criminal: 69,580
non-criminal: 76,360

All of these FY 2002 totals will change throughout FY 2003 as late data
entry is
completed by field staff. The stats will increase by a few (2? 3?...)
thousand
by January 2002.

I understand that you provided the statistical information that GAO


(see history below). GAO is asking for additional information regarding the 5/11 Personal Privacy
number of removals for all countries, total criminal removals, and non-
criminal
for 2002. Please provide this information to me as soon as you can to go
into
the GAO Final Report for the Visa Waiver Program.

context, removals please ask| |for the total number of
removals for all countries, total criminal removals, and non-criminal
for 2002. The yearbook only goes to 2000. Thanks.

I hope it is not too late to provide it to GAO, as suggested by Vickie

Sloan:

In FY 2002,1,506 persons were removed who had entered under VWP, of


which
204
were criminals. For earlier years, the comparable figures are:
FY2001: 880 persons, including 191 criminals
FY2000: 566 persons, including 161 criminals
FY 1999: 453 persons, including 121 criminals
FY 1998: 514 persons, including 83 criminals
FY 1997: 496 persons, including 78 criminals

We note also that the INS data on removals from 1995-2000 by criminal
status
and
country of nationality can be found in Table 66 of the 2000 INS
Statistical
Yearbook. These data, of course, cover aliens in all immigration
statuses.

In its comments to the GAO the INS noted that it 'has and publishes
data
from DACS on criminal and noncriminal removals by country" and that
"DACS,
also has status at entry, and there is a unique VWP status code." The
DAG's
Office has suggested that we provide the GAO the DACS information on
this
issue.
