Only legal heirs can claim share in your fathers property.

If your mother is alive, she will also be added as a party to the
suit for partition. If your fathers mother is alive, she will also
be added as a party to the suit for partition. If your father has
another wife and children, they will also be added as a party
to the suit for partition.
You can claim 1/5th of share in your fathers property
provided that your mother was died, your grand mother (fathers mother) was died and your father did not have another
wife. In your case, you should first file a suit for partition
or suit for succession of property before the Court of Law.

My sister, has left her hubands house 3 years back for

dowry harrasement has filed case for maintenance. Her
husband got married to another lady what action she should
take now?
Ans:
- Sanjeevi Sharma, Trichy
If your sister has come to know the fact that her husband
married another girl fraudulently, she should have immediately lodged a criminal complaint with the police station against
her husband by lodging FIR under section 494 & 498A of the
IPC & section 4 of dowry prohibition act. If one year lapsed
after her knowledge about her husbands second marriage,
it is difficult for her to get punishment to her husband from
the Court. Documents (or at least witnesses) are necessary to
prove the second marriage of your sisters husband. He will
be punished up to 7 years under Section 494 and 496 of IPC.
In case your sisters husband married without disclosing his
first marriage to his second spouse, he may be punished up
to 10 years under Section 495 of IPC.
She can concurrently file a case for maintenance under
section 125 Cr.P.C.
she can claim share in his husbands property by filing a
case under protection from domestic violence act.
she can also ask for a separate residence under the aforesaid act or she can get his house partitioned.
All the above said remedies are simultaneously available
to your sister provided you should be prompt in approaching
the court and the police. better you can consult a lawyer who
is specialised for family casses at the time of filing the case
for maintenance because pleading is of much importance.

The Parliment LEGENd
R V KRISHNA AYYAR
The Dawn of the 20th Century saw
the production of great man from the
madras Christian college. The first
was Shri G A Natesan, a journalist of
reputation and with whom Mahathma
Gandhi stayed at his residence in Mylapore during 1929-30 and it is said that
it was Natesan who asked Gandhiji to
attend the second round table conference in 1930. R.V.Krishna Ayyar,
who is the one of the founding of our
parlimentary system and democracy.
Then came S.Radhakrishnan, who rose
up to become the president of India
Lakshmanaswamy mudaliar and Ramaswamy mudaliar came next and then
Sir Mohamed Usman who was an active
governor of Madras Province and the
veteran parlimentarian S.Sathyamurthy
also came. Sathyamurthy, Usman,
Radhakrishnan and Mudaliar brothers
became close friend of R.V.Krishna
Ayyar and the friendship lasted till their
last days.
R.V.Krishna Ayyar was born poor
at Rasipuram in Salem district.He then
went to Salem Municipal high school,
then Salem College. At Salem College
during the years 1897-99 he became
a student of Rt.Hon.Srinivasa sastriar
who was a lecturer there. Srinivasa
Sastri wanted R V Krishna Ayyar to join
the servants of india society and wrote

excellent student R.V.Krishnan to join
the society. But R V Krishnan preferred
the path of Bal Gangadara Tilakar. From
Salem College R.V.Krishna joined the
Madras Christian College for his B.A.
It should be said that R.V.Krishnan
took the first rank in every examination from infant class till M.L. And he
studied on scholarship and won about
all the medals all the classes,This is the
record. The professors were so much
impressed by the intellectual eminence
of krishnan that during the various
functions krishnan was asked to sit in
first row along with professor a rare
achievement.From there Krishnan went
to Law College and became a student of
DR.S.Swaminathan, father of Govinda
swaminathan. Swaminathan was a
professor was a professor the Madras
Law College. He was impressed by the
intellectual document R.V.Krishnan
and He asked Krishnan to prepare the
notes for him to conduct the lecture
for the law classes. Thus it was a rare
case of a student preparing subject and
notes for his professor, rare case student
became a teacher for his own teacher.
He was enrolled in 1904 and served as
a junior to Swaminathan. But Krishnan
went to Salem 1905 to practice Law. It
was here he became into contact with
Rajagopalachari who was practicing as

