Consumer Complaint in DCDRF Chandigarh

Sanjay also request for Info under CPA 1986 but due to no info provided, both deficiencyies were challenged in this consumer complaint filed in DCDRF Chandigarh which is Registered as CC/139/2014 with District Forum-1 Chandigarh and can be checked at Confonet. In today s (18 March 2014) Order the bench consisting of Hon'ble Mr. P. L. Ahuja, President, Mr. Rajinder Singh Gill, Member and Mrs. Surjeet Kaur, Member, has admitted the complaint under the Consumer Protection Act 1986 while declining to entertain under Right To Information Act, 2005. This is a big victory for the RTI Moment.

THE CASE IS:1. Staff at ICC collecting Rs. 50/- instead of Rs. 15/- as prescribed by the Govt.. If insisted they misbehaved with consumer and thrown Billing document and say that I will not fill your form, go back to original Company and fill your form yourself. Or you may go to destination Company who may also fill your form, but I will fill your form only on payment of Rs. 50/-. During night or peak hours this rates may hike to Rs. 100 or Rs. 150 so. 2. When SANJAY made complaint to AETC Mohali (ICC Incharge for the District) and asked to clarify and demand back Rs. 35/- as only Rs. 15/- printed on Statutory Forms as form filling fee, but no response from AETC. Besides above staff has threatened to complainant and also use false police complaint only to create pressure to withdraw Barrier Complaint. 3. When Action taken report demanded through RTI Application to PIO o/o AETC Mohali with fee of Rs. 10/- and one envelop with postage Rs. 22/- for Regd. Post, but no response from PIO. 4. When request for information under CPA 1986 with partial payment of Rs. 50/- sent to AETC Mohali for the information about the quality of such service and whether Rs. 15/- is right or Rs. 50/-, no response received from AETC Mohali. 5. When Notice under CPA 1986 sent to PIO, AETC, ETC Punjab and FCT Punjab referring above both request for information (under RTI and CPA) and asked to supply info. within 30 days, than FCT Punjab wrote to ETC and copy to me. ETC Punjab wrote to AETC and copy to Sanjay. PIO replied that Info related to ICC can be given only by AETC. But no response from AETC. 6. Hence Consumer Complaint filed in DCDRF-1 Chandigarh on 28-2-2014 showing deficiency in both route which is Regd. as CC/139/2014 and listed for admission hearing on 18-03-2014. The matter was heard on 04 March 2014 for admission of the complaint. By the DCDCF1 on o4 Mar 2014 and order was passed: Be registered. Prima facie this
