RENEWAL OF AGREEMENT OF TENANCY

This Agreement of Tenancy is made Between in Continuation of Agreement of Tenancy which was Executed and signed by both the parties on____________. This Agreement of Tenancy is made at Karachi, this ______ day ___________2012.

BETWEEN
MR. ABDUL QADEER S/O MUSTAFA KHAN, holding NIC No.519-52081844 and New NIC No. 420009-378334-5, Muslim, adult, resident of FLAT NO. E-12, GREEN CITY, GULISTAN-E-JAUHAR, KARACHI, hereinafter called OWNER Party of the ONE PART:

MR. MUHAMMAD ASHRAF NASIR S/O MUHAMMAD IBRAHIM , holding NIC No.42000-043897-7, Muslim, adult, resident of FLAT NO. D5-A, TIME SQUARE, BLOCK-6, GULSHAN-E-IQBAL, KARACHI, hereinafter called the TENANT Party of the OTHER PART: (Both expression shall wherever the context so permits, mean & include their heirs, executors, administrators, successors, and assigns). WITNESSETH AS UNDER:
WHEREAS the OWNER is the sole and absolute OWNER of APARTMENT BEARING NO. G-44 ON THIRD FLOOR, MEASURING 2400 SQ. FTS. IN STREET NO. 13 in the project namely ASKARI-IV situated at Rashid Minhas Road, Gulistn-e-Jauhar, Karachi, hereinafter called the SAID PREMISES. AND WHEREAS the OWNER has agreed to let the SAID PREMISES, to the aforesaid TENANT on Monthly Rent of Rs. 25,000/- (Rupees Twenty Five Thousand Only), on the following terms and condition:

1. That the TENANT has deposited a sum of Rs. 30,000/(Rupees Thirty Thousand Only), to the OWNER which will be treated, as Fixed Security Deposit Money, refundable to the TENANT by the OWNER at the time of entire vacation of the SAID PREMISES (without interest) after deducting dues, damages, charges, if any.

2. That the TENANT has Paid post dated 11 cheques month wise from 09-06-2012 to 10-05-2013. 3. That the OWNER had handed over the vacant peaceful possession of the SAID PREMISES to the TENANT with all necessary fitting & fixtures, hence this Agreement of Tenancy, shall come into force with effect from the above mentioned date and shall be valid for eleven (11) months only i.e. effect from 09-06-2012 and expiring on 10-05-2013. 4. That the TENANT shall use the SAID PREMISES, for his/her own (Residential Purpose Only) and shall not sub-let the SAID PREMISES to any other person(s). 5. That the TENANT would pay the Electricity Bill, according to Meter/Sub-Meter reading Sui-gas charges, Water/Motor, Water Conservancy charges, Telephone Bill or Maintenance Union fee, if any, to the concerned authorities and after payment of all utility bills in original to be handed over to the OWNER on each and very month and the OWNER shall pay all Government Taxes, Property Taxes, etc., from his/her own sources and own expenses. 6. That the TENANT shall pay advance monthly rent to the OWNER for Five months after expiry of Six months. 7. That the TENANT shall not make any alteration addition, etc., of any kind in the SAID PREMISES any damage, to fitting & fixtures, etc. would be payable by the TENANT at full cost. 8. That if the OWNER wants to get the SAID PREMISES Vacated from the TENANT then he/she will have to give one months notice to the TENANT or Vice-Versa. 9. That the TENANT will be ejected from the SAID PREMISES, if he/she fails to pay the Monthly Rent for continuously three (3) months on the notice of fifteen (15) days from the Owner. 10. That this Agreement of Tenancy can be renewed by mutual consent of both the parties for further eleven (11) months period, and 10% Monthly Rent shall be enhanced after Every Year. IN WITNESSES WHEREOF the parties set their respective hands before the witnesses here at Karachi, the day month and the year first above mentioned.