an advocate there. Rajagopalachari realised the intellectual potency of Krishnan

and they became a great friends. This
friendship lasted for nearly 67years till
they died. But in 1910 the Government
appointed him a District Munsiff and his
posting was at Erode. It was at Erode
he made a great name for himself and
people used to say, If you want justice,
then go to Krishnan court. It was at
Erode E.V.Ramaswamy Naicker and
Krishnan became good friends. No
one knows how they respected each
other till their last. From Erode he was
shifted to Eluru now in Andhra pradesh.
Here T.Prakasam used to appear before Krishnan and they became great
friends. From Eluru he was shifted to
Chengalpet and here he decided the
famous Prasadam case. There was dispute between Vadakalai Ayyangar and
Thenkalai Ayyangars over the right to
get the first prasadam. The judgement
was hailed as the best and the Privy
council to which the case went on appeal accepted the findings of krishnan
and reported that this was one of the best
judgements they had come across. From
Chengalpet he was shifted to Kulithalai
and from there he was shifted to Nagapattinam. It was when he was serving
as District Munsiff at Nagapattinam, his
career changed. During 1918 the Government of India act introduced Dyachy
assembly and S.Sathyamurthy and M.Ananthasayanam Ayyangar who late a became speaker of India 1957 they were
together Simla were living during the period 1932 onwards.
The first company Act of 1934 was his draft. He relinquished
office in 1955 after Kamarajar became the Chief Minister
of Madras. The was an unprecedent public reception given
to Krishnan ayyar when he laid down his office. This was
the only occasion a secretary was given such a reception on
laying down office in the whole of India. If Sathyamurthy
had been alive he would not have allowed Krishnan Ayyar
to vacate office and would have allowed him to continue in
office as long as desired. A person claiming as the deciple of
Sathayamurthy, Kamarajar knows well the relations between
Sathyamurthy and Krishna Ayyar and how Sathyamurthy
respected him. Thus Kamaraja Nadar should have continued
R V Krishna ayyar in office so long he was available. It is a
great mistake of on the Kamarajar to have allowed Krishna
ayyar to vacate office. It only Krishna ayyar had continued
in office he would have given a Parlimentary Practices.
There are no monuments of memorials for Krishna ayyar
but look around the Parlimentary system in his memorial.
This legendary personality will be remembers so long as
the Government of the people and for the people by people

in the provinces and Legislative council was formed in British

Provinces. The Government then shifted Krishnan to the Law
Department of the Madras Government as a special officer
cum Assistant Secretary for the implementation of the 1918
act. Krishnan drafted the modalitities and other constitutional
features of 1918 Government of India Act and when the first
Legislative council was formed in 1921 he was appointed as
assistant secretary of the Legislative council. The first chairman of Madras legislative council was sir S.P.Rajagopalachari
and in 1923 he was posted as an advisor to the secretary of
state for india in London he vacated the office as president
of the Legislative council. To this vacancy the first secretary
of the Legislative council Shri L.D.Samikannu pillai was appointed president as of legistrative council and the Governor
appointed R.V.Krishnan as the secretary of the Legislative
council in 1924. It was at the Table of the House Krishnan
made a huge name and a time came during 1930, every one
considered him as an authority in Parlimentary Law, They
stopped consulting Sir Erskin may because there was R V
Krishnan to be consulted and he became the efford Erskin
may of India. During the period when he was at the table of
the house, Madras Province produced great parliamentarians
like S.Sathyamurthy, C.P.Ramaswamy ayyar, M.C.Rajah,
R.K.Shanmugam chetty, Sir A.Ramaswamy mudaliar,
Sir Mohamed usman, T.Prakasam, P.Ramamurthy,
M.Kalyanasundaram, C. Rajagopalchari etc. He sent a
note to the British Government in London 1930 Krishna
Ayyar report on the parlimentary system at the time
of the round table conference and this was hailed by
Macdonauld who was Prime minister of England then
and the Macdonauld award issued after the failure of
the second round table conference granting provincial
autonomy and Constitution Custom Procedure formed
the basis for they 1935 government of India act. Every
one in India accepted R.V.Krishna ayyar as one of the
great authority in constitutional law and law and practice Parlimentary of bodies. He vacated office in 1942.
The congress lost havily in the first elections in
1952 to the Madras Legislative Assembly, the Congress
secured only 144seats in a house of 395, Rajagopalachari was requested to form a ministry. Rajaji wanted
a strong person to be in charge Legislature and to train
new members under the Indian constitution. He cannot
think of anyone else than his old friend R.V.Krishnan
and made a personal request to him to accept the position of the secretary of the Legislature. Krishnan Ayyar first
declined the offer but Rajaji persuaded him to become the
secretary and so he joined the Legislature. R.V.Krishnan
was the only person to conduct the legislature at every stage
of the Indian constitutional. Development as the secretary,
First during the 1919 Government of India Act, then under
the 1935 Government of India act and then again under the
present Indian constitution in 1952.
No Law no enactment passed during the period when he
was the secretary of the legislature was questioned in any
court at any time.
He was an official member of the central Legislative
survives in humanity.
The well known film and TV Artist Kavithalaya Krishnan
considered as a Chella Pillai as film Director Balachandar,
and Electrical Engineer graduate Kavithalaya Krishnan is a
grand son of R.V.Krishna Ayyar.
As a Secretary of the Legislature, Krishna Ayyar will not
made any difference between the Ruling Party and Opposition. He will treat both alike as the production of the opposition and minority he is fundamental Law of the Parlimentary
Constitution.
