Harmonised Surveys and Certification

Fully implemented

The Harmonised System of Survey and Certification (HSSC) entered into force for Malaysia on 11 February 2012. Refer to MTN 2012/04 for details regarding how the HSSC is to be implemented. Amember of the Lloyd's Register Group (hereinafter referred to as LR) is required to send acopy of the initial certificates issued to each vessel by LR to the administration via LR Kuala Lumpur. LR is not required to send copies of subsequent certificates unless requested by the Administration.

Short Term Certificates LR is allowed to issue short term certificates valid for a maximum period of 2 months for the following conditions: l repairs can not be carried out at the port where the deficiency was found or reported; (this is only valid for navigation and radio equipment (malfunctioning) and LSA and FFA equipment (malfunctioning, servicing or testing) l spare parts are not available at the port where the deficiency was found or reported; (this is only valid for navigation and radio equipment (malfunctioning)and LSA and FFA equipment (malfunctioning, servicing or testing) In both cases the owners shall, withintwo weeksof thedate of issuance of the certificates, report to the Administration Ship Accreditation Unit with all relevant supporting documents including nature of deficiency, reason for non-rectification and proposed corrective action. or l Equivalent or alternative arrangements or temporary measures have been provided to the satisfaction of the attending surveyor in accordance with statutory requirements. Dependant on the port of registry the contacts are as follows (for contact details please see above): Port of Registry: l Port Kelang and Penang for West Malaysia (Port Klang should not be used as a Port of Registry on statutory certificates) l Kuching for Sarawak, East Malaysia l Labuan and Kota Kinabalu for Sabah, East Malaysia

Exemptions, waivers, extensions of certificates

LR is required to obtain authorisation from the Administration to issue any exemption certificates. The one exception to this is that LR is allowed to issue an exemption certificate (without contacting the Administration) for vessels constantly engagedon voyages between 30' North and 30' South (except bulk carriers), which do not have to comply with the requirements of SOLAS Regulation III/32.3.2 (carriage of an immersion suit for each person on board).

Extensions to Dry Docking Surveys LR is allowed to extend dry docking survey for a maximum period of three months from the due date as long as the following conditions have been met: l In cases where a dry docking is required, but cannot be carried out, an underwater inspection of the ship bottom is to be carried out before the nominal Docking Survey due date;

COLREG exemptions LR is authorised to issue exemptions to the COLREGS for vessels of less than 60 metres length overall (LOA). Ships for usage in specific operation are exempted from adhering to the requirements of COLREGs as stated below: l Regulation 23(a)(ii) l Regulation 2(i)(i), Annex I provided that the vertical distance between lights is not less than 1 metre. The above exemption is only applicable to ships with LOA less than 100 metres.

l In cases where an underwater inspection is not possible (e.g. poor visibility, draft restrictions, excessive current, refusal by port Authority), an internal inspection of the ship bottom structure, to the maximum extent practicable is to be carried out; l In cases of extensions of not more than one month in lieu of underwater inspection of vessel bottom, a general examination afloat to determine the vessel's fitness for continued service during the extension period. This should include theexamination and testing of steering machinery as considered necessary, review of onboard records to confirm satisfactory operation of the propulsion machinery, and that no damages and/or groundings have occurred since the last attendance byLR. In addition external examination of the saltwater systems with particular attention to non'metallic expansion pieces (if Fitted), sea valves and their attachment to sea chest/side shell should also be carried out. Extensions to Dry Docking Surveys may be granted for the following reasons: l Unavailability of dry docking or repair facilities or unavailability of essential material, equipment or spare parts for dry docking; l Delays incurred by action to avoid severe weather; l Unanticipated delays at loading/discharge facilities. Extensions to Dry Docking Surveys may NOT be granted for commercial reasons. Owners are to inform the Ship Accreditation Unit of the Administration, and send any supporting documentation,one month prior to the due date if the intention is to delay the dry-docking survey beyond the due date. Authorisation for issuing extensions is valid for all types of vessels that are less than 10 years old.

