Public Policy Think Tanks

We have before us the first edition of the Directory of Think Tanks (organizations and institutions) in Serbia. There was little mention of these organizations in us and, therefore, there are hardly any details about the work of these think tanks1. Think tanks were until 1990 subordinated to the state since it established them, financed them and ordered projects (academic institutions, institutes). Since 1990, the establishment of various nongovernmental, non-profit organizations had begun, which later on grew into nongovernmental think tanks. In the same period, some scientific and research institutes began to detach themselves from the state, some of them even financially and some of them in terms of programs because they got involved, through their research projects, into analyzing and finding solutions to topical social problems. Think tanks dealing with public policy and provision of intellectual services in countries of post-communist transformation played a major role in initiating public political discussions. As independent institutions representing the civil society, think tanks offer high-level independent researches, analyses, studies, strategies and alternative solutions to the ones of the official policy. Everybody benefits from their intellectual services. Nongovernmental organizations and civil movements can obtain expertise and important information. Media can get reliable information, and politicians and those that govern the state relevant arguments and independent reports on the current situation. The importance of think tanks lies in the fact that, apart from analyses and solution finding, they are engaged in enlisting public support to those solutions. They can promote their proposals in public and lobby for their approval. That is why two kinds of think tanks are referred to. One kind is traditional ones that are focused on analyses, high academic standards and independence, while the second ones are active think tanks that concentrate on the advisory role. They are also called action tanks because they try to bring their ideas to the attention of and popularize them not only for politicians but also the public at large. Many think tanks are somewhere in-between the two models endeavoring to make their analyses, advices, ideas as useful as possible to political decision-makers and the public at large.

According to that Directory, 16 NGOs were registered in this group of think tanks. However, there are no among them other expert institutions belonging to think tanks, such as various academic institutes.

The subject of this Directory is think tanks in Serbia. Under them, we mean all those organizations and institutions established by citizens themselves without any mediation or control of the state, as well as the scientific and research institutions established by the state, that are non-party and non-profit and established with the purpose to be engaged in: analyzing topical issues of the social, political, legal and economic systems, initiating public discussions on current social problems and questions, preparing proposals and pointing to possible ways of making changes. The basic objective of the Directory is to get an insight into the situation, number and activities of think tanks. It is intended for domestic and foreign governmental and nongovernmental organizations and institutions as well as donors and it is, therefore, published both in the Serbian and English languages. The Directory covers 22 think tanks in Serbia. It is positive that we have not included all such organizations, as there is still a lot of doubt as to which is and which is not a think tank. However, it is significant that we have begun our work on database of think tanks, and it will be much easier to add to it and introduce changes. Data on organizations were collected in the form of a standard questionnaire equal for all organizations. The questionnaire was completed by representatives of think tanks. The Directory contains an account of members and associates of reference think tank organizations and institutions, their projects and future plans. The data were collected to December 2000 inclusive. Now when our society and state are entering the period of democratic change and reforms full engagement of national think tanks, and cooperation with relevant foreign experts and organizations will be increasingly needed, along with further support of donors2 (both of those who have been present in this area so far and the new ones that are to come to Serbia). For that reason, we are of the opinion that this Directory will be of help to all potential users of results of the think tanks in Serbia.

The Network is engaged in re-evaluation, improvement and protection of the quality of academic education in Yugoslavia. By linking scientific excellence and high standards in education with social relevance and direct participation of students, the Network will create a basis for an allcomprehensive reform of university education in Yugoslavia in the future, and will prevent at least in part the most qualified, educated

young people from leaving the country for good. H Review of implemented projects (19972000) School year 1998/1999 The first lectures in the Network began in the summer semester of 1998/1999 school year. The total of 273 trainees attended 40 different courses within the framework of five programs: Challenges of Modern Theory and Practice of Democracy, Culture Studies, Environmental Studies, History and Epistemology of Natural Sciences, Politics, Individual and Society in the Light of the History of Ideas. Lectures were interrupted on 24 March 1999, due to the NATO intervention, and resumed in autumn so that the courses were completed in November 1999. During the instruction students took an active part and showed exceptional interest in such kind of work. H School year 1999/2000 In this school year, 210 students of the second generation enrolled, 30 each in every program. The semester began on 10 January 2000 and ended in June. The following programs were carried out: Culture and Gender Studies a View from the Balkans, Environment Challenge to Science, Technology and Society, European Law, Public and Local Policy, Administration and Governance, Challenges of Modern Theory and Practice of Democracy, Modern Business and Global Computer Networks, Religion Studies H Procedures and criteria for selection of programs and courses The procedure for selection of programs that will be carried out in the Network take place in the following order: A public announcement in media invites organizations Network Members, other NGOs and individuals The Curriculum Committee evaluates whether formal requirements of the competition are fulfilled Depending on the field covered by the program, the appropriate Division of the Academic Council (Division for Humanities and Social Sciences and the Division for Natural and Engineering Sciences ) appoints two independent evaluators for every program Evaluation and project proposal are submitted to the Academic Council, which after careful consideration gives its own evaluation of the program The Managing Board takes a final decision based on the recommendation of the Academic Council H Criteriafor the selection of programs and courses are as follows: Programs must be of high academic level, designed on the basis of the latest relevant theoretical knowledge Problem-oriented, multidisciplinary programs are preferred to the traditional discipline-oriented curricula of the state universities; Basic principles are openness and flexibility, academic freedom and active participation of both lecturers and students Programs proceed from the actual needs of students and aim at developing their capacity for critical thinking and responsible acting in their respective fields;

Social relevance of the course subject Interactive teaching and learning methods: lecturers should act as initiators and coordinators rather than as "lecturers", and rely on methods such as workshops, study groups, mentoring and discussions. H Criteria and procedures for the selection of lecturers Criteriafor selection of lecturers for Network programs include the following: Bibliography relevant to topics of the program/course the lecturer concerned is to take part in lecturing experience in national and foreign universities, and in alternative educational institutions academic title and acquired academic degree Hence, the procedure for selection of lecturers is connected with the procedure for program selection to be executed in the Network , and includes the following stages: authors of the submitted programs suggest lecturers for particular topics, attaching their CVs and a list of publications relevant to the topic independent program evaluators are obliged to give their opinion on competence of the proposed lecturers in conformity with given criteria Divisions of the Academic Council decide, on the basis of the proposed program project and independent evaluation, on competence of the proposed lecturers H Visiting lecturers from universities and scientific institutions in the country and abroad would always contribute to the quality of programs and to diversity of ideas to be offered to Network students. H Ongoing projects 1. Society and History interdisciplinary study of the Balkans social his tory Interdisciplinary study of the contemporary social history of Serbia in the Balkans and European context. Interaction of social and historical structures, including also individual and collective actors, mutual relationship of structures, events and persons, processes and crises and their social and historical consequences. H Compulsory Courses The first semester The Balkans at the time of Europeanization and Modern (19th and 20th - cen turies) History of Europe in modern era (since the end of the 18th to the end of the 20th century) The second semester Modernization process in Serbia: economic, political and social aspects Serbian society in transition H 2. European Studies legal and political aspects Transformation of Europe after the end of the cold war raised a series of questions on the future structure and form of European international policy. European organizations that had been limited to Western Europe before 1989 are rapidly enlarging to the east. Whether that connection will lead to their full integration or not, all former socialist countries need

