G.S.R. 622 (E).- Inexerciseof thepowersconferredby theproviso to article309,
andclause(5)of article148of theConstitutionandafter consultationwiththe
Comptroller andAuditor General inrelationto personsservingintheIndianAudit and
AccountsDepartment, theP resident hereby makesthefollowingrules, namely :-
1. Short titleand commencement -.
(1)Theserulesmay becalledtheCentral Civil Services(RevisedP ay)Rules,
2008.
(2)They shall bedeemedto havecomeinto forceonthe1St day of January,
2006.
2. Categories of Government servants to whom the rules apply: -
( 1 ) Saveasotherwiseprovidedby or under theserules, theserulesshall
apply to personsappointedto civil servicesandpostsinconnectionwith
theaffairsof theUnionwhosepay isdebitableto theCivil Estimatesas
also to personsservingintheIndianAudit andAccountsDepartment..
(2)Theserules shall not apply to :-
(i) personsappointedto theCentral Civil Servicesandpostsin
Groups'A', 'B', 'C' and'D' under theadministrativecontrol of the
Administrator of theUnionTerritory of Chandigarh;
(ii)personslocally recruitedfor serviceinDiplomatic, Consular or
other Indianestablishmentsinforeigncountries;
(iii)personsnot inwhole-timeemployment;
(iv)personspaidout of contingencies;
(v)personspaidotherwisethanona monthly basisincludingthose
paidonly ona piece-ratebasis;
(vi)personsemployedoncontract except wherethecontract provides
otherwise;
(vii)personsre-employedinGovernment serviceafter retirement;

any other classor category of personswhomtheP resident may,
by order, specifically excludefromtheoperationof all or any of
theprovisionscontainedintheserules.
3. Definitions- Intheserules, unless thecontext otherwiserequires-
( 1 ) "existingbasic pay"meanspay drawnintheprescribedexistingscaleof
pay, includingstagnationincrement(s), but doesnot includeany other
typeof pay like'special pay', etc.
(2)"existingscale"inrelationto a Government servant meansthepresent
scale applicableto thepost heldby theGovernment servant (or, asthe
case may be, personal scaleapplicableto him)asonthe1st day of January,
2006whether ina substantiveor officiatingcapacity.
( 3 )
Explanation- Inthecaseof a Government servant, who wasonthe1st
day of January, 2006ondeputationout of India or onleave
or onforeignservice, or who wouldhaveonthat date
officiatedinoneor morelower postsbut for hisofficiating
ina higher post, "existingscale"includesthescale
applicableto thepost whichhewouldhaveheldbut for his
beingondeputationout of India or onleaveor onforeign
serviceor, asthecasemay be, but for hisofficiatingina
higher post;
"existingemoluments"meanthesumof (i)existingbasic pay, (ii)
dearnesspay appropriateto thebasic pay and(iii)dearnessallowance
appropriateto thebasic pay '+ dearnesspay at indexaverage536
(1982=100).
(4)"present scale"inrelationto any post/gradespecifiedincolumn2 of the
First Schedulemeansthescaleof pay specifiedagainst that post in
column3 thereof;
( 5 ) "pay inthepay band" means pay drawnintherunningpay bands
specifiedinColumn5of theFirst Schedule.
(6)"gradepay"isthefixedamount correspondingto thepre-revisedpay
scales/ posts.
( 7)
"revisedpay structure"inrelationto any post specifiedincolumn2 of
theFirst Schedulemeansthepay bandandgradepay specifiedagainst
that post or thepay scalespecifiedincoltimn5&6thereof, unlessa
different revisedpay bandandgradepay or pay scaleisnotified
separately for that post.
(8)"basic pay"intherevisedpay structuremeans thepay drawninthe
prescribedpay bandplustheapplicablegradepay but doesnot include
any other typeof pay likespecial pay, etc.
I n the case of Government servants in the pay scales of HAG+, apex scale
and the Cabinet Secretary's scale, basic pay means the pay in the
prescribed scale.