Requirements General

EU Marine Equipment Directive Malaysia will accept equipment approved for compliance with the EU Marine Equipment Directive. Requirements for FPSOs and FSOs FPSOs and FSOs are to be surveyed and issued certificates as an oil tanker. The following certificatesshould be issued: Loadline, IOPP, Tonnage, SAFCON and Safety Equipment. FPSOs and FSOs built or keel laid or that underwent a major conversion after 1 January 2011 are to comply with the MODU Code.

Passenger Vessels, High Speed Craft, Special Purpose Ships, Propelled Accommodation Barges carrying more than 12 personnel and non-convention vessels Authorisation must be obtained from the Administration before carrying out surveys and issuing certificates. Requirements for FPSOs and FSOs FPSOs and FSOs are to be surveyed and issued certificates as an Oil Tanker Requirements for Crew Boats Authorisation must be obtained from the Administration before carrying out surveys and issuing certificates. Crew boats or fast crew boats carrying industrial personnel are to comply with: l Intact Stability Code - IMO Res 749(18) and Damage Stability - Offshore Supply Vessel Code (IMO Res A.235(82)) l LSA, FFA, Radio, Navigational Equipment; IACS Recommendation for Non-convention Size Vessel Rules (unrestricted voyage). l Construction - Crew Boat or High Speed Craft Class Rules l All applicable International Convention requirements. Requirements for Accommodation Barge (non-propelled) Authorisation must be obtained from the Administration before carrying out surveys and issuing certificates. The following certificatesshould be issued: l all applicable Convention certificates; l non-convention Safety Equipment and SAFCON Certificates (for vessels built before 6 November 2008)or l MODU Certificate (for vessels built on or after 1 November 2008). Requirements for Special Purpose Ship (Maintenance/Utility or Work Boat) Special Purpose Ships carrying industrial personnel are to comply with: l all applicable International Convention Requirements l SPS Code - the 2008 SPS Code supersedes the SPS Code (Resolution A.534(13)). The revised Code will be applied for vessels with a keel laying date or built on or after 1 January 2009. Malaysian vessels meeting the criteria of a special purpose ships under this Code are to obtain authorisation from the Administration for survey and certification. l Special Purpose Code (Resolution A.534(13)). Vessels built or with contracts signed prior to 31 December 2007 may comply with the Offshore Supply Vessel Code (ships complying with the OSV Code are limited to operation in the Malaysian Near Coastal Limit as defined by Malaysian Shipping Ordinance or 200 nautical miles from land and the number of industrial personnel is limited to 200).

Technical Requirements

Fire Plans, Safety Plans, Instruction and Safety Signs must be translated to Bahasa Malaysia. Organisations authorised to approve the translations are Dewan Bahasa dan Pustaka, Saz Marine Services Sdn, Bhd. and Institute terjemahan Negara Malaysia.

Periodical inspection and maintenance of permanently installed fire extinguishing systems, portable fire extinguishers and air cylinders of breathing apparatus All types of permanently installed fire-fighting systems, all types of portable fire extinguishers and breathing apparatus air cylinders must be subjected to periodical inspection and maintenance every year by approved shore based service stations or related government agency. The attending surveyor may require, based on the results of a periodical inspection, certain containers to be, also, tested hydrostatically. Hydrostatic testing is also required after repair. Where the loss of content exceeds 10% for CO2 and 5% for halon, the container must be recharged. Fixed gas fire-extinguishing systems Annual inspections should be carried out by a ship officer or engineer or authorised agent. 10% of high pressure containers should be hydraulically tested during each 10 year period or 100% of the containers after 20 years from the date of manufacture. A hydraulic test is required after repair A hydraulic test is also required if loss of content more than 10% for CO2 and 5% for Halon. Fixed foam fire-extinguishing systems in machinery spaces Foam sampling: an analysis of foam samples must be undertaken after three years from the date of manufacture and annually thereafter by an authorised service agent or manufacturer's laboratory. Portable fire extinguishers - water and foam All extinguishers are to be examined annually by a ship officer or engineer or authorised agent

