,that led to my
arrest and 11-1/2 year incarseration in the indiana dept.of correction,of which
I've served and now released on probation. after my arrest in the st.joseph county
jail in southbend indiana,and through out my 11-1/2 year incarseration,and
subsequent to my sept.3rd,2008/feb.7th,2009 release,I've been intentionally and
wrongfully diagnosed as a "delusional"and psychotic severely mentally ill
liability,by prison psychiatric staff,as well as other a'unethical" so-called
psychiatric professionals? intentional and false/convenient diagnosis,for the
purpose of covering the illegal actions of prison staff,if and when I seek legal
recourse against the indiana dept.of correction. documented diagnoses and
statements without an ounce of proof by way of sleep disorder examination(s)by
reputable sleep disorder specialists/clinics,as to whether or not I'm truly the
"delusional" nutcase they've bogusly diagnosed me to be,or that I simply suffer
from said sleep disorder? people,trust me on this,my sleep disorder is very real!
how else can one sleep through being gang raped by prison staff and other
prisoners without awakening during the assaults? and trust me also,when you awaken
from a sleep and yuo've anally raped(gang raped or other wise),you will most
definitely know it.
the needed sleep disorder examination(s)I need to debunk and prove false the bogus
psychiatric diagnoses and evaluations of me,and also to diagnose and seek remedy
if any for this disorder,are the initial and pertinent steps I believe necessary
to adress this disorder,and my future living with this disorder? however,due to my
indigent situation and being a recently released ex-convict,makes it impossible in
retaining competent or any legal representation,or to afford undergoing the needed
sleep disorder examination(s). january,2000,when housed on the secured housing
unit(the S.H.U.)of the wabash valley correctional facility,where I was locked down
23-hours per day,and with a less than laymans grasp of the law and it's many
intricacies and no tangible acess to the facility's law library,I filed "pro-se" a
civil rights complaint cause#TH00-0268-C-T/H,against the indiana dept.of
correction.that was methodically sqaushed by the indiana states attorney generals
office(legal counsel for the indiana dept.of correction)and the indiana courts.If
you look at the complete court docket,you will see the indiana courts afforded me
nothing!no discovery or motions to compel discovery(employee photos of prison
staff on duty during these assaults/incidents),the only means in which I could
correctly name and identify defendants; no motion for or motions to compel
appointment of legal counsel,yet the indiana dept.of correction had the entire
attorney generals office as their legal counsel against a lowly incarserated
indigent prisoner? however,in their haste to sqaush my complaint,they abused the
courts discretion as to being extra lenient toward incarserated pro-se
plaintiffs,thus leaving the proverbial legal door ajar,for me to via res juticata
and collateral esstopple,re-visit that particular civil complaint as well as
subsequent complaints for ongoing/future assaults upon me by prison staff and
other prisoners.as of june 30th,2008,I had /have a pending complaint against the
indiana dept.of correction,with the U.S.dept.of justice in washington D.C.,via
section chief of the criminal section-civil rights division,Mr. mark j.kapplehoff.
who stated in his june 30th response,that my complaint alone was not sufficient
enough evidence for him to authorize investigation(s).however at that time,I was
still incarserated and did not want to risk alerting prison staff that I had DNA
evidence from these on going assaults by prison staff and other prisoners.and as
of yet since my release from prison,I'm reluctant to contact mr. kapplehoff
without some kind of legal representation/public support,which would make the
dept.of justice more inclined to,with the DNA evidence I have and the confirming
of my sleep disorder,to give the go ahead for investigation(s) of my complaints.
people,sir and madam,yes that includes YOU! the prison staff of the indiana
dept.of correction(and more than likely in all prisons),in their official capacity
has and continue to pervert the law and the civil and human rights of those
they've been given official custodianship of and over.and unless I myself,with or
without your voices,take action and speak out against this kind of malignant
abuse,it will no doubt continue to flourish,ruining and ending the lives of our
loved ones. I have a friend a fellow musician(I wont mention her by name),but we
were a jazz/bossa nova duet(she a jazz guitarist and I played trumpet and flugle
horn).my friend had a younger brother,who in his late teens got into a situation
that required him to have to do prison time and unfortunately he cmmitted suicide
in prison.at that time,my being niave and ignorant to prison and it's predatory
environment,did'nt understand the reason(s)that led him to take his own life,until
I myself found out by way of first hand experience. look people,this was a young
decent good looking kid,who came from a really decent family,he had potential
galore and if not for that certain situation that threw him off track and into the
predatory environment of prison,he had a promising life ahead of him. however due
to our silence/turning a blind eye towards the unchecked/ungoverned criminal
environment of our prison systems,and the unethical/criminal behavior of prison
staff thereof,we will continue to senselessly lose our loved ones,particularlywhen
and where by speaking out,we can atleast shine a bright spotlight onto the
malignancies of the prison environments!!!...people,allow me to be the poster
child for and against prison rape and abuse!I have DNA evidence,and with the
confirming of my sleep disorder,your phone calls and the forwarding of copies of
this letter to the U.S.dept.of justice mr. kapplehoff's office,the forwarding of
this letter accompanied with your own letters and phone calls of concern to the
Oprah show,to dr,phil(I'd welcome his advice and any help he and his foundation
can offer),to the tyra banks show,to 60-minutes,20/20 and dateline investigative
news programs and any media or legal sources that you(joe and jane public)may have
knowldege of. again people,make me the poster child for and against prison rape
and abuse! I've already contacted the above mentioned talk shows with no
response,but with a loud voiciferous ground sewll of your concerned voices,maybe
their producers will reconsider? maybe.
finally I leave you with this.

"deprivation of civil rights under color of law"

(title 18,u.s.c.,section 242)

this statute makes it a crime for any person acting under color of
law,statute,ordinance,regulation,or custom to willfully deprive or cause to be
deprived from any person those rights,priviledges,or immunities secured or
protected by the constitution and laws of the United states.this law further
prohibits a person acting under color of law,statute,ordinance,regulation or
custom to willfully subject or cause to be subjected any preson to different
punishments,pains,or penalties,than those prescribed for punishment of citizens on
account of such person an alien or by reason of his/her color or race.
acts "under color of law" includ acts not omly done by federal,state or local
officials within the bounds of or limits of their lawful authority,but also acts
done without and beyond the bounds of their lawful authority;provided that,in
order for unlawful acts of any official to be done under color of any law,the
unlawful act must be done while such officials is purporting or pretending to act
in the performance of his/her official duties.this definition includes,in addition
to law enforcement officials,individuals such as mayors,council
persons,judges,nursing home proprietors,security gaurds,etc...,persons who are
bound by laws,statutes ordinance,orcustoms.
punishment varies from a fine or imprisonment of up to one year,or both,and if
bodily injury results or if such acts include the use,attempted use,or threatened
use of a dangerous weapon,explosives,or fire,shall be fined or imprisoned up to
ten years or both,and if death results,or if such act include kidnapping or an
attempt to kidnap,"aggravated sexual abuse or an attempt to commit aggravated
sexual abuse",or an attempt to kill,shall be fined under this title,or imprisoned
for any term of years or for life,or both,or may be sentenced to death.