"revised emoluments" means the pay in the pay band plus the grade pay
of a Government servant in the revised pay structure or the basic pay in
HAG+ &aboveand includes the revised non-practising allowance, if any,
admissible to him, in addition.
(10)"Schedule"meansa scheduleannexedto theserules.
4. Scale of pay of posts -
Thepay bandandgradepay or thepay scale, as
applicable, of every post/ gradespecifiedincolumn2 of theFirst Scheduleshall beas
specifiedagainst it incolumn5&6thereof.
5. Drawal ofpay inthe rev ised pay structure- Saveasotherwiseprovidedinthese
rules, a Government servant shall draw pay intherevisedpay structureapplicableto the
post to whichheisappointed;
P rovidedthat a Government servant may elect to continueto draw pay inthe
existingscaleuntil thedateonwhichheearnshisnext or any subsequent increment in
theexistingscaleor until hevacateshispost or ceasesto draw pay inthat scale.
P rovidedfurther that incaseswherea Government servant hasbeenplacedina
higher pay scalebetween1.1.2006andthedateof notificationof theseRulesonaccount
of promotion, upgradationof pay scaleetc., theGovernment servant may elect to switch
over to therevisedpay structurefromthedateof suchpromotion, upgradation, etc.
Explanation1- Theoptionto retaintheexistingscaleunder theprovisosto thisrule
shall beadmissibleonly inrespect of oneexistingscale.
Explanation2 - Theaforesaidoptionshall not beadmissibleto any personappointedto
apost onor after the1st day of January, 2006, whether for thefirst time
inGovernment serviceor by transfer fromanother post andheshall be
allowedpay only intherevisedpay structure.
Explanation3 - Wherea Government servant exercisestheoptionunder theprovisos
to thisruleto retaintheexistingscaleinrespect of a post heldby him
in an officiatingcapacity ona regular basisfor thepurposeof
regulationof pay inthat scaleunder Fundamental Rule22, or any other
ruleor order applicableto that post, hissubstantivepay shall be
substantivepay whichhewouldhavedrawnhadheretainedthe
existingscaleinrespect of thepermanent post onwhichheholdsa lien
or wouldhavehelda lienhadhisliennot beensuspendedor thepay of
theofficiatingpost whichhasacquiredthecharacter of substantivepay
inaccordancewithany order for thetimebeinginforce, whichever is
higher.
6. Exerciseof Option -
( 1 ) Theoptionunder theprovisosto Rule5shall beexercisedinwritingin
theformappendedto theSecondScheduleso asto reachtheauthority
mentionedinsubrule(2)withinthreemonthsof thedateof publication
of theserulesor whereanexistingscalehasbeenrevisedby any order

madesubsequent to that date, withinthreemonthsof thedateof such
order.
P rovidedthat -
inthecaseof a Government servant who is, onthedateof such
publicationor, asthecasemay be, dateof suchorder, out of India
onleaveor deputationor foreignserviceor activeservice, the
saidoptionshall beexercisedinwriting
so as to reachthesaid
authority withinthreemonthsof thedateof histakingchargeof
hispost inIndia; and
(i)
(ii)wherea Government servant isunder suspensiononthe1st day of
January, 2006, theoptionmay be- exercisedwithinthreemonthsof
thedateof hisreturnto hisduty if that dateislater thanthedate
prescribedinthissub-rule.
(2)Theoptionshall beintimatedby theGovernment servant to theHeadof
hisOffice.
(3)
If theintimationregardingoptionisnot receivedwithinthetime
mentionedinsub-rule(1), theGovernment servant shall bedeemedto
haveelectedto begovernedby therevisedpay structurewitheffect on
andfromthe1st day of January, 2006.
(4)Theoptiononceexercisedshall befinal.
Note 1-
P ersonswhoseserviceswereterminatedonor after the1st January, 2006and
who couldnot exercisetheoptionwithintheprescribedtimelimit, on
account of dischargeontheexpiry of thesanctionedposts, resignation,
dismissal or dischargeor disciplinary grounds, areentitledto thebenefitsof
thisrule.
Note 2 -
P ersonswho havediedonor after the1st day of January, 2006andcouldnot
exercisetheoptionwithintheprescribedtimelimit aredeemedto have
optedfor therevisedpay structureonandfromthelst day of January, 2006
or suchlater dateasismost beneficial to their dependents, if therevisedpay
structureismorefavourableandinsuch
cases,
necessary actionfor payment
of arrearsshouldbetakenby theHeadof Office.
Note 3 -
P ersonswho wereonearnedleaveor any other leaveon1.1.2006which
entitledthemto leavesalary will beallowedthebenefitsof thisrule.
7. Fixationof initial
pay inthe rev ised pay structure:
(1)
Theinitial pay of a Government servant who elects, or isdeemedto have
electedunder sub-rule(3)of rule6to begovernedby therevisedpay
structureonandfromthe1st day of January, 2006, shall, unlessinany case
theP resident by special order otherwisedirects, befixedseparately in
respect of hissubstantivepay inthepermanent post onwhichheholdsa-
lienor wouldhavehelda lienif it hadnot beensuspended, andinrespect

