Title of the Act. (his !ct shall be 6nown as the 0epart4ent of the +nterior and *ocal -o3ern4ent !ct of 5$$7.8 S)C. 9. Declaration of Policy. +t is hereby declared to be the policy of the State of pro4ote peace and order, ensure public safety and further strengthen the local go3ern4ent capability ai4ed towards the effecti3e deli3ery of the basic ser3ices to the citi:enry through the establish4ent of a highly efficient and co4petent police force that is national in scope and ci3ilian in character. (owards this end, the State shall bolster a syste4 of coordination and cooperation a4ong the citi:enry, local e;ecuti3es and the integrated law enforce4ent and public safety agencies under this !ct. (he police force shall be organi:ed, trained and e<uipped pri4arily for the perfor4ance of police functions. +ts national scope and ci3ilian character shall be para4ount. "o ele4ent of the police force shall be 4ilitary nor shall any position thereof be occupied by acti3e 4e4bers of the !r4ed Forces of the Philippines. S)C. =. Promulgation of Comprehensive Policies by Congress . > Sub?ect to the li4itations pro3ided in the Constitution, the President shall reco44end to Congress the pro4ulgation of policies on public order and safety to protect the citi:enry fro4 all for4s of lawlessness, cri4inality and other threats to peace order. CHAPTER I THE DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT S)C. @. The Department of the Interior and Local Government. (o carry out the policies and purposes of this !ct, the 0epart4ent of *ocal -o3ern4ent is hereby reorgani:ed into the 0epart4ent of the +nterior and *ocal -o3ern4ent, hereinafter referred to as the 0epart4ent, in accordance with the pro3isions of this !ct. S)C. &. Po ers and functions of the Department. +n furtherance of the ob?ecti3es of this !ct, the 0epart4ent shall continue to e;ercise the powers and

functions of the 0epart4ent of *ocal -o3ern4ent in addition to the powers and functions as herein pro3ided. S)C. #. !rgani"ation (he 0epart4ent shall consist of the 0epart4ent Proper, the e;isting bureaus and offices of the 0epart4ent of *ocal -o3ern4ent, the "ational Police Co44ission, the Philippine Public Safety College, and the following bureausA the Philippine "ational Police, the Bureau of Fire Protection, and the Bureau of Jail Manage4ent and Penology. S)C. %. Department Proper. (he 0epart4ent Proper shall consist of the e;isting staff ser3ice as pro3ided for under );ecuti3e .rder "o. 9#9 and the following officesA a' !ffice of the #ecretary > (he .ffice of the Secretary shall consist of the Secretary and his i44ediate staffB and b' !ffice of the $ndersecretaries and Assistant #ecretaries > (he Secretary shall be assisted by two 9' /ndersecretaries, one 5' for local go3ern4ent and the other for peace and order, at least one 5' of who4 4ust belong to the career e;ecuti3e ser3ice, and three =' career !ssistant Secretaries. S)C. C. %ead of the Department (he head of the 0epart4ent, hereinafter referred to as the Secretary, shall also be the e; officio Chair4an of the "ational Police Co44ission and shall be appointed by the President sub?ect to confir4ation of the Co44ission on !ppoint4ents. "o retired or resigned 4ilitary officer or police official 4ay be appointed as Secretary within one 5' year fro4 the date of his retire4ent or resignation. S)C. $. General Po ers& Terms of !ffice and Compensation of the #ecretary > (he authority and responsibility for the e;ercise of the 0epart4entDs power and functions shall be 3ested in the Secretary, who shall hold office at the pleasure of the President and shall recei3e the co4pensation, allowances and other e4olu4ents to which head of depart4ents are entitled. S)C. 57. #pecific Po ers and 'unctions of the #ecretary +n addition to his powers and functions as pro3ided in );ecuti3e .rder "o. 9#9, the Secretary as 0epart4ent head shall ha3e the following powers and functionsA a' Prepare and sub4it periodic reports, including a Euarterly !nti-Cri4e .perationDs Report and such other reports as the President and Congress 4ay re<uireB b' !ct as Chair4an and Presiding .fficer of the "ational Police Co44issionB and c' 0elegate authority to e;ercise any substanti3e or ad4inistrati3e function to the 4e4bers of the "ational Police Co44ission or other officers of ran6 within the 0epart4ent. S)C. 55. (egional !ffices. (he 0epart4ent shall establish, operate and 4aintain a regional office in each of the ad4inistrati3e regions of the country to i4ple4ent the policies and progra4s of the 0epart4ent. )ach regional office shall be headed by a regional director to be assisted by two 9' assistant regional directorsA one 5' for ?ail 4anage4ent and penology and another for fire protection in additional to the present assistant regional directors of the 0epart4ent of *ocal -o3ern4ent.

