CHECKLIST FOR SUBMISSION OF EARTHWORK PLAN UNDER THE KKMC (EARTHWORKS) BY LAWS 1987 IMPORTANT NOTES THE FOLLOWING

GUIDELINE IS PUT UP TO ASSIST SUBMITTING ENGINEERS AND TO REDUCE PROCESSING TIME . THIS SHOULD NOT IN ANYWAY BE REGARDED AS STANDARD OR PRE-APPROVED AS ACTUAL COMMENTS OR DATAILS REQUIRED MAY BE DIFFERENT FROM THOSE IN THE GUIDELINES AND VARIES FROM SITE CONDITIONS/TERRAIN. THE GUIDELINES PUBLISHED IS CORRECT AND MAY BE AMMENDED,EDITED TO SUIT THE CURRENT BYLAWS WITHOUT NOTICE FROM TIME TO TIME. ONLY COMMENTS WITH DEWAN BANDARAYA KOTA KINABALU LETTERHEAD AND DULY SIGNED BY THE ENGINEER CONCERNED IS CONSIDERED OFFICIAL. ------------------------------------------------------------------------------------------------------------------------1. Plan shall be submitted and signed by an Engineer qualified in Civil Engineering and counter signed by the owners and shall bear the full address of the owner. The Submitting Engineer is required to include the statement into the 1st page of the drawing "I hereby certify that the works have been designed by me in accordance with the sound engineering practice and that I take full responsibility for the design and proper performance of the same"
Earthwork Plans shall be submitted in (4) sets. {By laws 6.} Earthwork Plans shall be drawn to indicate cut and fill areas in different color. [By-laws 6.(2)] Plans to a scale of not less than 1:500 showing, [By-laws 7. (5)] a. the total area of the site and the area involving earthworks in hectares. b. finished formation level including i. Platform levels for the building or buildings; ii. Finished road levels; iii. Drain invert levels and crossing iv. Points of discharge or drainage v. All relevant boundary marks c. d. Any excavation, cutting or filling; e. Protection to the earthworks against erosion, including protection during the continuance of the earthworks; f. Protection of silt traps, settling ponds including provision during the continuance of the earthwork; g. Provision of adequate drainage to drain the site. A well defined site plan drawn to a scale of not less than 1:1000 depicting in clear color the site of the earthworks, road access,main streams, natural water courses, drains, landmarks and road names and adjoining lands or part thereof. {By-laws 7. (2)} Plans at two meters contours showing both existing ground on which the earthworks are to be carried out and adjourning land up to Min. of 20 meter or more from the site boundaries. To a scale 1:500 {By-laws 7.(3)} A statement on the subsurface geology including nature of bedrock and alluvium to be submitted. {By-laws 7. (4)} Longitudinal and cross-section diagrams of not less than 1:100 for the vertical scale and of not less than 1:500 of the horizontal scale showing the mass haul of all cuts and fills and embankments of the earthworks to be carried out on the site; {By-laws 7. (6)} The method of excavation, leveling, protection piling or any other geo-technical processes; {By-laws 7.(7)} {By-laws 7. (8)} Plan showing the haulage route to a scale not less than 1:2,500 and the hours which the route is to be used. {By-laws 7.(9)] The proposed earthworks for future phases of development should be highlighted in the location plan. The alignment of any proposed retaining structure, existing drains and proposed drains should be depicted clearly in different colors on the earthworks formation plans. The Kota Kinabalu City Hall should be informed pertaining to the location of the borrow pit or dump site if the site is within the jurisdiction of City Hall as per Earthwork By -laws 19. 1987 A separate set of earthworks plan for the dump site or borrow pit shall be submitted if the dump site is within the jurisdiction of City Hall as per City hall Earthwork By-laws 20. 1987

