6 QUESTION OF PRIVILEGE OF DEPUTY SPEAKER APOSTOL Rep. Apostol rose to appeal to the government agencies concerned to expedite the repair of damaged infrastructure in the Second District of Leyte, and to express his utmost gratitude, in behalf of his constituents, for the outpouring of assistance that they received in the aftermath of super Typhoon Yolanda from the President and other Executive agencies, Members of Congress, private companies and nongovernment organizations, whose names he read into the records. REFERRAL OF DEPUTY SPEAKER APOSTOLS SPEECH On motion of Rep. Durano, there being no objection, the Body referred Rep. Apostols speech to the appropriate Committee. THE PRIVILEGE HOUR At this point, it being a Monday, on motion of Rep. Durano, there being no objection, the Chair declared a Privilege Hour. Thereafter, the Chair recognized Rep. Neri J. Colmenares of Party-List Bayan Muna for his privilege speech, upon motion of Rep. Durano. PRIVILEGE SPEECH OF REP. COLMENARES Rep. Colmenares delved on the Marcos Human Rights Compensation Act which Congress passed a year ago. He however lamented to date the refusal of President Benigno S. Aquino III to implement said law and appoint the members of the Compensation Board that would give recognition and reparation to the human rights victims during martial law. He stressed that he cannot fathom the reason of the President for not implementing the law considering that the compensation money came from a Swiss bank and not from the government coffers. Stating that he himself was a human rights victim during martial law, he said that he cannot benefit from the compensation package considering that he is one of the main authors of the law. He stressed that the refusal of the President to implement the Human Rights Compensation Act would delay the application process of the thousands of victims who have long waited for recognition from the government for the violation of their human rights, some of whom are now old or have already died.

MONDAY, DECEMBER 2, 2013 He then urged his colleagues to use their oversight functions and investigate the reasons of the President for his continuing refusal to implement the law and likewise enjoined the human rights victims to assert their rights under the law. REFERRAL OF REP. COLMENARES PRIVILEGE SPEECH Thereupon, on motion of Rep. Durano, there being no objection, the Body referred the privilege speech of Rep. Colmenares to the appropriate Committee. ACKNOWLEDGMENT OF GUESTS Rep. Durano acknowledged the presence in the Session Hall of guests of Rep. Vicente J. Alcala. Thereafter, on motion of Rep. Durano, the Chair recognized Rep. Barry Gutierrez of Party-List Akbayan for his privilege speech. PRIVILEGE SPEECH OF REP. GUTIERREZ Rep. Gutierrez rose to commemorate the observance of World AIDS Day and discuss the urgent issues related to HIV/AIDS. As he noted the beginning of the countrys declaration of war against the disease with the passage of Republic Act (RA) No. 8504 or the Philippine AIDS Prevention and Control Act of 1998, he cited the governments action in curbing and stabilizing the spread of HIV and AIDS and the positive developments in the global arena. Considering the rise in the number of HIV/AIDS cases in the last 15 years and the shifting trends as well as changing dynamics in the demographics of people affected by the disease, Rep. Gutierrez stressed the need for Congress to craft measures that will prevent and control its spread. He said that despite government efforts to address this concern, the treatment and prevention is largely saddled by the countrys traditional values and culture thus giving the people a limited understanding of the disease. He then cited cases of continuing stigma and discrimination against the victims and their families; emphasized the need to equip the people with information on how to stay healthy and avoid HIV/AIDS infection; and stressed the need to provide adequate funds to the health sector to enable it to perform its tasks of giving treatment and support services to the affected persons.

On motion of Rep. Oscar Richard S. Garin Jr., there being no objection, the Body referred Rep. Gutierrez privilege speech to the appropriate Committee.

Rep. Seeres discussed with Rep. Rodriguez (R.) the apparent lack of involvement of the MNLF and Bangsamoro Islamic Freedom Fighters (BIFF) in the governments current peace talks with the MILF, as well as the importance of the participation of all rebel groups for a successful peace negotiation in Mindanao. EXTENSION OF THE PRIVILEGE HOUR On motion of Rep. Tugna, the Body extended the Privilege Hour by 20 minutes. INTERPELLATION OF REP. SEERES (Continuation) Thereupon, Rep. Rodriguez (R.) took note of and commended Rep. Seneres contributions to the peace process in Mindanao, especially in the forging of the governments peace accord with the MNLF during the Ramos Administration. He also agreed that all stakeholders to the Bangsamoro issue should be consulted to bring about lasting and inclusive peace in the region. MOTION OF REP. TUGNA As Rep. Tugna was about to make a motion to refer Rep. Rodriguez (R.) speech, Rep. Jonathan A. Dela Cruz sought recognition from the Chair. SUSPENSION OF SESSION On motion of Rep. On further motion of Rep. Garin, the Chair recognized Rep. Rufus B. Rodriguez from the Second District of Cagayan de Oro City to deliver his privilege speech. PRIVILEGE SPEECH OF REP. RODRIGUEZ (R.)