Hydraulic testing of all types of portable fire extinguishers should be conducted at intervals not exceeding 10 years, unless the extinguisher is found to be defective during an inspection. Hydraulic testing must be carried out by an accredited service agent or test facility. Prior to recharging an extinguisher, a thorough inspection and internal examination must be carried out by the service provider. LR is to verify that the test protocol is in accordance with the manufacturer's manual Water and Foam Extinguishers must be filled every 12 months by a ship officer or engineer or authorised agent. Portable fire extinguishers - CO2 All extinguishers are to be examined annually by a ship officer or engineer or authorised agent. All types of portable fire extinguishers should be hydraulically tested at intervals not exceeding 10 years, unless the extinguisher is found to be defective during an inspection. Hydraulic testing must be carried out by an accredited service agent or test facility. Prior to recharging an extinguisher, a thorough inspection and internal examination must be carried out by the service provider. LR is to verify that the test protocol is in accordance with the manufacturer's manual. CO2 extinguishers are to be recharged by an authorised service agent everytwo years. Air cylinders for breathing apparatus Air cylinders, high pressure fittings and hoses are to be externally examined annually by a ship officer or engineer or authorised agent. Hydraulic testing of SCBA cylinders is to be carried out at intervals not exceeding five years.

Immersion Suits The number of immersion suits must comply with SOLAS Regulation III/32.3. Two additional immersion suits are to be provided at the bridge, engine control room and forward station near the location of the forward life raft. Vessels operating only within 30 degrees North and 30 degreesSouth are exempted from this requirement. Emergency Escape Breathing Devices (EEBDs) EEBDs are to provided as follows: Machinery spaces containing internal combustion machinery used for main propulsion l One for Engine Control room; l One close to the engine workshop; l One near the escape route on each deck; l In cases where the engine control room and the engine workshop are close to each other only one EEBD needs to be provided; l In cases where the engine control room and/or workshop and the escape route are close together, the EEBD for the engine control room and/or workshop may be dispensed with. However, at leasttwo EEBDs must be provided. Machinery spaces Category A other than above l One EEBD should be provided near the escape route oneach deck. Where the space is on one level only and access to a safe space is direct and unimpeded, EEBD is not required. Cargo Ships l Two sets of EEBDs should be provided in accommodation spaces. Periodic Servicing and Maintenance of Lifeboats, Launching Appliances and On-load Release Gear Testing and servicing is to be carried out by: l an agent authorised by the manufacturer;

Embarkation Ladders and Pilot Ladders For cargo ships that use cranes for loading and unloading of cargoes (regardless of whether such cranes are provided onboard the ship or by a shore side facility), it is necessary to provide one ladder to meet the objectives of SOLAS II-1/3-9 and one ladder to meet the objectives of V/23. However, for ships where no cargo or other suspended loads may pass overhead, e.g. tankers, the accommodation ladder can be located within the parallel body so that one ladder can be used to meet the requirements of both SOLAS II-1/3-9 and V/23. LRIT See Safety Radio section below. Nautical charts and nautical publications The nautical publications required by SOLAS V/27 may be in digital format provided that: l The nautical publications and weekly notice to mariners in digital format are saved or kept as an additional back-up by a method separated from the main user system so that they can be made available to the OOW within a short period of time. l The nautical publication is protected from viruses and it is not possible for the original content to be editedby anyoneother thanthe issuing authority. l Only nautical publications issued by or under the authority of IMO member states will be accepted.

Technical Requirements

All cargo ships of 300 gross tonnage and above and passenger ships irrespective of their gross tonnage are to be fitted with GMDSS radio communication equipment complying with latest amendments to SOLAS 1974 chapter IV.

The DOC will be issued bythe Administration. The DOC may be issued by LR in foreign countries when authorised on a case by case basis by the Administration.The validity of theDOC issued to any ship manager will automatically ceasewhenever major modifications of organisational structure causes changes in the safety management structure or responsibilities are delegated to a third party. Where LR has information relating to this,theAdministration must be informed immediately. A list of the publications to be carried on board Malaysian vessels can be found in Malaysian Shipping Notice 25/2008. Offshore supply vessels Malaysian registered offshore supply vessels which carry industrial personnel operating in Malaysian waters may be categorised as non-passenger boats. The validity of the MLC Certificate will be five years from the issue date of the Statement of Compliance minus one day.

Although Malaysia is not a signatory to the ILO convention, all inspections, tests and examination shall be carried out in the manner prescribed by ILO convention no. 32. Quadrennial survey extended to 5 years, request must be made by Owners/Managers to the Director of Marine of the respective Marine Departments.