S)C. 59. (elationship of the Department ith the Department of )ational Defense. 0uring a period of twenty-four 9@' 4onths fro4 the effecti3ity of this !ct, the !r4ed Forces of the Philippines !FP' shall continue its present role of preser3ing the internal and e;ternal security of the StateA Pro3ided, (hat said period 4ay be e;tended by the President, if he finds it ?ustifiable, for another period not e;ceeding twenty-four 9@' 4onths, after which, the 0epart4ent shall auto4atically ta6e o3er fro4 the !FP its pri4ary role of preser3ing internal security, lea3ing to the !FP its pri4ary role of preser3ing e;ternal security. ,owe3er, e3en after the 0epart4ent has assu4ed pri4ary responsibility on 4atters affecting internal security, including the suppression of insurgency, and there are serious threats to national security and public order, such as where insurgents ha3e gained considerable foothold in the co44unity thereby necessitating the e4ploy4ent of bigger tactical forces and the utili:ation of higher caliber ar4a4ents and better ar4ored 3ehicles, the President 4ay, upon reco44endation of the peace and order council, upon the !r4ed Forces of the Philippines to assu4e the pri4ary role of the Philippine "ational Police P"P' to play the supporti3e role in the area concerned. +n ti4es of national e4ergency, all ele4ents of the P"P, the Bureau of Fire Protection, and the Bureau of Jail Manage4ent and Penology shall, upon direction of the President, assist the !r4ed Forces of the Philippines in 4eeting the national e4ergency. (he co4ple4entary relationship between the 0epart4ent of the +nterior and *ocal -o3ern4ent and the 0epart4ent of "ational 0efense in any of the preceding e3entualities shall be ?ointly prescribed by their respecti3e Secretaries in a 4e4orandu4 of agree4ent that shall thereafter be published and i4ple4ented. CHAPTER II THE NATIONAL POLICE COMMISSION S)C. 5=. Creation and Composition. ! "ational Police Co44ission hereinafter referred to as the Co44ission, is hereby created for the purpose of effecti3ely discharging the functions prescribed in the Constitution and pro3ided in this !ct. (he Co44ission shall be a collegial body within the 0epart4ent. +t shall be co4posed of a Chair4an and four @' regular co44issioners, one 5' of who4 shall be designated as 2ice-Chair4an by the President. (he Secretary of the 0epart4ent shall be the e* officio Chair4an of the Co44ission, while the 2iceChair4an shall act as the e;ecuti3e officer of the Co44ission. S)C. 5@. Po ers and 'unctions of the Commission. (he Co44ission shall e;ercise the following powers and functionsA a' );ercise ad4inistrati3e control o3er the Philippine "ational Police b' !d3ise the President on all 4atters in3ol3ing police functions and ad4inistrationB c' Foster and de3elop policies and pro4ulgate rules and regulations, standards and procedures to i4pro3e police ser3ices based on sound professional concepts and principles. d' );a4ine and audit, and thereafter establish the standards for such purposes on a continuing basis, the perfor4ance, acti3ities, and facilities of all police agencies throughout the countryB e' Prepare a police 4anual prescribing rules and regulations for efficient organi:ation, ad4inistration, and operation, including recruit4ent, selection, pro4otion and retire4entB f' )stablish a syste4 of unifor4 cri4e reportingB

Conduct sur3eys and co4pile statistical data for the proper e3aluation of the efficiency and effecti3eness of all police units in the country. h' Render to the President and to the Congress an annual report on its acti3ities and acco4plish4ents during the thirty =7' days after the end of the calendar year, which shall include an appraisal of the conditions obtaining in the organi:ational and ad4inistration of police agencies in the 4unicipalities, cities, and pro3inces throughout the country, and reco44endations for appropriate re4edial legislation. i' !ppro3e or 4odify plans, and progra4s on education and training, logistical re<uire4ents, co44unications, records, infor4ation syste4s, cri4e laboratory, cri4e pre3ention and cri4e reporting. ?' !ffir4, re3erse or 4odify, through the "ational !ppellate Board, personnel disciplinary actions in3ol3ing de4otion or dis4issal fro4 the ser3ice i4posed upon 4e4bers of the Philippine "ational Police by the Chief of the Philippine "ational PoliceB 6' );ercise appellate ?urisdiction through the regional appellate boards o3er ad4inistrati3e cases against police4en and o3er decisions on clai4s for police benefitsB l' Reco44end to the President, through the Secretary, within si;ty #7' days before the co44ence4ent of each calendar year, a cri4e pre3ention progra4B 4' Prescribe 4ini4u4 standards for ar4s, e<uip4ent, and unifor4s and, after consultation with the Philippine ,eraldry Co44ission, for insignia of ran6s, awards and 4edals of honorB n' +ssue subpoena duces tecu4 in 4atters pertaining to the discharge of its own powers and duties, and designate who a4ong its personnel can issue such processes and ad4inister oaths in connection therewithB and o' Perfor4 such other functions necessary to carry out the pro3isions of this !ct and as the President 4ay direct. S)C. 5&. +ualifications. "o person shall be appointed regular 4e4ber of the Co44ission unlessA a' ,e is at least thirty-fi3e =&' years of ageB b' ! 4e4ber of the Philippine Bar or ,older of a 4asterDs degree in public ad4inistration, business ad4inistration, 4anage4ent, sociology, cri4inology, law enforce4ent, national security ad4inistration, defense studies, and other related disciplinesB and c' ,as had e;perience in law enforce4ent wor6 for at least fi3e &' years. S)C. 5#. Term of !ffice. (he four @' regular and full-ti4e co44issioners shall be appointed by the President upon the reco44endation of the Secretary. .f the first four @' co44issioners to be appointed, two 9' co44issioners shall ser3e for si; #' years and the two 9' other co44issioners for four @' years. !ll subse<uent appoint4ents shall be for a period of si; #' years each, without reappoint4ent or e;tension. S)C. 5%. Temporary or Permanent Incapacity of the Chairman. +n case of absence due to te4porary or per4anent incapacity of the Chair4an, the President shall designate an !cting Chair4an. +n case of death or per4anent incapacity or dis<ualification of the Chair4an, the !cting Chair4an shall also act as such until a new Chair4an shall ha3e been appointed and <ualified.