today well informed experts who will help their societies and economies to integrate into this enlarged Europe. This applies the more so to Yugoslavia. The moment the transition begins, there will be strong need for experts who will be able to deal with the matters in a competent and versed manner. Education of such experts is the program objective of the European Studies. H Compulsory Courses The first semester European Union: European political identity and international relations Methodology of the humanities The second semester Theories and concepts of international relations Human rights in the world of states H 3. Political Theory and Practice of Democracy comparative perspective The objective of the project is to analyze, through compulsory courses, relevant world knowledge of modern state and civil society ( including challenges faced by modern liberal democracy in conditions of internationalization and globalization of over-all social processes), of present-day political theories of democracy, ethnos issues, nation, nationalism and democracy, and of problems inherent in liberal-democratic transition in Southeastern Europe. A combination of compulsory courses with the optional ones should afford an opportunity to students to acquire theoretical and practical-political knowledge and skills to reach, on their own, answers to the mentioned questions of relevance to the community they live in, and to questions that are of relevance in general to modern theory and practice of democracy. Students of social sciences should be informed in a multidisciplinary and systematic way (including historical, sociological, philosophic, cultural, socio-psychological and economic approaches) of major problems, discussions and theoretical contributions in the field of democratic legal and political theory. H Compulsory Courses The first semester Civil society and modern state: challenges of liberal democracy Modern political theory and democracy The second semester Ethnicity, nationalism and democracy Democratic policy in Southeastern Europe H 4. Culture and Gender Studies a View from the Balkans Research and educational strategy of Cultural Studies, as defined in the university curriculum it originated from, implies viewing the totality of cultural production as a text/context, and from that starting point raises questions of the phenomena of knowledge and power, discourse and practice favoring or impeding individuals and groups in their social life. A need for such an educational program derives from converging tendencies of communication and information technologies, including all transmission media and converging of social realities (postmodern culture and globalization). Some of the questions in such a devised research and educational program are as follows: o What are the ways and forms of structuring knowledge, power,

authority, language, institutions o What is the relation between global and local knowledge and cultural patterns, in what way and to what extent cultural processes reflect and create social relations o what are manifest forms of diversity in culture (sex, race, nation, language, class). H Actual milieu of would-be trainees of the Alternative Academic Educational Network raises in very acute form questions of prejudices and wrongful interpretations of cultural identity and ways of its manifestation through various forms of behavior. Re-examination of these stereotypes, establishment of a critically-based attitude towards ones own cultural identity and the culture of others as well as development of ideas of tolerance, especially among the young, are most positively necessary preconditions for the change of social situation. We are, therefore, of the opinion that an interdisciplinary program devoted to these issues has necessarily to be an integral part of activities of the Academic Network in view of its program orientation towards problem-defined contents which in a critical and creative manner reappraise developments in our present environment. Transition and Reconstruction : challenges and opportunities on the way to Europe The region of Southeastern Europe (SEE) is the most conflicting area in Europe today and one of the most complex cockpits of instability in the world. Long standing inter-ethnic, inter-cultural, religious, border and other conflicts marked the history of the region. The key question facing today countries of SEE, but also Europe and the whole international community, is whether there is readiness and ability to open up the questions of substance relating to pluralism and coexistence. Are there institutions at various levels from state, through the private sector and all the way to all other institutions of civil society which are able to promote the issues comprehensively and undertake responsibility for development of societies that will be open to multi-religious, multi-ethnic and multicultural developmental processes? International community is faced with a major task of recognizing the complexity and stratification of relations in the most backward region of modern Europe. Simultaneously, countries of the SEE have to develop activities aimed at providing information of modern developments in Europe. SEE needs a "European" model of development, with European system of values. A technocratic and social-democratic dimension of development is needed. Countries of the SEE have to secure to their citizens participation in democratization processes so as to cope with widespread bureaucracy prevailing both in the state itself at all levels and in cre14

ation of conditions for development of private sector, and in civil society development. This is closely connected with the necessity to affirm legal state vis--vis widely spread patronage of the state. Once these institutions are developed in SEE, then the possibility that the Region might fall into a trap of parochialism in a world where globalism prevails will be eliminated. Therefore, the program is designed in such a way to familiarize students with theoretical concepts and practical experiences of political and economic transition of the countries of Central - East Europe; necessary institutions and mechanisms for civil society and market economy building; challenges and opportunities offered by globalization and transition processes; models of reintegration and reconstruction of a country in SEE; processes of euro transition and eurization, etc. H Compulsory Courses The first semester Transition to democracy Transition economics The second semester Globalization and transition Institutions of civil society and market economy H 6. Living Environment a challenge to science, technology and society Industrial revolution and rapid development, with profit as the only yardstick of efficiency, has been perpetrated by way of uncontrolled exploitation of all available natural and human resources which unavoidably lead to undreamed-of dimensions of upsetting the natural ecological balance, degradation of environment, both natural and material , and social ones. Aware of perilous effects of further development of such a situation, developed societies pinpoint the problem and make efforts to put a stop to such an unfavorable development and, as far as possible, restore degraded environment, either by natural or artificial interventions, into its natural condition. The task is multilayered and distinctly multidisciplinary and interdisciplinary in character, comprising its social sciences, technological, social, political and legal aspects. A logical consequence of such an attitude was also development and spreading of academic, governmental and nongovernmental institutions the task of which is to analyze and study the developments that occurred, preparation of suggestions, proposing and taking measures with a view to accomplishing the mentioned tasks. Our society must not remain blind to these facts, it will have to take a number of measures to keep and preserve its place in the family of European societies. Unfortunately, without necessary intercooperation of all the relevant agents and without international cooperation, implementation of these measures will be very slow (accompanied with huge resistance) and isolated. Topics of the programs are conceived in such a way that they provide opportunity to listeners to identify some basic theoretical and empirical problems, but also the ways in which the contemporary science establishes connections between ecology, technology and society. By their choice of courses in the second and third semesters, listeners opt for a

more detailed examination of one or more partial disciplines, related to the problems of maintenance and regeneration of healthy living environment. Reports are published both in the Serbian and English languages, and regularly comprise a comparison of Yugoslav laws and regulations with international standards binding on Yugoslavia, an analysis of the application of those laws in practice, an account of the most drastic cases of human

