The respondent has fled a timely appeal fom the Immigration Judge's order denying the
respondent's application fr voluntary depaure and orderng te respondent removed to El
Salvador.1 The Depament of Homeland Security has fled a motion to dismiss the appeal. For
the fllowing reasons, te record in this matter will be remanded.
We review the Immigation Judge's fndings of fct fr clea error. Questions of law,
discretion and judgent, and all other issues are reviewed de novo. See 8 C.F .R.
I 003.l (d)(3)(i), (ii).
This Board has explained that because we have limited fct-fnding ability on appeal, the
Immigration Judges must include in their decisions clea ad complete fndings of fct. See
Mater of S-H-, 23 I&N Dec. 462 (BIA 2002). The record befre us does not include a complete
separate decision fom the Immigration Judge setting fr his reasoning fr denying voluntary
depaure. We note that the respondent was detaned and unrepresented at his last hearing, ad
there is no record of his having been advised, befre that heaing, of the possibility of applying
fr voluntary depature. At the heang, the respondent inquired about volunta depaure and
stated that he could ask relatives fr the fnds necessary to qualify (Tr. at 51-52). Afer the
respondent was asked about his passpor ad stated that he did not have a passpor, there wa no
inquiry as to whether he could obtain a passpor (Tr. at 52). The Immigation Judge told the
respondent that he was not eligible fr voluntay depaue because he could not leave the United
States within 15 days (Tr. at 52). However, the Immigation Judge did not explain why the

inability to leave within 15 days of the date of the hearing disqualifed the respondent fom
receiving volun depae. The Immigration Judge did not address the possibility of a
continuance.
Because the Immigration Judge did not issue a complete separate decision in tis matter, we
will remand the record to the Immigration Cour fr fer action. See Mater of A-P-, 22 I&N
Dec. 468 (BIA 1999); see also Matter of S-H-, supra (stating that a decision must accuately,
clearly, ad completely suaize te fndings of fct supported by the record ad must also
refect te Immigration Judge's analysis of te applicable statutes, regulations, and legal
precedents, ad clearly set frth the Immigration Judge's legal conclusions).

consistent wit the fregoing opinion and fr the enty of a new decision.
