On October 21, 2010, the XXXX family obtained Restraining Orders against Leonard Weber and Marsha Weber prohibiting the Webers from further harassing the XXXX family. The Webers have ignored the Orders restricting their conduct and have continued to annoy and harass the XXXX family both physically and psychologically. The most recent Restraining Order violation occurred on July 20, 2013. Therefore, as the Webers have continuously disregarded the Orders in place, and have displayed their intent to continue harassing the XXXX family, XXXX hereby moves this Court for an Order renewing the existing Restraining Orders for an additional 3 years. The Webers Have Continued To Annoy And Harass The XXXX Family In Violation Of The Restraining Orders 07/20/2013 - Earlier in the week, Mr. Weber followed XXXX in his car from Target, to a pet store, and then toward his home. On July 20, 2013, Mr. Weber followed XXXX from Von's to the post ofce and then followed him all the way to his home which is on dead end street. Mr. Weber parked his car in front of XXXXs home for approximately 10 minutes waiting for XXXX to come out. XXXX walked outside and Mr. Weber put his ngers in the shape of a gun, pretended to shoot XXXX, and then sped off. At this time, the Restraining Order prohibiting Leonard Weber from following or harassing XXXX was in effect. See Picture of Mr. Weber and Police Report #13-8216 attached hereto as Exhibit A. 06/23/2012 - XXXX was talking to neighbors on the XXXXs street. Mr. Weber drove up, parked, got out of his car, and proceeded to walk toward XXXX while yelling obscenities at him. XXXX retreated to his house without responding. There was a Restraining Order in effect at the time of this incident prohibiting Leonard Weber from approaching or harassing XXXX. See Video Frame Capture and Video dated 06/23/2012 attached hereto as Exhibit B. 06/22/2012 - Mr. Weber was driving on XXXXs street, saw him outside, ipped XXXX the bird while revving his engine, lost control of his car, and crashed into the XXXX familys retaining wall causing considerable damage. Mr. Weber went to his own house, returned with a camera, and stood in the middle of the XXXXs property taking pictures of the damage. At this time, there was a Restraining Order in effect prohibiting Mr. Weber from entering the XXXXs property or making physical contact with XXXX. XXXX instructed Mr. Weber to leave his property, stood between Mr. Weber and the damaged wall, and advised him to take pictures from the public sidewalk just a few feet away. Mr. Weber shoved XXXX out of the way and continued to take pictures while standing in the XXXXs driveway. XXXX, a Draganchuk security guard for the Ventura Keys community, witnessed Mr. Weber shove XXXX while standing in the XXXXs driveway. Mr. XXXX approached the scene and escorted Mr. Weber off of the XXXXs property. The Police were summoned and determined that Mr. Weber was in violation of the Restraining Order. Mr. Weber was cited under PC 166 for said violations. See Police Report #12-7260 attached hereto as Exhibit C.

