CONSTRUCTION SUPERVISION CONSULTANCY CONTRACT

ARTICLE 1: THE WORKS
A. The Works broadly comprise as follows:
- Project location: 194 Tran Quang Khai St., District Hoan Kiem, Hanoi,
Vietnam.
- Land area: 2,532m2
- Gross Floor Area: about 30,000m2
- Basement area: 4,800m2 (2 basements)
- Number of floors: 25 above ground level floors and 2 basements.
- Special features of the project
 Grade A office building with intelligent feature for leasing to Banks,
Financial Institutions, MNCs and Representative Office for International
Organizations in Hanoi, Vietnam.
 Partially to be used as Head Quarters of the prominent BIDV Bank
 Bored Pile with Diaphragm Wall
 Curtain Walling
 Most modern M&E Facilities (HVAC, FPLS, Power, Telecom, Security,
Internet, Elevators, etc) with computerized Building Management System.
B. Services to be provided by the Construction Supervision Company:
1.1 The scope of works to be carried out by the Construction Supervision
Company includes all supervision consultancy services for the execution
and equipment installation under BIDV Tower Project and its auxiliary
items in accordance with current Vietnamese regulations. The main scope
of works includes but not limit to the following:
1. To monitor, check and report to the Employer on the relevance of the
contractor’s capabilities to their proposals in the Tender.
2. To monitor, check and report to the Employer on the contractor’s
construction manpower and equipment brought into the construction
sites.
3. To monitor, check and report to the Employer on the contractor’s
quality management systems.
4. To monitor, check and report to the Employer on the construction
permits for use of machinery, equipment and supplies subject to safety
requirements in service of construction

5. . To monitor, check and report to the Employer on the contractors
establishments manufacturing construction materials, structures and
products in service of the construction
6. To monitor, check and report to the Employer on equipments, facilities,
testing instruments, the testing results of laboratories proposed by the
Construction Contractor.
7. To monitor, check and report to the Employer on the quality of supplies,
materials and equipment to be in stalled in the works, in compliance,
with the contract documents
8. To monitor, check and report to the Employer on the manufacturers
quality certificates, the testing results of standard complying
laboratories and the results of equipment quality expertise conducted
by organizations recognized by competent State bodies with regard to
construction materials, structures, products and equipment to be
installed in the works before they are put under construction
9. To monitor, check the relevance to the construction methods applied by
the contractors
10.To monitor, check and report on a regular and systematic basis the
process of performances of jobs or tasks by the contractor at the
construction sites. The checking results must be recorded in the
supervision diaries or checking reports in accordance with the
regulations.
11.To monitor, check and accept the construction works in accordance with
the regulations.
12.To collect and check all documents pertaining to checking and
acceptance of construction jobs, construction parts, construction
stages, the checking and acceptance of equipment, the checking and
acceptance of each completed construction item and the completed
construction work
13.To detect design errors and irrationalities and redress them or request
the designing contractors to redress them
14.To report, propose to the Employer the retesting for the quality of
construction parts, construction items and the whole construction works
when doubting their quality
15.To report to the Employer and coordinating with the concerned parties
in settling problems arising in the course of construction of works
16.To establish post contract report procedures and requirements with the
consultants and contractors and/or subcontractors.

