Dear Sir ,
In inviting to the reference above latter I am to rewrite you that after several notices and verbal instruction served to
you time to time you have failed to attain the 2nd milestone ( 50% of work ) and the intended time of completion for the
aforesaid work have already been expired on 29/10/2013. As per my site visit on 25/11/2014 it is found that after
completion of your time period still you are able to complete 45 % of the work only and which considered as very
unsatisfactory progress . In this extreme by good working season I have found only five labours in different stretches
in site during my inspection on 25/11/2013 . There are many works still remaining in initial stage like CD , Pucca drain ,
Retaining wall, breast wall , WBM and PC & SC works along with 2( two) numbers of RCC bridges . etc, which appears to
be impossible to complete the work due to your slow performance and callous attitude to abide with contractual liabilities
as per the terms of the agreements . Though you have mentioned many problem like: (1) Land compensation ,( 2) Disturb
area . , (3) Assam Bandhs ,(3) Security problem and (4) Decision regarding PC & SC works vide your latter No ---- Dt
27/11/2013 but all your problem have not satisfy/ justify the reasons for such type of unwanted delay of works occurs
and can not be relieved from lackadaisical attitude in execution of the contract .
Therefore it appears that you did not have taken the proper interest and initiative for gearing up the progress of work and
thus it becomes uncertain regarding the completion of the work . Can you justify your negligence and slow progress
deliberate causing imbursement of this Deptt. In public domain , besides causing extreme loss to public continence in
Road Transportation .
Under such circumstances L.D as was imposed to you for the work mentioned above under CL . 49.1 vide notice No
KMP/NEC/Comnn-9/28/2011 Dt 29/6/12 and when the L.D amount have crossed the 10 % of your tender value then the
work will automatically terminated from you under clause 49.3.
This latter may considered as a final notice and you are here by requested make appropriate progress of work as
required in site on or before 15th December 13 and, otherwise the undersigned will compelled to terminate the work
from you as per Cl. 59 of tender agreement and the same will be completed through other agency at your own rick and
cost as per discussion in the previous review meeting held on 22/11/2013.
The matter may be treated as MOST URGENT .

Dear Sir ,

Dear Sir ,
In inviting to the reference above latter I am to rewrite that you have failed to show the appropriate progress of work till
to day in spite of so many notices and verbal request from this end time to time .
It appeared that even after expire of fourteen month from the date of commencement of the work you could not have
achieve the first mile stone ( 25% of the work) ,whereas the 2 nd mile stone ( 50% of the work ) to be achieve by you
within next two month and which appears to be impossible due to your slow performance and and aluast attitude to
abide with contractual liabilities as per the terms of the agreements

Therefore it appears that you did not have taken the proper interest and initiative for gearing up the progress of work and
thus it becomes uncertain regarding the progress of work .
Under such cecumtancec L.D was imposed under CL . 49.1 vide notice No .Dt and it is become 10% of
your contract price amounting to Rs

data( Condition of of contract , section : 3 ) and therefore I am compelled to terminate the work as per Cl 59( g)
( Condition of contract , Section -3 of the contract agreement .
These notice has been sign&serve under my hand and seal on 28 th Dec2012 and you are requested eighter to attend or
depute your authorized representative to attend the incomplete final measurement taken by the concern field officer
of the department along with the A.E.E .PWRD Baithalangso NEC Sub Division & Guwahati NEC Sub division No II
on 2nd Jan2012 from hr. 10 am onwards .
