ABSTRACT AUTHORITY OF PERMIT CONFIRMATION FOR THE USE OF LAND OWNED BY THE BALI PROVINCE GOVERNMENT The application

Law Number 32, 2004 as the revision of Law Number 22, 1999 concerning Local Government brings about significant impact to the local government itself. The impact deals with among other things giving the authority to the Regency/City in the confirmation of permit for the use of land owned by Bali Province Government, this occurs because of the regulation of authority between the Province Government and the Regency City Government in the confirmation of permit of land use is not clear. The follow up of the authority Bali Province Government has issued norms having to do with the permit confirmation for use of land owned by the Bali Province Government, that is, the Local Government Regulation Number 2, 1992 concerning use of land owned by Bali Province Government. The issuance of the Local Government Regulation can be used as a reference or guide both by the Province Government and Regency/City Government in decision making in the field of the use of land owned by Bali Province Government. Permit confirmation of the use of land owned by Bali Province Government becomes the authority of the Governor to give permit by making application to the District Head in the Regency/City Government through the Regent to the Governor. Based on the specification of the Local Government Regulation of Bali Province strictly the relationship of the authority between the Regency/City Government and the Province Government has been regulated concerning the confirmation of permit of the use of land owned by Bali Province Government stipulating that the Province has the authority to confirm the land used by Regency/City Government and the Regency/City Government has the authority to use the lands of the Province Government based on its utility after having permit from the Province Government. The authority exercised by the Regency/City Government has been regulated in the Regulation of the Province Government but its implementation is still in deviation or contradictory to the higher regulation so that the Regency/City Government should understand the word use of land owned by the Province Government and the principles of permit confirmation of land use. The Regency/City Government only has the authority in using the land owned by the Province Government after going through permit procedure and permit confirmation by the Governor.