rights violation in that year and an over-all evaluation of human rights in the year under review in comparison with the preceding period. The Center took pains, whenever circumstances allowed, to attend sessions of the UN Commission on Human Rights, its sub-committee for the prevention of discrimination and protection of minorities or various UN committees for supervision over the respect for individual human rights, and to provide information, on such occasions, on situation in Yugoslavia. The Center communicated also to the UN Committee Against Torture a report on torture in Yugoslavia, as a response to the periodic report of the Government of the FRY (November 1998) on the implementation of the Convention Against Torture and Other Cruel, Inhuman and Degrading Punishments or Procedures. When the government of the FRY submitted to the Committee for Economic, Social and Cultural Rights its periodic report on the implementation of the International Covenant on Economic, Social and Cultural Rights, the Center informed the Committee of the results of its analysis of the Yugoslav legislation and its application in practice. The Committee requested the Government of the FRY to submit another report, while a representative of the Center was invited to attend the meeting of the Working Group, in May 2000, preceding its plenary session. H Legal service When the Law on Universities of the Republic of Serbia was passed in 1988, the Center began to provide legal aid and representation in its premises. Thus, teachers of the Law School in Belgrade, who have soon become victims of that law, opened with the help of lawyers of the Center, a Legal Clinic to help their colleagues from other university faculties. Some of the proceedings that started at that time ended, while some of them still last. Teachers of the Law School in Belgrade who opposed the new Law on University of Serbia registered in 1998 Center for Advanced Legal Studies, one of the basic tasks of which is provision of legal aid. The Belgrade Center cooperates closely with this organization. Tea Gorjanc, Ph.M. and Vladan Joksimovic of the legal service of the Belgrade Center, who underwent special training for human rights lawyers in the country and abroad, provide twice a week free legal aid in the premises of the Center for Advanced Legal Studies. Belgrade Center for Human Rights, i. e. its members, represent aggrieved persons before international bodies, such as the European Court for Human Rights. Three offices of the Center outside Belgrade provide also free legal aid. H Humanitarian activities Major humanitarian activity was taking place in Kraljevo where the Center distributed so far clothing, footwear, eiderdowns and packages with the most essential foodstuff and hygienic articles (since September 1999 to September 2000) to displaced persons in 13 collective centers. Thanks to the Norwegian peoples assistance and individual donors, the Center bought clothing for 29 parentless children who found refuge in a church at Prizren. With its modest means, the Center tries to improve the situation of and help refugees from Croatia, Bosnia and Kosovo who

are put up in a resort on Mt Tara as well as to certain groups of Roma in settlements in the surroundings of Belgrade. H Basic program orientation Center for Womens Studies in Belgrade has been functioning since 1992 as an alternative, interdisciplinary and comprehensive education project covering teaching, research and publishing. Education Courses Center for Womens Studies in Belgrade organizes undergraduate courses based on a program of one-year studies covering the basic course and optional courses. The basic course, which is compulsory for awarding a certificate, has an interdisciplinary approach and gives a survey of contemporary theories in the filed of gender studies. The course deals with topics in the area of humanities and social sciences, arts and natural sciences. Optional courses have to cater for most diverse interests of our students. They deal, in the same way as short cycles of lectures, with topics of ecofeminism, human rights, violence against women, epistemology, peace studies, etc. A long-term strategy of the Center for Womens Studies is introduction of gender studies into university education programs, and intention to develop also within the framework of these studies receptiveness for topics such as the minority rights and the right to be different. The Center for Womens Studies in Belgrade brings lecturers (both male and female) of related programs from foreign universities and supports visiting lecturing of its lecturers at other universities all over the world. Since its members are Law School professors, both active and those who were dismissed under the University Act (1998), from different areas philosophy, theory of law, positive law, sociology, economics and history - the Center is in a position to organize quickly, orderly and certainly in a qualified manner all sorts of educational programs for students, appropriate professions (journalists, teachers, judges, attorneys..), government services (army, police, legal aid service, humanitarian organizations and centers), individual categories of the population unaware of the rights they are entitled to and of the possibilities to exercise them (Roma, displaced and expelled persons), associations (of the handicapped, professional, students, nongovernmental) and other persons and organizations concerned. Center is ready and willing, taking into account its professional references and understanding of needs, to take part in this kind of activity in the whole territory of Yugoslavia, and also in the region, at the invitation of international organizations. In addition to the educational activities referred to, the Center offers an opportunity for professional and scientific communication in a professional circle concerned in the form of seminars, debates, round tables, colloquies and conferences. This is particularly important because, as far as current events related to the state, law and politics are concerned, results of these consultations can be presented to government bodies as expert opinions, model laws, expert analyses of the existing legal solutions, helping in that way to reform the state and legal order. A team of the so-called lawyers practitioners (attorneys and deposed judges gathered together in the CALS), on the other hand, is able to provide daily, selective free legal aid to organizations and individuals concerned: from counsel, writing of submissions to representation and seeing to it that decisions of the competent, primarily court bodies, are carried into effect. Similarly, thanks to their expert knowledge in the field of practical functioning of the legal system, they can also be practically

involved in research projects, training and preparation of law graduates, junior barristers and court associates for work in the judiciary, making analysis of the existing legal regulations and suggesting their improvements, and commenting on the existing court practice and its advancement. In conditions of a decade long neglect of education in general, including the legal one, on the part of the officialdom, publishing activity and the library of CALS are of special significance in which, the latter still being a modest one, there is huge interest, especially by undergraduates and post-graduates. CAA is nongovernmental and nonprofit organization which stands for peaceful solution of conflicts and regional cooperation, promotion of human rights, civil society building and development of democratic institutions. In the initial three years, CAA organized numerous antiwar manifestations, public protests, provided protection to those who refused to take part in armed conflicts, to victims of religious, national and political discrimination. In December 1992, CAA organized an international conference on war crimes committed in war conflicts in the territory of former Yugoslavia, giving an initiative for the establishment of the International Court in the Hague. Since 1993, CAA has been developing projects and programs, the longterm objectives of which are as follows: a) establishment of peace in the region through education and practice on nonviolent conflict solution; b) spreading awareness of human rights and provision of protection to victims of discrimination and repression; c) building of civil society and democratic institutions.

There are three groups within the CAA: Political Team 2000 an expert group dealing with activities of democratic forces the objective of which is to democratize Yugoslavia with the least possible delay and to bring it out of years-long crisis by a peaceful solution of pressing, political problems. The leader of the Political Team 2000 is Dr. Vesna Pesic, CAA director. Human Rights Council a group dealing with human rights through spreading the culture of human rights, education of citizens and provision of legal aid. Since 1995 it has been cooperating with the International Federation of Human Rights Leagues - FIDH (Paris, France), and since 1997, it is the full member of FIDH. There is also the Solidarity Fund within the Council which provides humanitarian and material aid to persons who were exposed to repression by the authorities due to the expression of their civil and political convictions. Coordinator of the Council is Aleksandar Resanovic, lawyer. Group for Development of Civil Society and Human Rights Monitoring deals with civil society building at the local level, monitoring of ethnic, religious and other rights of national minorities and Roma. Ongoing projects Fostering civil activism at the local level The Center for Antiwar Action has been developing for already three years, in cooperation with five regional centers, a program based on the promotion of development of independent civil society and democratic political system in Serbia, rise in pro-democratic civil activism and promotion of citizens awareness of basic principles of democratic processes, civic responsibility and human rights, and making the cooperation and exchange of information among civil groups in Serbia easier by developing a strong network of nongovernmental organizations throughout the country. The project has been implemented in cooperation with 5 organizations from the provinces in Serbia: Civil reading room LIBERGRAF Uzice, Board for Civil Initiative Nis, Center for development of civil society Zrenjanin, Center for development of democratic society Kragujevac and Center for peace and antiwar action Cacak. Basic activities of the five regional centers, coordinated by CAA in Belgrade, have been carried out in the one-year period after the September elections in Serbia, through city meetings, educational seminars and workshops. Coordinator of the Project: Jelena Savic State violence against citizens The basic objective of the project is protection of citizens against violence perpetrated by the state and raising of awareness of citizens including also officials in government bodies about the need to eliminate violence. CAA also wants to popularize the UN Convention against Torture and to inform citizens and official persons about provisions of the Convention, other relevant international documents, and appropriate legislation of the FR Yugoslavia, prohibiting state violence against citizens and guaranteeing the exercise of human rights. Along these lines, basic activities of the CAA are to encourage and educate official persons to treat citizens humanely and in accordance with law, and to register victims of state violence and collect their testimonies. Likewise, CAA organizes provision of legal aid to victims of state violence before the UN Committee against Torture. Finally, CAA organizes provision of humanitarian and financial assistance to victims of state violence and to their families. Coordinator of the Project: Aleksandar Resanovic Opening of police files The basic objective of this project is to rescind all those statutory provisions authorizing state security services to collect and keep data on citizens with a view to preventing or limiting in that way the right to privacy and other human rights and freedoms of citizens. In order to accomplish this objective, CAA moved the initiative for passing a law under which files would be opened, with the basic intention that state security services, both at the level of the FR Yugoslavia and Serbia, would be obliged to present to citizens files and collected data concerning them for their inspection. In addition, CAA advocates public destruction of files with data on citizens collected and kept by state security services contrary to the law, along with all files containing data on members and activists of the organization Otpor (Resistance). Finally, for the purpose of establishing legal state and democratization of the society, CAA moved an initiative to pass a law whereby that field would be regulated in accordance with modern international standards, preventing thereby abuse of powers by government bodies and securing an efficient protection of the right to privacy, and