03/01/12 - Mrs. Weber led a false police report claiming that XXXX violated a court Order by posting a publicly available court document on the internet. After investigating the complaint, the police determined that no violation had occurred and no further action was taken. See Police Report #12-2446 attached hereto as Exhibit D. 03/13/2011 - Mrs. Weber painted a sign on her broom that read "LOATHESOME" and again began pounding on the XXXXs border fence, yelling obscenities and waving her sign above the fence toward the XXXX familys breakfast nook approximately 6 feet away. At this time, there was a Restraining Order in effect prohibiting Mrs. Weber from harassing the XXXX family. After approximately 10 minutes of waving, pounding, and yelling obscenities, Mrs. Weber fastened her "LOATHESOME" sign to the border fence facing the XXXX family home and left it there. Mrs. Weber again began to yell obscenities at the XXXXs while repeatedly opening and slamming her garage side door that is located approximately 6 feet from the XXXXs living room. The police were summoned to calm Mrs. Weber down and to document her violation of the Restraining Order. Approximately 15 minutes later, while VPD Ofcer Alexander was at the XXXXs residence, Mrs. Weber again started yelling obscenities over the fence and repeatedly opened and slammed her garage side door, unaware that a Police Ofcer was present and observing her conduct. Thereafter, Ofcer XXXX interviewed Mrs. Weber regarding her conduct, during which Ms. Weber admitted that she had in fact been violating the Restraining Order by waiving the sign at issue and yelling obscenities over the fence. Ofcer XXXX proceeded to interview the neighbors as to what they witnessed, when Mrs. Weber again came out of her residence and began repeatedly yelling You fucking liar! at XXXX. XXXX did not respond to Mrs. Webers attempts to provoke him. See Picture of Mrs. Webers sign and Police Report #11-2782 attached hereto as Exhibit E. 03/12/2011 - XXXX was on Seaview Ave. talking with a group of neighbors that included children. Mrs. Weber drove by, swerved to the wrong side of the street so as to be closer to XXXX, slowed down her car and rolled down her window, displayed the middle nger at XXXX and yelled, "Fuck you, you fucking bastard lawyer." At this time, there was a Restraining Order in effect prohibiting Mrs. Weber from harassing the XXXX family. See Police Report #11-2782 attached hereto as Exhibit E. 03/07/2011 - The Webers called the police falsely claiming XXXX had installed a security camera on his house in violation of a court Order. The Ofcer observed that the camera in question was pointing toward the side yard running along the north side of s house and not at the Webers property. The Ofcer determined that such placement was not in violation of the Order and no further action was taken. See Police Report #11-2548 attached hereto as Exhibit F. 12/17/2010 (10-16022) - The Webers called the police and led a false report alleging that XXXX had violated a court Order. After thoroughly investigating the allegations, the investigating Police Ofcer found that XXXX had committed no violations and was in full compliance with the Order. The investigating Ofcer also found that the Webers were intentionally instigating confrontations to which XXXX did not respond. The Ofcers report specically states:

It appears that Leonard and Marsha Weber are going to the extremes as far as parking in front of the XXXXs house and moving his trashcans. It appears that they are almost instigating the problems and making it worse. Both Leonard and Marsha were advised not to cause anymore problems. Upon Marsha Weber complaining to the investigating Ofcer of nancial abuse with regard to the XXXX familys emails to the Webers attorneys, the Ofcer stated: I advised her that he had been emailing her attorney in reference to the incidences that both Leonard and Marsha were bringing upon themselves. In addition to the foregoing, Marsha Weber admitted to the investigating Ofcer that she continued to trespass upon the XXXXs property, continued to push items over the fence and onto the XXXXs property, and continued to move the XXXXs trash cans into the middle of the sidewalk in violation of the Restraining Order prohibiting such conduct. See Police Report #10-16022 attached hereto as Exhibit G. 11/22/2010 - Mr. Weber led a false Police Report stating that a light went on in the XXXX household early in the morning and that he was suspicious that someone might be taking pictures of his house. However, when he looked into the XXXXs bedroom window, he did not see anyone there. To protect himself, Mr. Weber then placed a large board against the coterminous fence at a 45 degree angle so that it protruded several feet over into the XXXXs breakfast nook. At the time of this incident, there was a Restraining Order in effect prohibiting Mr. Weber from placing items over the fence onto the XXXXs property. The true facts were that no one was taking pictures of the Webers property, there was no one present at the time, and his suspicions were never conrmed. See Incident Report #400655 attached hereto as Exhibit H. XXXX Has Been Emotionally And Financially Harmed By The Webers Repeated Violations Of The Restraining Orders The Webers multiple attempts to maliciously harm the XXXX family has been successful. The entire XXXX family has again suffered severe emotional distress at the hands of Leonard and Marsha Weber and have incurred signicant attorneys fees in preparing these Requests to Renew the original Restraining Orders. Therefore, XXXX requests sanctions be levied against the Webers in an amount sufcient to curb future malicious behavior and that attorneys fees be awarded in a reasonable amount to be determined at trial.
