DEFENDANTS MOTION TO DISMISS AND COMPEL ARBITRATION Pursuant to the Federal Arbitration Act (FAA), 9 U.S.C. 1 et seq, Defendants BuckleySandler LLP, Kirk Jensen, and Elizabeth McGinn respectfully move this Court to dismiss this action with prejudice and compel arbitration because the claims asserted in the Complaint of Plaintiff Matthew J. Ryans (Plaintiff) are subject to mandatory, binding arbitration. In the alternative, if the Court declines to dismiss, Defendants request that the Court stay all proceedings pending the completion of arbitration, in accordance with Section 3 of the FAA. 9 U.S.C. 3. Defendants also seek their attorneys fees and costs in bringing this motion. In support of this motion, Defendants submit the accompanying Declaration of Terri Carnahan and Memorandum of Points and Authorities, and include herewith a proposed Order under Local Civil Rule 7(c).

In accordance with Local Civil Rule 7(m), Defendants contacted Plaintiff on November 25, 2013, both by telephone and email, requesting that Plaintiff voluntarily withdraw his complaint and submit his claims to binding arbitration.
