NEWS RELEASE CITY OF MEDFORD

AttachedpleasefindtheorderfromtheDistrictAttorneythatmakespublictheterminationandrelease agreementbetweentheCityofMedfordandDaveBierwiler.Alsoattachedistheagreement.The documentsarefairlyselfexplanatory;howeverIwouldliketogivesomebackgroundontheagreement, andrespondtorecentcommentsmadebyDaveBierwiler. CityEmploymentRulesforManagementEmployees Employmentrulesareinplacetogoverntherelationshipbetweenmanagementemployeesandthe City.Thoserulesdescribetheemploymentrelationshipasatwill,whichmeansmanagement employeescanbeterminatedforanyreasonornoreason.Therulesallowanemployeetochallenge theterminationiftheterminationisbasedonanillegalreason.Suchillegalreasonsincludebutarenot limitedto:discriminationonaccountofage,sex,maritalstatus,race,religionandnationalorigin.The managementrulesalsohaveaprovisionthatauthorizestheCityManagertoprovideuptosixmonths salaryinseverancetomanagementemployees. TerminationAgreementandResponsetoStatementsbyMr.Bierwiler Undertherules,IexercisedmyauthoritytonegotiateasettlementwithMr.Bierwilerbasedonthe rulessixmonthsalaryfigure.Itookintoconsiderationhisover25yearsasCityFireChief.ButIwas notgoingtoexercisemydiscretionwithoutobtainingMr.Bierwilersreleaseofhisagediscrimination claim. Mr.BierwilerhasstatedthathisterminationwasbecausehewouldnotparticipateintheCitys explorationintojointoperationswithFireDistrict3.Thatissuenevercameupinourconversation. Instead,Mr.Bierwileronlyeverclaimedagediscrimination.Defendingclaimsofagediscriminationis costly,timeconsuminganddistractsfromtheoveralldaytodayconductofCitybusiness.HadIknown thatMr.Bierwilerwasnotreallyclaimingagediscriminationandinsteadwasclaimingthathewas

terminatedbecausehedisagreedwithdirection,goalsandpoliciesrelatedtohisdepartment,perhaps theoutcomewouldhavebeendifferent.Butatthetimeofenteringtheagreement,Iwasactingin goodfaithonbestinformationavailable. CityResponsetoPublicRecordsRequestandResponsetoStatementsbyMr.Bierwiler MydenialoftheMailTribunespublicrecordsrequesthonoredthetermsoftheagreement.That agreementcontainedanondisclosureclausewhichwasdraftedinpartbyMr.Bierwilerandhis attorney,aswellastheCityAttorneyandHumanResourcesDirector.Again,recentstatementsbyMr. Bierwilerthathedidnothaveanypersonalprivacyinterestinthecontentsoftheagreementare contradictedbyhisparticipationinthecreationoftheagreementandthelanguageoftheagreement itself. WhilewedeclinetofurtherchallengetheDistrictAttorneysdecision,wethinkthepolicyofdisclosure underthesecircumstancessetsabadprecedent.Ingeneral,courtsenforceconfidentialsettlement agreementsinordertoencourageresolutionofdisputes.Bynotallowinggovernmentstoparticipatein confidentialsettlements,ourabilitytoresolvedisputeswillbehampered,witharesultthatlocal governmentswillspendmoretimeandmoneyfightingclaimsinsteadofservingthepublic. InformationRegardingFireDepartmentActivities SinceMr.Bierwilersdepartureoversixmonthsago,MedfordFireandRescueandMedfordcityofficials havetakenstepstoensureagreatfutureforthedepartmentandourcitizens.OnAugust15,2013,the MedfordCityCouncilauthorizedtheacquisitionofpropertythatwillallowconstructionofFireStation2 inMedford. DiscussionsaboutsharedmanagementwithFireDistrict3andMedfordRuralFireDistrict2continue. Thegoalistoincreasetheefficiencyoffireandrescueservicedeliveryatorbelowcurrentcosts.
