Judicial Affidavit I, TERESITA ALAY, of legal age, Filipino, a resident of 134 Juan Luna Street, Barangay Uno, Cabuyao, Province of Laguna,

a. To prove that private complainant Teresita Alay and accused Eduardo Ordonez had live together in a common law relationship as husband and wife; b.To prove that the accused Ordonez committed acts of violence towards Teresita Alay; had

c. To prove that the accused, on several occasions, particularly on October 29, 2009 at 2:00 am and on December 4, 2009 at 11:00 pm, committed acts of violence against the private complainant Teresita Alay;

d. To prove all other matters material and/or relevant to the case. 1. Q: State you name, age, address, occupation, all other personal circumstances? A: I am Teresita Sanchez Alay, 58 years old, as of now, I am unemployed. A resident of 134 Juan Luna Street, Barangay Uno, Cabuyao City, Laguna. 2. Q: Ms. Witness, do you remember signing and executing a "Judicial Affidavit"? A: Yes, sir.

3. Q: I am showing you a document denominated as "Judicial Affidavit, is this the same Judicial Affidavit that you executed and signed? A: Yes, sir.

4. Q: Ms. Witness, are you Teresita Sanchez Alay, the private complainant in this case? A: Yes, sir. 5. Q: Do you know that accused Eduardo Ordonez? A: Yes, sir.

6. Q: How do you know Eduardo Ordonez? A: He was my husband, sir.

7. Q: Are you and Eduardo Ordonez married? A: No, sir. 8. Q: Why are you and Ordonez not married? A: Sir, because Eduardo Ordonez was previously

married. 9. Q: Do you know the wife of Eduardo Ordonez? A: Yes, sir. 10.Q: What is the name of the legal wife of Eduardo Ordonez? A: ______ 11. Q: Do you have proof that Ordonez is married? A: -------------( Copy of Eduardo Ordonez' and Blah blah's Marriage Certificate attached and marked as Exhibit " _____________") 12. Q: How long did you and Ordonez lived together as husband and wife? A: More or less twenty- five (25) years, sir. 13. Q: Since when did you live together as husband and wife, Ms. Witness? A: Since 1995, sir. 14. Q: During the coveture, did you and Ordonez sire a child, or children, for that matter? A: Yes, sir. We have a child. 15. Q: What is his/her name? A: _------------------16. Q: Do you have any proof, Ms. Witness? A: Yes, sir. I have with me a copy of our child's Birth Certificate.

Q: Ms. Witness, are you and the accused still living together? A: Not anymore sir. 18. Q: Since when did you stop living together? A: Since almost four (4) years ago. Since 2009 sir. 19. Q: You said that you stopped living together with Eduardo Ordonez, can you please state to this Honorable Court why? A: It is because of the incident that transpired on October 29, 2009at 2:00 am. Eduardo Ordonez --- check the TPO/PPO Petition. Then I went to the Barangay Hall ("Barangay") at around 1 to 2 am because I was worried that Ed did not come home. As soon as I was at the Barangay hall, I saw Henry Daclan. I believe he was the Ex Oficio Officer that night. I asked him where Ed was. He warned me that "Kapitan" Ed was asleep because he was drunk and that I should not wake him up. Despite Henry's warning I continued knocking at the door of Ed's office. When he was not responding, I went to the back of the Barangay and called out the window to his office. He was awakened and we started to shout at each other. In short, we had a fight. 20. Q: Then, what happened? A: As we were fighting, Henry tried to pacify us. I told him, in the vernacular, that he should not interfere with our fight. Then, when Henry went out of the room, I also went out. I admit, I was shouting as I was going out of the Barangay. Then, Ed went after me already carrying a rifle. I was shocked when he poked his gun at me. 21. Q: What did the accused do after he poked his gun

at you? A: As he was moving the gun down, the gun exploded. 22. Q: Were you injured by the firing of the gun or by the explosion of the gun? A: Good thing not, sir. Henry was able pull me to himself.