Rep. Rodriguez stated that the day marks the culmination of the Mindanao Week of Peace, a weeklong commemoration of the desire for genuine and lasting peace in Mindanao. He lamented that the country has grown weary of the continuous insurgency problems in the area, and that attempts to resolve the social and economic concerns of its people have taken a backseat because of other issues and calamities now besetting the nation. As a trueborn Mindanaoan, he enjoined his colleagues to be more compassionate to their brothers and sisters, especially the silent majority who has become casualties of war.

He thereafter referred to the signing in 2012 of the Framework Agreement on the Bangsamoro (FAB) which represents the dreams of the entire Bangsamoro people, and which further ignited when early in the year, the President issued Executive Order (EO) No. 120 creating the Transition Commission on the Bangsamoro that will draft the Bangsamoro Basic Law and ensure that its charter will reflect the goals and aspirations of its people. After describing the status of the annexes to the FAB which are still being formulated, Rep. Rodriguez urged his colleagues to give the proper democratic processes a chance to work. He also called on the Moro Islamic Liberation Front (MILF) and the Moro National Liberation Front (MNLF) to unite for the peace and development of their region. Thereafter, on motion of Rep. Sherwin N. Tugna, the Chair recognized Rep. Roy V. Seeres Sr. for his interpellation.

Thereafter, the Chair recognized Rep. Isidro T. Ungab, chairperson of the sponsoring Committee, to deliver his sponsorship speech on the measure. SPONSORSHIP SPEECH OF REP. UNGAB Rep. Ungab said that the 2013 General Appropriations Act (GAA) was passed and signed into law the previous year by President Benigno S. Aquino III as RA No. 10352 to serve the interest and needs of the Filipino people. He thereafter adverted to Section 63 of the said law and explained that it had to be amended to provide budgetary relief to national government agencies and local government units in their endeavor to address the series of man-made and natural calamities that had struck the country and which require a continuous program of rehabilitation, reconstruction, and aid. Rep. Ungab enjoined the Members to approve House Joint Resolution No. 7. On motion of Rep. Gonzales, the Chair recognized Rep. Dela Cruz for his interpellation. INTERPELLATION OF REP. DELA CRUZ Rep. Dela Cruz initially sought clarification on the issue of extending the validity of appropriations under the Calamity and Quick Response Fund to include the specific amounts therein under the 2013

He further underscored the constitutionality of the use of these funds as lump sum allocations for calamity, contending that there could be other budgetary appropriations for other forms of expenditures. Rep. Ungab replied that the Committee on Appropriations will only be able to determine the exact figure of the funds that are available and left unused by the end of December 2013. He explained that of the remaining total unused fund amounting to P133 billion under the 2013 GAA, several hundred billions from the Calamity Fund and the Quick Response Fund had already been released to various government agencies. SUSPENSION OF SESSION On motion of Rep. Gonzales, the Chair suspended the session at 5:53 p.m. RESUMPTION OF SESSION At 5:55 p.m., the session resumed. INTERPELLATION OF REP. DELA CRUZ (Interpellation) Rep. Ungab provided further clarification on House Joint Resolution No. 7, citing that the measure intends to extend the validity of unused appropriations, except for Personnel Services, under the 2013 GAA until 2014 in view of the present circumstances of the country. He explained further that practically all of the budgetary appropriations in the 2013 GAA will constitute the available and unused appropriations under the measure. Ungab delved on the Filipino spirit to rise against adversities in light of devastating typhoons, the Moro National Liberation Front (MNLF) siege in Zamboanga City, the 7.2 magnitude earthquake in Bohol, Cebu and neighboring provinces, and super typhoon Yolanda which wrought havoc in several areas in the country. As he noted the Filipino peoples spirit of resilience and ability to prevail over any adversity, he stated that the needs for relief, rehabilitation and reconstruction in the devastated areas are enormous and require urgent attention considering that the victims not only lost their loved ones but also their livelihood, homes and other personal properties and that the government should not allow them to lose their spirit of rising again. Rep. Ungab thereafter stressed the essence of bayanihan that has given hope to the typhoon victims, and emphasized how the Members, individually and collectively, have given their share for the relief efforts. However, he emphasized that Congress is still called upon its task of ensuring that the people would rise from these calamities, and explained that through House Bill No. 3423, the proposed P14.6 billion 2013 supplemental budget would be used for the rehabilitation and reconstruction of permanent structures, including other capital expenditures for disaster operations and rehabilitation activities in areas affected by said calamities and disasters. He concluded that the Bill would also give fresh hopes to fellow Filipinos in having a new and better future, and asked his colleagues to support it. Thereafter, on motion of Rep. Durano, the Chair recognized Rep. Tupay T. Loong for his manifestation. MANIFESTATION OF REP. LOONG On behalf of the Muslim Members and other members of the Committee on Muslim Affairs, Rep. Loong manifested the request for an additional budget allocation of P2 billion to be taken from the proposed 2013 P14.6 billion supplemental budget because the earlier allocation for war-torn Zamboanga City is not enough to sustain its rehabilitation and reconstruction through the provision of mediumand long-term programs.