of hispay intheofficiatingpost heldby him, inthefollowingmanner,
namely :-
(A)inthecaseof all employees:-
( i)
thepay inthepay band/pay scalewill bedeterminedby
multiplyingtheexistingbasic pay ason1.1.2006by afactor of 1.86
androundingoff theresultant figureto thenext multipleof 10.
(ii)if theminimumof therevisedpay band/ pay scaleismorethan
theamount arrivedat asper (i)above, thepay shall befixedat the
minimumof therevisedpay band/ pay scale;
P rovidedfurther that:-
Where, inthefixationof pay, thepay of Government servants
drawingpay at two or moreconsecutivestagesinanexistingscale
getsbunched, that isto say, getsfixedintherevisedpay structure
at thesamestageinthepay band, then, for every two stagesso
bunched, benefit of oneincrement shall begivenso asto avoid
bunchingof morethantwo stagesintherevisedrunningpay
bands. For thispurpose, theincrement will becalculatedonthe
pay inthepay band. Gradepay wouldnot betakeninto account
for thepurposeof grantingincrementsto alleviatebunching.
Inthecaseof pay scalesinhigher administrativegrade(HAG)in
thepay bandP B-4, benefit of incrementsdueto bunchingshall be
giventakinginto account all thestagesindifferent pay scalesin
thisgrade. Inthecaseof HAG+ scale, benefit of oneincrement for
every two stagesinthepre-revisedscalewill begrantedinthe
revisedpay scale.
If by steppingup of thepay asabove, thepay of a Government
servant getsfixedat a stageintherevisedpay band/ pay scale
(whereapplicable)whichishigher thanthestageintherevised
pay bandat whichthepay of a Government servant who was
drawingpay at thenext higher stageor stagesinthesameexisting
scaleisfixed, thepay of thelatter shall also besteppedup only to
theextent by whichit fallsshort of that of theformer.
Thepay inthepay bandwill bedeterminedintheabovemanner.
Inadditionto thepay inthepay band, gradepay correspondingto
theexistingscalewill bepayable.
Note - Illustration1 ontheaboveisprovidedintheExplanatory
Memorandumto theseRules.
(B)Inthecaseof employeeswho areinreceipt of special pay/allowancein
additionto pay intheexistingscalewhichhasbeenrecommendedfor
replacement by a pay bandandgradepay without any special
pay/allowance, pay shall befixedintherevisedpay structurein
accordancewiththeprovisionsof clause(A)above.

