A Notice of Appeal (For EOIR-26) must be fled within 30 calendar days of an Immigation
Judge's oral decision or the mailing of a wrtten decision unless the last day flls on a weekend or
legal holiday, in which case the appeal must be received no later than the next workng day. 8 C.F.R.
1003.38(b}, (c). I the instant case, the Imigation Judge's decision was rendered orally on
November 9, 2010. The appeal was accordingly due on or befre December 9, 2010. The record
refects, however, tat the Notice of Appeal was fled with the Board of Imigation Appeals on
December 22, 2010. We accordingly fnd that the appeal is untimely. I conjunction with the appeal
the Depaent of Homeland Security (DHS) has fled a Motion to Accept Duplicate Filing.
The DHS states that it sent the original Notice of Appeal to the Board on November 23, 2010,
via Federal Express, and that the Notice of Appeal was received by the Board on November 24,
2010, which would make the appeal timely fled. The DHS fher states that it appears that
the Board misplaced the Notice of Appeal. As supporting documentation, the DHS provided
a photocopy of online data showing that Federal Express made a shipment on November 23, 2010,
and that the shipment was received by the Board on November 24, 2010. We do not fnd the
fregoing to be suffcient fr us to consider this appeal by certifcation, fr the fllowing reasons:
The DHS did not provide a copy of the original Notice of Appeal. Also, the DHS did not fle a
.afdavit stating that the Notice of Appeal was frst sent to the Board, via Federal Express, on
November 23, 201 O; and the Federal Express tacking infration does not identif what was being
sent. Lat, the respondent opposes the DHS's motion. The Immigation Judge's decision is
therefre now fnal, and the record will be reted to the Immigation Cour without fher action.
See 8 C.F.R. 1003.3(a), 1003.38, 1003.39, 1240.14 ad 1240.15.
We note tat because we are dismissing the appeal fr lack of jurisdiction, either pay wishing
to fle a motion in this case should fllow the fllowing guidelines: I you wish to fle a motion to
reconsider challenging the fding that the appeal was untimely, you must fle your motion with the
Boad. However, if you are challenging any other fnding or seek to reopen your case, you must fle
your motion with the Immigation Court. See MatterofM/adineo, 14 I&NDec. 591 (BIA 1974);
Matter of Lope, 22 I&N Dec. 16 (BIA 1998). You should also keep in mind that there are stct
