ENSAYO N1 TEMA: LEGISLACION TURISTICA Segn: (Juan Carlos Monterrubio*)La literatura acadmica ha insistido en la existencia del derecho turstico. Aunque las relaciones entre el derecho y el turismo son innegables, su denominacin conceptual es cuestionable. En este sentido, el presente texto busca analizar la inexistencia del derecho turstico desde una perspectiva conceptual. Reconociendo la multidimensionalidad del turismo y la no-exclusividad del derecho a cualquier disciplina, se propone que el presunto derecho turstico no va ms all de una invencin conceptual que ha sido adoptada para intentar legitimar el binomio derecho-turismo desde perspectivas acadmicas, sin que esto implique necesariamente la justificacin de dicho concepto. PALABRAS CLAVE: derecho turstico, multidisciplinariedad, epistemologa turstica y jurdica Abstract: The Inexistency of Tourist Low. A Conceptual Analysis. Academic literature has insisted on the existence of tourist law. Although the relationships between law and tourism are undeniable, their conceptual nomination is questionable. In this vein, by acknowledging the multidimensional character of tourism and the lack of exclusivity of law to any discipline, the paper suggests that such tourist law should not be regarded more than as a conceptual invention. This invention, according to the authors, has been adapted to attempt to legitimate the relationship between law and tourism from academic perspectives. This, however, does not necessarily justify the existence of such a compound concept. KEYWORDS: tourist law, multidisciplinarity, law and tourism epistemology

ENSAYO N2 TEMA: ESTADO

Segn: (Salamanca.) Un pas es un estado que tiene una forma de organizar en el marco poltico, econmico, tecnolgico y social. Abriendo espacios de vida a todos los ciudadanos de dicho pas haciendo respetar de las normas y leyes. A country is a condition that has a way of organizing in the political, economic, technological and social frame. Opening spaces of life all the citizens of the above mentioned country making respect of the procedure and laws.

Segn: (Meja) el estado es un origen de una sociedad que tiene ciertas normas y reglamentos dentro de la naturaleza humana, con ordenes jurdicos y constitucionales. The condition is an origin of a company that has certain procedure and regulations inside the human nature, with juridical and constitutional orders.

Journal of Democracy en espaol) El dilema de un estado esta creada para ser nombrado un pas o nacin con sus propias leyes y su forma de gobernar un pas soberano libre y democrtico. TEMA: GOBIERNO

Es una persona elegida por un pueblo nombrada gobierno que dirige y que conduce la vida de un pas por mandos recomendados. Segn: (Len) un gobierno es un empleado del pueblo donde asume sus responsabilidades como gobernante haciendo cumplir las normas, reglamentos y leyes, como obligaciones de la sociedad entera, para lograr un desarrollo de buen vivir. Siendo la actividad turstica un fenmeno social intrnsecamente relacionado con las dems esferas que componen una determinada realidad, los nuevos preceptos paradigmticos caractersticos de la era posmoderna la afectan sobremanera, desencadenando nuevos modelos de apropiacin y consumo de los espacios urbanos y naturales.

Moquete Guzmn) Las vivencias de los grupos sociales estn relacionadas con las diferentes formas de apropiacin y uso del espacio geogrfico, destacndose las dimensiones materiales y simblicas a partir de las cuales se establecen los vnculos entre las acciones culturales desarrolladas a lo largo de la trayectoria de una comunidad y los territorios que las materializan. ENSAYO N5 TEMA: PERSONA NATURAL Segn: (J. C. Monterrubio y R. Coln) Persona natural: Es la denominacin legal que el cdigo civil nos otorga como individuos capaces de adquirir derechos, deberes y obligaciones. Natural person: It is the legal name that the civil code grants us as individuals capable of acquiring rights, duties and obligations.

Segn: (Coln) realizar actividades econmicas lucrativas, voy a generar ingresos que de acuerdo a ley se consideran rentas de tercera categora. To realize economic lucrative activities, I am going to generate income that - in agreement to law - are considered to be revenues of third category.

(1999)) tiene responsabilidad ilimitada, es decir, el dueo asume de forma ilimitada toda la responsabilidad por las deudas u obligaciones que pueda contraer la empresa, lo que significa que deber garantizar dichas deudas u obligaciones con su patrimonio o bienes personales. TEMA: PERSONA JURIDICA Segn: (Prez, E. (1978) Tratado elemental del derecho turstico. Daimon, Barcelona) Persona Jurdica es una empresa que ejerce derechos y cumple
obligaciones a nombre de sta. Al constituir una empresa como Persona Jurdica, es la empresa (y no el dueo) quien asume todas las obligaciones de sta. Legal person is a company that exercises rights and fulfills obligations addressed to this one. On having constituted a company as Legal person, it is the company (and not the owner) the one who assumes all the obligations of this one.

Segn: (Kelsen, H. (2003)) tiene responsabilidad limitada, es decir, el dueo o los

dueos de la empresa asumen solo de forma limitada la responsabilidad por las deudas u obligaciones que pueda contraer la empresa, las cuales solo se garantizan con los bienes, capital o patrimonio que pueda tener la empresa.
