TACLOBAN CITY The Bureau of Internal Revenue (BIR) has moved the validity of old receipts until August 30, from the original deadline of June 30 in response to mounting complaints on new rules. In a press statement, BIR Regional Director Diosdado Mendoza said that with the extension of validity, implementation of the new receipt system would take eect on August 31, 2013 instead of July 1. After August 30, 2013, all principal and supplementary receipts and invoices printed prior to January 18, 2013 shall no longer be valid. Any issuance of old receipts and invoices shall be deemed an issuance of an invalid receipt or as if no receipt was issued, Mendoza said. Cesar Balangatan, officer of Revenue District 88(Tacloban), for his part, said that the new deadline set by their agency is more than enough for business owners to comply the new directive. Originally, the deadline for the implementation on the use of new receipts and invoices was on July 1 as contained under Revenue Regulation (RR) No.18-2012. However, business groups across the country expressed their opposition to this arguing that the BIR did not gave them enough time to print new receipts and doing so would entail additional costs on their part. MB places Rural Bank of Borongan (Eastern Samar) under PDIC receivership All valid insured deposit claims will be paid
The Monetary Board (MB) placed the Rural Bank of Borongan, Inc. under the receivership of the Philippine Deposit Insurance Corporation (PDIC) by virtue of MB Resolution No. 962.A dated June 14, 2013. As Receiver, PDIC took over the bank on June 17, 2013. Rural Bank of Borongan is a single-unit bank located at corner J. Bocar and Cardona Streets, Borongan City, Eastern Samar. Latest available records show that as of March 31, 2013, Rural Bank of Borongan had 350 accounts with total deposit liabilities of P16.55 million. A total of 345 deposit accounts or 98.6% of the accounts have balances of P500,000 or less and fully covered by deposit insurance. Total insured deposits amounted to P15.61 million or 94.3% of the total deposits. PDIC said that upon takeover, all bank records shall be gathered, verified and validated. The state deposit insurer assured depositors that all valid deposits shall be paid up to the maximum deposit insurance coverage of P500,000.00. The PDIC also announced that it will conduct a Depositors-Borrowers Forum on June 21, 2013 to inform depositors of the requirements and procedures for filing deposit insurance claims. Claim forms will be distributed during the Forum. The schedule and venue of the Forum will be posted in the bank premises and in the PDIC website, www.pdic.gov.ph. The claim forms and the requirements and procedures for filing are likewise available for downloading from the PDIC website. Depositors may update their addresses with the PDIC representatives at the bank premises or during the Forum using the Mailing Address Update Forms to be furnished by PDIC representatives. Duly accomplished Mailing Address Update Forms should be submitted to PDIC representatives accompanied by a photo-bearing ID of the depositor with signature. Depositors may update their addresses until June 24, 2013. Depositors with valid deposit accounts with balances of P15,000.00 and below need not file deposit insurance claims. But depositors who have outstanding obligations with the Rural Bank of Borongan including comakers of the obligations, and have incomplete and/ or have not updated their addresses with the bank, regardless of amount, should file deposit insurance claims. For depositors that need not file deposit insurance claims, PDIC targets to start mailing payments to these depositors at their addresses recorded in the bank no later than the last week of June. For depositors that are required to file deposit insurance claims, the PDIC targets to start claims settlement operations for these accounts no later than the first week of July. The schedule of the claims settlement operations will be announced through notices to be posted in the bank premises and other public places as well as through the PDIC website, www.pdic.gov.ph. What happened to the promised water before the election?

recisely few weeks before the midterm election, mayoralty candidate, Rep.Florencio Bem Noel boasted together with the LMWD manager that because of Noels multi-million assistance, the water problem that has been a constant headache of Taclobanons will soon be a thing of the past. With wide smiles, the group had a photo and video ops where water was seen gushing from a big pipe. Noel was heard openly talking that he was the reason why Tacloban will soon have water within the week. Noel was so sure of his win that he made use of this basic commodity as a campaign issue. While he believed it would bring his victory, the other way happened; people became angry that a man who profess to love Tacloban, too would dare to use water as bait in the election. A sincere candidate who has an innate love for his fellowmen would not hurt the sensibili-

ties of his would-be constituents. At a time Mayor Alfred Romualdez was sweating hard to materialize his dream to have sufcient water here in Tacloban, chances were killed by the opposition. Even Rep.Noel did not lift a nger to help address the problem. He was a representative of Taclobanon-Warays, and all Warays who have rooted for him and his party list. But he has not done anything to solve the water crisis since he became the representative of the have-nots. Tacloban electorates, on the other hand, voted for LMWD managers daughter Raizza with the fervent hope that being his daughter; she could help make a miracle on the water availability in Tacloban. She has so much on her shoulders, in three years; she has to prove to the people that she deserved their trust and votes. She should not only help motivate her

