UEP: not just a mere August 30 deadline for new receipts more than educational but also an institution enough time for business owners to comply-BIR enterprising CATARMAN, N/SaWEATHER
TACLOBAN CITY The Bureau of Internal Revenue (BIR) has moved the validity of old receipts until August 30, from the original deadline of June 30 in response to mounting complaints on new rules. In a press statement, BIR Regional Director Diosdado Mendoza said that with the extension of validity, implementation of the new receipt system would take eect on August 31, 2013 instead of July 1. After August 30, 2013, all principal and supplementary receipts and invoices printed prior to January 18, 2013 shall no longer be valid. Any issuance of old receipts and invoices shall be deemed an issuance of an invalid receipt or as if no receipt was issued, Mendoza said. Cesar Balangatan, officer of Revenue District 88(Tacloban), for his part, said that the new deadline set by their agency is more than enough for business owners to comply the new directive. Originally, the deadline for the implementation on the use of new receipts and invoices was on July 1 as contained under Revenue Regulation (RR) No.18-2012. However, business groups across the country expressed their opposition to this arguing that the BIR did not gave them enough time to print new receipts and doing so would entail additional costs on their part. This was the answer of the BIR to the appeal of some businesses and taxpayers for an extension as well as rising concerns regarding the capacity of to page 2 mar Where can you find a university that operates a beach resort, a water refilling station, several agricultural fishery productions and now a gas station right inside its campus. TACLOBAN CITYA city official called on the police to help the campaign of the city government to clean the sidewalks from street vendors. The call was made by city information head B ernardita B ering Valenzuela during the recently-held Kapihan ha Balyuan who added that this particular move should be done by the police and not just by the city government. Valenzuela said that citys streets particularly those located within its downtown area must be free from street vendors

With the increasing number of vendors occupying the sidewalks, Valenzuela said that the people must not blame the city government instead address the problem to the police because they are the one responsible on the matter. T h e Tr a f f i c Operation Management Enforcement and Control Office (Tomeco) has no jurisdiction over that problem because t he y are re sp ons ibl e to control the traffic situation within the city not for the removal of the vendors occupying the sidewalk, Valenzuela added. In order to solve the problem about the increasing number of vendors occupying the sidewalks of the city, Valenzuela encourage the public to address the problem to the Philippine National Police while the city government will find ways to solve the problem as long as they would cooperate with them. On the other hand, Tomeco chief Salvador Buddy Estudillo said that they are planning to propose to the city government for the e r a d i c at i on of t ho s e sidewalk vendors along national roads. TACLOBAN CITY Residents near the Tacloban City Public Market and downtown area are afraid that the influx of Badjaos in the city might result to an increase of theft rate and other threats to public. The coming of these Badjaos to the city has brought problems to the public. I pity the Badjao children who cannot live in a wholesome home like what ordinary children have. fear that these Badjaos might steal properties of their business as some Badjaos were repeatedly caught roaming around the market during midnight hours. I make sure that my stall is safe from stealing because these Badjaos living in and near the public market are giving us so much fear that they might steal our properties especially that they have nothing to eat sometimes, says the fruit vendor. Also, businessmen in the downtown area are complaining because these Badjaos are ruining their business due to begging and loitering that scare away customers.

Some customers just decide not to go inside our establishment because sometimes, these Badjaos would standby in front of our business and would beg from people and that is really a problem to our business. We have a lot of beggars now in the city and these Badjaos just added to them, he said. Meanwhile, it was learned that the city government of Tacloban in coordination with other concerned government offices has already planned the necessary actions to send these Badjaos back to their homes in Bato and other parts in Southern Leyte.(RAM IDELBERT

What happened to the promised water before the election?