Initiator and promoters of the Political Team 2000 are Dr. Vesna Pesic, CAA director and Dr. Ljiljana Bacevic, director of the Center for researches in the sphere of political sciences attached to the Institute of Social Sciences. Within the project, a biweekly newsletter made available to general public is published . SerbianAmerican dialogue on the NATO intervention The objective of the project is to establish dialogue among experts from various social sciences fields, from Serbia and the U.S.A., on justification of the NATO intervention, with reference to existing standards of the international law and conditions for peaceful conflict settlement. Preparations for the future building of democratic institu tions in Yugoslavia Education of activists through participation in practical exercises in strategic planning and management, with a view to strengthening democratic institutions in Serbia and Montenegro, understanding of concepts and trends of modern management for the purpose of a more adequate preparation for the constitution and development of democratic institutions, development of successful strategic plans for diverse spheres of social activity, development of strategic associations and possibilities for cooperation among different organizations. Friendship clubs This project is experimental in character and deals with development of friendly relations between the countries that were at war in the period 1991 1995. Opening of friendship clubs between Serbia and Croatia and between Serbia and Bosnia and Herzegovina in the first phase of the project, and then between Serbia and the remaining countries of the region, represents a step towards the future development and peace in the Balkans, development of awareness of belonging to the common region and Europe, promotion of tolerance, understanding and friendship among the peoples, development of concrete and lasting forms of cooperation between professional, social and cultural organizations. Preparations are made for meetings of sociologists and historians from Serbia, Croatia and Bosnia and Herzegovina, aimed at renewing communications and cooperation among professional associations, initiating researches into past events, interpretations of events, exchange of documentation, exchange of experiences in the field of social research, then workshops for constructive conflicts solution and exhibitions of antiwar paintings, books and publications. Workshop on civil control of the army and police a project of seminars/workshops for media and journalists in Belgrade and other bigger cities in Serbia and Montenegro. The Seminar was held in cooperation with Media Center in Belgrade. More than 90 journalists of independent media in Belgrade and 9 other regional centers (Novi Sad, Subotica, Kikinda, Kragujevac, Valjevo, Cacak, Nis, Podgorica, Kotor) took part in the seminars. The seminars were over in April 2000, and communications of seminar lecturers were published in a short study entitled Civil Control of the Army and Police Associates and executioners of the project: Dr. Miroslav Hadzic, Dr. Budimir Babovic, Jovanka Matic, M.Sc., and Milorad Timotic, M.Sc. Normative presuppositions for civil control of the army and police in Serbia/Yugoslavia the purpose of the project is to propose, on the basis of studies and analyses of civil control of the army and police in present-day democratic societies, states in post-socialist transition, and the existing solutions in FRY, solutions for future democratic Yugoslavia. The research began early in 2000 and the first stage was finished in August. The research was conducted in cooperation with the

Those are: Civil-military relations in FR Yugoslavia (18 May 1998) Media image of the Army of Yugoslavia, in cooperation with Media Center from Belgrade (29 September 1998) The military and police in ethnic conflicts, in cooperation with the Forum for Ethnic Relations from Belgrade (4 December 1998) The Army of Yugoslavia on the boundary of the crisis, in cooperation with the Civic Alliance of Serbia (17 August 1999) All mentioned round tables contributed to broaching the question of the civil control of the military in Yugoslavia and received appropriate publicity in independent media. Participants in round table discussions were eminent experts in relevant topics, including university professors Dr. Vojin Dimitrijevic, Dr. Vucina Vasovic, Dr. Pera Sipka, Dr. Sulejman Hrnjic and outstanding military sociologists. H Ongoing projects Human rights protection in the army and police of FR Yugoslavia a research project the objective of which is to describe and analyze very sensitive topics of the state of human rights in these two institutions of force in FR Yugoslavia. Implementation of the project started in June 2000 in cooperation with the Belgrade Center for Human Rights. By development of a number of partial studies an all-comprehensive insight will be obtained into the problems of human rights in the army and police, and on that basis a short manual will be prepared, intended for members of these organizations and other citizens. Results of the research will be presented to the public by posters and at promotional gatherings. The research will be completed in the beginning of 2001. The project is co-financed by the Westminster Foundation for Democracy from London and Freedom House from Budapest. The role of the military factor in the conflict in Kosovo a project of a study which would explore and explain limitations in the application of military force in ethnic conflicts. The project was submitted, early in 1999, to the Know-How Fund in the British Embassy in Belgrade with an application for financial support but later developments (break-up of diplomatic relations) interrupted the procedure of its consideration. New Balkan armies and security of Southeastern Europe a research project having the objective to explain new security situation in the Balkans that have ensued from disintegration of SFRY. Dimensions and challenges of new common security a project of an educational and information seminar for activists of nongovernmental organizations in FRY. The project was prepared at the request of the Konrad Adenauer Foundation in Belgrade but the funds have not been secured yet. Views of the Yugoslav public on the NATO enlargement a project of a public opinion poll in FRY with regard to the NATO enlargement. Comparative advantage of the organization or institution The Center for Civil-Military Relations is the only nongovernmental organization in FRY that managed to gather people qualified to study civil-military relations, that is to deal with theoretical and applicatory aspects of military sociology. This matter was completely disregarded at the time the Center was founded (1997), but it is now already topical, and with democratic reconstruction of our society it will be increasingly so. According to available data, there is no nongovernmental organization in neighboring counties either that would be directly engaged in matters falling within the sphere of work of the Center. Accordingly, the Center could possibly coordinate scientific-research work of similar organizations in immediate neighborhood, or at least give initiatives for joint projects on civil-military relations and security problems in the region.