18. In the case where there is critical cutting/filling to be carried out, survey plans signed by Licensed Surveyor should be submitted together with the proposed earthwork plans. In this respect, slope stability report signed by the relevant P Slope protection measures against soil erosion, such as retaining walls, close turfing, and other etc. should be provided to all cut/fill slopes and to be indicated on the plans in colors. R.C boundary drains of adequate size along the boundaries to serve the development and adjacent low-lying areas should be provided and indicated on the plan in color, including the discharge point. (2) Two copies of the design calculation of the proposed retaining structure should be submitted separately. Permanent R.C drain should be provided as per drainage plan submitted with all the level informations.(i.e invert levels of proposed drains and existing drains) No encroachment shall be allowed onto the adjacent neighboring lands. Entrance and the egress from the site to with all the necessary signboards to the proposed development should be properly constructed at the site and depicted on the drawings. The amount of earth to be excavated or filled and the place when such excavated earthwork is to be deposited or the earth to be used for filling is to be obtained and accompanied with the approval by Assistant Collector of Land Revenue, Lands and Surveys Department. Payment of submission and earthworks fees as per Earthworks By laws 20. 1987 to be remitted to the Kota Kinabalu City Hall. The fees to be paid under these By-laws shall be as follow; i. (a) on the submission of plans (b) General earthworks ii. Where the general earthworks exceeds 6 m below the highest ground level - Fees 50.00 ringgit - 250.00 ringgit per half hectare or part thereof - 1 time the fee prescribed in (i) (b) above - 2 times the fees prescribed in (i) (b) above Fees 50.00 ringgit per vehicle per month

Payment of submission and earthworks fees based on the site areas and volumn of earthwork to be deposited in the City Hall as per Earthworks By laws 20. 1987. The above earthwork fees does not include the earth transportation permit fees, as such, the Consultant Engineer is required to submit the following information to the City Hall; {By-laws 18(j)} a. b. Location of dump site or borrow pit whichever is applicable c. Number of transporting vehicles to be used. d. Estimated volumn/quantity of surplus earth to be disposed off to the dump site or imported earth to the proposed development site whichever is applicable. e. Completion period. f. If earthworks involve the use of any public roads, Cawangan Traffik Polis and Jabatan Kerja Rayas Road Maintenance Section to be consulted. g. Earth moving hours should be approved by Cawangan Trafik Polis. A paved wash bay should be constructed and provided at the site for all vehicles leaving the site and onto a public road as per Kota Kinabalu City Hall Earthworks By-laws 18 (a) 1987. The paved wash bay should be equipped with high pressure water jet. The detail of paved wash bay should also be submitted. The stretch of the access road between the paved wash bay and to the edge of public road, should be properly sealed or concrete-lined. The paved wash bay should be fitted with a heavy duty mild steel cover on top, properly designed to sustain the weight of earth moving lorries to prevent silt from bringing out the site and dirtying the public roads. All washing from the work bay shall be directed into a silt trap measuring not less than 1m X 1m X 1.2m in depth before its final discharge into a suitable outlet. (By-Laws 18.(b)

31. 32. Precautions should be taken at all time to protect the adjoining lands, buildings, roads and other properties. {By-laws 7. (12)} Detailed plans to a scale of not less than 1:50 and specifications of any close sheet piling or other retaining structure to stabilization of slope required under these By-laws and showing the expected dip and strikes of bedrock and the expected depth to bedrock. {By-laws 7. (13)} The calculation and all ground levels and contours referred to in this By-laws shall be drawn with reference to the Lands and Surveys bench marks and the bench marks shall be established on site for reference.{By-laws 7. (14)} The sides of all foundation earthworks exceeding 3 meters in depth shall be protected by close steel sheet piling. If not exceeding 3 meter in depth, other alternatives method of protection to the banks shall be erected. {By-laws 10 (1) (a),(b)} Soil investigation shall be carried out and the depth of the water table in any foundation earthworks need be determined; and the Engineer submitting the plans under By-laws shall submit the soil investigation report and shall certify that any lowering of the water table will not effect any surrounding structures, roadways or any other properties.{By laws 11} Boundaries are to be visibly identified by Licensed Surveyor with painted wooden sticks before any earthworks can commence. {By-laws 12} Consultant/Developer is to submit a topograph survey plan certified by a licensed surveyor. Where there are tree in the earthwork site, the same shall not be cut or cleared until the earthworks site is ready to be worked. {By-laws 13.