THE GRAND JURY OF THE COUNTY OF ONONDAGA by this indictment accuses


KIMBERLY AMIDON of the crime of GRAND LARCENY IN THE SECOND DEGREE in violation ofSection I55.40(I) ofthe Penal Law ofthe State of New York committed as follows : The said KIMBERLY AMIDON, on or about January of 20II through December 20I2, at the Town of Manlius, in this county, stole cash funds, the property ofTown of Manlius, Justice Court, the value of such property being in excess offifty thousand dollars, to wit: in excess offifty thousand dollars.

SECOND COUNT
AND THE AFORESAID GRAND JURY by this Indictment further accuses KIMBERLY AMIDON of the crime ofFALSIFYING BUS/NESS RECORDS IN THE FIRST DEGREE in violation of Section I7 5.I 0 of the Penal Law ofthe State of New York, committed as follows: That on or about the January of 20 II through December of 20 I2, at the Town of Manlius, in this county, the defendant committed the crime of FALSIFYING BUSINESS RECORDS IN THE SECOND DEGREE in that with the intent to defraud, prevented the making oftrue entry or caused the omission thereof in the business records of an enterprise, and her intent to defraud included an intent to commit another crime or to aid or conceal the commission thereof, to wit: a larceny.

THIRD COUNT
AND THE AFORESAID GRAND JURY by this Indictment further accuses KIMBERLY AMIDON of the crime ofDEFRAUDJNa.THE GOVERNMENT in violation of Section I95.20 ofthe Penal Law ofthe State of New York, committed as follows: That on or about January of 20II through December of 20I2, at the Town of Manlius, in this county, the defendant, being a public servant, engaged in a scheme constituting a systematic ongoing course of conduct with intent to defraud the state or a political subdivision of the state or the governmental instrumentet?ity ijfthe state by false or fraudulent pretenses, representations, or promises and so obtained property with a ;;;udfin excess of $I , 000 from such state political subdivision. g 8

by law or is clearly inherent in the nature of her office, to wit: The defendant failed to perform her official duty as a Court Clerk in the making of all cash deposits into the Court's bank account. FIFTH COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses KIMBERLY AMIDON of the crime of FALSE RETURNS; PERSONAL INCOME AND EARNINGS TAXES in violation of Art 37: Sec 1804 ofthe State of New York, committed the following: That on or about the 1 ih day ofApril, 2012, at the Town of Manlius, in this county, the defendant, with the intent to evade a tax imposed by Art 22 or any related income earnings tax statute filed a false or fraudulent return and, with such intent, substantially understated on such return her tax liability under such article or such statute, to wit: the defendant filed a New York State Tax Return and failed to disclose additional taxable income in doing so the defendant was able to evade a tax liability in excess of$1,500 on her 2011 return which was lawfully owed to the State. SIXTH COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses KIMBERLY AMIDON of the crime ofFALSE RETURNS, PERSONAL INCOME AND EARNINGS TAXES on or about the 15'h day of . April, 2013, at the Town of Manlius, in this county, the defendant, with the intent to evade a tax imposed by Art 22 or any related income earnings tax statute filed a false or .fraudulent return, and with such intent, substantially understated on such return her tax liability under such article or such statute; to wit: The defendant filed a New York State Tax Return and failed to disclose additional taxable income irl doing so the defendant was able to evade a tax liability in excess of$1,500 on her 2012 return which was lawfully owed to the State.
