A BILL to provide for the establishment of the Khyber Pakhtunkhwa Ehtesab Commission, for good governance to create an effective institutional structure

for the prevention of corruption and corrupt practices and to hold accountable all public office holders, accused of such practices. WHEREAS the Pro$incial 0o$ernment of the <h'ber Pa9ht&n9h,a is desiro&s to implement the Charter of 0ood 0o$ernance of the Pro$incial 0o$ernment, in order to ens&re the implementation of la,s, safe#&ard of citi/ens= ri#hts, and pro$ide 5&stice ,itho&t dela' and in a transparent manner &nder a s'stem of #ood #o$ernance> AND WHEREAS p&rs&ant to )rticles 3( and 3% of the Constit&tion of the 1slamic 4ep&blic of Pa9istan, all citi/ens ha$e a ri#ht to the promotion of social 5&stice and social and economic ,ell?bein# thro&#h efficient, honest and effecti$e mana#ement of p&blic reso&rces> AND WHEREAS the Charter of 0ood 0o$ernance of the Pro$incial 0o$ernment, re6&ires the pro$ision of a comprehensi$e redressal mechanism to address fail&re or miscond&ct on the part of p&blic office holders, ,hile mis&sin# or ab&sin# their po,ers or a&thorit' thro&#h corr&ption, corr&pt practices, misappropriation of propert', recei$in# 9ic9bac9s, commissions and for matters connected and ancillar' or incidental thereto> AND WHEREAS it is e@pedient to pro$ide for a mechanism thro&#h ,hich the reco$er' of 0o$ernment mone' and other assets from P&blic .ffice :olders, ,ho ha$e misappropriated or recei$ed s&ch mone' or assets thro&#h corr&ption, corr&pt practices and mis&se of po,er or a&thorit' can be achie$ed> NOW, THERE+ORE, it is e@pedient to establish an a&tonomo&s and acco&ntable anti?corr&ption instit&tion in the Pro$ince of the <h'ber Pa9ht&n9h,a, in order to promote the inte#rit' and acco&ntabilit' of p&blic sector administration.

B2C 1t shall appl' to all the p&blic office holders, ,ho are performin# their f&nctions, in connection ,ith the affairs and the emplo'ment of 0o$ernment f&nds in the

Pro$ince of the <h'ber Pa9ht&n9h,a and incl&des all those persons, ,ho are in$ol$ed and deals ,ith the transaction and &tili/ation of 0o$ernment mone'. B3C 1t shall come into force at once. 2( De3i!iti !"(---B1C 1n this )ct, &nless there is an'thin# rep&#nant in the s&b5ect or conte@t,? BaC Dacc&sedE means a person in respect of ,hom there are reasonable #ro&nds to belie$e that he is or has been in$ol$ed in the commission of an' offence triable &nder this )ct or is the s&b5ect of an in$esti#ation or in6&ir' b' the Commission, or an' other a#enc' a&thori/ed b' the Commission in this re#ard &nder this )ct> DassetsE means an' propert' o,ned or controlled b' or belon#in# to an acc&sed ,hether directl' or indirectl' or held benami in the name of his spo&se or relati$es or associates, ,hether ,ithin or o&tside Pa9istan ,hich he cannot reasonabl' acco&nt for or for ,hich he cannot pro$e pa'ment of f&ll and la,f&l consideration> DassociatesE means? 3( E"t#4&i"/2e!t 3 t/e C 22i""i !(---B1C )s soon as, after the commencement of this )ct, 0o$ernment shall establish a Commission, to be 9no,n as the <h'ber Pa9ht&n9h,a Ehtesab Commission. 5( C 20 "iti ! 3 t/e C 22i""i !(---B1C !he Commission shall consist of fi$e Commissioners nominated b' the Search and Scr&tin' Committee and confirmed b' the "e#islati$e Committee on 0o$ernance and )cco&ntabilit' in accordance ,ith the pro$isions of this )ct. B2C !he Commissioners shall hold office for one non?e@tendable term of fo&r B04C 'ears from the da' he enters his office and shall not be eli#ible for reappointment for a second termA B3C 2hene$er the office of a Commissioner falls $acant before the completion of the term of the said Commissioner, the "e#islati$e Committee shall, &pon nomination b' the Search and Scr&tin' Committee, appro$e the nomination of a ne, Commissioner for the remainder of the term of the said Commissioner. B4C Fo act or proceedin#s of the Commission shall be in$alid b' reason of absence of a Commissioner or e@istence of an' $acanc' amon# its members or defect in the constit&tion thereof. B10C D&rin# his term in office, if a Commissioner has an' interest in an' matter to be disc&ssed, in6&ired, in$esti#ated or decided b' the Commission, he shall, prior to an' disc&ssion of the matter, disclose in ,ritin# to the Commission, the fact of his interest and the nat&re thereof. Explanation.---3or the p&rpose of this section, a Commissioner shall be deemed to ha$e an interest in a matter if he has an' interest, pec&niar' or other,ise, in s&ch matter ,hich co&ld reasonabl' be re#arded as #i$in# rise to a conflict bet,een his d&t' to honestl' perform his f&nctions &nder this )ct and s&ch interest, so that his abilit' to consider and decide an' 6&estion impartiall' or to #i$e an' ad$ice ,itho&t bias, ma' reasonabl' be re#arded as impaired. B2C !he "e#islati$e Committee shall be chaired b' the Spea9er of the Pro$incial )ssembl' ,hile the Secretar', Pro$incial )ssembl' shall act as the Secretar' of the "e#islati$e Committee. B3C !he "e#islati$e Committee shall ha$e the po,ers to? BaC BbC BcC BdC confirm nominees for the Search and Scr&tin' Committee> confirm nominees for the office of Commissioners of the Commission> re5ect nominee, Commissioners or members of the Search and Scr&tin' Committee b' three?forth ma5orit' $ote> and re$ie, the report presented to it b' the Commission.