} Top soil to the depth between 8 cm to 15 cm shall not be discarded from the site during site preparation without the consent of the City Hall. This shall be set aside by the owner for landscaping purpose on the site or given to Kota Kinabalu City Hall free of charge for beautification purposes if required. {By-laws 14} All earthworks exceeding 3 meters in height or depth shall be protected by a retaining structure on stabilization of slope. {By-laws 15} All earthworks embankments where permanent retaining structures or stabilization of slope are proposed, shall be provided with temporary retaining measures or stabilization of slope during the continuance of such earthworks. Such permanent retaining structures shall subsequently be submitted to Kota Kinabalu City Hall for checking and approval. {By-laws 15. (2} All earthwork shall be carried out in such a way as to give adequate safeguard to all adjacent properties at all times. No site water shall be discharged to the adjacent lands.{By-laws 15. (3)} Earthworks to be carried out shall be phased in the order submitted under By-laws 7.(b) and no earthwork shall commence or continue to the next phase unless the Engineer submitting the plans certifies in writing that the earthworks are not likely to cause nuisance or damage to the surrounding properties.{By-laws 16.} The owner undertakes in writing to prevent the incidence of earth droppings from earth moving vehicles. The loading bay of such vehicles shall be covered by canvas or other suitable material. In the event that any earth dropping occurs into a public road/drains, such earth shall be removed by the owner at his own expense to the satisfaction of the City Hall.{By-laws 18.(c)} The owner shall ensure that no obstruction is caused to any existing drainage system, public street/road during the course of executing the earthworks. {By-laws 18 (d)} The owner shall provide drainage system to drain off all surface water from the work site into a silt trap before its final discharge into a suitable outlet drain, canal stream or river. Such silt trap provided shall be of adequate size and regularly desilted throughout the duration of the earthworks. {By-laws 18 (e)} The owner shall carry out proper site management and quality control, such as maintaining all drains, silt traps, settling ponds regularly to the satisfaction of the City hall. {By-laws 18. (f)} dumping ground; {By-laws 18. (g)} All other nuisances or damages to surrounding properties are to be fully rectified by the owner at their own cost at a period specified by City Hall; {By-laws 18. (h)} Any seepage arising out of the earthworks shall be under drained to the satisfaction of the relevant authority and no ponding be allowed. {By-laws 18. (i)} The Engineer submitting the Plans shall notify the City Hall in writing as in Form EW2 of the intention to commence or resume earthworks and shall include particulars of the intended work. The Engineer Submitting the Plans shall within one week of the completion of the earthworks, notify the City Hall in writing of its completion as in Form EW3.(By-laws 5 (4) Written Consent to be obtained from the authority concerned or adjacent land owner(s) for land cutting and filling encroaches onto the road /road reserve or private property. The earthwork involves hill slope cutting and filling, it is subjected to the approval of Kota Kinabalu City Hall High Risk Committtee. Any recommendation from the High Risk Development Committee shall be incorporated into the design. To submit a copy of the approved Developement Plan for reference. A security deposit of an amount to be determined, based on the development area and volumn of earthwork on site as per approved rate imposed by the City Hall, in a form of Banker Cheque made in favour of Dewan Bandaraya Kota Kinabalu to ensure the proper execution of the earthwork as per KKMC (Earthworks) By Laws 1987 and until the full completion of the whole development should be deposited in the City Hall before the endorsement of the earthwork plans. Min. 10-0 high approved hoarding or security fence with gate and proper locks should be provided and erected to perimeter boundary of the whole developemnt in where the earthworks or construction of the project abutting to any existing housing estates.
