PREPARATORY COURSE LEADING TO PART B OF THE SINGAPORE BAR EXAMINATIONS 2013

GUIDE TO THE APPLICATION PROCESS

APPLICATION PERIOD 22 April 2013 - 12 June 2013

1.

Time and Duration The Singapore Institute of Legal Education ['the Institute'] will be conducting a Preparatory Course leading to Part B of the Singapore Bar Examinations ['Part B Course 2013'] commencing 10 July 2013 for persons seeking admission as Advocates and Solicitors of the Supreme Court of the Republic of Singapore. The Course will end on 7 December 2013. Applicants are expected to be familiar with the relevant provisions regarding the Course in the Legal Profession Act (Chapter 161) and its subsidiary legislation .

Full-Time Course The Course is a full-time course and students are required to attend scheduled classes, workshops, events and programmes reflected in the Course timetable. Students are reminded that under the Act, the Institute may decline to certify you as eligible for admission to the Roll of Advocates and Solicitors unless satisfied of your attendance and compliance with the Course requirements and its Code of Conduct. Absence from the Course will only be permitted when a written request with reasons and supporting documents has been submitted and the request granted by the Senior Director or Deputy Director in writing. If you are absent due to illness, the absence must be supported by a valid medical certificate dated on the day of absence or on the first day in a continuing period of absence. The overall intent is to ensure absences do not adversely affect your training and performance in the Course. Punctuality and steady attendance are also parts of the training in professional attitudes.

REQUIRED ACTIONS FOR SUBMISSION OF APPLICATION Step 1: Complete all fields of information required in the Online Application Form. Check that the information you have supplied is accurate as discrepancies in information may adversely affect registration. By clicking on the Submit button, you are declaring that all the content submitted is true and accurate to the best of your knowledge at the time and that you agree to be bound by that content.

IMPORTANT NOTE: The Institute will correspond with you primarily using e-mail during the application process to convey messages such as requesting for outstanding documents, notifications etc. Hence, it is important that you provide a valid and correct e-mail address and maintain your e-mail account regularly. The Institute will not be responsible for undeliverable e-mails and their consequences. Step 2: Step 3: Step 4: Print and sign the completed Online Application Form. IMPORTANT NOTE: Where any of the documents is in a language other than English, a certified true English translation of such document should be enclosed as well. a. b. c. d. e. Degree certificate(s) for your law degree(s) and other degree(s). Academic transcripts for your law and other degree(s) for each academic year.

f. If your law degree is from a university in Australia, New Zealand, or the United States of America, a letter from your university stating your ranking.1 g. If you have become a barrister-at-law of England or of Northern Ireland, a member of the Faculty of Advocates in Scotland, a solicitor in England or Northern Ireland or a writer to the Signet, law agent or solicitor in Scotland, the relevant certificate from your Inns of Court. h. If you have obtained the Diploma in Singapore Law from the National University of Singapore [NUS], the relevant certificate from NUS. i. If you have passed Part A of the Singapore Bar Examinations, a certificate from the university that conducted it.

j. If your degree certificate or your academic transcripts do not reflect the class of your honours or your final GPA attainment, a letter from your university stating your ranking2 k. Where applicable, a letter from the law firm or organization stating that you have for a continuous period of not less than 6 months, received relevant legal training, been engaged in relevant legal practice or work, or received relevant legal training and been engaged in relevant legal practice or work. The letter must state the following: The exact duration (dd/mm/yyyy - dd/mm/yyyy) you were employed there; The position(s) you held and the department(s) in which you worked; The nature of the legal work in which you were engaged; Dates of medical leave and annual leave during this period if any taken by you; and The contact details (including telephone number and email address) of a partner or director of the law firm or organisation, willing and able to verify this information. l. If you have been exempted from any of the requirements of the Act or the Rules, the letter of exemption of the Ministry of Law. IMPORTANT NOTE TO NUS AND SMU GRADUATES: As an interim indication of your legal qualification - the notification from NUS or SMU to you that you have passed the requirements for an LLB Honours from the university and reflecting your class of honours awarded will be sufficient. The transcript will be required for verification at a later date once it is available to you. Certification should be carried out by an independent person of recognised authority (not by a relative), such as the University/College Dean/Registrar, an official of an Inn of Court, a lawyer of standing or notary public, but not by a relative of the Applicant. A description of the certifiers status or authority should be placed under the signature. Step 5: Prepare a crossed cheque or cashiers order made payable to Singapore Institute of Legal Education. The registration fee for registration as a qualified person is S$107.00 (inclusive of GST) and must be added to the course fees of: a. b. c. IMPORTANT NOTE: The fees must be paid in Singapore Dollars. Post-dated cheques or cash will not be accepted by the Institute. Transfers from foreign banks or financial institutions must be through a cashiers order remitted by a local bank. IMPORTANT NOTE: The Institute will process the application only if all documents are received within 14 days from date of the online submission of the same or by 5.00 pm on 14 June 2013 whichever is the earlier, failing which we shall assume that you are no longer interested in your application for the Course and the application will be treated as cancelled. You must submit any other documents that may be requested or required by the Institute. The Institute shall have the right to cancel your application if you fail to submit the required documents Step 7: You will thereafter receive Notification Email I from the Institute, confirming receipt of your application form together with the supporting documents and the payment of the fees and notifying you whether: 1. you have been accepted into the Part B Course 2013, or 2. you have been given a conditional acceptance into the Course (if you have yet to fulfill all the requirements of being a qualified person under the Legal Profession (Qualified Persons) Rules, or 3. your application has been rejected. Step 8: Prior to the commencement and registration of the Course, and if you are accepted into the Course, you will receive Notification Email II which will contain: 1. confirmation of the elective subjects you have been allocated;or 2. secured information granting you access to the online training platform where the Course Schedule and Training Materials may be found; and 3. details of the Registration and Commencement Session of the Course. 4. CONDITIONAL ACCEPTANCE Applicants who will attain the status of a "qualified person" a. upon completion of relevant legal training/practice/work on or before 9 July 2013; or b. upon receipt of Ministry of Law's letter of exemption from the requirements of being a "qualified person" on or before 9 July 2013, may be given conditional acceptance and be duly registered in the Course pending the fulfillment of all the said requirements of being a qualified person. The Institute reserves the right to revoke any conditional acceptance granted to any applicant.

