2 DPE/!uide"ines/II(d)/2 Appointment o# Centra" !o$ernment ser$ants in t%e Centra" pub"i& enterprises on immediate absorption basis'terms and &onditions o# The undersigned is directed to say that instructions were issued vide the Ministry of Finance (Bureau of Public Enterprises) O.M. o. !("!)#$%&B.P.E. (P'EB)( dated ).%.*+$! to the effect that save in the e,ceptions cases -entioned therein( deputation of Centra" .overn-ent servants to the Centra" public enterprises would not be allowed and the officers could /oin the enterprises only on i--ediate absorption basis. The -odalities of appoint-ent of .overn-ent servants in the enterprises after the issue of these instructions( as also the 0uestion of granting ter-inal benefits to the .overn-ent servants going over to the enterprises on i--ediate absorption basis has been under consideration of the Centra" .overn-ent and it has been decided that the appoint-ent of the .overn-ent servants in the Centra" public enterprises will be on the following ter-s and conditions1& *. Re"ease o# t%e !o$ernment ser$ants #or appointment in t%e enterprises( 2 .overn-ent servant who has been selected for a post in a Centra" public enterprise -ay be released only after obtaining and accepting his resi)nation fro- the .overn-ent service. ". Retention o# "ien *uasi'permanent status( o lien#0uasi per-anent status of the .overn-ent servant concerned will retain in his parent cadre. 2ll his connections with the .overn-ent will be severed on his release for appoint-ent in an enterprise and he will not be allowed to revert to his parent cadre. %. Pa+ #i,ation( 2 govern-ent servant selected for a post in a Centra" public enterprise will be free to negotiate his e-olu-ents with the enterprise on appoint-ent to a post in a public sector enterprise on i--ediate absorption basis(

a .overn-ent servant will be at par with other e-ployees of the enterprise and will be governed by the rules of the enterprise in all respects. Pensionar+ bene#its( (i) Resi)nation fro- .overn-ent service( with a view to secure e-ploy-ent in a &entra" public enterprise with proper per-ission will not entail forfeiture of the service for the purpose of retire-ent#ter-inal benefits. 3n such cases( the .overn-ent servant concerned shall be dee-ed to have retired fro- service fro- the date of such resi)nation and shall be eligible to receive all retire-ent#ter-inal benefits as ad-issible under the relevant rules applicable to hi- in his parent organi4ation. The officer eligible for pension should e,ercise an option within ) -onths of the date of his resi)nation for either of the following two alternatives15

a. Pro&rata -onthly pension and death&cu-&retire-ent gratuity as ad-issible under the relevant rules. b. Pro&rata gratuity and a lu-psu- a-ount in lieu of pension wor6ed out with reference to the co--utation tables applicable on the date of resi)nation. Note( 7here no option is e,ercised within the prescribed ti-e li-it( the officer will be governed by alternative (a) above. Option once e,ercised shall be treated as final. (iii) 2ny further liberali4ation of pension rules decided upon by .overn-ent after the date of resi)nation of a Centra" .overn-ent servant to /oin the public enterprise will not be e,tended to hi-. 2 .overn-ent servant who opts for pro&rata -onthly pension on his resi)nation fro- .overn-ent service will not be entitled to relief on pension during his service in the public enterprise.

Lea$e( 2 .overn-ent servant ta6ing up an appoint-ent in a Centra" public enterprise will be entitled to encash-ent of earned leave to his credit at the ti-e of acceptance of his resi)nation fro- .overn-ent service( sub/ect to a li-it of *$8 days. 9alf pay leave will stand forfeited. ()) .ami"+ Pension( 3f there is no fa-ily pension sche-e in a public enterprise( or if the officer does not beco-e eligible to /oin fa-ily pension sche-e in the enterprise( the fa-ily pension as ad-issible under the Centra" .overn-ent will be allowed to hi-. ". For the purpose of these instructions i--ediate absorption -eans acceptance of resi)nation of an officer fro- .overn-ent service to enable hi- to ta6e up an appoint-ent in a Centra" public enterprise for which he had applied with proper per-ission.

'ince the ter-inal benefits -entioned above are ad-issible only to those officers who leave .overn-ent service to secure e-ploy-ent in the enterprise( with proper per-ission( a case of grant of these benefits -ay be processed only after ascertaining fro- the enterprise concerned that the officer has actually /oined the-. :. The stipulation of i--ediate absorption will apply to all appoint-ents of Centra" .overn-ent servants in the Centra" public enterprises( irrespective of the level of appoint-ent( the -ode of recruit-ent( and whether an appoint-ent is in public interest or otherwise( but sub/ect to the e,ceptions -ade in the O.M. dated ).%.*+$! referred to above. !. For the purpose of these orders( a Centra" public enterprise is an underta6ing wholly or substantially owned by the .overn-ent of 3ndia( and which is accepted as such by the Bureau of Public enterprises. ). The ter-inal benefits etc. enu-erated in para * above will be ad-issible to all Centra" .overn-ent servants( who secure appoint-ents in Centra" Public enterprise with proper per-ission. 2 .overn-ent servant selected for appoint-ent in an enterprise on the basis of an application sub-itted by hi- before /oining the .overn-ent service will be dee-ed to have applied with proper per-ission for the purpose of these orders. ;. 2ll e,isting instructions on the sub/ect will stand a-ended# superseded to the e,tent indicated in the preceding paragraphs. For-al a-end-ents in the statutory rules( where considered necessary( will be carried out in due course. $. 2ll cases of grant of pensionary benefits etc. to .overn-ent servants( who are appointed in the &entra" public sector enterprise on i--ediate absorption basis( shall be decided by the ad-inistrative Ministries# <adre <ontrolling 2uthorities#2uthorities co-petent to accept resi)nation of a .overn-ent servant in accordance with provisions of this O.M. 2ll other cases not covered under the provisions of this OM or which re0uire rela,ation of any provision should continue to be referred to the Bureau of Public Enterprises with necessary service particulars. <ases of doubtful nature also should continue to be referred to the Bureau of Public Enterprises. +. Pension

Pension on Absorption in or under a Corporation or Government or Body ?$en a Government employee is permitted to be absorbed in a Corporation or company owned or controlled by Government or autonomous body a Pro rata Pension s$all be calculated wit$ re!erence to $is service under Government at t$e time o! absorption. 2.0 Invalid Pension I! a Government employee $as become permanently incapacitated !or !urt$er service and declared so by an appropriate aut$ority' $e will be granted an invalid pension. 5nce invalidation is accepted' $e cannot see& employment even i! $e produces a certi!icate o! !itness at a later date. I! $e is on unearned leave on medical certi!icate and $e is invalidated' t$en $e need not -oin duty as per leave rule #0A. In addition to $is pension and ot$er bene!its admissible under rules' one o! $is dependants may get appointment on compassionate grounds i! t$e invalidated employee $as not completed 0/ years o! age on t$e date. )Pension Rule /1+.

Compulsory Retirement Pension

Compassionate Allowance

In case o! Government employees dismissed' or removed !rom service' normally no pension or gratuity is payable. But t$e competent aut$ority may in deserving case sanction Compassionate allowance not more t$an two t$ird o! pension or gratuity or bot$ w$ic$ would $ave been admissible' i! $e $ad retired on medical certi!icate sub-ect to t$e minimum pension.