recisely few weeks before the midterm election, mayoralty candidate, Rep.Florencio Bem Noel boasted together with the LMWD manager that because of Noels multi-million assistance, the water problem that has been a constant headache of Taclobanons will soon be a thing of the past. With wide smiles, the group had a photo and video ops where water was seen gushing from a big pipe. Noel was heard openly talking that he was the reason why Tacloban will soon have water within the week. Noel was so sure of his win that he made use of this basic commodity as a campaign issue. While he believed it would bring his victory, the other way happened; people became angry that a man who profess to love Tacloban, too would dare to use water as bait in the election. A sincere candidate who has an innate love for his fellowmen would not hurt the sensibili-

ties of his would-be constituents. At a time Mayor Alfred Romualdez was sweating hard to materialize his dream to have sufcient water here in Tacloban, chances were killed by the opposition. Even Rep.Noel did not lift a nger to help address the problem. He was a representative of Taclobanon-Warays, and all Warays who have rooted for him and his party list. But he has not done anything to solve the water crisis since he became the representative of the have-nots. Tacloban electorates, on the other hand, voted for LMWD managers daughter Raizza with the fervent hope that being his daughter; she could help make a miracle on the water availability in Tacloban. She has so much on her shoulders, in three years; she has to prove to the people that she deserved their trust and votes. She should not only help motivate her

Just make true your promise on water

Persons are sometimes measured through their integrity or ability to make true their promises especially those made in pacts; sad to say that there are liars and people who do not make true their promises. One of the prominent people who promised something big to the people of Tacloban was Congressman Florencio Noel, who declared that he will bring water to the taps of Taclobanons and that the problem on water insufficiency would become a thing of the past. Together with the LMWD manager, they invited CATV8 for video-ops, one of the campaign materials in the just concluded election. It was about his show o on water where holds are still waiting for the promise to happen. More than a month after the election, some faucets trickle with the needed life sustenance but could not really be used for drinking as the liquid that flows out is turbid and dirty. How could LMWD manager, Engr. Villasin agree to be used during the election? But one thing positive his family reaped, people voted for his daughter Raizza thinking that she could be the angel of luck that will bring miracle to the city. Many people openly accept that they voted for her because she could be the answer to their incessant prayer for water. As the peoples hold on

B(em)N(oel) claimed that through his eorts, the problem on water will become a thing of the past. In the media mileage, they showed a water pipe overflowing with so much water. Some became hopeful realizing that there is water in the city; others became angry at the seeming manipulation of a basic resource

that was even used as bait for votes. How could people use water for political purposes? It is a basic need that is equivalent to life. It is hard to forget the eect of that political ploy on people. Most learned how petty some people could be. Today, most taps in the city are still dry and house-

investment for her soul and the souls of others in heaven. In deed she did when she got her promotion with her charitable works as credential that others submitted on her behalf. Was this not the gist of the gospel reading on June 19 which message conveyed this very drift? In said Scriptural reading Jesus said to his disciples, Be careful not to make a show of your righteousness before people. If you do so, you do not gain anything from your Father in heaven. He added, When you give something to the poor, do not have it trumpeted before you, as do those who want to be seen in the synagogues and in the streets in order to be praised by the people. I assure you, they have been already paid in full. If you give something to the poor, do not let your left hand know what your right hand is doing, so that your gift remains really secret. Your Father who sees what is kept secret, will reward you. (Gospel: Mt 6:16, 1618). Rev. Fr. Oliver Mazo, a new parochial vicar of the Sto. Nio Parish, in his homily in an afternoon mass on June 19, stressed facts or circumstances that the person to be arrested has committed it. What delineates the second from the rst is that while the arresting ofcer or person actually saw the commission of the offense in the rst, he has no such information under the second as all he had was personal knowledge of facts or circumstances tending to establish that the person to be arrested was the one who committed it, e.g. the sight of a eeing individual from a murder scene holding a knife with bloodied shirt. The least controversial in the annals of jurisprudence is the third which allows for warrantless arrests when the person to be arrested is a prisoner who has escaped from a penal establishment or place where he is serving nal judgment or is temporarily conned while his case is pending, or has escaped while being transferred from one connement to another. The principle under the third is simple: a prisoner, be he convicted (found guilty by virtue of a nal judgment) or detained (incarcerated while his case is still being tried or because he was convicted but the judgment is yet to be nal), who has escaped can be arrested by anyone without warrant. I do hope that fellow gets to read this. With a little explanation, I dismissed him merely with instructions to look for the material over the internet. on modesty when one does his charity works or any good deed, underscoring Jesus message. He said that when one is praised by the people for his good deeds he loses his chance to receive his reward from God for the reason that he has already received it although not from God. The people should be circumspect not to do humanitarian work only to heave praises from people but instead for people to praise and glorify God, from Whom blessings, graces and heavenly gifts emanate. NO ONE CAN SERVE TWO MASTERS

