Mental Health Act 1983Individuals must be suffering from a mental health disorder where they need constant assistant and treatment before they are sectioned. They must also have an advocate who can get their point across more clearly, they must also be aware of their rights. If the individual is sectioned then because of this act then they can be giving medication even when it is against the individuals will. After care must be always be provided for those who are no longer sectioned e.g. counselling.

lets them be treat as an individual and prevents them from going to prison for things they might do what break the law as long as they are detained in a mental hospital and here they will get special care.

Mental Capacity Act 2005The Mental Capacity Act provides a framework to empower and protect people who may lack capacity to make some decisions for themselves. They must be empowered to make decisions by themselves, this could be because they have a mental illness, learning difficulties, brain injury or a stroke. They are allowed to make decisions for they if they are capable but if not the decisions have to be made for the individual with them being at the best interest. This act makes sure they dont suffer from disempowerment, marginalisation and makes them have equal opportunities even though they are mentally ill they still have human rights and their own mind but they might need an advocate to do so. It also stops the vulnerable individual getting treated differently because of their age or the way they look, if the person making decisions on them lets age determine their choice then they are breaking the Mental Capacity act 2005.