S)C. 5C. (emoval from !ffice. (he 4e4bers of the Co44ission 4ay be re4o3ed fro4 office for cause. !ll 3acancies in the Co44ission, e;cept through e;piration of ter4, shall be filled up for the une;pired ter4 only. Pro3ided, (hat any person who shall be appointed in this case shall be eligible for regular appoint4ent for another full ter4. S)C. 5$. Prohibitions. (he Chair4an and 4e4bers of the Co44ission shall not engage in the practice of any profession, or inter3ene, directly or indirectly, in the 4anage4ent and control or any pri3ate enterprise. (hey shall not, directly or indirectly, ha3e any financial or 4aterial interest in any transaction re<uiring the appro3al of their office. S)C. 97. following unitsA a' !rgani"ational #tructure. (he Co44ission shall consist of the

b' #taff #ervices (he staff ser3ices of the Co44ission shall be as followsA 5' (he Planning and Research Ser3ice, which shall pro3ide technical ser3ices to the Co44ission in areas of o3erall policy for4ulation, strategic and operational planning, 4anage4ent syste4s or procedures, e3aluation and 4onitoring of the Co44issionDs progra4s, pro?ects and internal operationB and shall conduct thorough research and analysis on social and econo4ic conditions affecting peace and order in the countryB (he *egal !ffairs Ser3ice, which shall pro3ide the Co44ission with efficient and effecti3e ser3ice as legal counsel of the Co44issionB draft or study contracts affecting the Co44ission and sub4it appropriate reco44endations pertaining theretoB and render legal opinions arising fro4 the ad4inistration and operation of the Philippine "ational Police and the Co44issionB (he Cri4e Pre3ention and Coordination Ser3ice, which shall underta6e cri4inological researches and studiesB for4ulate a national cri4e pre3ention editorial direction for all cri4inology research and cri4e pre3ention publicationsB (he !d4inistrati3e Ser3ice, which shall pro3ide the Co44ission with assistance on budgetary and financial 4attersB pro3ide the necessary ser3ices relating to records, correspondence, supplies, property and e<uip4ent, security and general ser3ices, and the 4aintenance and utili:ation of facilitiesB and pro3ide ser3ices relating to 4anpower, career planning and de3elop4ent, personnel transactions and e4ployee welfareB (he +nspection and Monitoring Ser3ice, which shall conduct continuous inspection and 4anage4ent audit of personnel, facilities and operations at all le3els of co44and of the P"P and shall 4onitor the i4ple4entation of the Co44issionDs progra4s and pro?ects relati3e to law enforce4entB and

(he +nstallations and *ogistics Ser3ice, which shall re3iew the Co44issionDs plans and progra4s and for4ulate policies and procedures regarding ac<uisition, in3entory, control, distribution, 4aintenance and disposal of supplies and shall o3ersee the i4ple4entation of progra4s on transportation facilities and installations and the procure4ent and 4aintenance of supplies and e<uip4ent.

Disciplinary Appellate ,oards (he Co44ission shall establish a for4al ad4inistrati3e disciplinary appellate 4achinery consisting of the "ational !ppellate Board and the regional appellate boards. (he national !ppellate Board shall decide cases on appeal fro4 decisions rendered by the P"P chief, while the regional appellate late boards shall decide cases on appeal fro4 decisions rendered by officers other than the P"P chief, the 4ayor, and the PeopleDs *aw )nforce4ent Board P*)B' created hereunder.

S)C. 95. (egional !ffices. (he Co44ission shall establish, operate and 4aintain regional offices headed by regional directors who shall i4ple4ent the policies and progra4s of the Co44ission in their respecti3e regions. For ad4inistrati3e purposes, the regional offices of the Co44ission shall be attached to the regional offices of the 0epart4ent. Sub?ect to the standards that will be prescribed by the Co44ission, the regional offices shall li6ewise perfor4 the function of ad?udication of benefit clai4s. S)C. 99. Eualifications of (egional Directors. "o person shall be appointed regional director unlessA a' ,e is at least thirty =7' years of ageB b' ! holder of a baccalaureate degree and appropriate ci3il ser3ice eligibilityB and c' ,as at least fi3e &' years e;perience in the field of law enforce4ent, cri4inology or police ad4inistration.