nongovernmental organizations in Serbia that would found a new NGO, the so-called watch dogagency for fight against corruption. This new NGO would join the network Transparency International as one of its branch organizations. Within the framework of this project, CPS has established cooperation with the Center for Transition from Montenegro, headed by Nebojsa Medojevic. A series of short studies relating to urgent needs for humanitarian assistance in various fields which our Center was also engaged in before. Results of these projects have been communicated to the new authorities of Serbia and Yugoslavia (relevant ministries, above all) but also to foreign donors (EU, UN, USA, etc.). Institutional membership in professional networks associations and unions CPS is the member of SEE PIN network (South East European Policy Institute Network ), linked with the Stability Pact for Southeastern Europe and represents an expert pool of ideas and concepts that should help the Pact development and its more efficient functioning. The Network was established in September 1999, and CPS is national coordinator for Serbia. Within the framework of the Network, a newsletter Stability Pact Watch is published biweekly, providing in individual issues coverage of topical developments and initiatives in the countries of the Region and European Union, which primarily relate to the Stability Pact and strengthening of cooperation in the Region. CPS is a partner institution of the Center for European Policy Studies (CEPS) from Bruxelles in cooperation with which we are working on a number of projects and with which we shall continue to develop cooperation in step with the rapprochement of Serbia (Yugoslavia) to the EU. Since July 1999, the Center is the member of the Europe South-East Policy Forum attached to CEPS, and is also the signatory of the Declaration on Stability of Southeastern Europe . In the near future, CPS intends to make a coalition with a number of other NGOs to fight corruption and create thereby a new NGO as a branch of Transparency International international network for struggle against corruption. H Protocol-based cooperation with national and foreign organizations and institutions We have cooperation based on the protocol on cooperation with quite a number of foreign organizations and institutions, such as CEPS, East-West Institute , SEE PIN, US Institute for Peace (USIP), CEU, etc. The Center is a member of the coordinating board of nongovernmental organizations for pre-election campaign of NGOs Exit 2000. The Center is the member of the Alternative Academic Educational Network (AAEN), consisting of 15 educational and research organizations. H Donors CPS is supported by a considerable number of foreign and domestic donors, among the foreign ones being German Marshall Fund , USAID OTI, Freedom House , Karl Popper Fund , and a small number of domestic ones who want to remain anonymous. H Publishing activity CPS published so far, either on its own or in cooperation with other publishers, four books and about ten shorter reports. Status of national minorities in the states that originated from disintegration of Yugoslavia Experts of the project team made a report on the legislation on minority rights in those countries and practice in its implementation with recommendations to their parliaments and representatives of international community on changes that should be made in the matter. Experts papers were published in a separate publication, and a round table on the agenda of which were those papers was held in Kotor in June 2000. Analysis of the Grey Economy in the FR Yugoslavia and Recommendations for its Legalization G. Bozovic, M Radovanovic, et al (This research project was based on a survey of the gray economy conducted in the territory of the FR of Yugoslavia, whereby a representative sample of 3,000 persons aged 15-75 was used. The survey enabled the linking of a microeconomic analysis of the gray economy, based on the socio-economic, demographic and other characteristics of the parti-cipants, with a global analysis of the gray economy within the scope of overall economic activity. Recommendations were also made as to the method of reducing the volume of the gray economy in the areas of market relations and fiscal and monetary policies, as well as in construction industry. The assessment of the gray economy in the FR of Yugoslavia was based on the supply-supply method, while econometric analyses were based on the Probit and Tobit models, and the Hecksman procedure). Development Strategy of Pharmaceutical Industry in the FR Yugoslavia LJ. Pejin, M. Radovanovic, et al (After the separation of the former republics and the UN Sanctions the satisfaction of domestic drug needs was under constant pressure. Decline in financial resources in the health sector resulted in drug shortages and debts toward drug producers. In FRY there are 7 major drug producers with modern technology which produce drugs of good quality. The objective of the project was to assess the future role of the pharmaceutical industry within the health sector and its role in the economy as well. Major issues considered in the pro73

ject were drug pricing mechanism, drug financing and the state role in the future development of the pharmaceutical sector. The project outlined the future status of the pharmaceutical industry regarding the ownership status, its potentials on the foreign markets, financing of drugs within the health sector and pricing policy). Development Strategy of the Energy Sector in the FR Yugoslavia - G Pitic, J. Galic, et al (The analysis is focused on trends in power consumption and generation, including the relevant projections of energy balances, as well as the possibilities of using the available indigenous energy resources and options relating to imports of energy products. The entire research was devoted to: a) harmonization of economic and power supply development and establishment of a rational industry structure, b) efficient utilization of energy and improvement of its efficiency, c) reliance on domestic energy sources, coupled with the improvement of the existing technologies and the application of new ones, d) the ecological aspect of power supply development, e) an economic-financial analysis of investment requirements. In the elaboration of this study, a multidisciplinary approach was taken by using the Delphi forecast and brain storming, whereby the best solution was sought through multiple iterations). Integration of Refugees and Internally Displaced Persons Trough SME Development Z. Njegovan (The concept of this Program is to enable integration of the refugees and displaced people who are oriented to settle in FR Yugoslavia. The program combined the environmental, development and trade aspects to support private persons, mostly those who have an interest in introducing and improving new technologies in production. In the first phase, some specific aspects and conditions an the local level were researched. Analysis of refugees by location and accommodation - where they settled, the quality of accommodation and living conditions, the structure by sex, age, educational and professional attainments, activity of the members of their households. Parallel, macroeconomic conditions of development were researched, along with all necessary policy measures aimed at the SME development and institutional infrastructure for further expansion and growth of the sector. Some locations were also chosen where 12 concrete projects were proposed for introducing the SME-s, with all necessary aspects (production capacity, technology, production, organization, input and output market analysis, and economic and financial aspects of profitability of the particular project, pay back period, internal rate of return, etc). Strategy and Programs of SME Development in the FR Yugoslavia Z Njegovan, J. Galic (The Strategy covers all aspects of advancement of Institutional, organizational, financial and technical conditions for the development of small and medium enterprises in FR Yugoslavia. It consists of three sections. The first section deals with the condition of and problems associated with development of SMEs in FRY. It presents the SME status in the economic system: financial status, profitability, efficiency and employment. The second section of the Program contains the strategy and policy of further SME development. Chief objectives and key elements for fostering their development are identified . It covers the following issues: financing the SMEs, fiscal policy, the linkage of the privatization process in the country with further development of SMEs, possibilities of creating conditions for SME development in various economic branches, such as agriculture, commerce, trade, tourism, transportation, etc. The third section gives some proposals for institutional

