All price-list, quotation & estimates are subject to revision and/or cancellation without notice. Price charged will be those ruling at the date of dispatch. Quotation & contracts are subject to normal supplies of raw material and stores. We reserve the right to withdraw or cancel the same, without any liability. All prices, quotation & estimates are ex-work, Rajkot. Transportation & Transit insurance will be extra. 100% payment is mandatory before machine dispatch. 20% payment on booking and balance payment against Performa invoice before dispatch. We shall take reasonable precaution to ensure good packing before dispatch but not liable for any damage or loss during transit. Our responsibility ceases soon as the goods are loaded on rail and/or receipt is obtained from the carriers and/or local delivery challan is obtained from the buyer. The delivery quoted without engagement or guarantee. The delivery may be made in full or instalments. Best efforts will be made for delivery in time but we shall not be liable for any loss due to the delay in delivery arising through circumstances beyond our control & the buyer will have no right to rescind the contract due to such delay. All drawings, descriptive matter, weigh dimensions, catalogues, figures given for performance of machine are approximate only any based on our experience and whilst they are substantially correct, are subject to modification without notice and the buyer shall not be entitled to reject the goods on account of any variation therein. Any defect should be immediately notified in writing mentioning defect. Any goods returned without written notice and our consent, will be at buyers risk and cost. We shall replace the defective part if the workmanship proved to be defective. However we will not be responsible for any defect or failure of goods supplied witch have been subjected to any process after delivery All disputes and questions whatsoever which may arise between the parties here to our of or in connection with this contract shall always be deemed to have arisen in Rajkot and no other court except the civil court, Rajkot shall have jurisdiction to entertain or try the same. Unless otherwise instructed in writing by customers and accepted by us inspected by our staff as per test certificate issued by us shall be conclusive evidence that goods covered by the certificate can fulfil guarantees given by us and it will be binding on customers. Inspection will be done at our work place only and the acceptance of Machines will be final and conclusive. Liability / risks will be passed on to the customers immediately upon dispatch / delivery of goods from our work place. We offers the services of expert Engineers for erection and demonstration of the machines supplied upon customers express request on chargeable basis, as and when such personnel can be spared. The charges will depend upon the type of machine, plus 1st class to and from train fare and conveyance expenses for our Service Engineers form our nearest service station to customers works. 5
