Im going to take one more segment on deposition testimony to show you, the reader, something interesting.

As a reminder, these State witnesses were sworn to tell the truth concerning what they did and who was involved on the night of the murder: Ray Stanleys version comes from the police records interrogation notes, and says that at approximately 10:00 p.m., Frank and Felix came to Rays home with a large amount of jewelry and that they had to blow some guy away to get it. He was the first one to implicate the brothers. Tina Garcia at interrogation and in her deposition said her brothers asked if they could borrow the car to go the movies. They did not have any jewelry on when they left the house at 7:00 p.m. She said they returned home approximately 10:30 or 11:00 p.m. They showed her and Ray a plastic bag that had two gold rings and a gold watch. And Felix stood there and he said he had to shoot somebody to get the gold and Frankie said all he did was help Felix get this gold. She said the brothers had brought back this guys briefcase and decided to burn it in their backyard to get rid of it. The time was about 12:00 a.m. Remember Tinas version of the facts of the crime given in her deposition? Frankie said to her that A.J. had introduced him to this man (JoJo Tramontana) and that when he met the man he had a bunch of gold on. So Frankie said that he had called him and set up a meeting with him. Frankie was already in this mans room and Frankie said that he had told the man something about Felix was working and he had to come and get the car. And so, Felix called the mans room from the coffee shop and he went upstairs after he called the room and Frankie said something to the man about Felix picking up the keys to the car. When the man let Felix in, Felix said that the man was telling him something about where he was gonna take Frankie or he was gonna take Frankie out. And Felix said that thats when he told the man he wasnt gonna take Frankie anywhere, and he said he pulled a gun out on him and took the man in the room and he shot him in his head. Frankie said that he cut his throat with something.

That was the actual sequence of events according to Tina Garcia. Julie Morris version of the events that fateful night In the previous chapter I recited what Julie said: she was told by Frankie that Felix shot this man. Frankie had also told her he wasnt present. She dont remember Frankie telling her he cut the mans throat. Julie said Frankie attained the gold chains from Ray and Felix who got them off 22nd Street, which she later admitted was a made up story. She said when this 22nd Street story was discussed, Frank, A.J., herself, Tina and Ray were present. To continue on in her deposition, Julie gives an alibi as to where Frank was the night of the murder. She said, at 6:15 p.m. on August 3rd, the night of the murder, Frank picked her up at work. They drove to Tina and Rays house, stayed for about 30 minutes and then she, Frankie and Felix left. They rode around, stopped at a bar called Huttos, and eventually drove Felix over to Michelles and dropped him off about 8:15 p.m. From there she and Frankie drove back to Huttos to make plans for the evening with her cousin Linda, who works there, along with her friend Mike. Linda got off work at 9:00 p.m. She and Frankie went on over to Lindas house until they arrived. They partied at the house till around 11:30 p.m. and decided to finish it off at the park. She and Frankie were the first to leave the park. They drove over to Michelles to pick Felix up. The time is 3:00 a.m. Julie dropped both Frankie and Felix at Tina and Rays place. The following day when she and Frankie were together, they stopped and bought a newspaper and Frankie looked at the death notices. She said they went back to Tina and Rays apartment and Frankie showed them the paper. There was the notice of the death of Joseph Tramontana. She stated no one said anything as they read the paper. Terry Stubbs version which began when she walked in on A.J. talking with Frank. Frank told Terry they (Frank and Felix) went to dinner with this man named Joseph and then went to the motel. When they were in the room, Frank had a slice thing and he described it as something long with a hook and he stood behind this man and chopped his neck. And Felix shot him in the head. They got some gold and stuff.

A.J. Lynchs version was a bit more detailed but it started off with saying he had met the victim at a gay bar called Ki Kis where they went to shoot pool about a year and a half earlier. The victim, JoJo Tramontana, was Gay. Frank stayed behind but A.J. And another guy went out and bought JoJo some cocaine. This other guy was with JoJo, had black hair and looked like me A.J. Said. [What is important to remember here is A.J. also looked like Frank, and Felix and Frank looked alike- brothers only a little over a year apart.] On the day before the murder, Frank told A.J. he was walking down the street, coming from his grandmothers house, and this guy stopped him. It was JoJo Tramontana. He said they were just talking and the next night they were gonna go out and party. On the night of the murder Frank told A.J. that he and JoJo were going out partying. That they bought some Quaaludes from somebody there at the motel and drank some beer. They said that Felix was sitting in a chair and the guy was talking to Felix and Frank was behind him. And that Frank cut the guys throat and Felix shot him. And Frank told him the guy kept saying How could you do this to me? A.J. saw Frank with all this gold the next day and told A.J., he killed this guy and they took it. [In my previous chapter I did not mention a couple who claims they were with Frank and Julie the night of the murder. They never met Felix. I mentioned a Linda in Julies rendition of the facts that fateful night. This is the same Linda but adding another deposition by her friend Mike.] Linda Reeder stated on the night of August 3, 1981, she was at work at Huttos Corner and little after 6:30 p.m. Julie and Frank came in to Huttos and bought beer. She saw them drive thru the parking lot before stopping in again about an hour and a half later, little before 9:00 p.m. waiting for her to get off work. The four made arrangement to get together at her mothers house when she got off work 9:00 p.m. Julie and Frankie drove on over to her house, Mike took his car home and she went by his house to pick him up. They arrived at her house around 9:20 p.m. where she saw Julie and Frankie watching TV. She said they stayed there till about 11:15 p.m. and we all went to the park in two cars. Julie and Frank left about 2:30 a.m.

They left a half hour later. She said Julie told her they were leaving to go pick up Felix and take him home. She doesnt know where they went afterwards. She never saw Felix with them that night. What is little disturbing as you see this scenario of the events that night are so identical as to Julies version, she was asked by ASA Mark Ober if she and Julie talked about the events and tried to refresh their memories with each other? She avoided directly answering the question by we didnt put words in each others minds or we both know what happened that night and finally said, a little, yes. Mike Galluppos version is he was with Linda, Frank and Julie that night. He was doing laundry across the street from Huttos when he saw Frank and Julie at Huttos. So he walked across the street and they invited him to go with them to Lindas house after she got off work, somewhere around 9:00 p.m. They were all drinking and decided to go to the park, leaving the house about 11:00 p.m. and arriving a little bit before 12:00 a.m. in separate cars. Frank and Julie left about 2:30 a.m. and he and Linda left about 3:30 a.m. He did not know where Felix was and really hadnt met him until the night of the arrest when he and Linda were in the same car with Frank, Felix and Julie. There was only one statement made to Mike all this time about the night of the murder and that was Frank telling him he didnt do it. There was some discussion with the attorneys, about that night with Linda, prior to the depositions and Mikes response was, I want to make sure, you know, I didnt forget anything because like I say Im not exactly sure on all the times but I am now because I remember, because like that was a couple months ago or something. [If you take note of Julies, Lindas and Mikes versions, and timing, regarding the night of August 3, 1981- doesnt it appear scripted? Now, compare what Tina Garcia and Ray Stanley said occurred that night involving Frank and Felix Garcia. Wonder who is telling the truth, if at all? I need to interject this is not trial testimony. Whom and what is said at trial will come later in my story. Will the stories be different?]