(C)Inthecaseof employeeswho areinreceipt of special pay component with
any other nomenclatureinadditionto pay intheexistingscales, suchas
personal pay for promotingsmall family norms, special pay to P arliament
Assistants, Central (DeputationonTenure)Allowance, etc., andinwhose
casethesamehasbeenreplacedintherevisedpay structurewith
correspondingallowance/pay at thesamerateor at a different rate, the
pay intherevised
pay
structureshall befixedinaccordancewiththe
provisionsof clause(A)above. Insuchcases, theallowanceat thenew
rateasrecommendedshall bedrawninadditionto pay intherevisedpay
structurefromthedatespecifiedintheindividual notificationsrelatedto
theseallowances.
(D)Inthecaseof medical officerswho areinreceipt of non-practising
allowance, thepay intherevisedpay structureshall befixedin
accordancewiththeprovisionsof clause(A)aboveexcept that, insuch
cases, thepre-reviseddearnessallowanceappropriateto thenon-
practisingallowanceadmissibleat indexaverage536(1982 = 100)shall be
addedwhilefixingthepay intherevisedpay band, andinsuchcases,
non-practisingallowanceat thenew ratesshall bedrawnwitheffect from
1.1.2006or thedateof optionfor revisedpay structure, inadditionto the
pay so fixedintherevisedpay structure.

Note 1-
(a)Inthecaseof Group D employees, thepay intherevisedpay structure
will befixedinitially inthe-1S pay bandasper Clause(A)abovewiththe
appropriategradepay andarrearspaidaccordingly. Thereafter, pay of such
of thoseGroup D employeeswho already possesstherevisedminimum
qualificationsrecommendedby theCommissionprescribedfor entry into
P B-1wouldbefixedwitheffect from1.1.2006inP B-1withgradepay of
Rs.1800.
(b)Suchof thoseexistingGroup D employeeswho do not possessthe
revisedminimumqualificationsfor entry into P B-1wouldberetrainedby
theconcernedDepartment preferably withina periodof sixmonthsso that
payment of arrearsonaccount of upgradationarenot delayed. After re-
training, theseGroup D staff will also beplacedintheP ay BandP B-1with
thegradepay of Rs.1800 witheffect from1.1.2006andarrearsdrawn
accordingly. OnceplacedintheP B-1P ay Band, thiscategory of Group D
staff will regaintheir seniority vis-a-vistheother category of Group D staff
that already possessedtheminimumqualificationsandwere, therefore,
placedintheP B-1P ay Bandason1.1.2006. Inter-seseniority of all the
employeesinerstwhileGroup D will befully maintainedwithGroup D
employeeina higher pre-revisedpay scalebeingplacedhigher vis-a-visan
employeeina lower pay scale. Withinthesamepre-revisedpay scale,
seniority whichexistedprior to revisionwouldcontinue.
(c)Arrearsshall bepayablewitheffect from1.1.2006inboththecasesi.e. to
thoseGroup D employeeswho possessthequalificationsandareplacedin
P B-1straight away andthoseGroup D employeeswho do not possessthe
qualificationsandareplacedafter re-training.

Note 2 A - Wherea post has been upgraded as a result of therecommendations of the
SixthCP Cas indicated in Part B or Part Cof theFirst Schedule to these
Rules, the fixation of pay in the applicable pay bandwill bedone in the
manner prescribed in accordance with Clause (A)(i)and(ii)of Rule7by
multiplying the existing basic pay as on 1.1.2006by a factor of 1.86and
rounding the resultant figure to the next multiple of ten. Thegradepay
corresponding to the upgraded scale as indicated in Column 6of P art B or C
will bepayable in addition.Illustration4Ain this regard is in the