infrastructure necessary for the SME development. It is proposed to establish the federal SME agency and appropriate organizational units for special SME development financing, and a credit insurance and guarantee fund. A presentation is also made of the development of an institutional network of regional and local centers for rendering advisory, edu cational and technical services to SMEs). H Major international projects: Preparatory Assistance Project (PAP), Refugee Integration Area Based Program (UNDP) G. Matkovic, et al (In view of the fact that, with the process of integration, the issue of refugees and other war affected persons is shifting from the humanitarian to developmental sphere, the preparatory assistance project comprises research into the basic criteria at the municipal level in Yugoslavia which should be taken into account in selecting the regions for the integration of refugees and other war affected persons. The importance of this research is reflected in the fact that according to the 1996 census there were 566.278 refugees and war affected persons registered in the FR of Yugoslavia. The project includes: a) area situation analysis for the FR of Yugoslavia; b) analysis of the war affected persons in the FR of Yugoslavia; c) analysis of the employment potentials; d) findings, recommendations and programme outline). Census of Refugees and Other War Affected Persons in the FR Yugoslavia (UNHCR) G. Matkovic, et al (The analysis of the data obtained by the census and formulation of comments and issues stemming from the census results. The analytical report, based on the census data, is formally presented to international organizations providing aid and other relevant international institutions. The United Nations High Commissioner for Refugees, the Refugee Commissioner of Serbia and the Commissioner for Displaced Persons of the Republic of Montenegro jointly carried out the census of the war affected persons who found refuge on the territory of the FR Yugoslavia. The census both in Serbia and Montenegro was the first systematic collection of data on refugees and war affected persons conducted in the FR Yugoslavia. In both republics the census was carried out on an individual basis.). Refugee Household Food Survey in the FR Yugoslavia (UNHCR) G. Matkovic, et al (In 1996, all agencies providing humanitarian assistance programs for refugees agreed to assist only the most vulnerable population requiring food assistance. It was, therefore, necessary to establish the criteria for the new beneficiary population. In this respect, the purpose of this survey is to give the UNHCR more exact and quantifiable data on refugee households and to assess how severely they would be affected if humanitarian food assistance were to be further reduced and eventually completely stopped. The target group was refugee households in the territory of the FR of Yugoslavia. The selection included the persons who were registered in the Census of war affected persons. The whole households of the selected persons were surveyed (cluster sampling). 2004 households with the total of 5864 members were selected). Possible Impact of Recent Socio-Economic Situation in the FR Yugoslavia on Availability of Drugs (UNICEF) Lj. Pejin, et al (the NATO intervention in 1999, caused a sharp fall of FRY economy. It resulted in a sharp fall of average income and rise in unemployment. Available resources for health care protection have declined, and health care expenditures decreased bel75

low US$ 60. The objective of the studies was to assess the impact of country situation on drug availability. Purchasing power was low and health producers had difficulties in maintaining production during the NATO intervention. Major findings were that health sector could not sufficiently satisfy the present drug needs of the population. The burden will fall upon patients, which are already impoverished. Pharmaceutical industry is capable of maintaining production, but there is a large problem related to the health insurance debt to the producers. Humanitarian help is not sufficient. Such a situation will result in drug underuse, as it was reported during influenza epidemic which resulted in a high number of persons infected, with unexpected number of fatal cases). Economic Effects of NATO Intervention on Primary Education - Assessment of Damage and the Necessary Resources for Reconstruction (UNICEF) M. Dinkic, et al (The project assesses damage to facilities in Central Serbia and Vojvodina, estimates damage in terms of displacement and losses stemming from the decrease in the social product caused by the NATO intervention. Authors define the most urgent needs and give recommendations for renewal and reconstruction of primary education). Human Development Report - Yugoslavia 1996 (UNDP) G. Matkovic, et al (Elaboration of the Human Development Report (HDR) for Yugoslavia in 1996 was designed in accordance with the concept of the United Nations Development Program - UNDP. In compliance with the global concept, the report for Yugoslavia contains an analysis of the following: the present state and problems in the economic development sphere, including the gray economy, employment, poverty and income distribution; present state and problems in the domain of public health, pension and disability insurance funds, education and social protection; human rights and freedoms; gender issues; environmental protection; problem of refugees, as well as other related problems). Human Development Report - Yugoslavia 1997 (UNDP) G. Matkovic, et al (The theme chosen for 1997 national HDRs is "social cohesion and human development" with special attention paid to the notion of social exclusion, i.e. marginalization of different social groups and individuals. The expected result of such an approach is to understand and alleviate some of the negative effects of economic restructuring in order to maintain social cohesion. The concept of social exclusion is not equated with poverty but it tends to enable different dimensions of exclusion to interact. Therefore, the report examines the following: economic development and social cohesion, including poverty and social inequality; unemployment; refugees and other war-affected persons; the elderly and pensioners; the gray economy; economic reforms and reforms in the social sector in the conditions created by transition). Human Development Report - Yugoslavia 1998 (UNDP) G. Matkovic, et al (The report examines the changing role of the state by conducting research into the following aspects: legal aspects of the state; the state, economy and banking system, including privatization and restructuring of the economy; social sector and the role of the state; participation; respect for human rights; financing of state and public expenditure. Pejin, et al (Objective of the project was to introduce WHO and World Bank methodology, Global Burden of Disease in order to improve knowledge of a scale of health problems in the country. The methodology should be used for cost effectiveness analysis, priority selection and other decision making at the level of health authorities. Calculations are based upon the statistical data for 1995 . The results obtained were discussed in three ways: as the absolute DALY numbers, as the percentage of the total loss attributable to a specific cause and in relation to the age groups). National Action Plan for Women (UNICEF) G. Matkovic, et al (National Action Plan for Women covers all important fields of womens activities and their position in the society. The project analyses the following topics: a) institutional support for the improvement of womens position, b) women and supply market, c) women and health, d) women, marriage and family, e) women and education, f) violence against women and h) women as agents of change. The expert analysis provides elements for NPA for women in FRY in terms of goals and concrete activities for achieving these goals). Survey on Income and Expenditures in Montenegro (OCHA) G. Matkovic, et al (The main goal of the performed survey is to provide a genuine picture of the socio-economic situation of households in Montenegro, to assess their vulnerability, to discover coping mechanisms, and to obtain more realistic levels of employment and unemployment. Secondly, this survey should represent the basis for a more comprehensive formulation of aid programs, including both humanitarian projects and the increasingly more present development oriented responses). Survey on Pensioner Household for Nutrition and Living Conditions (UN WFP) G. Matkovic, et al (According to the results of the performed survey, 237,000 (one third) of the most vulnerable households were not able to ensure regular nutrition, which means three meals per day. Additionally, based on answers on the consumption of individual items, it might be judged that approx. 557,000 pensioner households (more than three quarters) did not have food enough, except for the most basic items wheat and wheat products. But even this group of items, which consists of the most regularly available products, is in short supply in approximately 380,000 households (more than a half). Other products, like meat, fruit, milk, lag far behind, and luxury products are almost out. Therefore the nutritional equilibrium is dangerously tilted). Indicators for Monitoring National Drug Policies in Federal Republic of Yugoslavia (UNICEF) Lj. Pejin, et al (The manual and tailor-made Excel spreadsheet program are designed for use primarily by national health authorities and other officials that are responsible for implementation of the national drug policy. These indicators could provide a mechanism for monitoring the implementation of major strategies for national drug policy in the country. Some of the indicators could be used as regular indicators for necessary reports on the pharmaceutical situation. their communities. The European Movement in Serbia supports those processes and events that contribute to that objective and promote European values and traditions in Serbia. The European Movement in Serbia supports the promotion of mutual understanding and cooperation of individuals, communities and states in the European area, and encourages all-comprehensive and free communication among them, above all in the fields of culture, media, economy and politics. The European Movement in Serbia, as a part of the International European Movement, takes as a point of departure in its activities full respect for human values, freedoms and rights, achievement of the rule of law and respect for diversity, and all those civilization values on which the Council of Europe is founded. In cooperation with all those that support such orientations, the European Movement is engaged in the creation of political and other conditions for the accession of the FR Yugoslavia to the European Union. This implies resumption and normalization of ruptured ties with European countries, and with former Yugoslav republics in particular. The European Movement in Serbia attaches special attention to work with youth so that ideas of European integration and civil society would be disseminated among those who will be future proponents of the development of democratic and prosperous Serbia. H Review of implemented projects (19972000) The organization is in existence since 14 October 1999. Energy for democracy Information was obtained, in cooperation with the Association of Free Towns and Municipalities of Serbia, about the requirements of cities in crude and fuel oil for heating purposes and forwarded to the European Union; more difficult cooperation with the EU due to sanctions was the reason for bilateral arrangements with some countries, such as Norway and Canada, which delivered energy products in direct cooperation with local self-governments and G17 PLUS; by the end of the heating season, energy products were delivered to 12 opposition towns in Serbia; the EU, local self-government bodies of free towns, the governments of Norway and Canada, IMG international monitoring agency and G17 PLUS cooperated in the project. Establishment of the expert network G17 PLUS by a manifestation called New people for new era, in December 1999, a competi88

