WHEREAS

We hold these truths to be self-evident, that all people are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness; that to secure these rights, Governments are instituted among People, deriving their just powers from the consent of the governed; that whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness, therefore BE IT RESOLVED that We the People of the United States do ordain and establish the following Amendment to the Constitution of the United States: Section 1. If the Government guaranteed by Article IV Section 4 is shutdown, the Senators and Representatives shall have exactly 336 hours from the instant that the shutdown commenced to resume the nominal operations of the Federal Government or their terms of office shall be dishonorably terminated without delay or exception, they shall receive no further Compensation for their Services paid out of the Treasury of the United States including pensions for the remainder of their lives, they shall be considered to have engaged in rebellion against the Constitution of the United States, and they shall no longer be privileged from Arrest. Section 2. During the Same and Simultaneous 336 hours the legislatures of each State and Territory of the United States shall be compelled into session until having completed the purpose of naming replacements of the same political party as their predecessors, and the Executive Authority thereof shall issue Writs of Election to fill vacancies so created. Section 3. If any Bill to resume the nominal operations of the Federal Government shall have passed the House of Representatives and the Senate be presented to the President of the United States and the Same shall have neither been signed nor returned by the President within 48 hours (Sundays excepted) after it shall have been presented to him, the Same shall be a Law in like Manner as if he had signed it, unless the Congress by their Adjournment or dishonorable termination prevent its Return, in which Case it shall not be a Law. Section 4. This article becomes effective immediately upon ratification; if this article becomes effective during a continuing shutdown of the Federal Government, then the shutdown shall be considered to have commenced at the same instant that this article becomes effective. Section 5. The President shall have the power to enforce, as Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, the provisions of this article.