CHAPTER III THE PHILIPPINE NATIONAL POLICE A. ORGANIZATION S)C. 9=. Composition. Sub?ect to the li4itations pro3ided for in this !ct, the Philippine "ational Police, hereinafter referred to as the P"P, is hereby

established, initially consisting of the 4e4bers of the police forces who were integrated into the +ntegrated "ational Police +"P' pursuant to Presidential 0ecree "o. %#&, and the officers and enlisted personnel of the Philippine Constabulary PC'. For purposes of this !ct, the officers and enlisted personnel of the PC shall include those assigned with the "arcotics Co44and "!RC.M' or the Cri4inal +n3estigation Ser3iceB and those of the technical ser3ices of the !FP assigned with the PC and the ci3ilian operati3es of the C+S. (he regular operati3es of the abolished "!P.*C.M +nspection, +n3estigation and +ntelligence Branch 4ay also be absorbed by the P"P. +n addition, a PC officer or enlisted personnel 4ay transfer to any of the branches or ser3ices of the !r4ed Forces of the Philippines in accordance with the pro3isions of Section C& of this !ct. +n order to be <ualified for transfer to the P"P units in Metropolitan Manila and in highly urbani:ed cities, an indi3idual 4ust ha3e co4pleted not less than second year collegiate wor6 or its e<ui3alent in training of se3enty-two %9' collegiate units. !nyone who has any pending ad4inistrati3e or cri4inal case or has been ad?udged liable or con3icted of any cri4e pending appeal shall be allowed to ?oin the P"P pro3isionally without pre?udice to final ?udg4ent by a body of co4petent ?urisdiction. (he per4anent ci3ilian e4ployees of the present PC, +"P, "arcotics Co44and, C+S, and the technical ser3ices of the !FP assigned with the PC, including "!P.*C.M hearing officers holding regular ite4s as such, shall be absorbed by the 0epart4ent as e4ployees thereof, sub?ect to e;isting laws and regulations. S)C. 9@. Po ers and 'unctions > (he P"P shall ha3e the following powers and functionsA a' )nforce all laws and ordinances relati3e to the protection of li3es and propertiesB b' Maintain peace and order and ta6e all necessary steps to ensure public safetyB c' +n3estigate and pre3ent cri4es, effect the arrest of cri4inal offenders, bring offenders to ?ustice and assist in their prosecutionB d' );ercise the general powers to 4a6e arrest, search and sei:ure in accordance with the Constitution and pertinent lawsB e' 0etain an arrested person for a period not beyond what is prescribed by law, infor4ing the person so detained of all his rights under the ConstitutionB f' +ssue licenses for the possession of firear4s and e;plosi3es in accordance with lawB g' Super3ise and control the training and operations of security agencies and issue licenses to operate security agencies, and to security guards and pri3ate detecti3es, for the practice of their professionsB and h' Perfor4 such other duties and e;ercise all other functions as 4ay be pro3ided by law. +n addition, the P"P shall absorb the office of the "ational !ction Co44ittee on !nti-,i?ac6ing "!C!,' of the 0epart4ent of "ational 0efense, all the functions of the present Philippine !ir Force Security Co44and P!FS)C.M', as well as the police functions efficiently and effecti3ely, the P"P shall be pro3ided with ade<uate land, sea, and air capabilities and all necessary 4aterial 4eans or resources.

S)C. 9&. !rgani"ation (he P"P shall be headed by a Chief who shall be assisted by two 9' deputy chiefs, one 5' for operations and one 5' for ad4inistration, both of who4 shall be appointed by the President upon reco44endation of the Co44ission fro4 a4ong the 4ost senior and <ualified officers in the officeA Pro3ided, howe3er, (hat in no case shall any officer who has retired or is retirable within si; #' 4onths fro4 his co4pulsory retire4ent age be appointed as Chief of the P"P. (he P"P shall be co4posed of a national office, regional offices, pro3incial offices, district offices and city or 4unicipal stations. !t the national le3el, the P"P shall ha3e regional offices, including that of the "ational Capital Region, which 4ay be di3ided into two 9' separate regions without pre?udice to the pertinent pro3isions of the .rganic !ct for the !utono4ous Regions of the Cordilleras and Musli4 Mindanao relati3e to the creation of a regional police force in the area of autono4y. )ach of these regional offices shall be headed by a regional director for peace and order. !t the pro3incial le3el, there shall be a P"P office each headed by a pro3incial director. +n the case of large pro3inces, police districts 4ay be established by the Co44ission to be headed by a district director. !t the city or 4unicipal le3el, there shall be a P"P station, each headed by a chief of police. (he Chief of the P"P shall, within si;ty #7' days fro4 the effecti3ity of this !ct and in accordance with the broad guidelines set forth herein, reco44end the organi:ational structure and staffing pattern of the P"P to the Co44ission. S)C. 9#. Po ers& 'unctions and Term of !ffice of the P)P Chief. (he co44and and direction of the P"P shall be 3ested in the Chief of the P"P who shall ha3e the power to direct and control tactical as well as strategic 4o3e4ents, deploy4ent, place4ent, utili:ation of the P"P or any of its units and personnel, including its e<uip4ent, facilities and other resources. Such co44and and direction of the P"P 4ay be delegated to subordinate officials with respect to the units under their respecti3e co44ands in accordance with the rules and regulations prescribed by the Co44ission. (he Chef of the P"P shall also ha3e the power to issue detailed i4ple4enting policies and instructions regarding personnel, funds, properties, records, correspondence and such other 4atters as 4ay be necessary to effecti3ely carry out the functions, powers and duties of the Bureau. (he Chief of the P"P shall be appointed by the President fro4 a4ong the senior officers down to the ran6 of chief superintendent, sub?ect to confir4ation by the Co44ission on !ppoint4entsA Pro3ided, that the Chief of the P"P shall ser3e a ter4 of office not to e;ceed four @' yearsA Pro3ided, that in ti4es of war or other national e4ergency declared by Congress, the President 4ay e;tend such ter4 of office. S)C. 9%. -anning Levels. - .n the a3erage nationwide, the 4anning le3els of the P"P shall be appro;i4ately in a accordance with a police-to-population ration of one 5' police4an for e3ery fi3e hundred &77' persons. (he actual population density and actual de4ands of the ser3ice in the particular areaA Pro3ided, (hat the 4ini4u4 police-to-population ratio shall not be less than one 5' police4an for e3ery one thousand 5,777' personsA Pro3ided, further, (hat urban areas shall ha3e a higher 4ini4u4 police-to-population ratio as 4ay be prescribed by regulations.