Jesus said to his disciples, No one can serve two masters. He will either hate one and love the other, or be devoted to one and despise the other. You cannot serve God and mammon. Therefore I tell you, do not worry about your life, what you will eat (or drink), or about your body, what you will wear. Is not life more than food and the body more than clothing? Look at the birds in the sky; they do not sow or reap, they gather nothing into barns, yet your heavenly Father feeds them. Are not you more important than they? Can any of you by worrying add a single moment t your life-span? Why are you anxious about clothes? Learn from the way the wild owers grow. They do not work or spin. But I tell you that not even Solomon in all his splendor was clothed like one of them. If God so clothes the grass of the eld, which grows today and is thrown into the oven tomorrow, will he not much more provide for you, O you of little faith? So do not worry and say, What are we to eat? or What are we to drink? or What are we to wear? all these things the pagans seek. Your heavenly Father knows that you need them all. But seek rst the kingdom (of God) and his righteousness, and all these things will be given you besides. Do not worry about tomorrow; tomorrow will take care of itself. Sufcient for a day is its own evil.

Citizens arrest

Upping the Ante

frANZ RAYMOND P. ASPA I was recently visited in our ofce by an unusual client (unusual because his query was uncommon of the many who come to our ofce for advice). His question was not on how he could regain the land he inherited from his father or what to do after being mauled by the police. His question was not very peculiar but downright unusual: when is citizens arrest allowed? He cut me off even before I could answer his question with his narration that he previously sought answer from a policeman detailed somewhere in a neighbouring town but did not have any clue of the answer. Poor fellow. So when really is citizens arrest allowed? To answer that, we must rst determine the two kinds of arrest the lawful kind that is. The rst form of lawful arrest is that which is ordered by the court, which order is contained in the famous warrant of arrest. Its issuance depends on the discretion of the court where the criminal case is recommended to be led by the investigating public prosecutor. It is discretionary because the court must determine independently of the ndings of the prosecutor that there exists probable cause based on his own appreciation of the evidence that the accused ought to be placed behind bars, at least during the intermittent period that the trial of his case is continuing. Two considerations must be taken into account in exercising this discretion: one, the criteria of probable cause should be the judges ever constant guide; second, his determination of the existence (or absence) of probable cause should be personal, that is to say, he cannot just simply afrm lock, stock and barrel the ndings of the prosecutor that probable cause exists. He must personally determine that. Is citizens arrest possible under the rst form? I submit that it is not. Under the Rules on Criminal Procedure, the duty of executing the warrant of arrest is vested in the arresting of-

cer and a private citizen, a civilian, cannot be such an ofcer. Hence, it is not likely, at least theoretically, that a person not an ofcer of the law will come barging in to your home for the purpose of effecting an arrest pursuant to a warrant. It is under the second form that the so-called citizens arrest is warranted. These are the instances (there are three) when the arrest of a person is allowed, and legal, even without any warrant. Its basis, the Rules on Criminal Procedure, opens: A peace ofcer or a private person may, without a warrant, arrest a person: followed by the enumeration of the three circumstances when warrantless arrest is allowed. The rst of the three is the so-called in agrante delicto arrests. This gives the peace ofcer or a private person authority to arrest a person even without any warrant when, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense. Arrest without warrant is allowed in this instance because the supposed transgressor is caught in the act of committing an offense either on the very occasion thereof or immediately prior to or after it. Under the second, an offense has just been committed and the peace ofcer or the private person has probable cause to believe based on personal knowledge of

