Hello,

I am filing this complaint on lsrael Garza of the Mental Health and Substance Abuse Division of DSH$ for
intentionally providing misleading updates on the status of the open records that I have requested.

In response to my April 21st request for some survey result tables, Mr. Garza on April2gth initially denied in
no uncertain terms that his agency possessed any Texas School Survey documents:

'DSHS does nof have any records on localschool district level results/reports of Iexas School Survey
fram 1988 to 1994. You may contact Iexas A&M- PPRI (our school survey contractor) for this ,equ*"t,'

After I requested documentation confirming that these documents have been destroyed or disposed of, Mr.
Garza on May 1st confirmed that they may have copies and that they have been searching for them since I

submitted my April2lst request:


"Per yotrr, we are attempting to locate convenience coples of the resutt tables from each of the 20

responslve informatian immediately following the receipt of your first email. Llnderstandably. given the
age of these paper records, DSHS cannat confirm that this responsrve information is in its possesslon.
However, DSHS has asked to examine the contents af boxes in a warehause ofisife that may potentialty
contain the requested responsive information (i.e., convenience copies) that were moved during the
consalidation of legacy lexas Commission on Atcohot and Drug Abuse (TCADA), now DSHS. please note
that even if they can be located, these were convenience copies senf fo legacy TCADA by the publ6
Policy Research lnstitute (PPRI) af lexas A&M lJniversity that conducted the Survey: the originals were
sent by PPRI to each of the respective Texas local school districts."

Mr. Garza has on two previous occasions initially denied that DSH$ has responsive information to my
requests only for me to find out to the contrary. On one of those occasions, I had to file a comptaint letter
with the Texas Attorney General's office to release the requested information from DSHS.

I am urgently requesting that DSHS provide greaier oversight to ensure that I receive complete and
accurate information in response to my open records requests.