S)C. 9C. (an. (he second in co44and of the P"P with the ran6 of deputy director general shall be the 0eputy Chief of the P"P !d4inistration. (he third in co44and with the ran6 also of deputy director general shall be the 0eputy Chief of the P"P for .perations. !t the national office, the head of the directorial staff shall ha3e the ran6 of director general shall be 6nown as Chief of the 0irectorial Staff of the P"P. (he heads of the 3arious staff di3isions in the directorial staff shall ha3e the ran6 of director with the position title of 0irector of the 0irectorial Staff of their respecti3e functional di3isionsA (he head of the +nspectorate 0i3ision with the ran6 of chief superintendent shall assu4e the position title of +nspector -eneral. (he heads of the ad4inistrati3e and operational support di3isions shall ha3e the ran6 of chief superintendent. (he head of the "CR with the ran6 of director shall assu4e the position title of "CR 0irector. (he heads of the regional offices with the ran6 of chief superintendent shall assu4e the position title of Regional 0irector. (he heads of the "CR district offices with the ran6 of chief superintendent shall ha3e the position title of 0istrict 0irector. (he heads of the pro3incial offices with the ran6 of senior superintendent shall be 6nown as Pro3incial 0irector. (he heads of the district offices with the ran6 of superintendent shall ha3e the position title of 0istrict 0irector. (he heads of the 4unicipality or city offices with the ran6 of chief inspector shall be 6nown as Chief of Police. S)C. =7. General +ualifications for Appointment. > "o person shall be appointed as officer or 4e4ber of the P"P unless he possesses the following 4ini4u4 <ualificationsA a' ! citi:en of the PhilippinesB b' ! person of good 4oral conductB c' .f sound 4ind and bodyB

B. PROFESSIONALISM, WELFARE AND BENEFITS S)C. =%. Performance 2valuation #ystem. > (here shall be established a perfor4ance e3aluation syste4 which shall be ad4inistered in accordance with the rules, regulations and standards, and a code of conduct pro4ulgated by the Co44ission of 4e4bers of the P"P. Such perfor4ance e3aluation syste4 shall be ad4inistered in such a way as to foster the i4pro3e4ent of indi3idual efficiency and beha3ioral discipline as well as the pro4otion of organi:ational effecti3eness and respect for the constitutional and hu4an rights of citi:ens, de4ocratic principles and ideals and the supre4acy of ci3ilian authority o3er the 4ilitary. (he rating syste4 as conte4plated herein shall be based on standards prescribed by the Co44ission and shall consider the results of annual physical, psychological and neuropsychiatric e;a4inations conducted on the P"P officer of 4e4ber concerned. S)C. =C. Promotions.- a' ! 4e4ber of the P"P shall not be eligible for pro4otion to a higher position or ran6 unless he has successfully passed the corresponding pro4otional e;a4inations for technical ser3ices and other professions, and has satisfactorily co4pleted an appropriate and accredited course in the P"P! or e<ui3alent training institutions. +n additional, no 4e4ber of the P"P shall be eligible for pro4otion unless he has been cleared by the PeopleDs *aw )nforce4ent Board P*)B' of co4plaints proffered against hi4, if any. b' Special pro4otion 4ay be e;tended to any 4e4ber of the P"P for acts of conspicuous courage and gallantry at the ris6 of his life abo3e and beyond the call of duty or selected as such in nationwide search conducted by the P"P or any accredited ci3ic organi:ation. (he ter4 Foperational super3ision and controlF shall 4ean the power to direct, superintend, o3ersee and inspect the police units or forces. +t shall include the power to e4ploy and deploy units or ele4ents of the P"P, through the station co44ander, to ensure public safety and effecti3e 4aintenance of peace and order within the locality. For this purpose, the ter4 Fe4ployF and FdeployF shall 4ean as followsA F)4ployF refers to the utili:ation of units or ele4ents of the P"P for purposes of protection of li3es and properties, enforce4ent of laws, 4aintenance of peace and order, pre3ention of cri4es, arrest of cri4inal offenders and bringing the offenders to ?ustice, and ensuring public safety, particularly in the suppression of disorders, riots, lawless 3iolence, rebellious or seditious conspiracy, insurgency, sub3ersion or other related acti3ities.

