PART XI, A. General (1-2) and;
B. Pre-Inspection Activities (Request for_an Investigation) 3{a) — (i) et seq. and as
referenced in the “ANNEX ON IMPLEMENTATION AND VERIFICATION” ("VERIFICATION
ANNEX") of the “CONVENTION ON THE PROHIBITION OF THE DEVELOPMENT,
PRODUCTION, STOCKPILING AND USE OF CHEMICAL WEAPONS AND ON THEIR
DESTRUCTION” including, but not limited to:
ARTICLE X. “ASSISTANCE AND PROTECTION AGAINST CHEMICAL WEAPONS” (1-11)
and;
ARTICLE XII. “MEASURES TO REDRESS A SITUATION AND TO ENSURE COMPLIANCE
INCLUDING SANCTIONS” and;
ARTICLE XIV. “SETTLEMENT OF DISPUTES”
Dear Director General,
This communication is for the purposes described above. My family has been poisoned
with “BANNED - Chemical Weapons” also considered “Weapons Of Mass Destruction” in
Tomball, Texas. Texas is one of the several states of the Union of States, known as the United
States of America. The United States of America are States Parties pursuant to the above
stated “CONVENTION”.
aMy wife, Brandi L. Hardin and |, James D. Hardin and our family are “Victims” of a
Chemical Weapons attack within the United States of America, which is one of the “OPCW
States Parties” pursuant to the above stated “CONVENTION” and who are in violation of the
same.
I have attached documentary information, including photos of the “Glass Vile” which 1
found in our backyard on 6/26/09, which is enclosed by a 6’ wood fence. From our research,
we believe the “Glass Vile” could possibly be manufactured by “Tubex” (The manufacturer,
possibly, of the “Delivery Device”) pursuant to ARTICLE II, “DEFINITIONS AND CRITERIA”.
After finding the “Glass Vile,” it was placed into a plastic zip lock bag on 6-26-2009 and
using a napkin to preserve any and all fingerprints for investigation purposes. We then were
informed to send the “Glass Vile” to a respectable laboratory (Microbac) to determine what
the remaining liquid in the vile consisted of. The Microbac Report is dated 8-11-2009 pursuant
to Lab Log Number: 0908134, The labs “Product Characterization” method used to identify the
unknown liquid remaining in the “Glass Vile” was done with Flame lonization Detector, and/or
GC/MS Adapted from NYSDOH 310-13 methodology.
Using the above method to test the unknown liquid remaining in the “Glass Vile,”
Microbac lab results evidence that the liquid remaining in the glass vile consisted primarily of a
combined chemical solution of Phenol (CAS #108-95-2) with trace amounts consisting of
Ergotamine (CAS #143-15-5) and Benzenediol (CAS #123-31-9). This analysis is certified as
conforming to generally accepted laboratory practices by Peter Indick (Managing Director, NYS
ELAP CERT 10795).
My wife and I did not make a police report when first finding the “Glass Vile” on 6-26-
2009, because we had no idea what the liquid actually consisted of in the “Glass Vile” and we
did not understand at that time that we were in serious danger from what the glass vile
contained inside of it. However, after we received the lab results, we still had no way to
comprehend the severity of the chemicals found in the glass vile, so we requested a
compounding pharmacist, Albert Leo Berrettini, Jr. to do an analysis based on his expert
analysis of the Microbac lab results to help us and others to understand what the lab results
actually meant in layman’s terms. Mr. Berrettini did indeed do an Affidavit with supporting
evidence pertaining to the Microbac lab results.
‘As we were trying to make sense of the Microbac lab results and the analysis of the
Microbac tab results we had just became aware of, we experienced some more disturbing
events on the evening of 8-29-2009. My wife asked me to check a lawn sprinkler head next to
tthe side walk at our front entry walkway leading to the front door of the home, due to us being
concerned that this huge patch of grass was dead without any explanation, so we assumed the
sprinkler head in that area may have malfunctioned. This same thing was happening in 2
certain area in our backyard as well, but we had already observed that the sprinkler head in
that area of the backyard was working and functioning perfectly, The area of dead grass in the
backyard was in the direct vicinity that the glass vile was found 2 months prior to these grass
2areas mysteriously dying. This home is located at 16410 Willowpark, Tomball, Texas [Postal
Code 77377]. At that time, we unfortunately did not understand that the chemicals in the
glass vile could cause the vegetation to die as well,
While checking the sprinkler head in the front yard that evening, my wife noticed a Black
Suburban turn the corner onto our street and as it was in the motion of the turn it blacked-out
all lights inside and outside. While | was turning on the water at the sprinkler control box
located in the garage at the rear of the house, | was unaware of what my wife had just
witnessed as she was at the front sidewalk of our home. After | cut the sprinkler on for about
15 seconds, | then turned it back off and I proceeded down the driveway toward the front of
the house to see what my wife observed pertaining to the sprinkler head’s status.
As | proceeded walking down the driveway toward the front to find out if my wife could
see rather the sprinkler was functioning, | observed my wife walking as fast as she could as she
yelled at me to “take cover, take cover”. | still did not understand why my wife was terrified
and as | continued to go down the driveway, | witnessed a blacked out suburban turning the
lights on and slowly driving by our house. At this time, | realized that this behavior by the black
suburban seemed unusual and I then realized why my wife was so terrified and trying to warn
me that something was wrong. My wife immediately started explaining to me what she had
witnessed this black suburban do as it was turning onto our street and the immediate danger
she felt.
‘The suburban continued to go very slow as it continued down our street. it then
stopped at the end of the street at the stop sign, where it stayed for so long, that I decided to
run into the house for my keys. 1 jumped! into the car and by the time | got to the end of my
driveway and onto the street, my wife informed me that it just turned left and had been sitting
at the stop sign that whole time. I went the way the suburban had first come onto our street
and took a right and then took another right on the next street over. While going down that
street, the stated black suburban backs out of a driveway in front of me where it was turning
around to go back the way it had just came from. Once | was behind the black suburban, 1
wrote down the plate number. When the black suburban got to the stop sign on that street, it
stopped for what seemed to be an eternity. | was stopped behind it and became very terrified
that the party/parties were going to get out or perhaps just shoot me down right there because
it refused to move from the stop sign. In fear for my life, 1 was about to reverse my car to get
from behind the black suburban, when the suburban put its left blinker on and very slowly
proceeded out of the entry to the subdivision,
‘At that time, | immediately took a right and then right again on my street returning back
home. Once | arrived back home, my wife and | called 911 from my wife’s cell phone to report
the event and gave them the Texas Plate # for the black suburban and told the operator on 911
‘that it was very suspicious activity and we were in fear for our lives. We were told police were
being dispatched out to our home immediately, but over three hours later the officers never
showed up or called to notify us of any change. My wife and | waited at the front door area
and watched out the front windows waiting anxiously for the officers to arrive. To our dismay,
the officers never showed up.