Note 3 - A Government servant who isonleaveonthe1st day of January, 2006andis
entitled to leave salary shall become entitled to pay in the revised pay
structure from 1.1.2006 or the date of option for the revised pay structure.
Similarly, where a government servant is on study leave on the first day of
January, 2006 he will be entitled to the benefits under these Rules from
1.1.2006 or the date of option.
Note 4- AGovernment servant under suspension, shall continue to draw subsistence
allowance based on existing scale of pay and his pay in the revised pay
structure will be subject to the final order on the pending disciplinary
proceedings.
Note 5 - Wherea Government servant isholdinga permanent post andisofficiating
in a higher post on a regular basis and the scales applicable to these two
posts are merged into one scale, the pay shall be fixed under this sub-rule
with reference to the officiating post only, and the pay so fixed shall be
treated as substantive pay.
T he provisions of this Note shall apply mutatis mutandis, to Government
servants holding in an officiating capacity, posts on different existing scales
which have been replaced by the revised pay structure.
Note 6- Where the 'existing emoluments' exceed the revised emoluments in the case
of any Government servant, the difference shall be allowed as personal pay
to be absorbed in future increases in pay.
Note 7 - Whereinthefixationof pay under sub-rule(1), thepay of a Government
servant, who, in the existing scale was drawing immediately before the 1st
day of January, 2006morepay thananother Government servant junior to
him in the same cadre, gets fixed in the revised pay band at a stage lower

thanthat of suchjunior, hispay shall besteppedupto thesamestageinthe
revisedpay bandasthat of thejunior.
Note 8 - Wherea Government servant isinreceipt of personal pay onthe1st day of
January, 2006, whichtogether withhisexistingemolumentsexceedsthe
revisedemoluments, then, thedifferencerepresentingsuchexcessshall be
allowedto suchGovernment servant aspersonal pay to beabsorbedin
futureincreasesinpay.
Note 9 - Inthecaseof employeeswho areinreceipt of personal pay for passingHindi
P ragya, Hindi Typewriting, Hindi Shorthandandsuchother examinations
under the"Hindi TeachingScheme", or onsuccessfully undergoingtraining
incashandaccountsmattersprior to the1st day of January, 2006, whilethe
personal pay shall not betakeninto account for purposesof fixationof initial
pay intherevisedpay structure, they wouldcontinueto draw personal pay
after fixationof their pay intherevisedpay structureonandfromthe1st day
of January, 2006or subsequently for theperiodfor whichthey wouldhave
drawnit but for thefixationof their pay intherevisedpay structure. The
quantumof suchpersonal pay wouldbepaidat theappropriaterateof
increment intherevisedpay structurefromthedateof fixationof pay for the
periodfor whichtheemployeewouldhavecontinuedto draw it.
Explanation- For thepurposeof thisNote, "appropriaterateof increment
intherevisedpay structure"means3% of thesumof the
pay inthepay bandandthegradepay at thestageat which
thepay of theemployeeisfixedintherevisedpay
structure.
Note 10- Incaseswherea senior Government servant promotedto a higher post
beforethe1st day of January, 2006drawslesspay intherevisedpay structure
thanhisjunior who ispromotedto thehigher post onor after the1st day of
January, 2006, thepay inthepay bandof thesenior Government servant
shouldbesteppedup to anamount equal to thepay inthepay bandasfixed
for hisjunior inthat higher post. Thesteppingup shouldbedonewitheffect
fromthedateof promotionof thejunior Government servant subject to the
fulfillment of thefollowingconditions, namely:-
(a)boththejunior andthesenior Government servantsshouldbelongto
thesamecadreandthepostsinwhichthey havebeenpromoted
shouldbeidentical inthesamecadre.
(b)
thepre-revisedscaleof pay andtherevisedgradepay of thelower
andhigher postsinwhichthey areentitledto draw pay shouldbe
identical.
(c)thesenior Government servantsat thetimeof promotionshouldhave
beendrawingequal or morepay thanthejunior.
(d)theanomaly shouldbedirectly asa result of theapplicationof the
provisionsof Fundamental Rule22 or any other ruleor order
regulatingpay fixationonsuchpromotionintherevisedpay
structure. If eveninthelower post, thejunior officer wasdrawing
morepay inthepre-revisedscalethanthesenior by virtueof any

advanceincrementsgrantedto him, provisionof thisNoteneednot
beinvokedto step up thepay of thesenior officer.
(2)Subject to theprovisionsof rule5, if thepay asfixedintheofficiatingpost
under sub-rule(1)islower thanthepay fixedinthesubstantivepost, the
former shall befixedat thesamestageasthesubstantivepay.
8. Fixation of pay in the revised pay structure of employees appointed as fresh
recruits on or after
1.1.2006- SectionII of P art A of theFirst Scheduleof theseRules