8( C !"tit%ti ! 3 t/e Se#$c/ #!1 Sc$%ti!9 C 22ittee( ???B1C !he first Search and Scr&tin' Committee constit&ted &nder section (, shall administer the process of the constit&tion and appointment of s&bse6&ent Search and Scr&tin' Committee and Commissioners respecti$el'. B2C 2hene$er an' seat or position is la'in# $acant in the Search and Scr&tin' Committee or ,here a position of Commissioner is $acant, the Search and Scr&tin' Committee shall fill the position accordin# to the criteria prescribed &nder this )ct. B3C !he Search and Scr&tin' Committee shall comprise fi$e B0 C members of hi#h moral inte#rit', rep&te and stat&re, and at least one of ,hom shall be a femaleA Pro$ided that no person presentl' in ser$ice of 0o$ernment or the office bearer of a political part' shall be a member of the Search and Scr&tin' Committee, &nless s&ch person resi#ns from s&ch ser$ice or part' office, as the case ma' be, at the time of appointmentA B4C ) person shall not be appointed as member of Search and Scr&tin' Committee &nless heA BaC BbC BcC BdC is a citi/en of Pa9istan> is an indi$id&al ,ith rep&tation of hi#h moral inte#rit' and competenc'> is not less than fort'?fi$e B4 C 'ears and more than se$ent'?fi$e B( C 'ears of a#e d&rin# the 'ear of selection> and declare his assets as per la,.

