Dear Mr. Marcus:

(U) This responds to DCI Document Request No. 10


(DR #10), dated 4 August 2003, issued by The National Commission
on Terrorist Attacks Upon the United States (the "Commission").
By agreement, this response is part of a "rolling" production in
which the Central Intelligence Agency is providing documents to
the Commission as soon as they are identified as responsive.

(U) The first page of each enclosed document has been


sequentially bates-stamped. In this, and all future document
productions, the first digit of the bates-stamp identifies the
specific DCI Document Request to which the document responds and
the remaining digits refer to the document number.

(U) Enclosed please find document Nos. 1000296 through


1000301, responsive to Item No. 4 of DR#10. Although, the
Agency has already produced documents on this item, this
material serves to follow-up on some of the questions posed by
the Commission Staff during our 13 November 2003 status meeting.

Dear Mr. Marcus:

(U) This is our latest response to Item No. 5 of DCI


Document. Request No. 8 (DR #8),- dated 3 July 2003, issued by The
National Commission on Terrorist Attacks Upon the United States
(the "Commission"). In your memorandum of 26 August 2003, you
identify Item No. 5 as among the "most important categories of
documents requested by the Commission."

(U) The first page of each document covered by this


production has been sequentially bates-stamped. In this, and
all future document productions, the first two digits of the
bates-stamp identifies the specific DCI Document Request to
which the document responds and the remaining digits refer to
the document number.

(U) This production consists of documents that were


originally included in the group of documents that are
responsive to Item No. 5 of DR #8 and were produced to the
Commission under cover of my 17 October 2003 letter to you. The
enclosed documents were removed from the 17 October production

and replaced with placeholders notifying the Commission of their


removal, because the documents required further internal review
and coordination. Our coordination of the document is now
complete and the documents (bates-stamped as Nos. 0800389A,
0800390A, 0800390B, 0800392A, 0800392B, 0800399A) may now be
substituted for the placeholders inserted in the compilation of
documents produced on 17 October 2003. The documents covered by
this letter bear numbers that end in "A" or "B", indicating that
the document should be inserted into the document previously
produced that bears the identical number. (For example,
0800389A should be placed into document No. 0800389.)

(U) If you or any of the Commission staffers have any


questions regarding the manner in which the referenced documents
should be inserted into the materials produced on
17 October 2003, please contact me at I 9/11 closed by statute

(U) All of these documents are, by prior agreement, being


retained by the Agency and are available for your inspection at
CIA headquarters.

(U) Please note the following regarding this production of


documents.

(U) First, some of these documents pertain to categories


of documents and types of information to which, by prior
agreement, only certain members of the Commission and its staff
have access. All documents subject to limited access are held
in| 9/11 closed by statute |at CIA headquarters. These
documents have been removed from the documents placed in the
Commission's reading room at CIA and replaced with placeholders
indicating that the document is sub-iect to limited access and
located in| 9 / 1] - Closed by Statute j

(U) Second, please note that the inclusion of talking


points as part of the Agency's response to Item No. 5 of DR #8
does not mean that such talking points were actually used by the
DCI in meeting with the National Security Advisor. In addition,
the listing of topics in the talking points does not establish
that the DCI and the National Security Advisor actually

discussed the topic. Likewise, the absence of talking points


concerning a particular subject does not establish that the
topic was not discussed between the officials, but only that no
talking points were drafted for the topic.
