Rule 1 These Rules willgovem the classification and enlistment of Contractors who will be considered for any
work in the Irrigation Department, U.P. who are entitled to tender for the work according to their enlistment. However, these rules shall not apply to specialised type of Contractors enlisted under AA, A & B Classes who will be on 'All Uttar Pradesh State Basis'; in order words, contractors under these Classes would be permitted t~ tender for any work in the Irrigation Department anywhere in U.P. Contractors enlisted in Class .'C', 'D' & 'E' will be for jurisdiction of Circles and Divisions whose head quarters are in the particular Commissionaryl District respectively. Rule 2 (1) Enlistment of Contractors will be made separately for the following categories(i] Civil Works [ii] Electrical/Mechanical Works [iii] Each category of contractors will be further classified in Class AA,A,B,C,D & E as in Appendix 'A', according the upper financial limit for the works for which a contractor is enlisted in the particular class can tender. Enlistment to all classes willbe open to all individuals, Firms registered under the Indian partnership Act and Public or Private Limited Companies. PROVIDED that an applicant will be enlisted only in that crass to which he is found entitled in accordance with these rules by the authority prescribed herein for the purpose. Rule 4 Qualification for enlistment An applicant for enlistment to a particular class should have a minimum solvency as mentioned in Appendix 'B', Technical Staff as mentioned in Appendix 'C' and should have minimum machinery, tools and plants as mentioned in Appendix C-1 or C-2, as the case may be. He should have satisfactorily executed at least two works, whose individual values should at least be as mentioned in Appendix '0' and should not have been previously convicted for an offence involving moral turpitude. However, if a contractor does not have the past experience as required in Appendix 'D' but fulfils all other .conditionsfor enlistment, Willbe enlisted provisionally under Class-D category for a period of two years. This period of probation can be extended by one year on special grounds by the Superintending Engineer concerned. For Class-E Category, no previous experience is necessary. Rule 5 Proof of Applicant's Solvency (i) In case individuals, firms and undivided Hindu Families, proof of solvency of the applicant willconsist of a Certificate signed by the District Magistrate concerned or a Certificate reference of Scheduled Bank. The aforesaid Certificate of District Magistrate or Scheduled Bank.should be supported by an affidavit (duly attested by Public Notary) fumished by the applicant giving full details of movable and immovable property of the individuaVfirm(s). Movable and immovable property of the individuals/firms should not be less than the minimum and if at any time it falls of the minimum prescribed, he shall inform the authority concerned by rElgisteredpost. (ii) In the case of Public or Private Limited Companies, the proof of the company's solvency will be its last Balance Sheet audited and certified by a Chartered Accountant or a Certificate/ Reference of a Scheduled Bank. In case of Certificate of Scheduled Bank. as provided is attached, it should be supported by an affidavit (duly attested by Public Notary)or movable and ifllmovabfe property clause (i) above. Rule 6 - Proof of employment of tecimical staff Proof of employment of the required technical staff will consist of a declaration by the applicant in the followingform in the presence of a Notary Public, giving full particulars of the required staff :

Rule 8 - Proof of previous experience Evidence of satisfactory execution of two works of the required value will consist of certificate fram Engineer-in-Charge of the works not below the rank of an Executive Engineer. . Rule 9 (1) The application for enlistment will be made in the form given in Appendix 'E', accompanied by receipt of the Division/Sub-Division of the application fee mentioned in para (2) and documents mentioned in sub-para 3. A separate application will have to be moved for different categories of works. (2) The application fee shall be as under :-

Class M Rs. 200/Class A Rs. 1DO/Class B Rs. 80/Class C Rs. SO/Class D Rs. 3D/Rs. 20/Class E and it shall not be refunded. (3) Every application shall be accompanied by the following documents: [i) Proof of the solvency of the applicant [ii] Proof of employment of the required technical staff [iii] Proof of possession of required machinery, tools and plants [iv] In case of a firm duly certified, copy of Partnership Deed and registration certificate; in case of a Company, copy of the Memorandum of Articles of Association. (4) In case of any change in solvency, technical staff as mentioned in Rule-4 above, or change in partners or constitution of a firm or Articles of Association/Constitution of a Company, as mentioned in Rule 9(3) above, the same shall be intimated to the authority for enlistment within seven days of such change and an acknowledge of' the same shall be obtained. Rule 10 Officers authorised to enlist An application for enlistment to a particular Class of Contractors will be presented to the authority mentioned in the Appendix 'F' read with Appendix 'F-1' & 'F-2' who will be the final authority in the matter subject to the provisions of appeal and review made thereunder. Enlisting authority will verify from the District Magistrate the antecedents of the contractor in Appendix 'E' (1). He will also make enquiries from the two references given by the contractor in his application form and only after his full satisfaction, if he deems it fit, he will issue order regarding enlistment of the contractor in the category applied for. Rule 11 - Areas in which the enlisted contractor can work Enlistment authority will enquire, to whom an application for enlistment is presented, and may get such enquiry held as he considers necessary before passing the final orders. If the authority is satisfied that the applicant is suitable for being enlisted in the Class applied for, he will pass an order to this effect. The order will, however, be provisional and will become final only after the contractor has deposited the security money provided below in Rule 13. if the authority is not so satisfied, he will pass an order rejecting the application giving reasons thereof and intimate the applicant in writing within one month of such rejection/acceptance order. The applicant can, thereafter, file an appeal against the rejection order before the concerned next higher authority who will dispose off the same ordinarily within three months. (2) All applications shall ordinarily be disposed off within three months of the date of presentation. (3) A contractor whose application for enlistment has been rejected shall not be entitled to apply afresh for enlistment within one year of the date of final order passed in the case.