17. To attend all meetings with the Employer and other contractors when
necessary.
18. To monitor and report on construction progress and targeted completion
dates to ensure that the construction works are carried out in
accordance with the specification, performance criteria and quality
control procedures.
19. To ensure that the drawing, instructions and details are issued timely in
accordance with agreed construction schedule and that responses to
contractors and/or subcontractors queries are acted upon promptly.
20. To monitor and report the effect of all variations and delays-potential or
otherwise – on the programme and budgetary cost commitment and
obtaining approval. Receiving and reviewing the contractors and/or
subcontractors submissions for payment and making recommendations
to the Employer.
21. To monitor the statements of contractual disputes and resolving these
to the best interests of the Employer.
22. To liaise and co-ordinate with the consultants and contractors and/or
subcontractor in the submission of all maintenance and operation
instructions and manuals, test certificates, guarantees, indemnities, as-
built drawings and as-installed diagrams.
23.To inspect the completed works for compliance with the contract
documents and drawing prior to issuance of the Taking-Over Certificate
24. To inspect the remedial works carried out on defects during and at the
end of the Defects Notification Period in conjunction with the
consultants prior to issuance of the Performance Certificate.
25. To assist in obtaining all clearances and approvals necessary from the
relevant Authorities.
26.To liaise with the consultants on commissioning and testing programme
and arranging handover to the Employer after operational tests and full
commissioning services have been satisfactorily completed.
27. To arrange with the consultants and contractors and /or subcontractors
on the training of the Employer’s maintenance personnel in the
operation of an installed plant and equipment.
28. To support to Employer provide on priority basis Construction
Supervision Consultancy services for the project, in conformity with
local practices and relevant Authority Requirements (Law and Code,
Ordinances, Decrees, Circulars, Decisions, etc).
29. To provide Construction Supervision Consultancy services in
connection with contractual issues, construction method and systems,

site safety and cleanliness, quality control and workmanship, applicable
standards..
30.To coordinate with other consultants (to be) engaged by the Employer
for the project.
31. To provide all documents relevant to the services of the project in full
compliance with the requirements of the Employer.

33. To fully administer the con tract in accordance with the relevant contract
documents.
34.To supervise and verify all construction activities in general on the basis
of the contract drawings, specifications and other conditions as
stipulated in the relevant contract.
35.To provide all information in addition to the contract drawings during the
progress of construction to the relevant contractors and/or
subcontractors.
36.To attend the weekly progress and coordination meeting with the
contractors and/of subcontractors to be required for the whole period of
construction.
37. To coordinate all design & drawing issues in-between the relevant
consultants with contractors and/or subcontractors for proper
construction on site.
38. To screen in advance all the submittals (shop drawings, samples of
materials, test reports, etc) to be submitted by the contractors and/of
subcontractors for approval.
39. To issue Instructions or Directions for any addition, omission and
modification to the original contract including any rectification subject to
approval from Employer.
40.To provide regular (weekly) progress report and advise to Employer.
41.To monitor and to take care all work force under his direct control.
42. To examine and certify all the as-built drawings to be submitted by the
relevant contractors and/or subcontractors upon completion of the
contract.
43.To provide complete punch- list after hand –over inspection.
44.To recommend the Taking-Over Certificate to Employer upon
satisfactory inspection of the completion of outstanding work and
remedying defects’ punch list.

45.To carry out other duties in compliance with Construction supervision
Consultancy Services Contract to be made with JV Company.
46.All documents shall be provided in Vietnamese and English language.

1.2.1 Resident M&E Engineer (RM&E)


The following are generally the scope of work, responsibilities and
duties of a RM&E in connection with Mechanical & Electrical (M&E)
work not necessary limited to the following:
1. To take the leading role in supervising and verifying all construction
activities in connection with mechanical& electrical (M&E) work as
stipulated in the relevant contract documents;
2. To provide all information in addition to the drawings during the
progress of construction to the relevant contractors and /or
subcontractors;
3. To assist RA to chair weekly progress and coordination meeting with
the contractors and /or subcontractors as and when required for the
whole period of construction;
4. To coordinate all design & drawing issues in between the relevant
consultants with contractors and/or subcontractors for proper
construction on site;
5. To screen in advance all the submittals (shop drawings, samples of
materials, test reports, etc.) to be submitted by the contractors
and/or subcontractors for approval;
6. To assist RA in the issuance of Instructions or Directions for any
additions, omissions and modifications to the work including any
rectification subject to Employer’s approval in connection with
mechanical & electrical (M&E) works;
7. To assist RA with regular (weekly ) progress report;
8. To supervise and to take care of all work force under his direct
control;
9. To examine all the as-built drawings to be submitted by the relevant
contractors and/or subcontractors upon completion of the contract;
10. To provide complete punch –list after hand-over inspection;
11. To recommend to RA upon satisfactory inspection of the rectified
punch –list;
12. To carry out other duties in compliance with the Construction
supervision Consultancy Contract to be made with JV Company;
