THREE CRUCIAL BILLS TO BE

TABLED IN PARLIAMENT!
It is gratifying to note and is imperative
that the Central Government is seriously
contemplating to bring the important bills on
Right to Information (Amendment) -2013,
Prevention of Corruption (Amendment) Bill 2013, Judicial Appointment Commission Bill
2013 in the ensuing session of Parliament. The
Standing Committee of Parliament of
S. GANAPATHY
Department of Personnel, Public Grievance,
Cell
: 98401 50211
Law and Justice is headed by Shantaram Naik
to hear the views of the public and others on the Bills. The Panel
consists of 29 members. The members of the Committee from Tamilnadu
are T.R.Balu (DMK), N.S.V.Chithan(Congress), S.Semmalai and Rama
Subbu (AIADMK) and others like S.S.Rai, P.C.Gadigoudar, Arjun
Magwall, S.D.Sariq and Sailendra Kumar.
The Panel visited Chennai and gathered the views from the public,
State Government, Central Government, Chennai Port Trust, Neyveli
Lignite Corporation, Banks, Advocates Bar Council members, social
activists and political parties on the three Bills and also the vigilence
mechanism existing in these respective institutions on last Friday and
Saturday. The Standing Committee Chairman, Shantaram Naik while
giving press interview to reporters said that the Central Information
Commission (CIC) had issued an order to bring all the political parties
under the umbrella of Right to Information Act (RTI). If the Act is
amended, the Committee was examining the scope of the definition of
the Public Authority in the Act, if exhaustive informations are given
under the Act to the applicant. What will be scope of such informations
and consequences of such disclosures on National , State political
parties in India and whether the proceedings of the various confidential
meetings of political parties held to shortlist or finalise candidates,
details of the political funding etc., The revelation may become an
impediment on the functioning of the polical parties. These almost
become necessary to guage the feelings of the political parties and
others. Recently the Central government had passed a resolution in
the Parliament to prohibit RTI from the purview of asking to divulge
certain crucial informations of politcal parties to the applicants of RTI.
Under the present system, the selection of Supreme Court and
High Court Judges are being done under a Collegium of Judges. The
Government is contemplating to bring Judical Appointment Commission
Bill and hear the public views. While the Panel on public hearing started
its views, the office-bearers of the Madras Bar Association (MBA)
complained to them that intimation calling for their views could reach
so late to the Assocication only on Friday and they are unable to
submit anything on the subject because of paucity of time. Advocates
Forum for Social Justice President, K.Balu submitted a brief
memorandum pledging support to the Judicial Appointment Commission
which would replace the present Collagium system. The Committee
then asked advocates and Bar leaders to send their return submission
to the Ministry directly.
With regard to Prevention of Corruption Act, there are certain salient
features like giving sentence to bribe givers, to confiscate the property
earned through illegal corrupt methods, to safeguard the whistle
blowers, protecting the honest government officials, sentencing
alleging the business houses that offer huge bribes to government
servants to get it done etc., The Panel will hold meetings from October
6 - 10 in Mumbai and Jaipur and then submit the report to the Central
Government in another 3 months time.
The Amendments to the respective laws, if passed in Parliament are
laudable and welcome, infact giving a teeth to the people in the public
affairs. The RTI should be applicable to all the political parties to be
transparent. With regard to the amendment in the Prevention of
Corruption Act, eventhough it is an offence under Indian Penal Code
(IPC) both the receipt of bribe and offer of bribes to public servants.
But in reality, the whole society is infested, inflicted like infection by
corruption. Without offer of bribes, nothing moves and people do not
know how to arrest this menacing trend. It has become very common
and a way of life. The Government should contemplate seriously on
this vexatious issue which is threatening the very fabric of society and
offer deterrant punishment to the receipient of bribes and order for
confiscation of properties earned through illegal means like corruption
/ gratification etc. At present there is no stringent provision of
confiscation of property. The convicted persons simply escape by
paying penalty and undergoing sentences etc ordered by the court.
Crores and crores of rupees have been lost in various scams, a huge
loss to the exchequer and should have to be recovered from the covicted
persons, if proved. It should be a deterrance for the offenders, dare to
do these illegal acts in future.