F0eployF shall 4ean the orderly and organi:ed physical 4o3e4ent of ele4ents or units of the P"P within the pro3ince, city or 4unicipality for purposes of e4ploy4ent as herein defined. 9' +ntegrated Co44unity Safety Plans. (he 4unicipalHcity 4ayor shall, in coordination with the local peace and order council of which he is the chair4an pursuant to );ecuti3e .rder "o. =7$, as a4ended, de3elop4ent and establish an integrated areaHco44unity public safety plan e4bracing priorities of action and progra4 thrusts for i4ple4entation by the local P"P stations. +t shall, li6ewise, be the duty of the city or 4unicipal 4ayor to sponsor periodic se4inars for 4e4bers of the P"P assigned or detailed in his city or 4unicipality in order to update the4 regarding local ordinances and legislations. =' !d4inistrati3e 0isciplinary Powers. +n the areas of discipline, city and 4unicipal 4ayors shall ha3e the power to i4pose, after due notice and su44ary hearings, disciplinary penalties for 4inor offenses co44itted by 4e4bers of the P"P assigned to their respecti3e ?urisdictions, as pro3ided in Section @5 of this !ct. @' .ther Powers. +n addition to the afore4entioned powers, city and 4unicipal 4ayors shall ha3e the following authority o3er the P"P units in their respecti3e ?urisdictionA i' !uthority to choose the chief of police fro4 a list of fi3e &' eligibles reco44ended by the pro3incial police director, preferably fro4 the sa4e pro3ince, city or 4unicipalityB ii' !uthority to reco44end the transfer, reassign4ent or detail of P"P 4e4bers outside of their respecti3e city or town residencesB and iii' !uthority to reco44end, fro4 a list of eligibles pre3iously screened by the peace and order council, the appoint4ent of new 4e4bers of the P"P to be assigned to their respecti3e cities or 4unicipalities without which no such appoint4ent shall be attested. S)C. &@ Po er and 'unctions 3 (he Fire Bureau shall be responsible for the pre3ention and suppression of all destructi3e fires on buildings, houses and other structures, forests, land transportation 3ehicles and e<uip4ent, ships or 3essels doc6ed at piers or whar3es or anchored in 4a?or seaports, petroleu4 industry installations, plane crashes and other si4ilar incidents, as well as the enforce4ent of the Fire Code and other related laws. (he Fire Bureau shall ha3e the power to in3estigate all causes of fires and, if necessary, file the proper co4plaints with the city or pro3incial prosecutor who has ?urisdiction o3er the case. S)C. && !rgani"ation - (he Fire Bureau shall be headed by a Chief who shall be assisted by a deputy chief. +t shall be co4posed of pro3incial offices, district offices and city or 4unicipal stations. !t the pro3incial le3el, there shall be an office of the pro3incial fire 4arshal which shall i4ple4ent the policies, plans and progra4s of the 0epart4entB and 4onitor, e3aluate and coordinate the operations and acti3ities of the fire ser3ice operating units at the city and 4unicipal le3els. +n the case of large pro3inces, district offices 4ay be established, to be headed by a district fire 4arshal. !t the city or 4unicipal le3el, there shall be a fire station, each headed by a city or 4unicipal fire 4arshalA Pro3ided, (hat, in the case of large cities and 4unicipalities, a district office with subordinate fire stations headed by a district fire 4arshal 4ay be organi:ed as necessary. S)C. %$ Payment of #alary and Allo ances to the %eirs of $niformed Personnel 3 +n case any unifor4ed personnel has been officially confir4ed as 4issing in action under any of the circu4stances pro3ided in the preceding section, the Chief of the P"P, Fire or Jail Force, as the case 4ay be, shall direct pay4ent of the absent unifor4ed personnelIs 4onthly salary and allowances and other e4olu4ents pertinent thereto to hisHher heirs for their support for a 4a;i4u4 period of one 5' year fro4 the date of co44ence4ent of absence or when last heard fro4 as those 6idnapped or captured by lawless ele4ents. S)C. C7 'inding of Death and Termination of Payment of #alary and Allo ances 3 /pon the ter4ination of the one 5' year period as specified in the

