    Goal1:Deincentivizemedicalmarijuanatoensurerecreationalusersareappropriately funneledintotheI502modelratherthanthemedicalmarket. Goal2:Createaproperlyregulatedmedicalmarkettoensurepatientshaveaccesstoan adequate,safe,consistentandsecuresourceofmmj. Issue1:MMJpatientsareallowedtopossess24ouncesasa60daysupply. Strategy:Reducepossessionamounts.The60daysupplywasenactedduetothelack ofanadequate,safe,consistent,andsecuresourceofmmj(SB6032(2007)).See DOHs2008legislativelymandatedreportonpatientaccessat: http://www.doh.wa.gov/portals/1/Documents/2000/PatientAccess.pdf. Implementationoftheretailmarketandregulationofmmjsaleswillresultinthisno longerbeinganissue. Issue2:Mmjpatientshaveanaffirmativedefenseofmedicalnecessityforpossessionabove thelegallimit. Strategy:Eliminatethisdefensebasedoncreationofanadequate,safe,consistentand securesourceofmmj. Issue3:Mmjpatientsareallowedtogrowtheirown(upto15plants). Strategy:Eliminateorreducehomegrows.Thiswasenactedaspartofthe60day supplywhichisnolongeracriticalissue. Issue4:Therearenoagerestrictionsformmj. Strategy:Placerestrictionsonmmjforminorssuchasparentalpermission,more frequentfollowupandcoordinationwithprimarycareprovider,andpossessionbythe minorofmorethanasingledose(topreventsharing).Eliminatinguseforminorswould alignbetterwithfederalgoalsbutwouldlikelynotbesuccessful. Issue5:Provisionforcollectivegardensisagatewaytoillicitsales. Strategy:Eliminatecollectivegardens.Again,thiswasenactedduetothelackofan adequate,safe,consistentandsecuresourceofmmj.Thisisnolongeranissue.If collectivegardensareretained,languageisneededtoensuretheyareconductedas intended.

    Issue6:Noclearrequirementsfortaxationexist.Somedispensariescollectsalestax,othersdo not. Strategy:Regulatesalesinasystemparalleltorecreationalsaleswithrequired,but reduced,taxation. Issue7:Mmjpatientsareaffordedsomeprotectioniffoundinpossessioninanotherstatethat recognizesmmj. Strategy:None.Washingtoncannotcontrolactionsofotherstates. Issue8:Itisveryeasytogetanmmjrecommendationfromahealthcareprovider. Strategy:Requireahigherlevelofproofofthequalifyingconditionandmorestringent standardsofcareandfollowup.Couldinclude:Definingdebilitatingconditionand intractablepain(tomeanmorethanmerechronicpain);increasetherestrictionsona providerspractice;providerstricterpenaltiesforviolationsbyproviders;requirea stablelocationratherthanhotelroomsandfestivaltents;requireatimelimiton authorizations;requirethoroughandregularfollowupcaresimilartotherulesfor treatingpatientswithopioids;eliminatetheabilitytopetitionfornewconditionstobe added. Issue9:Mmjpatientshaveadditionalprotectionsunderthelawrelatedtosuitabilityfororgan transplantsandparentalrightsandvisitation. Strategy:Eliminatingtheseprovisionswouldlikelybemetwithgreatresistance. Issue10:Patientswantaccesstospecialstrainsofmmjthatmightnotbeavailableina regulatedmarket. Strategy:Theregulatedmarketwillrespondtoconsumerdemands. AdditionalConsiderations:

    Wouldlimitationsonpossession,andeliminationofhomegrowsandcollectivegardens reducerobberiesandothercrimes? IsaseparatemedicalmarijuanasystemstillnecessaryaftertheimplementationofI502? Shouldtheideaofaregistryberesurrected?Tworeasons:immediateidentificationof validpatientsandrecordofproviderswhomakerecommendations.Ifyes,shoulditbe mandatoryorvoluntary?Apatientwhodeclinesamandatoryregistrycouldstillchoose toaccessmarijuanathroughtheretailmarket.