Just make true your promise on water

Persons are sometimes measured through their integrity or ability to make true their promises especially those made in pacts; sad to say that there are liars and people who do not make true their promises. One of the prominent people who promised something big to the people of Tacloban was Congressman Florencio Noel, who declared that he will bring water to the taps of Taclobanons and that the problem on water insufficiency would become a thing of the past. Together with the LMWD manager, they invited CATV8 for video-ops, one of the campaign materials in the just concluded election. It was about his show o on water where holds are still waiting for the promise to happen. More than a month after the election, some faucets trickle with the needed life sustenance but could not really be used for drinking as the liquid that flows out is turbid and dirty. How could LMWD manager, Engr. Villasin agree to be used during the election? But one thing positive his family reaped, people voted for his daughter Raizza thinking that she could be the angel of luck that will bring miracle to the city. Many people openly accept that they voted for her because she could be the answer to their incessant prayer for water. As the peoples hold on

Upping the Ante

frANZ RAYMOND P. ASPA I was recently visited in our ofce by an unusual client (unusual because his query was uncommon of the many who come to our ofce for advice). His question was not on how he could regain the land he inherited from his father or what to do after being mauled by the police. His question was not very peculiar but downright unusual: when is citizens arrest allowed? He cut me off even before I could answer his question with his narration that he previously sought answer from a policeman detailed somewhere in a neighbouring town but did not have any clue of the answer. Poor fellow. So when really is citizens arrest allowed? To answer that, we must rst determine the two kinds of arrest the lawful kind that is. The rst form of lawful arrest is that which is ordered by the court, which order is contained in the famous warrant of arrest. Its issuance depends on the discretion of the court where the criminal case is recommended to be led by the investigating public prosecutor. It is discretionary because the court must determine independently of the ndings of the prosecutor that there exists probable cause based on his own appreciation of the evidence that the accused ought to be placed behind bars, at least during the intermittent period that the trial of his case is continuing. Two considerations must be taken into account in exercising this discretion: one, the criteria of probable cause should be the judges ever constant guide; second, his determination of the existence (or absence) of probable cause should be personal, that is to say, he cannot just simply afrm lock, stock and barrel the ndings of the prosecutor that probable cause exists. He must personally determine that. Is citizens arrest possible under the rst form? I submit that it is not. Under the Rules on Criminal Procedure, the duty of executing the warrant of arrest is vested in the arresting of-

cer and a private citizen, a civilian, cannot be such an ofcer. Hence, it is not likely, at least theoretically, that a person not an ofcer of the law will come barging in to your home for the purpose of effecting an arrest pursuant to a warrant. It is under the second form that the so-called citizens arrest is warranted. These are the instances (there are three) when the arrest of a person is allowed, and legal, even without any warrant. Its basis, the Rules on Criminal Procedure, opens: A peace ofcer or a private person may, without a warrant, arrest a person: followed by the enumeration of the three circumstances when warrantless arrest is allowed. The rst of the three is the so-called in agrante delicto arrests. This gives the peace ofcer or a private person authority to arrest a person even without any warrant when, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense. Arrest without warrant is allowed in this instance because the supposed transgressor is caught in the act of committing an offense either on the very occasion thereof or immediately prior to or after it. Under the second, an offense has just been committed and the peace ofcer or the private person has probable cause to believe based on personal knowledge of

From these businesses, UEP have funded the renovations and improvements of offices and workplaces inside the campus. The university also provides scholarships to several poor and deserving students in cooperation with local government units. It was also announced that the university Board of Regents have approved the resolution to increase the number of its barangay scholars. At present, UEP only admits one child of each barangay official as scholar of the university. With this new resolution, we plan to cover the scholarship of all children of barangay officials. Malots protests could destabilize Baybay-Cari

BAYBAY CITY- The continued protest being staged by mayoralty candidate Marilou Malot Galenzoga and her supporters could aect this citys peace and order and even its economy. Thus said Baybay Mayor Carmen Cari as Galenzoga led her supporters in staging their protest rally outside the City Hall premises last Thursday afternoon. The rally staged by Galenzoga together with her supporters was to dramatize their protest against Cari being declared as winner by the City Board of Canvassers (CBOC). Cari herself said that the rally staged by Galenzoga has no permit issued by the city government, which made her violate a city ordinance prohibiting such action without the necessary permit. But I advised the city police and the fire station personnel to observe maximum tolerance against the protestors, Cari said. It was learned that the camp of Galenzoga is planning to stage another rally on July 1, the day Cari is to start her first day in office under her new term as mayor of the city. But this early, Cari said that she would make sure that her rivals group has to secure a permit first before they can hold another one. We will not allow them to hold a rally if they do not have a permit, she said. Cargo truck fell at San Juanico Bridge, man died

TACLOBAN CITY-A six-wheeler cargo truck fell down to the San Juanico Bridge yesterday afternoon which resulted to the death of its driver. Arianne Maypa, administrative and training chief of the City Disaster Risk Reduction Management Council (CDRRMC), said the driver, who was only identified as Dexter, died on the spot with his lone passenger, Bitoy Areso, managed to jump o from the ill-fated vehicle. The remains of the driver were brought to the Eastern Visayas Regional Medical Center, 12 kilometers away from the scene of the incident. Based on their initial investigation, the vehicle bearing plate number GSG 738, was from Tacloban on its way to Catbalogan City in Samar when it apparently lost its brakes resulting to the incident. Several railings of the bridge were destroyed due to the incident. The cargo truck was loaded with paints and plywood materials and said to be owned by Nador Capangalan who is from Catbalogan. Investigation over the incident is still in progress as of press time. (JOEY A.
