Range Resources, Cecil Township, Washington County: A valve failed on a storage tank on Range Resources' Worstell impoundmenl and 30 gallons of treated water drained into crushed stone. It was cleaned up by Range and no soil contamination occurred. During a routine compliance session between DEP and Range, the incident was discussed informally. This incident was enoneously reported in the press to be a leak at the impoundment. This caused residents of Cecil Township to raise environmental concerns with the Cecil Township Supervisors. Jesse White is now heavily involved and personally appeared at DEP to review documents pursuant to a RTKL request. Cecil Township Supervisors wrote to CRC John Poister asking that DEP hold a public meeting. After consultation with counsel and program staff, Poister invited the Commissioners to a private conference at DEP. DEP is getting considerable push back from press and others regarding the refusal to hold a public meeting. (Susan Malone, 412.442.4179)

MarkWest Liberfy Midstream and Resources, LLC (MarkWest), Houston Gas Plant, Chartiers Township, Washington County: On July 14, MarkWest brought a new de-ethanizer on-line, resulting in several visible emission episodes of thick black smoke. DEP received numerous complaints and inspected the facility on July 15 and July 16 and observed no opacity violations since the events were sporadic. MarkWest attributes the visible emissions to the flaring of natural gas liquids and stated that the unit is operating as designed, that the public was never at risk and it will continue to work with DEP
to evaluate the issue and take the necessary steps to minimize the potential of similar events. DEP recently installed an air monitoring station near the facility as part of an effort to perform long-term air

sampling. The station's monitoring equipment does not indicate any anomalies associated with the incidents. DEP is involved in an ongoing investigation, gathering data and awaiting calculations of volumes that were sent to the flare from MarkWest. (George Washburn r 412.442.5228)

City of Uniontown (Uniontown), South Union Township (South Union) Yard Waste Issues: On July 9, Representative Mahoney and Senator Kasunic were copied on an e-mail sent to DEP from South Union. In February 2013, South Union was awarded$222,993 in grant funding for a replacement dump truck, a high lift for the compost site and recycling education. At the time the application was submitted, in June 2012, South Union did not request funding for a grinder. In January 2013, DEP sent an NOV to Uniontown for dumping yard waste from the joint compost site at an unpermitted site. Uniontown's excuse for the illegal dumping was that its grinder had broken down. In May 2013, Uniontown applied for grant funding for a new grinder to replace the2002 grant funded model. South
Union is pressuring DEP to fund the new grinder for the Uniontown/South Union yard waste compost site. DEP is concerned that the collection and composting programs are not economically sustainable unless the communities change the management of the programs and provide for better maintenance of the equipment. A letter requesting more documentation to prove their yard waste collection and composting programs are sustainable will be sent to Uniontonn/South Union prior to making future funding decisions to benefit these two communities. Schrader's motion was not seconded by another supervisor, so the conference will proceed as scheduled. Schrader

did not indicate whether or not he would attend the conference at the DEP's headquarters in Pittsburgh. Township Chairman Thomas Casciola said that questions regarding the impoundment must be answered as soon as possible, even if that means doing so in a private forum.
"We tried to get the DEP to go along with us, and they rejected us," Casciola said. "We can get some answers on

Friday. If we push the issue, the DEP is going to put their back up against the wall and they're not going to be available to answer anything."
Cindy Fisher, a township resident and supervisor candidate, said that the tenuous nature of a private eonference that
is not recorded could result in a lawsuit.

We have resolved the meeting format -it will include the Cecil Township Supervisors, counsel and Township Manager attending on Friday August 9th at 11:00a.m. . The meeting will be held in the Monongahela Room. Recording the meeting either on audio or video is prohibited. Our next step should be to get together before the meeting to discuss any concerns or sensitive issues with the folks in
Cecil.

I had a contentious call from a Cecil Township resident by the name of Rose Churray. She wants to know why we aren't holding a public meeting with residents. She called today and asked who was responsible for making the decision to hold next week's conference with just the Cecil Supervisors and not "the people".Saying she had a right to know, she demanded an answer and has given me a deadline. I tried to explain that the decision wasn't made by just one person-but, she wanted names.