YOUR HEAVENLY FATHER KNOWS THAT YOU NEED THEM ALL

At times we might see the sermon on the Mount as a mountain climb with Jesus at our head. In the opening Beatitudes he sketches out the marvelous vista that will be ours from the top: rejoice and be glad for there is the kingdom! He then leads us rst through familiar tracks, the Commandments. But suddenly bids us leap on to a higher ground especially on the daunting ledge of loving our enemies. Surely we must be at the top by now? Perfect as our heavenly Father is! No. There is still the hardest rock-face of all to tackle; perfect trust: no to worry. What! Not to worry about what we are to eat, to drink, to wear? No, he tells us, not to worry! That would be to lie down in the meadow with the other master: the other god, Mammon, the Celtic Tiger. It is for you to cling to your Father in heaven. His love you cannot doubt. His power to give you all you need is certain. Set your heart on him and his will. Love him, that is 100%. And your neighbor as much as yourself. (Feed from the Tree of Life by Columba Breen, OSB, published by Paulines. Visit us at www.paulines.ph or at Paulines Media Center, Real St., Tacloban City. When they take their oath of ofce, they pledge to the people to effectively carry out their mandates. The pledge is not to their party or their party leader but to the people of Tacloban. This is one way of looking at their roles and how they can carry out their work for the welfare of the public. This is very crucial as many things could happen this coming October. Malots protests could destabilize Baybay-Cari

BAYBAY CITY- The continued protest being staged by mayoralty candidate Marilou Malot Galenzoga and her supporters could aect this citys peace and order and even its economy. Thus said Baybay Mayor Carmen Cari as Galenzoga led her supporters in staging their protest rally outside the City Hall premises last Thursday afternoon. The rally staged by Galenzoga together with her supporters was to dramatize their protest against Cari being declared as winner by the City Board of Canvassers (CBOC). Cari herself said that the rally staged by Galenzoga has no permit issued by the city government, which made her violate a city ordinance prohibiting such action without the necessary permit. But I advised the city police and the fire station personnel to observe maximum tolerance against the protestors, Cari said. It was learned that the camp of Galenzoga is planning to stage another rally on July 1, the day Cari is to start her first day in office under her new term as mayor of the city. But this early, Cari said that she would make sure that her rivals group has to secure a permit first before they can hold another one. We will not allow them to hold a rally if they do not have a permit, she said. The city mayor added that what her political rival is doing would not only aect the peace and order situation of the city but even its economy. went to his office yesterday. Galenzoga also questioned before the central office of the Comelec on the alleged railroaded proclamation of Cari as the winner in the mayoralty race. She said that Cari was proclaimed as mayor despite of the fact that the transmitted votes canvassed by the CBOC were only 25 percent of the votes cast. Based on the results of the CBOC, Cari garnered

Because of our good peace and order situation, many investors had come to us and put their investments in the city, but because of what they are doing, we might lose some of those who are planning to put investment in the city, Cari said. She added that if her worry would indeed happen, she would be constrained to file a case against Galenzoga like economic sabotage. Cari also said that she is also mulling the possibility of filing other possible cases against 30,618 votes as against Galenzogas 15,421 votes or a dierence of 15,197 votes. But Galenzoga said that based on the results of the Comelec transparent server, she received a total votes of 25,851 against Mayor Caris 20,658 votes or a margin of 5,193 votes. The remains of the driver were brought to the Eastern Visayas Regional Medical Center, 12 kilometers away from the scene of the incident. Based on their initial investigation, the vehicle bearing plate number GSG 738, was from Tacloban on its way to Catbalogan City in Samar when it apparently lost its brakes resulting to the incident.
