OFFICE OF THE DIRECTOR OF PUBLIC PROSECUTIONS

SERVICE CHARTER VISION To be a highly professional, effective and efficient prosecuting body in Kenya MISSION To serve the Government and the public providing professional, effective and efficient prosecution services OBJECTIVE OF THE CHARTER The objective of this service charter is to raise awareness about our role as the DIRECTOR OF PUBLIC PROSECUTIONS in the administration of justice and to share the values and standards we have set to guide us in the delivery of our services. This charter is a commitment by the DIRECTOR OF PUBLIC PROSECUTIONS to improve service delivery to the government, the Public and all other stakeholders in the criminal justice sector. OUR MANDATE The mandate of the DIRECTOR is derived from ARTICLE 157 of the Constitution, which confers powers on DIRECTOR OF PUBLIC PROSECUTIONS exercisable by himself or officers subordinate to him. The powers include: To advise the government on all criminal matters To institute any criminal proceedings against any person before any court other than (court martial) in respect of any offence alleged to have been committed by that person To take over and continue any such criminal proceedings instituted or undertaken by himself or another person or authority.

Subject to clause (7) and (8), discontinue at any state before judgment is delivered any criminal proceedings instituted by the by the Director of Public Prosecution or attend over by the Director of Public Prosecutions. To advise the Police to investigate any matter or alleged offence To review prosecutions started by the police to ensure fair prosecution

OUR AIM To contribute to the reduction of crime in Kenya and to increase public confidence in the criminal justice system by fair and independent review of cases and by firm, fair and effective prosecution at court. OUR CORE FUNCTIONS Our core function is to prosecute those charged by the police and other investigative agencies with criminal offences while upholding, protecting and promoting human and constitutional rights. Specifically we: Advise the police on possible prosecutions Review prosecutions started by the police to ensure the rights defendants are prosecuted on the rights charges before the appropriate court. Undertake public prosecutions of cases forwarded by the: police, Kenya Anticorruption Commission, Criminal Investigations Department, Banking Fraud Investigations Units, cases taken over from private Prosecutors. Represent the State in all criminal cases, criminal applications and appeals Advise Government Ministries, Departments and State Corporations on matters pertaining to the application of criminal law. Expound and disseminate prosecution policy, Monitor the training, appointment, and Gazettement of Public Prosecutors in Statutory Corporations Address parliamentary questions relating to administration of criminal justice Address complaints raised by members of the public, watchdog bodies and other institutions Undertake other administrative roles relating to efficient and effective administration of criminal law in the country.

ORGANISATIONAL STRUCTURE

The Director of Public Prosecutions is a Constitutional office, headed by the Director of Public Prosecutions, with a team of State Counsel and Para-legal staff. As part of the ongoing reforms in the Governance, justice, Law and Order Sector through the Reform and Restructuring Program, the functions of the Director have been re-organized along the following key departmental sections: The Anti-corruption, Economic Crimes, Serious Fraud prosecution and Asset Forfeiture Section. Counter-Terrorism, Narcotics, Organized Crime and Money Laundering Prosecution Section. General Prosecution and Appeals Section. Extradition, Mutual Legal Assistance and International Cooperation Section. Sexual offences and Gender based violence. Piracy and Maritime section Administration sections

The Sections are aimed at building specialized capacity in prosecution services. Any government office, member of public or any stakeholder can raise an issue relating to criminal justice by writing to the Attorney General or to the Director of Public Prosecutions. CLIENTS OBLIGATIONS Any government office, member of the public or any stakeholder, making an inquiry or complaint to the Attorney General must not only do so in writing but must also provide all the necessary information including but not limited to attaching relevant documents, full names and addresses of parties involved, dates and police stations involved if any. Making reference to any of our previous correspondence will be helpful. PERIODIC REVIEW OF THE CHARTER We commit ourselves to carry out periodic reviews of this Charter to enable us improve our services and meet emerging challenges. COMPLAINTS AND FEEDBACK

We aim to continue improving our service delivery and will appreciate feedback from you on our performance. We believe that constructive engagement with our clients and stakeholders will help us improve our service delivery. If the service provided is not satisfactory, please channel all your genuine complaints to the Director of Public Prosecution.