tion for admission to membership of the expert network from all over Serbia (55 cities and towns) was completed; a data base was created on experts in local communities who will be engaged in accordance with requirements of individual projects; funds were secured for opening G 17 PLUS local offices and 19 out of the planned 28 ones have been opened so far all over Serbia Asphalt for democracy in the course of summer 2000, the governments of Germany and Norway, in cooperation with local independent authorities and local G17 PLUS offices, delivered 200 tons of bitumen and emulsion for street and road paving in 10 cities in Serbia; the project continues Pre-election campaign G17 PLUS took an active part in pre-election campaign of DOS and Vojislav Kostunica. Program for Democratic Serbia was printed (on the basis of which DOS candidates for federal elections signed the Agreement with Serbia as their commitment to implement the program in case of winning the elections), and White Book of Milosevics Rule , which were distributed to the public at all pre-election meetings of the opposition; 25 meetings were held throughout Serbia where around 250,000 copies of both publications were distributed; three leaflets were printed with the circulation of 4 million copies and were thrown into mail boxes all over Serbia; T-shirts, caps, posters, badges, fliers, flags, cigarette lighters were printed on; 16 video and 20 radio spots were made and broadcasted in local independent RTV stations; cartoonist Predrag Koraksic Corax drew 8 cartoons announcements which were printed in two independent dailies for the whole duration of the campaign; representatives of G17 PLUS appeared in local media every day form 16 August to 21 September; the Drum Company of Dragoljub Djuricic was engaged as a musical background and trade mark of public appearances of G17 PLUS; a concert Smile for Democracy was organized within the framework of the associated campaign The time has come, and the theatrical play Five Star Containerby Dusan Kovacevic was played in many cities where the campaign was going on. Summer school of the labor market policy, August 2000 Regular monthly Newsletter G17 , since January 2000 H Ongoing projects Institute G17 was scheduled to be established by the end of 2000, as a response to radical political changes taking place in Serbia and Montenegro after the victory of democratic forces in federal and local elections held on 24 September 2000. G17 intends to found a major scientific and research center for study of economic processes and application of contemporary developments in the economy, with a view to promoting economic and social advantages of Serbia and Montenegro. At the first development stage, the Institute would provide analytical services to newly-established governments and to the National Bank of Yugoslavia, while at a later date it would prepare economic studies for the FRY, neighboring countries and other countries in Southeastern Europe. The Institute will have the staff of around 60 researchers, the majority of which has already cooperated with G17 and has taken part in its projects. H Review of implemented projects (19972000) In carrying out the global project of the Institute, entitled Europe and Yugoslavia: integration, modernization and transition problems , the following was completed: Processes, institutions and contradictory trends of the European integration from the political, economic and security aspects were theoretically elaborated on; Analysis was made of the problems of the FR Yugoslavia in all essential aspects constitutional-political, economic, social and cultural ones and directions of the society reform from the standpoint of basic social and political targets were indicated; Major problems of the regional Balkan integration were indicated in an interdisciplinary way and the foundation was laid for further research into this complex problem; An insight was had into the general body of problems relating to transition in Eastern Europe and a review of major issues of a detailed comparative research, which will follow as a continuation of the general project, was given. Out of four sub-projects of the Institute, two of them Europe after Maastricht and The FR Yugoslavia in present-day Europe - are completely implemented (including the publication of results), while for the remaining two The Balkans as the European

Region and Transition in Eastern Europe - the results will be published by the end of 2000, while some new projects will be completed in that period. Even before the inception of this Project, the Institute tried to promote in our country the idea of European studies as an interdisciplinary research into complex processes characteristic of integrations, and the place of our country in those processes. This ambitious undertaking implied theoretical-methodological basis for this kind of study, rich analytical and empirical references, many-sided national and international cooperation, and forming both within the Institute and general national scientific potential for a long-term engagement in these matters. With the implementation of this general project, the IES research profile has acquired its final shape, taking into consideration the mentioned general objectives. The Institute is particularly pleased that it managed, by launching many research topics, to gather an enviable young scientific potential that proved to be able, with the assistance of already well established scientific workers in the Institute, to perform proficiently this kind of work. the Institute for Social Sciences is a specialized library in the area of humanities and social sciences. It is also a documentation center of these two research institutions. The Library is an open type one used not only by scientific and professional associates employed in the Institute for Philosophy and Social Theory and the Institute for Social Sciences but free access is also available to other numerous members of other scientific institutes of the Belgrade University, and through interlibrary loan , to members of all Yugoslav libraries. The Library was founded in 1957 and after 40 years of its existence it acquired the holdings of 135.000 volumes of domestic and foreign monographs and periodicals. The main Library stock consists of around 65.000 monograph titles and around 1.770 periodical titles in the area of sociology, philosophy, political science, economics, law, history, demography, etc. H Access to large library networks The Institute for Philosophy and Social Theory has regular exchange of publications with numerous libraries, the major ones being: The Congress Library Washington, D.C. 20540-4180; The Academy of Sciences of Russia. The basic LEX objective is to provide interdisciplinary expert support and assistance in the building of future democratic civil society, legal state and modern market economy. LEX activity consists in: first, provision of direct expert support in designing and promotion of fundamental solutions of the future economic and social system for the needs of all relevant actors, change proponents; second, preparation of concrete models of key, systemic laws (including proposals for constitutional changes) in major fields of economic and social system. In this way, implementers of democratic changes would have prepared models of the most important laws, along with reform solutions, above all in the field of civil liberties and rights and their protection, modern market economy, new education system, etc. that would be harmonized with European legal, economic and other standards; third, widely ramified system of expert education (both before and after elections). H Review of implemented projects (19972000) Illegal deposition of judges independence of the judiciary and legal state The objective of the project was to inform the expert public (judges, prosecutors, attorneys, attorneys general) and citizens concerned in Serbia about the way judges were deposed and possibilities that they might exercise their right to justice in conditions of such independence of courts.