Supervisor Tom Casciola, the board's president, said the Aug. 6 meeting with Range Resources last about 45 minutes and centered on concei-ns about truck traffic on Swihart Road near the impoundment and the permitting procedure that led to its construction. "We didn't make any deals with them," Casciola said. "We really just told them about our concerns and they agreed to
address them."

He said the township continues to receive complaints about hear,y tanker and truck traffic in the area and set up roadway cables to monitot' the number of industrial vehicles.
Casciola, who was joined by supewisors Elizabeth Cowden and Frank Ludwin, said they also discussed apparent

confusion over the township's permitting process and how Range notified the rnunicipality of the impoundment. The

Range Resources officials did not return messages seeking comment on the private meeting.

A rvater impoundment that has been the subject of controversy in Cecil Township could operate indefinitely, although the state Department of Environmental Protection thinks it is unlikelv that the natural gas drilling-based reservoir will remain much longer,

"Realistically, because the cost of tr-ansporting water is such tl-rat it becomes an economical (hindrance) in a ro-mile
radius, there will be a limited future for that," DEP spokesman John Poister said after attending a conference with Cecil

Township supewisors. "We just don't know when (it will close). We can't place a date."
This topic and several others regarding the Worstell impoundment on Swihart Road, which is operated by Range
Resources, were addressed during a private conference Friday at the DEP's Pittsburgh headquarters. The conference had been contested for weeks by some residents and one supervisor who argued that the meeting should be public.

The impoundment itself also has been a contentious issue, and township supewisors questioned why the Worstell site has not yet been restored by Range Resources. According to the dam permit approved by the DEP in 2o1o, the dam

"must be restored within nine months of the last well serwiced by the impoundment being placed in to production."

However, Poister said the permit includes multiple well sites that ale being drilled, and Range could conceivably extend the nine-tnonth deadline by adding new well sites. He said it is standard for an impoundrnent to be utilized for at
least three well sites.

The DEP also addressed questions regarding the impoundment's leak detection system. Poister said the system was

not required by the DEP when the impoundment was originally constructed, but it was installed for Range Resource's own
data collection purposes. Poister said the DEP believes "there has not been a leak that has compromised the soil at the Worstell impoundment" and that two previous wastewater spills at the impoundment were contained and cleaned up quickly. Supewisor Andy Schrader, who has vocally protested both the impoundment and private nature of the conference,
asked the DEP whether the water at the Worstell site is contaminated. Schrader said he received about z5 questions from several township residents who were concerned about the quality of their water. He questioned the DEP's oil and gas

representatives about a spike in the levels of certain chemicals at one of the monitoring wells in November 2011. Range
Resources data shows the level of chloride rose 1,ooo milligrams per liter between September and November 2011. There

were also increases in the levels of strontium, barium and sodium.

"When it has a spike at go feet down in the ground water, that's a concern," Schrader said. "Now, you've got these contaminants in the groundwater. That was the question that really needed to be answered, and they still don't have the ilnswer."
Poister said the levels came down immediately after they were measured, and that the spike was an anomaly. Controversy aside, township President Thomas Casciola said much of the discussion during the conference was technical language about the systems and processes used at the impoundment. He said, while the tovrnship was frustrated that Range Resources bypassed the township in obtaining proper approvals for the original use and construction of the impoundment, he understood the DEP's permit was not dependent on other municipal requirements. Yet, he said,

"It makes it tougher for

us to address the application after the fact."

While the conference did not answer every question that the supervisors had, Poister said the DEP is still looking into their concerns.
"There are still questions, and there is still an investigation ongoing," Poister said. "We promised to give them some updated material that we showed them (yesterday). We also hope that we can have an improved line of communication

with them."

There has been some negotiating between DEP and Cecil Township Supervisors over the date and time for a meeting. The supervisors had requested DEP representatives attend a public meeting-a request rejected by the agency. We, in turn, proposed a 501 conference type gathering to be held at DEP offices on Waterfront Drive. The offer was accepted. The Supervisors proposed July 29th for the meeting.
