92706 Fr: Dianne King 22320 Harbor Ridge Ln. #2 Torrance Ca. 90502 Re: Bill dated February 27, 2002 Due to the poor quality of representation that I received, the verbal abuse I endured as you yelled and screamed at me, and the fact that you refused to even look at the court documents proving that my x-husband received a $500 credit in the equilization of our assets during our divorce I am refusing to pay the balance on this bogus bill. You even had the audacity to yell at me I know what the court documents say and it doesnt say that and demand that I return guns to an idiot that has threatened to kill me with them. With this and the attached paperwork for you to review I am demanding that you provide me a bill with the balance of zero for my records as you have failed in your obligation to provide proper representation for your client. With this we will be finished with all correspondence. If you fail to comply I will be forced to file a complaint with the California State Bar Association under Rule 3-110 Failing to Act Competently. A) A member shall not intentionally, or with reckless disregard, or repeatedly fail to perform legal services competently. (B) To perform legal services competently means diligently to apply the learning and skill necessary to perform the member's duties arising from employment or representation. If the member does not have sufficient learning and skills when the employment or representation is undertaken, or during the course of the employment or representation, the member may nonetheless perform such duties competently by associating or, where appropriate, professionally consulting another member reasonably believed to be competent, or by acquiring sufficient learning and skill before performance is required, if the member has sufficient time, resources, and ability to do so. (C) As used in this rule, the term "ability" means a quality or state of having sufficient learning and skill and being mentally, emotionally, and physically able to perform legal services. This may have the effect of: Depending on the seriousness of the offense, a lawyer can be given a warning, put on probation, suspended from practicing law for a period of time, or disbarred - prohibited from practicing law in California. And will also provide me with legal remedies to recover a complete refund of all money spent with you and possibly seek punitive compensation. This will effectively tie up both your time and mine. However with my hourly being $13/ hr and yours being $250 /hr this is a lot more cost effective for me than you. You may have the corrected bill and all of my court documentation made ready for me to pick up.