The project was implemented in the form of panel discussion in three cities of Serbia where deposed judges informed the public of legal ways to depose judges and about the way they had been deposed. The public was informed of effects of such a violation of court independence in the context of actions of extra constitutional and extralegal centers of power for a considerable period of time. Citizens were also informed by deposed judges of possible perspectives of court independence and position of judges at the present time. The project comprised: Constitutional law analysis Slobodan Vucetic Labor law analysis Dr. Zoran Ivosevic Adjective law analysis Leposava Karamarkovic, M. Sc. Analysis of the law on courts and possibilities of deposition Vida Skero Deposition of judges and economic transformation in connection with developments in commercial courts, above all with register and bankruptcy cases Jelisaveta Vasilic Topical commentaries of other deposed judges. The project was implemented within the framework of three public panel discussions held in Belgrade, Cacak and Nis, in cooperation with local NGOs. Those panel discussions were covered by media, through local media, in cooperation with ANEM, and video cassettes were also distributed in other cities and towns. Legal framework for economic changes The objective of the project was as follows: - Stocktaking of the existing constitutional and statutory solutions governing economy and behavior of different economic agents - Projection of an optimum legal framework necessary for launching of the process of economic changes - Stocktaking of the existing constitutional and statutory solutions that have to be, accordingly, changed or adapted to contemporary European and international standards - Setting of priority legislative actions that would have to be taken in optimum conditions (changes in political environment) so as to make up the time lost with the shortest possible delay - Establishing priorities for actions which are possible to be taken in the existing circumstances in cooperation with civil society of Serbia, civil society of Montenegro and the Government of Montenegro, and which can contribute to development of awareness in the broadest public opinion of market economy advantages, based on adequate constitutional and statutory solutions, and founded on transparency, publicity, guaranteed permanence, competition. The project was implemented in a consultation held in Kotor, 13 14 July 2000, where LEX and GTZ experts took part. Posters for the campaign, leaflets and stickers were designed and distributed, a series of public panel discussions organized on the following topics: What kind of government do we want? Why are these elections fateful? Why are some people afraid of democratic changes? What kind of president do we need? Panel discussions took place in cities and towns of Serbia Belgrade, Kikinda, Velika Plana, Becej, Kraljevo, Leskovac, Pirot. Our most outstanding experts participated in various forms of the campaign psychologists, lawyers, sociologists, etc. The author of the graphic design for posters, billboards, leaflets, stickers is our renowned artist and cartoonist Predrag Koraksic Corax. The Project was implemented by organizing a stand-by around the clock during the crisis period in the election process. Our experts refuted more than 7o objections of SPS/YUL filed with the City Election Commission the purpose of which was to challenge, outside the law, the will of citizens in local elections and annul legal election process in which Democratic Opposition of Serbia has won, and objections were addressed to the Federal Election Commission on account of irregularity of elections in certain constituencies. Of special importance was a constitutional appeal whereby a political way out of the crisis and its solution in legal and juridical institutions was made possible (an appeal lodged with the Constitutional Court and defense of its counts before the FCC was completely accepted and on the basis of the appeal Dr. Vojislav Kostunica was declared the winner). H Ongoing projects New police legislation in Serbia Author and coordinator: Budimir Babovic Objective of the project NEW POLICE LEGISLATION IN SERBIA is to offer, on the basis of acquired experiences and observations, and an analysis of solutions and experiences of democratic countries and certain countries in transition, alternative solutions for competences, organization and control of police forces in Serbia. Those solutions will be formulated in the model of a new law on internal affairs. A systematized analysis and presentation of the body of problems would emphasize significance of negative effects of the existing organization and political abuses of the police. Total revision of the concept of security system and proposing of new standard-setting solutions come as one of the priority tasks in the struggle for democratic changes. This is what justifies the existence of the project which has to deal with these issues in an over-all and coherent way. The project should be implemented in two stages. The first one includes preparation of documentation and working out of the model of a new law on internal affairs. At the second stage, education of members of internal affairs bodies will be organized (both in the country and abroad) in accordance with the new concept and new solutions.

Preparation of law graduates to pass the bar examination Author and coordinator: Leposava Karamarkovic This project would enable young law graduates to prepare themselves as easily and as better as possible for passing their bar exam. Candidates attending such a form of practical instruction would have an opportunity to listen to lectures of and have exercises with top experts in relevant fields of law, primarily judges and prosecutors, and present and formers university Law School professors in part, in other words, people who exactly know what they are asked for and expected, what is the emphasize placed on, and what is traditionally the most difficult for young law graduates in coping with the matter. The objective of the project is, in the first place, preparation of young law graduates for passing the bar exam. In the second place, may be even more important strategically, it is the training of young qualified people in performing work in their professions with proficiency. Awaiting structural and substantial changes in the concept of the judiciary, it is necessary along with the change of the over-all system and, accordingly, of the judicial system, to educate young people so that they might be professionally prepared and trained to face such changes and to pursue their jobs with a high degree of excellence and competence. Instruction is organized in LEX premises. A course should include 20 candidates. Duration of the preparatory instruction is three months. The total number of classes is 205. Project secretary: Danica Gavrilovic Work on the project would be based on the elaboration of the principle of division of power, and on generally accepted rules of the international law on independence of the judiciary, enjoined in the Universal Declaration on Independence of Justice and General Principles of Independence of the Judiciary, provisions of which are, under par. 2, Article 16 of the Constitution of Yugoslavia, integral part of our legal system. In addition to the institutionalization of the constitutional principle of independence of the judiciary, guarantees of court independence would also be elaborated on: nomination of judges, permanence of judges office, residential permanence of judges, immunity of judges, assignment of tasks and cases, lay judges, responsibilities of judges and their deposition, association of judges, financial position of judges, court budget, etc. The project would also point out the substance of fair administration of justice. The outcome of the project would be: a model law on courts and judges, and a model code of judges ethics. Innovation of the cultural policy in the local community. This project was carried out in 10 local communities of Serbia and Montenegro. Its objective was to contribute to the creation of a new concept of cultural policy, to bring about changes in cultural patterns; to encourage cultural actions with new contents and forms; to contribute to a purposeful building of a network of cultural institutions; to strengthen institutional cooperation of cultural institutions; to contribute to striking a balance and partnership relations between the public and private sectors; to encourage initiatives the result of which would be satisfaction of cultural needs of different social groups. H Ongoing projects Modernization of the local community development institu tions There are numerous reasons for launching such a project in five big cities of Serbia. First, political, economic and social system of Serbia is characterized by many anachronisms as regards its institutional set-up and functional solutions which are manifested in a low level of their efficiency, effectiveness and economy. Second, modernization of the system (government and economy) presupposes a simultaneous change in its essential characteristics (ambiance) but also its constituent parts, where in any case the local level belongs with its most important institutions and organizations. Third, the change in the policy of status quo or rather option for change and development, points to the necessity to re-examine the network of existing institutions which can bear the burden of reconstruction, but also to create new, better ones. Fourth, key institutions of the local community development are a proper framework for preparation and establishment of future regional communities, the scope of work of which will be real innovation in relation to the traditional administrative system of territorial organization. Fifth, such a project will undoubtedly provide a reliable picture of the over-all institutional and organizational milieu, both its quantitative and qualitative sides, which are unavoidable presupposition for research and consultancy work in each particular environment. Alternative Laws: Law on Government Administration and Law on Local Self-Government An important link in the chain of changes in the existing legislation is the preparation of two major laws governing the area of government administration and local self-government, competences, organization and functioning. In both areas, their evolutionary path will be presented, then a critical analysis of existing laws, and after that an account of foreign authors dealing with this statutory matter in ten or so European states will be given and, finally, models of new laws, with alternative solutions and appropriate explanations. The most attractive segments of the current election system and election process would be compared with analogous reaches in Poland, Slovakia, Croatia and Germany.