preceding section, the 4issing unifor4ed personnel shall be auto4atically ter4inated. +n the e3ent said personnel shall thereafter be found to ha3e been ali3e and is not entitled to the benefits paid under the preceding sections of this !ct, said benefits shall be rei4bursed to the Sate within si; #' 4onths fro4 the disco3ery of the fact or his reappearance. ,owe3er, if his continued disappearance was fraudulent or 4ade in bad faith he shall, together with his co-conspirators, be prosecuted according to law. S)C. C5 Complaints and Grievances 3 /nifor4ed personnel shall ha3e the right to present co4plaints and grie3ances to their superiors or co44anders and ha3e the4 heard and ad?udicated as e;peditiously as possible in the best interest of the ser3ice, with due regard to due process in e3ery case. Such co4plaints or grie3ances shall be resol3ed at the lowest possible le3el in the unit of co44and and the respondent shall ha3e the right to appeal fro4 an ad3erse decision to higher authorities. S)C. C9 Prohibitions: Penalties 3 !s professional police, fire and ?ail officers and 4e4bers responsible for the 4aintenance of peace and order and public safety, the 4e4bers and officers of the P"P, Fire or Jail Force are hereby prohibited fro4 engaging in stri6es, rallies, de4onstrations and other si4ilar concerted acti3ities, or perfor4ing other acts pre?udicial to good order and police discipline. !ny P"P, Fire or Jail Force 4e4ber found guilty by final ?udg4ent of 3iolating the pro3isions of the preceding paragraph shall be dis4issed fro4 the ser3ice without pre?udice to whate3er cri4inal or ci3il liability he 4ay ha3e incurred in relation to such 3iolations. C,!P()R 2+++ (R!"S+(.RK PR.2+S+."S Sec. C= #ecretary of the Department of Local Government on %oldover Capacity 3 (he incu4bent Secretary of the 0epart4ent of *ocal -o3ern4ent shall perfor4 the functions of the Secretary of the +nterior and *ocal -o3ern4ent on holdo3er capacity until such ti4e when a new Secretary shall ha3e been appointed by the President and confir4ed by the Co44ission on !ppoint4ents. S)C. C@ #pecial !versight Committee - ! Special .3ersight Co44ittee is hereby created, co4posed of the Secretary as Chair4an, the Secretary of Budget and Manage4ent as Co-chair4an, the Secretary of "ational 0efense, the incu4bent PC-+"P 0irector -eneral, the incu4bent Chair4an of the Ci3il Ser3ice Co44ission, the respecti3e Chair4en of the Co44ittee on *ocal -o3ern4ent and the Co44ittee on "ational 0efense and Security in the Senate, and the respecti3e. Chair4en of the Co44ittee on Public .rder and Security and the Co44ittee on "ational 0efense in the ,ouse of Representati3es, as 4e4bers, which shall plan and o3ersee the e;peditious i4ple4entation of the transfer, 4erger andHor absorption into the 0epart4ent of the personnel, property, appropriations and installations of in3ol3ed agencies. S)C. C& Phases of Implementation - (he i4ple4entation of this !ct shall be underta6en in three =' phases, to witA Phase I 3 );ercise of option by the unifor4ed 4e4bers of the Philippine Constabulary, the PC ele4ents assigned with the "arcotics Co44and, C+S, and the

personnel of the technical ser3ices of the !FP assigned with the PC to include the regular C+S in3estigating agents and the operati3es and agents of the "!P.*C.M +nspection, +n3estigation and +ntelligence Branch, and the personnel of the absorbed "ational !ction Co44ittee on !nti-,i?ac6ing "!C!,' of the 0epart4ent of "ational 0efense, to be co4pleted within si; #' 4onths fro4 the date of the effecti3ity of this !ct. !t the end of this phase, all personnel fro4 the +"P, PC, !FP (echnical Ser3ices, "!C!, and "!P.*C.M +nspection, assigning the4 to the P"P, Fire and Jail Forces by their respecti3e units. Phase II 3 !ppro3al of the table of organi:ation and e<uip4ent of all bureaus and offices created under this !ct, preparation and filling up of their staffing pattern, transfer of assets to the 0epart4ent and organi:ation of the Co44ission, to be co4pleted within twel3e 59' 4onths fro4 the effecti3ity date thereof. !t the end of this phase, all personnel to be absorbed by the 0epart4ent shall ha3e been issued appoint4ent papers and the organi:ed Co44ission and the P"P shall be fully operational. (he PC officers and enlisted personnel who ha3e not opted to ?oin the P"P shall be reassigned to the !r4y, "a3y or !ir Force, or shall be allowed to retire under e;isting !FP rules and regulations. !ny PC-+"P officer or enlisted personnel 4ay, within the twel3e-4onth period fro4 the effecti3ity of this !ct, retire and be paid retire4ent benefits corresponding to a position two 9' ran6s higher than his present grade, sub?ect to the conditions that at the ti4e he applies for retire4ent, he has rendered at least twenty 97' years of ser3ice and still has, at 4ost, twenty-four 9@' 4onths of ser3ice re4aining before the co4pulsory retire4ent age as pro3ided by e;isting law for his office. Phase III - !d?ust4ent of ran6s and establish4ent of one 5' lineal roster of officers and another for non-officers, and the rationali:ation of co4pensation and retire4ent syste4s, ta6ing into consideration the e;isting co4pensation sche4es and retire4ent and separation benefit syste4s of the different co4ponents of the P"P, to ensure that no 4e4ber of the P"P shall suffer any di4inution in basic longe3ity and incenti3e pays, allowances and retire4ent benefits due the4 before the creation of the P"P, to be co4pleted within eighteen 5C' 4onths fro4 the effecti3ity of this !ct. (o acco4plish the tas6s of Phase +++, the Co44ission shall create a Board of .fficers co4posed of the followingA "!P.*C.M, Co44issioner as Chair4an and one 5' representati3e each fro4 the PC, +"P, Ci3il Ser3ice Co44ission, and the 0epart4ent of Budget and Manage4ent. /pon the effecti3ity of this !ct, the Secretary shall e;ercise ad4inistrati3e super3ision as well as operational control o3er the transferred, 4erged andHor absorbed !FP and +"P units. (he incu4bent 0irector -eneral of the PC-+"P shall continue to act as 0irector -eneral until such ti4e as he shall ha3e been replaced by the President. S)C. (he personnel of the P!FS)C.M or the Coast -uard shall, within the transition period, ha3e the option to ?oin the P"P or re4ain with the P!FS)C.M or the Coast -uard, as the case 4ay be. S)C. C% Absorption by the Department of the )ational Action Committee on Anti3%i;ac.ing 3 (he 0epart4ent shall absorb the "ational !ction Co44ittee on !nti,i?ac6ing under the 0epart4ent of "ational 0efense, and the transfer of assets,

