TERMS OF REFERENCE

JULY 4, 2013 CANADA/ASSEMBLY OF FIRST NATIONS: SENIOR OVERSIGHT COMMITTEE for COMPREHENSIVE CLAIMS (CCSOC) Objective Based upon the principles of recognition and reconciliation, to examine Canadas various policies respecting comprehensive claims (CCP) to more efficiently and effectively reconcile the section 35 rights and interests of Aboriginal peoples with the rights and interests of all Canadians and propose options to renew, update or reform the policy framework to more effectively address section 35 rights in Canada. Membership The membership of the CCSOC will consist of: For Canada: 2 from AANDC, including Co-chair 2 from AANDC Ministers Office 2 from PMO 2 from PCO Others, as required

For the Assembly of First Nations: Mandate 1. The CCSOC will serve as a senior-level forum for promoting cooperative approaches and options aimed at renewing Canadas relationship with First Nation peoples based upon the principles of recognition and reconciliation, and to recommend more effective policies and processes for addressing First Nations section 35 rights, in line with commitments made in the Crown ~ First Nations Gathering Outcomes Statement (January 24, 2012), and the meeting of the National Chief and the Prime Minister on January 11, 2013 The mandate of the CCSOC involves: a) identifying specific areas/elements of Canadas CCP that are impeding Co-chair: Regional Chief Jody Wilson-Raybould Regional Chief Ghislain Picard 2 from Quebec 2 from British Columbia Other regional representatives as required Others, as required

progress in negotiations and in achieving reconciliation and reaching agreements, including final treaty agreements, and may require reform. b) examining a broad range of reconciliation options, other than reaching final treaty agreements; c) considering the use and establishment of a joint technical working group and/or sub-committees to, inter alia, produce discussion papers, and identify options for solutions in respect of specific policy issues; and Time Frame 3. The CCSOC will remain in effect until December 1, 2013, unless otherwise decided by consensus of the CCSOC and with concurrence of the Prime Minister and the National Chief.

Other Matters 4. Workplan a) A joint workplan shall be developed to guide the work of the CCSOC. 5. Working Groups and Sub-Committees a) Where the CCSOC establishes an AFN-AANDC Comprehensive Claims Joint Technical Working Group and/or sub-committees, it shall provide direction with respect to overseeing progress consistent with the joint workplan. 6. Recommendations a) Discussions of the CCSOC shall result in joint recommendations to the National Chief, the Prime Minister and the Minister. b) In overseeing and/or undertaking joint action, each party will be respectful of the other members respective recommendations.

c) In carrying out the direction(s) of the CCSOC, each member shall be responsible for accomplishing any activity required in a timely manner and consistent with the practices of their respective organizations. 7. Schedule of Meetings a) The CCSOC shall meet on a monthly basis, normally on the second Friday of the month. b) As circumstances require, members may request additional meetings. 8. Record of Discussion a) Short joint records of discussion shall be maintained of the meetings of the CCSOC by a secretariat comprised of 2 members of the Comprehensive Claims Joint Technical Working Group. 9. Coordination With Existing Processes a) Work of the CCSOC shall be coordinated with that of existing processes (e.g., regional policy work, Working Groups stemming from the Crown-First Nation Gathering) to avoid duplication of efforts and to benefit from work already accomplished. 10. Communications a) In order to promote candid, open and respectful dialogue, CCSOC meetings will be without prejudice and confidential. Only the Minister and Regional Chief Cochair Jody Wilson-Raybould will act as spokespeople. b) No social media or public communications will take place based on the meetings without joint consent.