indicatestheentry level pay inthepay bandat whichthepay of direct recruitsto a
particular post carryingaspecific gradepay will befixedonor after 1.1.2006.
Thiswill also beappliedinthecaseof thoserecruitedbetween1.1.2006andthe
dateof issueof thisNotification. Insuchcases, wheretheemolumentsinthepre-revised
pay scale(s)[i.e., basic pay inthepre-revisedpay scale(s)plusDearnessP ay plus
DearnessAllowanceapplicableonthedateof joining]exceedsthesumof thepay fixed
intherevisedpay structureandtheapplicabledearnessallowancethereon, the
differenceshall beallowedaspersonal pay to beabsorbedinfutureincrementsinpay.
9. Rate of increment in the revised pay structure
-Therateof increment inthe
revisedpay structurewill be3% of thesumof thepay inthepay bandandgradepay
applicable, whichwill beroundedoff to thenext multipleof 10. Theamount of
increment will beaddedto theexistingpay inthepay band.

inthis
regardisintheExplanatory Memorandumto theseRules. Inthecaseof P B-3, variable
ratesof increment at 3% and4% havebeenprovided. Thehigher rateof increment will
begrantedto not morethan20% of thestrengthof officersinP B-3.
10.
Date of next increment in the revised pay structure
- Therewill beauniformdate
of annual increment, viz. 1st July of every year. Employeescompleting6monthsand
aboveintherevisedpay structureason1st of July will beeligibleto begrantedthe
increment. Thefirst increment after fixationof pay on1.1.2006intherevisedpay
structurewill begrantedon1.7.2006for thoseemployeesfor whomthedateof next
increment wasbetween1st July, 2006to 1st January, 2007.
P rovidedthat inthecaseof personswho hadbeendrawingmaximumof the
existingscalefor morethana year asonthe1st day of January, 2006, thenext increment
intherevisedpay structureshall beallowedonthe1st day of January, 2006. Thereafter,
theprovisionof Rule10 wouldapply.
P rovidedthat incaseswhereanemployeereachesthemaximumof hispay band,
shall beplacedinthenext higher pay bandafter oneyear of reachingsucha maximum.
At thetimeof placement inthehigher pay band, benefit of oneincrement will be
provided. Thereafter, hewill continueto moveinthehigher pay bandtill hispay inthe
pay bandreachesthemaximumof P B-4, after whichno further incrementswill be
granted.
Note 1-
Incaseswheretwo existingscales, onebeinga promotional scalefor the
other, aremerged, andthejunior Government servant, now drawinghispay
at equal or lower stageinthelower scaleof pay, happensto draw morepay
inthepay bandintherevisedpay structurethanthepay of thesenior
Government servant intheexistinghigher scale, thepay inthepay bandof
thesenior government servant shall besteppedup to that of hisjunior from
thesamedateandheshall draw next increment inaccordancewith-Rule10.

