AFFIDAVIT OF FACTS UNDER THE PENALTY OF PERJURY
Now comes Shane C. Buczek, propria persona, and provides the following
statement offacts in support ofhis allegations that the government's case against him is
without merit.
HISTORY
The accused was indicted by sealed indictment on March ~ 2008, charging with
violations of18 USC 1001 (a) (2) (Count 1); 18 USC 1542 (Count 2) and 18 USC 1028(a)
(4) (Count 3). Docket # 1.
The accused was released on signature bond on March 1 4 ~ 2008 and Rule 5(c) (3)
documents were received by this court from the Northern District ofCalifornia on March
4, 2008. Docket #s 3 and 4.
STATEMENT OF FACTS
On Friday March 7
th
, 2008 at approximately 6:30am 4 men were knocking at my
Brother's door in Newark California. We were concern who they might be.
They knocked on the door continuously for about an hour. We made some
Phone calls to our mom and we were encouraged to let them in.
When we let then in they came in slowly and they talked to me Shane Buczek

For 10 to 15 minutes and then they really didn't produce much of anything, but a
Copy, one piece of paper copied thing here, it says, I'll just go ahead, I have it
Right in front of me. It stated United States District Court Warrant for the Arrest
of
Shane C. Buczek The warrant has a seal on it, like a stamp nothing engraved
On it or anything, it's just a copy, and the person that signed it, on here states
his
Name as issuing Officer Rodney C. Earl, back on March 4th 2008, Buffalo, and
New
York, Warrant was Received and executed and there is nothing else down at the
Bottom of the warrant; that is pretty much about it. There was no affidavit of
Probable cause, there was no statement, nothing. So, I went ahead and
Complied because my understanding they were sending, they were going to
have;
I think they were going to get another 10 or 15 guys coming down, and a lock
Smith to take the door apart, WOW and this is American?
So J went ahead and got into the car, we drove over to the Newark Police
Department which is no more than 5 miles away, Newark in California. They
Transferred me from the local police into a federal car, which is a black car, I
Don't really remember the year, and make, I believe it was a ford, a black ford,
Four door, sedan probably, on the drive up from Newark to down town San
Francisco, the agent Jose'. all I know is the first name is Jose' like San Jose,
Well his name was Jose' and he was fairly nice, and there was ah African

American driving the car, fairly nice guy, there was numerous phone calls with
Jose and the Assistant District Attorney which I believe his name would have
Been Adam Reeves, and lover heard conversations through the cell phone, that
The cell phone was so loud and the Jose' the Department of Justice Agent, I
Don't think he knew that I knew that I was listening, and that I could hear
Everything that was going on. Adam Reeves assistant District Attorney for San
Francisco US Department of, clearly stated that this is the most bazaar case, I
Don't know what is going on here, but this is really strange, I don't know why they
Are bringing him in for this, for a passport document or something, and he didn't
Understand that, and he says "get him in here, we'll take care of it and that pretty
Much all, kept saying this case didn't make any sense I have no cause. SO I got
in there, as soon as I got in there, no more then 15 seconds, the public defender
The federal public defender came right up to me, and he told me "listen, I heard
About your case, I am going to do everything I can, to get you out of here right
Away, but you have to do this, this, this and that, well the thing that that was
Which I told you earlier, is that I had too, agree to the following. I believe there
Are 3 things, First of all they made me agree, that I would report back to buffalo,
Now remember I'm hand cuffed, If I didn't agree, I just go back, they throw me in
Jail, so I had to agree, I had no choice, I had to agree to go back to Buffalo by
March 14, for a 2 PM o'clock hearing. Secondly I had to promise NOT to record
Any public or private Lien's against any real personal property of any Public
Servant and not contact the United States Attorney's office. Also not to file
Anything with the Assistant United States Attorney OffICe at 138 Delaware

They are forcing all the stuff, down my throat, so I had to agree to these three
Stipulations, which obviously to me is very difficult to agree to all this, but I had

Choice, it was either agree to it or go back up stairs and take you to the penalty
Box, and hang out over the weekend so I went and ahead and got released on
That, but the charges are all title 18 charges, and basically there is not one
Charge that is valid, (1948) now the system is Broken, because I know how the
System works, they can twist and tum, and say things that are not true and if

Have a dumb jury, like some of the people, they get are mentally retarded I think,
I said guilty I "guess he did this, or what ever" but the fact are I never did
Anything illegal at all, my passports a passport and my world passport is my
World passport, and my Apostle is my Apostille identification is legitimate, and
Has my own name on it, my own private documents, and they are turning around
And saying that fraudulent well maybe you guys didn't make them but their

Break Down facts
Approximately between 8: am to 8:15 am in the morning special agent Jose'
Requested my passport, and he, actually asked for my 10, and I had my

My United States passport. so he kept that, I don't think that was lawful for him

Me, from 1999, they kept my damaged passport, so I like have no 10 reft, they
Took all my forms of 10 so all I have left is my body, you know, so I want to put

Passport, Jose' and there was no, (warrant) I complied straight through, and

Impossible, there is no way your going to be able to keep this case here, in San

80% of the time they were talking about don't do this, don't do that, agree to this

ID. There is no fadual Statement, it faDed to be brought up within the one year
time limit and the pleadings, testimony, or discovery are based on codes, rules
and or the patriot act ill direct violation ofthe Constitution.
IV. I deelare the date ofthis dOC1lDlent a trick or scheme under color ofla... ill
violation of my right to life liberty and the pursuit of happiness.
v. No agency can enforce a deprivation rights, under color of law. The State
Department is confin.ed to the limitation ofthe Constitution. A license often
becomes an arbitrary control by the government that makes a erime out of
what ordinarily would not be a crime. IT TURNS A RIGHT INTO A
PRIVILEGE.
VI. The date ofthe doenment is a fraudulent date. I went thought customs between
Canada and New York the day of Super Bowl Sunday February 3,2008 the
kicJmtJ of the game is scheduled for 6:18 PM EST. I had to get home for the
game.
VU. December 20,2006, is repBgD8nt to common sense, has nothillg to do with
anything and I am unclear as to where this date came from.
VllI. I having tried to seeure a Postal PasspoJ1 have had my personal property
withheld, without reason or cause to violate the Constitution.

question or where the validity ofa statute of any State is drawn in question on the
ground of its being repugnant to the Constitution, treaties, or laws ofthe United
States, or where any title. right, privilege, or immunity is specially set up or
claimed under the Constitution or the treaties or statutes of, or any commission
held or authority exercised under, the United States. (b) For the purposes ofthis
section, the term "highest court of a State" includes the District of Columbia
Court ofAppeals.
CONCLUSION
The accused submits to the cowt, under penalty ofperjury the foregoing
statement of facts in his case, which disputes the alleged crimes so recklessly sought to be
enforced against the accused by the Department ofJustice.
For the reasons stated above, this court is respectfully requested to accept this
Statement ofFacts under the penalty ofperjury in order to avoid a violation ofthe
Accused's Substantive and Due Process Rights.