B C E@cept for members of the first Search and Scr&tin' Committee, ,ho shall be appointed thro&#h proced&re prescribed in section (, the Search and Scr&tin' Committee shall be responsible for initiatin# the process for appointment of s&ccessor member or members of Search and Scr&tin' Committee si@ B6C months prior to end of ten&re of members of the Search and Scr&tin' Committee or immediatel' &pon creation of a $acanc', as the case ma' be, and the process for nomination of Commissioners prescribed in section %, shall appl' m&tatis m&tandis to nomination and confirmation of members for the Search and Scr&tin' Committee. B6C -embers of the Search and Scr&tin' Committee shall elect one amon#st them as Chair, ,ho shall dischar#e administrati$e responsibilities in relation to f&nctionin# of the Search and Scr&tin' Committee in cons&ltation ,ith the members, and in case of an' disa#reement decisions ,ill be reached b' ma5orit' $ote. B(C !he Search and Scr&tin' Committee ma' meet as often as necessar' for the effecti$e performance of its f&nctions and t,o thirds of the members shall constit&te a 6&or&m for a meetin#. B%C -embers of the Search and Scr&tin' Committee shall ser$e for one non? e@tendable term of fo&r B04C 'ears on an honorar' basis and shall not be rem&nerated for their ,or9A Pro$ided that all e@penses related to f&nctionin# of the Search and Scr&tin' Committee shall be borne b' the Commission, and the Commission shall also pro$ide secretarial staff to the Search and Scr&tin' Committee to assist its f&nctionin#. B+C ) member of the Search and Scr&tin' Committee ma', b' ,ritin# &nder his hand addressed to the 0o$ernor, resi#n from his position. B10C ) member of the Search and Scr&tin' Committee shall not be remo$ed &nless b' three?fo&rth ma5orit' $ote of members of the "e#islati$e Committee on the #ro&nd of miscond&ct or for ph'sical or mental incapacit' &pon s&ch declaration bein# made b' a -edical Joard constit&ted b' 0o$ernmentA Pro$ided that the "e#islati$e Committee shall afford s&ch member the ri#ht to be heard prior to $otin# on his remo$al. :( A00 i!t2e!t 3 t/e 2e24e$" 3 t/e 3i$"t Se#$c/ #!1 Sc$%ti!9 C 22ittee(--B1C )fter the commencement of this )ct, 0o$ernment, ,ithin fifteen B1 C da's, shall nominate candidates as pro$ided in s&b?section B3C of section 6, at least one of ,hom shall be a female, and send s&ch list to Secretar' and sim&ltaneo&sl' p&blicl' disclose the list of recommended candidates for scr&tin' in$itin# comments and ob5ections from the p&blic a#ainst s&ch nominees to be sent directl' to Secretar' ,ithin a period of si@ B06C da's. B2C 2ithin se$en B0(C da's of receipt of the list of nominees from the Search and Scr&tin' Committee, the Secretar' shall circ&late to members of the "e#islati$e

Committee the list of all nominated candidates to#ether ,ith p&blic comments and ob5ections recei$ed in relation to s&ch nominees. B3C 2ithin se$en B0(C da's of receipt of the nominations b' members of the "e#islati$e Committee, and in $ie, of the p&blic comments and ob5ections recei$ed in relation to s&ch nominees, the "e#islati$e Committee shall confirm the nominees &nless it re5ects a nominee b' three?fo&rth ma5orit' $oteA Pro$ided that if the "e#islati$e Committee neither confirms a nominee nor re5ects him b' three?fo&rth ma5orit' $ote, s&ch nominee shall be deemed to ha$e been confirmed. B4C 1f a nomination is re5ected b' the "e#islati$e Committee, it shall comm&nicate its decision to 0o$ernment and 0o$ernment shall nominate another candidate ,ithin se$en B0(C da's of s&ch re5ection and res&bmit the name of s&ch candidate to the "e#islati$e Committee in accordance ,ith the proced&re hereinabo$e prescribed. B C Fot later than one B01C da' of the confirmation or deemed confirmation of nominees, the Secretar', shall send the names of the nominees confirmed or deemed to ha$e been confirmed to the 0o$ernor for appointmentA Pro$ided that if the 0o$ernor fails to ma9e s&ch appointments ,ithin a period of ten B10C da's of receipt of the list of nominated candidates, s&ch nominated candidates shall be deemed to ha$e appointed and 0o$ernment shall iss&e notification accordin#l'. B6C !he pro$isions of s&b?section B6C, B(C, B%C, B+C and B10C of section 6 shall appl' m&tatis m&tandis appl' to first Search and Scr&tin' Committee, appointed &nder this section. ;( P$ ce1%$e 3 $ #00 i!t2e!t 3 C 22i""i !e$"(--- B1C !he Search and Scr&tin' Committee shall see9 applications for the position of Commissioners from the #eneral p&blic thro&#h p&blic ad$ertisementA B2C Fot,ithstandin# an'thin# contained in s&b?section B1C, the Search and Scr&tin' Committee ma' recommend to the "e#islati$e Committee, the name of an' person of hi#h rep&te, inte#rit' and stat&re, to be appointed as Commissioner, ,ho had not applied &nder s&b?section B1C.