Rule 13 General Security


(1) A general security as mentioned in Appendix 'G' shall be deposited by the Contractor within one month of the receipt of orders of enlistment or within such period, not exceeding three months, as may be extended by the authority ordering enlistment. If no such security is deposited, the order of enlistment will be deemed to have lapsed and the matter will be finally closed. This general security for enlistment will be deemed to have been considered/adjusted against the earnest money/security for any individual tender. (2) The general security may be in one of the form as specified in P;:Iras613 to 615 of Financial Hand Book Vol. as amended from time to time. (3) The contractor will then become entitled to tender for works allowed by Rule II read with Rule I above. Earnest Money with each tender shall be deposited by such contractors as provided for in the notice for invitation of tenders. The eamest money shall be in one of the form as per Rule 13 (2) above, (4) The general security may be refunded to the contractor on the expiry of a period of 6 months from the removal of his name from the Register of Classified Contractors.

Rule 14 Technical Staff at site of work (1) The contractor shall have to keep the staff at the site of work as per Appendix 'C' attached. (2) If the contractor fails to comply with Sub-Rule (1), the Engineer-in-Charge of the work shall report the matter to the enlisting authority of the contractor, who, after giving the contractor such opportunity to explain, as may be considered necessary and appropriate, order the removal of the Contractor's name from the Register of Classified Contractors. This may be in addition to any action which may be taken against the contractor in terms of his contract for the work. i) Unsatisfactory execution after tender is accepted. ii] Failure to commence work when tender is accepted. iii] Failure to maintain required capital, technical staff, machinery, tools and plants iv] Failure to maintain the required amount of general security v] Conviction of an offence involving moral turpitude vi] Any other act which in the judgement of the authority competent to order removal of the name from the list, is undesirable or amounts to misconduct. (3) The officer ordering the removal will inform all officers, concerned who will make a note to this effect against the name of the contractor in their register.

Rule 16 Appeal/Review
An applicant or enlisted contract who feels aggrieved by any order passed under these rules may file

an

appeal to the next higher authority within a period of one month of receipt of intimation of such orqer and the order passed by such authority after holding such enquiry, as it may consider necessary, shall be final. Such appeals/review shall, ordinarily, be disposed off within a period of two months.

Rule 17

- Register of Classified

Contractor

(1) All authorities competent to enlist contractor and all other Superintending/Executive/ Assistant Engineers shall maintain a Register of Classified Contractors in Forms mentioned in Appendix 'H'. Separate registers shall be maintained for different categories; under each category, separate pages will be allotted for contractors of different classes. (2) In this register, names of the contractors will be entered under the class in which the contractor is ordered to be enlisted either by the authority maintaining the register or by any higher authority having jurisdiction. For this purpose, the order of enlistment, which has become final after deposit of general security, shall be communicated by the enlisting authority to all concerned officers.

Rule 18 Certificate of enlistment (1) The authority competent to enlist a contractor to a particular class will issue of a Certificate of Enlistment to the contractor in the form mentioned in Appendix, after the order of enlistment has become final on deposit of general security. The enlisting authority shall also inform all the concerned officers about the registration/enlistment of the contractor by endorsing the above order. (2) The enlistmentwill be valid for a periodof three yearsandthe yearwill be reckonedfrom 151 July to 30lh June. Even if the registration is made in any of the calendar month, such as, if the register is made in the month of October, 2003, the validity of regi~trat;on will be from the date of issue of the order to June, 2006. (3) At least two months before the expiry of certificate, the contractor will apply for renewal of the certificate to the authority competent to enlist a contractor of that class and having jurisdiction in the form mentioned in Appendix 'I'. The authority concerned will then issue a fresh certificate of enlistment, valid till the end ofthe next three years. (4) Duplicate certificate of registration may be issued in case where they are lost or destroyed due to an accident or for any other valid reason. The application for a duplicate copy should be presented within a week from the date on which it has been lost. The following fee will be charged for the issuance of a duplicate copy. AA Class Contractors Rs. 60/A Class Contractor!} Rs. SO/a Class Contractors Rs. 40/C Class Contractors Rs. 30/D Class Contractors Rs. 20/E Class Contractors Rs. 10/(5) In case of firms and privat~ and public limited companies, an individual should be authorised to deal with the Department on their behalf on prQductionof Power of Attomey. Rule 19 , (1) All the enlisted contractors are required to apply to the Income Tax Officer of the area in which they are assessed for grant of Income Tax Clearl:jnce in the month of May every year. The Tax Cleanmce Certificat~ in original should be submitted to the authority competent to enlist a particular class of contractors by the end of June every year. . (2) The Contractors who fail to submit the Income-tax Clearance Certificate or fails to show any justifiable reason for non-supply of the Income-tax Clearance Certificate, their registration is liable to be cancelled. (3) Contractors will be required to certify that they will not gel themselves registered under more than one name. (4) No Engineer Qr a gazetted rank or other Gazetted Officer employed in the Irrigation Department, U.P. is A!lowedto work as Contractor or as employee of a contractor for a period of two years of his retirement from Govt. service without the prior permission of Govt. of U.P. If subsequently either the contractor or any of his employee is found any time to be such a person who had not obtained the permission of the Govt. of U.P., his registration is' liable to be cancelled. .., ,)

(5) Contractors who are near relative/s of Divisional/District Engineer or Officer between the grades of Superintending Engineer of the Irrigation Department, U.P. will not be allowed to tender for works in the Circle where their near relative is working. Note: A relative will include wife, husband, parents, children or grand children, brothers and sisters, uncles, aunts and cousins and their names will be removed from the list of registered contractors.
