TOWN OF PAOLI, INDIANA ORDINANCE 2013-08 AN ORDINANCE ADOPTING CHAPTER 76, ATV, DIRT BIKE, AND GO CART USE

PROHIBITED

WHEREAS, it is necessary for the Town Council of the Town of Paoli, Indiana (the Town) to address the use of ATVs, dirt bikes, and go carts in the Town of Paoli; WHEREAS, a to protect the citizens of and visitors to the Town, it is necessary for the Town to prohibit the use of ATVs, dirt bikes, and/or go cart upon the public streets, alleys, and sidewalks within the Town; NOW, THEREFORE BE IT ORDAINED by the Town Council of the Town of Paoli, Indiana, that this Ordinance prohibiting the use of ATVs, dirt bikes, and/or go carts shall be codified at Chapter 76 of the Code of Ordinances of the Town of Paoli, Indiana as follows: CHAPTER 76: ATV, DIRT BIKE, AND GO CART USE PROHIBITED Section 76.1 76.2 76.3 Definitions Use of ATVs, dirt bikes, and/or go carts prohibited Penalty for violation

76.01 DEFINITIONS For the purpose of this Chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning: (a) All-Terrain Vehicles (ATV). Means and includes every motorized, off-highway vehicle that: (1) is fifty (50) inches or less in width; (2) has a dry weight of twelve hundred (1,200) pounds or less; (3) is designed for travel on at least three (3) non-highway or offhighway tires; (4) is designed for recreational use by one (1) or more individuals;

has a seat or saddle designed to be straddled by the operator; and has handlebars for steering control.

Dirt Bike. Means and includes every two (2) wheeled vehicle being capable of cross-country travel on natural terrain without benefit of a road or trail. Go Cart. Means and includes every motorized miniature vehicle capable of achieving speeds in excess of ten miles per hour and commonly used on courses or race tracks specifically designed for such vehicles. Street. Means and includes any public street, avenue, road, boulevard, highway, alley or other public place located in the Town. Sidewalk. Means and includes every part of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians located in the Town. 76.02 USE OF ATVS, DIRT BIKES, AND/OR GO CARTS PROHIBITED To protect the citizens of and visitors to the Town, the use of ATVs, dirt bikes, and/or go carts is prohibited upon the public streets, alleys, and sidewalks within the town. (Ord. 2013-08, passed 10-15-13) 76.03 PENALTY FOR VIOLATION.
Any person who shall violate any provision of this Ordinance shall, upon conviction thereof, be fined not less than Twenty Five Dollars ($25.00) nor more than One Hundred Dollars ($100.00) for the first violation. Second and subsequent violations will result in a fine of not less than Fifty Dollars ($50.00) nor more than Two Hundred Dollars ($200.00). In the event of a continuing or maintaining of a violation of any section of this chapter, any person, firm or corporation causing or maintaining said nuisance shall upon conviction, be fined in a sum not less than Five Hundred Dollars ($500.00).