Withdrawal A duly registered student who does not take up his/her place on the Course or who withdraws from the Course for a reason other than failure to become a qualified person will forfeit his/her fee, subject to the discretion of the Institute to return the fee in whole or in part in the light of the circumstances, and also subject to a deduction of S$535.00 (inclusive of GST) for administrative expenses. Application to withdraw from the Course must be made in writing and signed by the Applicant.

Training Employment Pass (TEP) All applicants who are not citizens or permanent residents of Singapore are required to obtain a TEP to attend the Course; regardless of a. whether they graduated from NUS or SMU; or b. whether they graduated from foreign universities and were granted an exemption by the Ministry of Law from the requirement of being a citizen or permanent resident of Singapore. A duly registered foreign student will NOT be allowed to attend the Course if he/she does not obtain a TEP by 10 July 2013. A certified true copy of the TEP has to be produced by that date. SELECTION OF ELECTIVE SUBJECTS All students in the Course are required to successfully complete 7 compulsory subjects and 2 elective subjects.

Elective Subjects There are 7 elective subjects offered in the Course in 2013, which are divided into Category A Electives and Category B Electives. Each student has to successfully complete 2 elective subjects, one from each category. The elective subjects offered in each category are:

Category B Electives B1 B2 B3 B4 Admiralty Practice Wills, Probate& Administration Practice Cross-Border Transactions Mediation Skills Applicants who have undertaken any Mediation Skills or Mediation Advocacy module during their undergraduate studies are prohibited from opting for this elective in this Category. Those who took the Negotiations module only are NOT affected by this restriction. ADM WPA CBT MED

In completing the Online Application Form, applicants are required to state their order of preference for these subjects within each category. Selecting'1' against a subject name indicates that subject is the most preferred choice while selecting '3' or '4' against a subject name indicates that subject is the least preferred. Students are to rank all 3 subjects within each category in this gradient of preference. The maximum number of students for each Category A Elective Subject is 200. The maximum number of students for each Category B Elective Subject is 150. The Institute will endeavor to allocate 1 elective subject from each category to students according to their preference, however the selection of the elective subjects remains the prerogative of the Institute through its internal selection processes. The decision of the Institute on the allocation of elective subjects to any student is final. Students who have not been allocated their preferred elective subjects are encouraged, upon completion of the Course, to pursue their training in these subjects through the Continuing Professional Development administered by the Institute. IMPORTANT NOTE: Please be careful when making your selection for an elective as the Institute will NOT entertain any request for a change of an elective after you have submitted your online application form. Brief descriptions of each subject are given below: Category A Electives Elective A1 Synopsis: Advanced Corporate Practice [ACP] This subject provides students with a basic understanding of the legal issues and practical aspects of corporate deal making in Singapore. Topics covered include the establishment and governance of a Singapore company, private and public M&A transactions, equity and debt capital market fundraisings, joint ventures, due diligence and competition law. The course will be taught through lectures, with additional tutorials on key topics, by experienced practitioners. Foundational knowledge of Singapore Company Law. Intellectual Property Law Practice [IPP]

Synopsis:

