DIRECT EXAMINATION Good Morning Your Honor. Same appearance for the accused.

I am Law Intern, Vanessa Arrha A. De Leon, from the UP Office of Legal Aid under the direct control and supervision of Office of Legal Aid supervising lawyer, Atty. Jose M. Jose. We are ready, your Honor. Manifestation: I would like to manifest Your Honor, that I visited and tried to persuade my witness for today to submit to a taking of a judicial affidavit on 3 occassions. However, he refused to be interviewed and have his affidavit taken and stated that he will just appear before the court in pursuance of the subpoena I filed before this court. COURT: CALL YOUR WITNESS TO THE STAND. Your Honor, we call Mr. Mike Goco to the stand. Mr. Goco, Could you please state for the record, your name, age, residence, occupation and other personal circumstances. Your Honor, we offer the testimony of Mike Goco in order: 1. To present and authenticate the certified true copies of TCTs No. M-28454 and M-28455; as well as 2. To establish the existence of an entry of preliminary attachment No. 46240 in the said Transfer Certificates of Title at the time of their inscription; 3. To establish knowledge of the buyer of the entry of preliminary attachment at the time of the sale. COURT: YOUR WITNESS. With the permission of this Honorable Court. COURT: PROCEED. Questions: 1. Could you please state your position in the Register of Deeds of Malabon? 2. Since when have you been an examiner in the Register of Deeds? 3. Is this your first time appearing in court on behalf of the Register of Deeds? a. Can you recall how many times youve already appeared before the court on behalf of the Register of Deeds? 4. Could you please inform us what are your principal duties and responsibilities as an examiner in the Register of Deeds? a. At this stage, the fact that he has knowledge with regard to the making of annotations should come out. b. In examining a title of land, do you look through and examine all of the pages of a title (including the page containing the memorandum of encumbrances)? c. In examining a title of land, what needs to happen in order for you to conclude that the title or entries therein is in order? 5. You are appearing before this court this morning by virtue of a subpoena? Correct? 6. Do you have a copy of the subpoena with you?

7. In the subpoena, you were required to present certified true copies of TCTs Nos. M-28454 and M-28455 in the name of Sps. Fernando M. Aguilar and Victoria S. Aguilar? Did you bring these with you today? May we request the Court that TCT No. M-28454 page 1 be marked as Exhibit 1, page 2 be marked as Exhibit 1A and the entry of preliminary attachment be marked as Exhibit 1B and the date of inscription be marked as Exhibit 1C. We also request that TCT No. M-28455 page 1 be marked as Exhibit 1, page 2 be marked as Exhibit 1A and the entry of preliminary attachment be marked as Exhibit 1B and the date of inscription be marked as Exhibit 1C. 8. Could you please tell us the name of the person who prepared the certified true copies of the title? 9. Who signed these certified true copies? 10. In page 2 of both TCT No. M-28454 and M-28455, there can be found an annotation, entry no. 46240, NOTIFICACION or PRELIMINARY ATTACHMENT? I would like to ask you to walk us through the creation of an entry such as this. Why is an entry such as this made in the first place? 11. Who in the Register of Deeds is in charge of making this entry? 12. What kind of information are usually included in the entry? 13. After the making of an entry, what happens next? 14. Who signs the entry? 15. After signing the entry, is there any step left to complete an annotation? 16. As an examiner and just by looking at the entries in the certified true copies of the TCTs before you, do you have any observation regarding the entries? *If Mike Goco was already part of the Register of Deeds at the time of entry of the annotation, ask him if he was able to come across the said Title?