personnel and accountabilities of this office to the 0epart4ent shll proceed in accordance with the pro3ision of this chapter. S)C.CC Transfer& -erger& and Absorption of !ffices and Personnel 3 !ll properties, e<uip4ent, and finances of the transferred and absorbed agencies, including their respecti3e financial accountabilities, are hereby transferred to the 0epart4ent. (he transfer, 4erger andHor absorption of any go3ern4ent officeHunit concerned shall include the functions, appropriations, funds, records, e<uip4ent, facilities, choses in action, rights, other assets, and liabilities, if any, of the transferred officeHunit as well as the personnel thereof, who shall, unless re4o3ed for cause and after due process, in a holdo3er capacity, continue to perfor4 their respecti3e duties and responsibilities and recei3e their corresponding salaries and benefits. (hose personnel of the transferred, 4erged, andHor absorbed officeHunit whose positions are not included in the new position structure and staffing pattern appro3ed by the 0epart4ent or who are not reappointed shall be gi3en preference to ?oin the 0epart4ent or any of the offices thereunder or shall be allowed to retire under e;isting laws, rules and and regulations. .therwise, they shall be dee4ed separate and paid gratuity e<ui3alent to one and one-fourth 5 5H@' 4onths basic salary for e3ery year of ser3ice or a fraction thereof. (he personnel of the e;isting 0epart4ent of *ocal -o3ern4ent shall, unless re4o3ed for cause and after due process continue to perfor4 their duties and responsibilities and shall recei3e their corresponding salaries and benefits. (he heads of the 3arious bureaus and offices created under this !ct shall, within si; #' 4onths fro4 the effecti3ity of this !ct, reco44end the organi:ational structure and staffing pattern of their bureaus and offices for appro3al by the SecretaryA S)C. C$ Compulsory (etirement for I)P -embers 3 !ny pro3ision hereof to the contrary notwithstanding and within the transition period of four @' years following the effecti3ity of this !ct, the following 4e4bers of the +"P shall be considered co4pulsory retiredA a' (hose who shall attain the age of si;ty #7' on the first year of the effecti3ity of this !ctB b' (hose who shall attain the age of fifty-nine &$' on the second year of the effecti3ity of this !ctB c' (hose who shall attain the age of fifty-eight &C' on the third year of the effecti3ity of this !ctB and d' (hose who shall attain the age of fifty-se3en &%' on the fourth year of the effecti3ity of this !ct. S)C. $7. #tatus of Present )AP!LC!-& PC3I)P 3 /pon the effecti3ity of this !ct, the present "ational Police Co44ission and the Philippine Constabulary+ntegrated "ational Police shall cease to e;ist. (he Philippine Constabulary, which is the nucleus of the integrated Philippine Constabulary-+ntegrated "ational Police, shall cease to be a 4a?or ser3ice of the !r4ed Forces of the Philippines. (he +ntegrated "ational Police, which is the ci3ilian co4ponent of the Philippine Constabulary+ntegrated "ational Police, shall cease to be the national police force and in lieu thereof a new police force shall be established and constituted pursuant to this act. C,!P()R +J F+"!* PR.2+S+."S

S)C. $5 Application of Civil #ervice La s 3 (he Ci3il Ser3ice *aw and its i4ple4enting rules and regulations shall apply to all personnel of the 0epart4ent. S)C. $9 'unding - For purposes of organi:ing and constituting the 0epart4ent, and for carrying out the pro3isions of this !ct, the appropriations of the abolished, transferred or reconstituted offices for the current fiscal year shall carry out the pro3isions of this !ct shall be included in the annual -eneral !ppropriations !ct. S)C. $= Implementing (ules and (egulations 3 Githin ninety $7' days fro4 his appoint4ent, the Secretary shall pro4ulgate rules and regulations necessary to ensure the effecti3e i4ple4entation of this !ct. S)C. $@ #eparability Clause - +f any portion or pro3ision of this !ct is declared unconstitutional, the sa4e shall not affect the 3alidity and effecti3ity of the other pro3isions not affected thereby. S)C. $& (epealing Clause 3 !ll laws, decrees, e;ecuti3e orders, rules and regulations, and other issuances or parts thereof which are inconsistent with this !ct are hereby repealed, a4ended or 4odified accordingly. (he pro3isions of );ecuti3e .rder "o. 9#9 shall re4ain 3alid insofar as they are not inconsistent with the pro3isions of this !ct. S)C. $# 2ffectivity 3 (his !ct shall ta6e effect after fifteen 5&' days following its publication in two 9' national newspapers of general circulation.