11. Fixation of pay i
nthe rev ised pay structure subsequent to the 1St day
of January,
2 006. -
Wherea Government servant continuesto draw hispay intheexistingscaleand
isbrought over to therevisedpay structurefroma datelater thanthe1st day of January,
2006, hispay fromthelater dateintherevisedpay structureshall befixedinthe
followingmanner:-
(i)
P ay inthepay bandwill befixedby addingthebasic pay applicableonthe
later date, thedearnesspay applicableonthat dateandthepre-revised
dearnessallowancebasedonratesapplicableason1.1.2006. Thisfigure
will beroundedoff to thenext multipleof 10 andwill thenbecomethepay
intheapplicablepay band. Inadditionto this, thegradepay
correspondingto thepre-revisedpay scalewill bepayable. Wherethe
Government servant isinreceipt of special pay or non-practising
allowance, themethodology followedwill beasprescribedinRule7(i), (B),
(C)or (D)asapplicable, except that thebasic pay anddearnesspay to be
takeninto account will bethebasic pay anddearnesspay applicableason
that datebut dearnessallowancewill becalculatedasper ratesapplicable
on1.1.2006.
12. Fixationof pay onreappointment
after the 1St day ofJanuary , 2 006to apost held
prior to that date -
A Government servant who hadofficiatedina post prior to the1st
day of January, 2006but wasnot holdingthat post onthat dateandwho onsubsequent
appointment to that post drawspay intherevisedpay structureshall beallowedthe
benefit of theproviso to Fundamental Rule22, to theextent it wouldhavebeen
admissiblehadhebeenholdingthat post onthe1st day of January, 2006, andhadelected
therevisedpay structureonandfromthat date.
13.
Fixation of pay on promotion on or after 1.1.2006
- Inthecaseof promotionfrom
onegradepay to another intherevisedpay structure, thefixationwill bedoneas
follows:-
(i)
Oneincrement equal to 3% of thesumof thepay inthepay bandandthe
existinggradepay will becomputedandroundedoff to thenext multipleof
10. Thiswill beaddedto theexistingpay inthepay band. Thegradepay
correspondingto thepromotionpost will thereafter begrantedinadditionto
thispay inthepay band. Incaseswherepromotioninvolveschangeinthe
pay bandalso, thesamemethodology will befollowed. However, if thepay
inthepay bandafter addingtheincrement islessthantheminimumof the
higher pay bandto whichpromotionistakingplace, pay inthepay handwill
besteppedto suchminimum.
(ii)Inthecaseof promotionfrom. P B-4 to HAG+, after addingoneincrement in
themanner prescribedinRule9, thepay inthepay bandandexistinggrade
pay will beaddedandtheresultant figurewill becomethebasic pay in
HAG+. Thisshall not exceedRs. 80,000, themaximumof thescale. For
Government servantsinreceipt of NP A, pay plusNP A will not exceedRs.
85,000.
14. Mode of payment of arrears of pay -
Thearrearsshall bepaidincashintwo
instalments. Thefirst instalment shouldberestrictedto 40% of thetotal arrears. The
remaining60% of arrearsshouldbepaidduringthenext financial year.

Explanation- For thepurposesof thisrule:
(a)"arrearsof pay"inrelationto a Government servant, meansthe
differencebetween:
(i) theaggregateof thepay andallowancesto whichheisentitled
onaccount of therevisionof hispay andallowancesunder
theserules,for therelevant period. Revisedallowances
(except for dearness allowance andnon-practisingallowance)
will bepayableonly witheffect from1.9.2008; and
theaggregateof thepay andallowancesto whichhewould
havebeenentitled(whether such'pay andallowanceshad
beenreceivedor not)for that periodhadhispay and
allowancesnot beenso revised.
(b)"relevant period"meanstheperiodcommencingonthe1st day of
January, 2006andendingwiththe31st August, 2008.
15. Overriding effect ofRules - Theprovisionsof theFundamental rules, theCentral
Civil Services(Revisionof P ay)Rules, 1947, theCentral Civil Services(RevisedP ay)
Rules, 1960, theCentral Civil Services(RevisedP ay) Rules, 1973, Central Civil Services
(RevisedP ay)Rules, 1986andCCS (RevisedP ay)Rules, 1997shall not, saveasotherwise
providedintheserules, apply to cases wherepay isregulatedunder theserules, to the
extent they areinconsistent withtheserules.
16. Powerto relax - WheretheP resident issatisfiedthat theoperationof all or any
of theprovisionsof theserulescausesunduehardship inany particular case,hemay, by
order, dispensewithor relaxtherequirementsof that ruleto suchextent andsubject to
suchconditionsashemay consider necessary for dealingwiththecaseina just and
equitablemanner.
17. Interpretation- If any questionarises relatingto theinterpretationof any of the
provisionsof theserules, it shall bereferredto theCentral Government for decision.