MONDAY, DECEMBER 2, 2013 On motion of Rep. Durano, the Chair recognized Rep. Neri J. Colmenares for his interpellation. INTERPELLATION OF REP. COLMENARES After stressing his desire for the government to provide assistance to the people as well as for the rehabilitation and reconstruction projects in the affected areas of the Visayas Region, Rep. Colmenares said that he merely wanted an assurance that the proposed supplemental budget would go directly to the intended beneficiaries. He thereafter raised concern on all the Presidents remaining relief funds, like the Calamity Fund and Quick Response Fund, as well as the available money from the Special Purpose Funds that could be realigned as calamity allocation. He also inquired on the criteria used in identifying and determining the order of beneficiaries, as well as the lack of rehabilitation plan and itemization of funds in the measure. This, as he referred to the recent Supreme Court ruling that prohibits the allocation of lump-sum funds in the national budget. Rep. Ungab thereupon discussed with Rep. Colmenares the governments rehabilitation plans and the budgets for the rehabilitation and reconstruction of the areas devastated by both natural and manmade disasters. The latter questioned the absence of an itemized plan in the proposed bill and expressed his concern that the funds for these plans might not reach the people who are truly in need. Thereafter, on motion of Rep. Durano, the Chair recognized Rep. Antonio L. Tinio for his interpellation. INTERPELLATION OF REP. TINIO At the outset, Rep. Tinio affirmed his commitment to insuring the effective delivery of relief, rehabilitation and reconstruction to all the calamitystricken areas and reiterated the duty of Congress to fulfill their constitutional obligation to act expeditiously, provide the necessary funds and ensure that each peso out of the National Treasury will be accounted for. Rep. Tinio then discussed with Rep. Ungab his following concerns: whether Malacaang conducted a meeting with development partners to outline the initial Typhoon Yolanda recovery and rehabilitation plan and why Congress was not informed of such plan; the scope of the calamity funds in terms of the nature of the covered calamities and geographical areas; and his apprehension on the wide scope and latitude that Congress will be giving to the President if it approves the Bill.

15 Rep. Tinio further cited several contentions against the proposed Supplemental Appropriations, to wit: a) that the supplemental calamity fund constitutes undue presidential discretion and another form of presidential pork; b) that the proposed fund should be subject to line-item budgeting in the exercise of the congressional power over the purse and to deter graft and corruption; and c) that specific amounts of calamity funds must be provided to affected provinces and localities. Pertinent to the budgetary requirement of transparency and accountability, Rep. Tinio debated with Rep. Ungab about the constitutional and legal issues relevant to the enactment of regular and special appropriations in light of the specific provisions of the Administrative Code of 1987 and the Constitution. They further talked about the specific power of the President to augment appropriations. In closing, Rep. Tinio underscored the need for transparency so that the much-needed funds for rehabilitation would not be abused considering that lump-sum discretionary funds had been previously subjected to graft and corruption. Thereafter, on motion of Rep. Jorge Bolet Banal, the Chair recognized Rep. Dela Cruz for his interpellation. INTERPELLATION OF REP. DELA CRUZ Initially, Rep.