Students will be instructed on the practices and the procedural rules that apply to protect various intellectual property rights (including patents, trademarks, copyrights, registered designs and plant varieties protection) in Singapore. A litigation module will also acquaint students with the pleading and proof of intellectual property infringement actions, invalidations and revocations. They will also be equipped with the necessary tools and legal principles to substantively advise clients on the (interlocutory and final) remedies that are available to effectively enforce and litigate intellectual property rights. There are no course pre-requisites as such but students who have read Intellectual Property as a subject in an LLB degree course (or equivalent), or have acquired a foundational knowledge of intellectual property through relevant legal training, will derive the greatest benefit from this course. The Law and Practice of Arbitration [ARB] The subject is intended to introduce students to the law and practice of arbitration in Singapore. It is also designed to equip students to be able to understand the processes involved in commercial arbitration both international and domestic. It will also help the student navigate the applicable procedural aspects of arbitration in Singapore. The objective of the subject is to prepare a lawyer to be able to understand enough of arbitration law and practice to advise a client on the basics of commercial arbitration in contrast to litigation. The subject will cover key areas of commercial arbitration: Introduction to Arbitration law and practice and its legislative framework; The Arbitration Agreement and Fundamental Concepts of the UNCITRAL Model Law; The Role of the National Court in the Arbitral Process; Recognition and Enforcement of Arbitral Awards; Interim Measures and Foreign Arbitrations; Arbitration Rules and Practical Matters. No specific prior knowledge is required. However, those who have taken litigation modules covering Evidence, Advocacy and Civil Procedure during their undergraduate studies or are familiar with these aspects of the law through work experience will have an advantage.

Category B Electives Elective B1 Synopsis: Admiralty Practice [ADM] This subject will provide an insight into the practice of admiralty and shipping laws from the perspective of experienced practitioners. How is a ship arrested? What does the Sheriff do? What are the usual forms of security for the release of a ship? How does one challenge the arrest, if its irregular or wrongful? What are the costs and expenses involved? It will equip students with a working knowledge of the application of the substantive law, and the practice and procedures of this specialised area of practice. The workshop will enable tutors to review the drafts of documents prepared by a junior practitioner. Although it is recommended for students intending to practice in a disputes practice area, it is a course for everyone, including students who have not done any substantive law subjects on this area. Nil Wills, Probate & Administration [WPA] Students (particularly those interested in estate matters, intending to practise personal law or develop an expertise in probate law and administration) will receive tutelage on the drafting of wills and practical pointers relating to the law and practice of testate and intestate succession. In particular, procedural aspects relating to the application for letters of representation and steps to be undertaken as well as practical problems to overcome will be covered. There is also an integral component touching on the Mental Capacity Act (Cap 177A, 2010 Rev Ed). All relevant legislation and instructive and illustrative recent Singapore case law will be covered. Passing reference will be made to the Administration of Muslim Law Act (Cap 3, 1999 Rev Ed) but Islamic law of inheritance will not be the focus of this subject. Nil Cross-Border Transactions [CBT] This subject is intended to provide students with overviews of the following types of international / cross-border transactions: (i) mergers and acquisitions, (ii) dispute resolution, (iii) funds, financial regulation and private banking, (iv) capital markets fund raising and (v) bank financings. The focus will be on the conduct of these types of transactions in cross-border contexts, and students will be introduced to various considerations practitioners take into account when advising on matters which are international in nature. which are international in nature. Students will also be provided with an overview of current international legal and regulatory issues. The focus will be on obtaining practical exposure to these topics, and lectures will be conducted by partners and other senior lawyers from Clifford Chance. Pre-requisites: Elective B4 Synopsis: Nil Mediation Skills [MED] This skills-development subject provides a unique opportunity for those who wish to explore mediation in greater depth and to develop fundamental mediator skills. In the near future, there will be a growing need for more lawyer-mediators. Mediation is also increasingly recognized as an essential management tool for leaders. Students will be better equipped when required to step in as neutral third parties to assist clients in resolving disputes and be able to play a more effective role in conflict management in the work place. The subject will largely encompass experiential learning. Apart from lectures, students can expect to participate in practical exercises and mediation role-plays in an interactive and enjoyable environment. The successful completion of this module will also entitle students to earn half credits towards being accredited as a Mediator by the Singapore Mediation Centre. Applicants who have undertaken any Mediation Skills or Mediation Advocacy module during their undergraduate studies are prohibited from opting for this elective in this Category. Those who took the Negotiations module only are NOT affected by this restriction.

Free Associate Student Membership with the Singapore Academy of Law All practitioners who are admitted to the Singapore Bar, or appointed to the Singapore Legal Service, are required to be members of the Singapore Academy of Law ['SAL']. Since the Singapore Institute of Legal Education is appointed under the auspices of the Singapore Academy of Law, applicants for the Course are eligible to be an Associate Student Member upon successful registration as a student of the Course. Under an arrangement with the SAL, the Institute will send the applicants particulars to the SAL to process their free Associate Student Membership account. This membership is free for 6 calendar years or until admission date to the Singapore Bar or appointment date to the Singapore Legal Service, whichever is the earlier.