MEMORANDUMEXP LANATORY TO THE CENTRAL CIVIL SERVICES
(REVISED P AY)RULES, 2008
Rule1- Thisruleisself-explanatory.
Rule2 - Thisrulelaysdownthecategoriesof employeesto whomtherulesapply.
Except for thecategoriesexcludedunder clause(2), therulesareapplicableto all persons
under therulemakingcontrol of theP resident servinginDepartmentspaidfromCivil
Estimates. They do not apply to theemployeesunder theMinistry of Railwaysand
civilianpersonnel paidfromDefenceServicesEstimates, for whomseparateruleswill be
issuedby theMinistriesconcerned. Therulesdo not also apply to GraminDakSevaks
intheDepartment of P osts. Therules, however, apply to workchargedestablishments.
Rule3 &4 - Theserulesareself-explanatory.
Rule5- Theintentionisthat all Government servantsshouldbebrought over to the
revisedpay structureexcept thosewho elect to draw pay intheexistingscales. Those
who exercisetheoptionto continueontheexistingscalesof pay will continueto draw
thedearnessallowanceat theratesinforceonthe1st January, 2006andthedearness
allowancewill count towardstheemolumentsfor pension, etc. to theextent it so counted
onthesaiddate. If a Government servant isholdinga permanent post ina substantive
capacity andofficiatingina higher post, or wouldhaveofficiatedinoneor moreposts
but for hisbeingondeputationetc., hehastheoptionto retaintheexistingscaleonly in
respect of onescale. Sucha Government servant may retaintheexistingscaleapplicable
to a permanent post or any oneof theofficiatingposts. Inrespect of theremainingposts
hewill necessarily haveto bebrought over to therevisedpay structure.
Rule6- Thisruleprescribesthemanner inwhichoptionhasto beexercisedandalso the
authority who shouldbeapprisedof suchoption. Theoptionhasto beexercisedinthe
appropriateformappendedto therules. It shouldbenotedthat it isnot sufficient for a
Government servant to exercisetheoptionwithinthespecifiedtimelimit but also to
ensurethat it reachestheprescribedauthority withinthetimelimit. Inthecaseof
personswho areoutsideIndia at thetimetheserulesarepromulgated, theperiodwithin
whichtheoptionhasto beexercisedisthreemonthsfromthedatethey takeover charge
of thepost inIndia. Inthecaseof Government servantstherevisedpay structureof
whosepostsareannouncedsubsequent to thedateof issueof theserules, theperiodof
threemonthswill runfromthedateof suchannouncement.
P ersonswho haveretiredbetween1st January 2006andthedateof issueof theserules
arealso eligibleto exerciseoption.
Rule7(1)- Thisruledealswiththeactual fixationof pay intheexistingscaleson1st
January, 2006. A few illustrationsindicatingthemanner inwhichpay of Government
servantsshouldbefixedunder thissub-rulesubject to steppingup of pay under Notes
below rule7(1)aregivenintheattachedAnnexure.

Rule7(2)- Thebenefit of thisruleisnot admissibleincaseswherea Government servant
haselectedtherevisedpay structureinrespect of hissubstantivepost, but hasretained
theexistingscaleinrespect of anofficiatingpost.
Rule8- ThisRuleprescribesthemethodof fixationof pay of employeesappointedas
freshrecruitsonor after 1.1.2006.
Rule9 &10 - Theserulesprescribethemanner inwhichthenext increment inthenew
scaleshouldberegulated. Theprovisosto thisruleareintendedto eliminatethe
anomaliesof junior Government servantsdrawingmorepay thantheir senior by the
operationof substantivepart of thisruleandalso takingcareof theGovernment
servantswho havebeendrawingpay at themaximumof theexistingscalefor morethan
oneyear ason1.1.2006andalso thoseGovernment servantswho havebeenstagnatingat
themaximumof theexistingscaleandareactually inreceipt of stagnationincrement on
adhoc basis.
